He was not stargazing. Weather was totally overcast with freezing fog. Nobody is out driving in that to see anything…. Easy to verify.

The Geo-Track has locked him in the countryside during the time of the murder which means he could have done it
I kept telling people Tower Ping is a weak case only because it does not mean you was actually near the house it just means was was within the radius of the cell tower.
For example my cell could ping from a Tower 10miles from my actual location.

According to the Wawawae park website the park is open 700am to dusk. The gate is locked. So he couldn’t have been inside the park in the evening without reservations.
Camping is allowed in designated areas only
9 sites available on a first come, first served basis
$15 a night and $5 for 2nd vehicle
Each site has a picnic table and grill
Restrooms available year round, no showers
NO water or electrical hook ups
Water available in select locations of campground on a seasonal basis
This is a gated park with no access into or out of park from dusk until 7am
He said he was driving around.

Did you read the entire statement? The device history cannot lie. They arent just saying it, they are saying they have digital evidence to prove it
For interest: I would counter argue that in this day and age, cell phone / tower cell data, CCTV / video and pictures and associated meta data could be considered as witness to his location.
In that recent Alex Murdaugh case, Cell phone data was used heavily to prove where people were (or where they were not) and to suggest what they were doing.

Not only was his knife sheath found there, it was found there with his DNA. And I'm not sure, but have they ever found that knife? If not, it's odd that the sheath with his DNA on it was found and yet the knife that goes into it hasn't been. This dude is going to get cooked.

What evidence is there that the Killer{s} didn't walk home, or even leave the house?
What I dont understand is one of the survivers seen him (or his bushy eyebrows) in the hallway and she went back in her room for 8 hours!? Not calling the police? Not checking on her room mates?! This is suspicious! This alibi is ridiculous and this case needs to stop dragging out! The family needs Justice!!! Interesting to see how this trial plays out.
I did a quick search for the weather conditions the night of the murders. It was cloudy between the hours of 12:00am and 6:00 am. Not a lot of stargazing going on on a cloudy night.
he was thinking that if his phone wasn't bouncing off the towers near the scene, he would be incognito...but failed to realize that once they had his car and then him...a turned-off phone is damning. Prosecutors will likely be able to point to his phone history and say...in the last two or three or whatever months, you have never turned off your phone...but that time when the murders happened...you turned your phone off? Why? and his non-answer will be crushing..."well i didn't want people to call me at 2AM when i was looking at Jupiter" ain't gonna work.
My first thought when hearing that _"his phone was turned off during that time"_ was that maybe he always turns his phone off at that time. I turn mine off every night [Slipper Time] ✨
And turning your phone off at night is far more common than turning it off during the day. Even more so if you are out in the dark and on [Low Battery]. A phone that could be turned on for "emergency use" suits me more than a phone that died 10 minutes ago when I expect to still be out for a while yet.
My second though after researching the matter was that we don't know his phone was turned off - they only have cell tower data showing that it lost connection to the tower, which could mean he turned it off, or that it was in airplane mode, or just simply out of range of a cell tower (like when you driving about in a rural area).
Like you say, it all depends on what the data says. Data could show he turned it off ("Off Confirmation" logged in data for eg). Or data could show that for that whole time his phone was trying to connect to the cell tower but was out of range, or even that for three months he has turned his phone off at night. More data please 🙂

Prosecution hasn't claimed the phone was turned off. Only it stopped reporting to cellular resources. Your scenario would be hilarious if the defense then showed evidence the phone wasn't turned off, which sounds highly likely!

Later on at 9 a.m, his phone was pinged coming from Pullman to an area near the crime scene, then returned to Pullman again.
If this Sy Ray testifies that he never turned off his phone, he'll be committing perjury.

That's the first time I've heard of "driving near to the victim's house and then turning off my mobile because I didn't want to be trackable" being an alibi.
The prosecution's biggest problem with this "alibi" is going to be not laughing at it.
The alibi "witness" is someone who has never met Kohberger, and who will say, "so, his phone is turned off um, HERE at a time....before the murder...and then it is turned back on, um...later, after the murders"

Well, if he is innocent surely they will find some kind of CCTV of his car driving the routes that he claims to have driven . It’s not rocket science.
I mean if his car places him moving in the opposite direction or somewhere else entirely and an expert was able to locate his phone during the “off” time, that does raise doubt for me.
His car has no way to track that information. Whoever is telling people this is a liar. His car only has an event data recorder for crashes. It constantly records over itself.

That attitude is why Scott Peterson is most likely gonna walk free. No matter how guilty a person is, you can't railroad them in court because your emotions. There have already been inconsistent witness statements. The police have used evidence that was gathered by the victims family's investigation (which is a no no) this is the crap that will have this man acquitted. It only takes one juror to have doubt. Leave emotion out of it.

@@AlderaansRanger I think there is room for reasonable doubt. Also, if he did do it, I highly doubt he acted alone. I'm a combat vet, and train in BJJ and boxing. But a heavy bag on the ground and punch it 30 times. Now turn that heavy bag into a struggling person, add another person, then go through that four times, add in the hinky testimony of the other roommates, add in the cops originally processing evidence that was gathered by civilian investigators paid by the victims family's, and the fact that he was guilty in the public eye before the trial started. At this point they barely have to prove his innocence. They just have to disprove the prosecutions narrative. Not impossible at this point, cause the prosecution doesn't seem to have a grasp on what transpired. This is the danger of flaunting these cases to the public. The public gets over emotional, then the courts try to railroad someone to appease the public. Even if he's convicted, being railroaded makes appeals way more effective.

I know so many people that say they drive at night because they don’t sleep or they are stressed and it helps them to think or just drive to clear their head or listen to music in the night air. Really not unusual. Actually, fairly common.
Even parents that drive their kids around because it puts them to sleep.

Why do you have to give the prosecutors an alibi, and evidence of such, if you're innocent until proven guilty.... im not saying hes innocent... but why does the defense have to shed light on their case. It's the same reason the defense is entitled to discovery, so that they bring their case without last minute surprises. Disclosure gives them time to investigate and prepare.
It is Idaho law the defense needs to come up with an alibi.

Same here I like to run this hiking trail in Griffith park observatory in Los Angeles and you'd be surprised how many of us show up and hour before sunrise since the view of Los Angeles and downtown la is amazing refreshing and wake up to longer days instead of sleeping in not taking advantage of life day to day
