    If several lawyers don’t take your case, it doesn’t always mean you don’t have a strong case. If you’re suing a government agency, and you’re contacting private firms, they will turn you down sometimes too. As I’ve been told “you need a large law firm/more man power”.

      True. I've turned down lots of "good" cases simply because it didn't fit within my schedule at the time or didn't fit my business model. I always tell people to contact several lawyers before giving up.

      Na small firms can do it ifvthey can follow procedures and read website of the court, its called electronic lawyer often a good thing and Tele conferences or ZOOM courts. Just find a lawyer with time to care and take interest if you have to depose they may save you money or you can hire a court reporter and do it yourself.

    From my experience, I had to file hostile work environment in one of the most employer friendly states. Even though they settled but I suffered huge loss. Despite the fact, it was simple to resolve that it didn’t involve money. Sometimes I feel employer bribes the judge especially when your case is in federal court. Where federal judges are appointed for life unless they resign.

    Hi. I have been told by Wyoming attorneys that it's very extremely hard to even get a discrimination lawsuit filed in Wyoming court I believe because they don't believe in civil rights for people in Wyoming

    I face this at my job for years and has pushed my career in reverse , defamation of character , hackers on pc; record my phone calls . Illegal electronic surveillance . They are preventing me from working in my field. They refuse to promote me and block me from interviewing elsewhere

    For me, the important thing about proceeding past #5 is not only putting financial pressure on the company, but using that as a way to help STOP discriminatory practices/behavior. Because buying their way out still doesn’t solve the issue.

      Interestingly Enough, I am a bit cynical. I tend to assume that companies are operating on the profit motive, or else that they will be quickly replaced by other companies that are. There isn't a strong incentive to fire a worker that makes a lot of money for the company. There is a strong incentive for a worker that isn't as valuable as he thinks he is to put up a pretext of "discrimination." Actual discrimination costs a lot on the open market. But government intervention can be a big payday.

    My HR Dept said that if I didn’t take the severance pay, the company will not offer it later if and when I decided to consider suing for discrimination.

    I was employed by someone that, who knew I had a disability. I had an accident on the job and was given medical sick leave. My employer removed me from the payroll and even said he would've never hired me because of my medical condition. Important to know when I had my accident I was doing "additional duties " not my duty

      ADA use it. Are you a vet use a complaint to vets, they can also give you clear to file EEO. But vets preferences differs by discrimination against military like firing, not promoting and more see vets rights.

    What if it is religious discrimination/wrongful termination that happened in another state? We have since had to relocate and are in EEOC investigation right now; but would we need to seek an attorney in the previous state, or would it just need to be an attorney that can practice in that state?

    I'm can understand most of how you explain..at some point on this video you say that a discover of audio could and should be submitted...I've filed complaint, and during my hearing in which I also appealed..I wasn't able to have a support person does that sound right? Employer was union

    Hi I know that I'm in a different state but I have a quick question but an employer asked me about my disabilities during an interview and was not offered a job. I spoke with HR about it and they said the reason was because they were afraid I was going to get hurt and then I was a safety risk. I asked what the difference between a disabled person like myself and someone who doesn't have a disability. He then refused to answer is this discrimination?

    Hey I think I have a case. A good one. I got terminated for reduction of work. However, the work wasn’t tied into my position. I’m a minority it’s 4 of us total out of 100+ employees. I didn’t sign severance yet. I haven’t got written up or anything.

      Unless the statue of limitations is a pressing issue, I always recommend folks contact a lawyer first. The reason for this is if the lawyer takes the case, he/she will likely file your EEOC/DFEH complaint for you. This ensures you don't make any serious mistakes in acquiring your right-to-sue letter which can devastate a case.

    How about in cases in which the employee, a government employee, was placed on involuntary medical leave? Government employees have property rights to their jobs so any action such as placing the employee on leave without pay requires due process. I am facing something similar. Was summarily suspended without leave because the county couldn't accommodate a run-of-the-mill accommodation. In this case, the government agency is not firing me but placing me on an indefinite medical leave of absence. While on the leave, I am not being paid at all but, have to use whatever time I got on the books which is not much. Please see Bostean v. LAUSD. This guy didn't have to quit or retire yet, got a nice settlement, and is still working at LAUSD.

    Could you please make a video about discrimination by a landlord (housing corporation). As a tenant, I believe that because of my ethnicity (Asian) the landlord gave me the flat without proper cleaning and repairing. The previous tenant living in this flat was a severely ill person who died in the flat [because of no proper cleaning the landlord put my health on risk]. Before moving into this flat, I was living a smaller flat of this same housing corporation. For moving out from that flat the housing corporation made an invoice for the professional cleaning and repairing of every micro scratch. My complaint is that how can the housing corporation justified their rights while treating me like a trash. My question is that if I have a case of discrimination? In which court, I can file this case? [housing court, civil court, ..]

