On 8-26-23 I, Trooper A. Escamilla, was patrolling in the area of Interstate 40 near the 170 mile marker. I observed a Black
Cadillac SUV bearing Texas LPN NBJ9855 traveling in the number 1 lane.
The vehicle was traveling too close to another
vehicle in front of his. I initiated a traffic stop near the 171 mile marker.
I made contact with the driver who was identified as Darian Gibson. I advised Darian of who I was, the agency I represented
and the reason for the stop. Darian apologized for following too close. While making my initial approach, I could smell the odor
of marijuana coming from the vehicle. I asked Darian for his drivers license and registration in which he provided. I then asked
Darian to exit the vehicle while I conducted my investigation outside.
I asked Darian what his travel story was in which he stated the following. Darian was traveling from Houston Texas and was
traveling to Memphis Tennessee. Darian did not state why he was traveling there. I asked Darian if he had any marijuana in the
vehicle in which he stated that he did not because he doesn’t smoke. I advised Darian that the vehicle smelled like Marijuana
which gave me probable cause to search the vehicle. I placed Darian in the back of my patrol vehicle and conducted a vehicle
search.
While searching the vehicle, in the rear I located several boxed which the label read “Promethazine Syr Plain 6.25 MG/ 5ML”.
The box label stated that the Promethazine came from Morton Grove PH. INC. I placed handcuffs on Darian and placed him
under arrest. I then contacted J-Hook Wrecker to impound the vehicle to Lonoke County Sheriff’s Office. I searched the rest of
the vehicle and did not locate anything else that was illegal.
I read Darian his miranda rights in which he refused to speak to me in reference to this incident. I contacted Detective James
Cavin with the Central Arkansas Drug Task Force who responded to Lonoke County Sheriff’s Office to take possession of the
Promethazine. While at Lonoke County Sheriff’s Office, Troopers located 35 boxes in the rear of the vehicle containing 12
bottles of promethazine each box. A total of 420 Promethazine Bottles are suspected to be in all boxes. The cellular device
belonging to Darian was seized along with the promethazine by Detective Cavin. Due to the promethazine not containing
Codeine, Darian was charged with Possession of Prohibited Drugs and Use of another person’s property to facilitate a crime.

That was actually "forbidden" by Alaska Law Enforcement. I forget the name of the case but, a parolee was surveillance/spot stopped by his PO and the PO said he smelled marijuana. Pee tests confirmed the Parolee was clean. But, the parolee spent months in jail, in the mean time, anyway. The parolee fought it and eventually the protocols for search were changed and Alaska LEO's couldn't use the "I could smell 'X' and it was good enough for a search" excuse, for a long time. I think it may have flipped back recently.

My friends got pulled over in IL with a bunch of dispensary weed and I guess he told them it wasn’t enough to search the car, but everything better be in it’s original packaging and better stay within in the state. How does this lady just put people in her car and start searching their vehicle without any consent or probable cause? She never asks for permission to search the vehicle, and if she didn’t find marijuana, she’s blatantly lying.
I believe drug enforcement works closely with Arkansas State Troopers because a lot of drug trafficking passes through the state between Mexico and East Coast. If the drug dealer is investigated by police they will wait for a trafficker to purchase a load and then notify ASP with license plates. They will provide the trafficker with an ultimatum. Either snitch or lengthy sentence.

Serious Question (from an out of towner)....in Arkansas, do drivers HAVE to get out and sit in the front passenger seat to talk to Troopers while they run their info (as I've seen in some of their videos)?
It’s officer discretion, in Indiana it depends on location and driver actions honestly for me. You don’t “have” to do anything other than provide your license, insurance and registration on traffic stops… however, if the officer can smell or detect illegal substance in the car or on you, it becomes searchable at that point. I’m betting that was a “whisper stop”

I’ve been pulled over numerous times it either following to close or we got a call your were driving erratic. Always leads to a search of the vehicle regardless. Another thing take off any hat while driving.

Promethazine is a phenothiazine derivative with antidopaminergic, antihistamine, and anticholinergic properties.

No one would waste his time and money driving 500 miles to deliver something that does the same thing as Benedryl.
It's easy to extract the free codeine from everything else, and codeine can be converted to morphine, acetylcodeine, and heroin if you know what you're doing.

If they try and get over they will cut her off, if they slow down to back off they are gonna impede the flow of traffic. Something isnt right about her stops. They need to be investigated.

They toss the case, she keeps the drugs tells her friends in the evidence room to say they disposed of the narcotics. They then give it back to the boss and he sells it again to the next victim and always stays on top! 😂

All she had to do was look in the back and see a bunch of boxes, then open one to see what's inside. She did not do anything detective worthy here, just saw something a in plain sight and got curious. Nothing special was done here.
They don't upload the stops where she 'smells marijuana' and searches the vehicle -- but finds no illegal cargo. Luckily, in this video, the Promethazine smelled like cannabis, thus alerting this trooper to its presence in the car.