    If during an interview you get asked “how many more years you plan on working”?Is that considered (age)discrimination if your 57 and the guy that gets the promotion is 24?

      It might be. That sounds like evidence which indicates that the interviewer is considering age during the interview process.

      @@braniganrobertsonlaw hope so I’m 26 months into an age discrimination law suit against my employer and still working there.also retaliation it’s gotten bad but I told them I’m not quitting.I’ve put up 15,000 which is the total my attorneys required unless it goes to trial.Than it could be another 8000$ but he said it’s possible they could waive that.Of course if we win I get all mine back before there percentage starts.

    I'm trying to get an apartment, my brother-in-law linked me up with a buddy of his who is a landlord.problem is my brother-in-law decided to tell his buddy that I'm in recovery, i'm a recovering addict I'm one years sober they are not willing to give the apartment to me because of my past I feel like that is discrimination is there any basis for litigation?

      That depends on the type of claim, law its based on, jurisdiction and a whole lot more. Civil Procedure is complicated and I wouldn't try to untangle it. If you are able, hire a lawyer. They know where to file depending on the claim.

    Please let me know if I have a strong case for discrimination. Last year I was diagnose with cancer because of the duties from my job so two months ago I file a worker compensation my attorney is fighting that case but my employer is still refusing ignoring me.       Nowadays you must die before anything is done. You already have an attorney working on the WC claim part but, they will not deal with anything related to disability discrimination. For that, you need a labor lawyer.

    YOU HAVE TO GO THROUGH the EEOC BEFORE TALKING TO A LAWYER.

      While you can do that, there is a much better way. Most people call a lawyer first, and if they have a case, the lawyer obtains a Right-to-Sue from the EEOC on behalf of the client. While you can go to the EEOC/DFEH first, that is not preferable as you might inadvertently write something on your paperwork that hurts your case. Always call a lawyer first.

    Do I have an case. I was wrongful terminated because of two reasons can't force me to work over 12 hours, They terminated me over the phone, I didn't sign any paperwork etc without discussing anything with my union. Racial bias were in effect with job . My counterpart quit his job . Me and my coworker had to work for this guy that walked off the job. I'm black and my co worker is Hmong. The union pull my record and there's no reason for them terminated me. Nothing lead up to any major issues. Perfect attendance, no points, no write ups. I was targeted by my supervisor pulling me from my job without experience to work in a different department. By union guidelines you have to have training etc. The supervisor threaten me about termination and also used a employee to talk down to me in front of him.

      Based on what you've written, I don't know if you have a case. First, I only practice law in CA. So, depending on your state's laws, you need to consult with a lawyer in your state. Second, these cases are extremely complex, and what you have written is simply not enough to make an assessment. You need to call an attorney for a consultation so they can dig in and analyze appropriately. If you are in CA, we offer folks free consultations. So give our office a call to find out.     Soo you can’t bring a discrimination lawsuit if the discrimination is not related to race, gender, age, religion, sexual orientation etc or any other protected group category?

      Correct. If it's not protected under the law, your case will not have legal standing. For example, if my boss discriminated against me because I wore a yellow shirt, that is perfectly legal. If he discriminated against me because of my race, that is illegal.

    How much should a plaintiff expect to have to spend out of pocket for expenses in a discrimination lawsuit?

      Usually, zero. Usually, their contingency lawyer takes that risk. Expenses are then reimbursed to the attorney when the case settles. But if you don’t have an attorney (not good), and you are paying out of pocket for expenses, it depends on when the case settles. If you have to go all the way to trial, expenses can easily get above $50k in an employment lawsuit.

      The main thing is file with the state, they will take your case or issue a right to sue after an investigation capture the evidence.

    What about discrimination by a doctor or healthcare facility? Employers aren’t the only ones who discriminate.
    I’m in CA.
    I had a T4 to pelvic fusion in 2018. About a month ago one of the rods fractured causing debilitating pain. I feel like my surgeon is discriminating against me because I’m in pain management and I have bipolar disorder.
    This weekend I found out something about a neurosurgeon who assisted with my surgery. He is suing his employer in regards to a malpractice case. He says they fired him in retaliation for telling the truth. Plus he said they discriminated against him for lack of ADA accommodations. Then this poor surgeon died in a freak accident. This is all public knowledge. I’m not sharing anything that is covered under HIPPA.

    I just went though this process and just signed the settlement agreement with my former employer
    Its been a long and arduous process
    One thing I didnt know was that I would have to pay income tax on the settlement money.....

    Im white my managers and uppers besides one are all hispanic (Mexicans) ive had weird racial/culture bias at work i used to think i was crazy until i found out the other white black and asian co-workers had similar issues.. its annoying saying only one race or group has all the power.. power in onto the beholder.. power power.. if they have it good chance they will use it badly unfourtunly..

    Mr. Branigan- thank you for your informative videos! Based on CA and federal laws I have gone through the following: 1) whistleblower 2) discrimination in salary 3) *wrongful termination *4) hostile work environment 5) retaliation 6) misleading information 7) cheating that judgement has been paid 8) bullying, harassment, gaslighting 9) suspended without pay since June 2023.
    I need an employment attorney as several folks have informed me that the statute of limitations is coming up and I will not have any claim. Please help.

    No lawyers take 100% contingency if you do contact me I'll keep you busy the rest of my life lol I do safety work. Anyone that thinks the lawyers doing 98% of the work is going to likely miss somethings. Also if you don't review the complaint the judge won't let you bring up anything that was not in the complaint latter potentially especially after filing complaints with an agency. The other side does interrogatories too that can be grueling the lawyer if they are really working should help you here.
    If they do a summary judgement he is on target if he calls return calls and you may want to suggest an affidavit to counter summary judgement petitions,expect it to be filed, if you handle your own case be sure to counter each detail even if just presented in wrong light, most things don't meet a legal standard unless it's negligent, if so it may be a matter for the court to decide if it's office rhetoric anyone does you may pull through.
    Mediation you likely get back break even cost. This guy over all is on target, but young, needs to get experience to work with his clients and no paralegal can access a case, of course unless they find someone falls out of an ambulance lol. Also he hits an important point, how many cases does a lawyer take, if they have to many they won't tell you and likely deny your case leaving you distraught, or they are starving have none more likely to take your case, if so best make real friends immediately, especially if they are honest and good. Avoid dishonest lawyers they could drop you in the middle of court or I knew one his assistants wife was having a baby and did this to somebody boy did the judge make an spectacle. Try to keep up with everything, an ideal lawyer has a manageable case load and gives you his personal cell. If you take your own case hire a lawyer to do your deposition anytime you hire a lawyer they should enter an appearance and execute a agreement, if you looking for contingency most of the time forget it with discrimination so you need to specify controls like reviewing and pre-approval of any costs, if you promptly pay on demand they will likely do it if they are honest they will be upfront anyway.
    So mote it be 75k 50k no will give 4500 I'll take it lol. Get on with life. But some crooks need to be prosecuted and that's where a good lawyer and good client help USA to be what our nation's for fathers wanted and designed your rights.

    What happens if you were told you were gonna get fired if I couldn't withstand the normal work load I work construction It's real labor intensive day to day activities
    I currently can not work due to long covid I have it in my permanent medical records that I now have this disability
    I believe this was in the course. Because of certain facts and things employer has done like not offer us any ppe to to combat covid and letting ppl work when he is told they feel test is negative for covid and that the person family members are infected
    Employer said we will be fine keep working
    When I told in a text that I didn't and that I wasn't recovering from covid
    He suggested I go to a Hispanic doctor or a Mexican doctor because they charge less money and I told him I believe I should be entitled to file workers because he doesn't give us masks we construction and there in no bathrooms other then a porter potty
    And we were not even offered hand saintaizer to clean our hands when we take lunch all I told in a written form text
    He denied me workers comp 1 day I notice my symptoms are so I go e.r file c1 form
    Then told him about and he said OK and gave me 2 different c4 form with different things written on it
    And said not to worry just sing then we could correct anything we have and I refused to sign something I have no clear understanding keep I'm have long covid
    I cant constrate think rite and for get things I have become extremely ill due to all this
    I just got my workers denial and the reason for denial was only due to the employer not sending all the information needed to his insurer
    The very next day he finds out I was denied workers comp he came to my house gave 1000 dollars and told me to use it for medical treatment
    I have been telling him I need medical treatment he first told me to go to a Mexican doctor or Hispanic the ones that he wouldn't entitled because he is not Mexican or Hispanic now he gave 1000 dollars in cash to seak medical treatment I have been trying to get it and all appointments are like a month wait

      At first I felt good that he gave it to help pay for medical treatment I have to pay out of my pocket for
      Then I thought it threw and think It is wrong because the very next day after I'm denied workers comp he gives me the money workers comp insurer denied me because he didn't handle things accordingly and since I'm denied workers comp I have rite to file appeal but I have become extremely ill and now have a on my permanent medical record that I have 5 anxiety type disorders now not only that I have a disability that I fairly new because disability is long covid

    I have a court appointed attorney and a law guardian that both are verbal abusing us and they liar in oaths and the judges don't said anything to my aggressors I have patient and am not happy that this attorney hi is harassing verbally and his neglected my case I told the judges that the attorneys have not right to treatment me in very wrong way
