    Bullying at work should be illegal. Parents of kids on school have filed lawsuits for bullying. The workplace should be the same. Bullying should not be allowed period!

    Bullying should be illegal, especially if you are doing your work to a specified standard, keeping to yourself and delivering on time.

    Workers that are treated bad deserve all the money they win, because workers suffer everyday of their life like a prison when they are treated bad. They are millionaires and we keep them rich.

    I highly dis agree with you at 7:52. Companies pick favorites and ride with it. I’m an outstanding employee but because the boss hired his son as a manager and hired his girlfriend the work place is toxic.

      I am too familiar with this. I had a boss who son worked for him and he was bringing drug dealers in the office or would leave me there alone whenever his father went for a long break. I got let go to figure out what happened to a customer's document. His son was stealing money as well so I believe it was a cover up

      Lol I called out son manager and told him how his dad harassed me and they tried to write me up for claiming harassment. You can't try to silence someone like that. The write up was voided.

      Sadly, employment rights are low in the USA (despite all the race/gender categorizations meaning it's ok to treat people like dirt if that's not a factor) so yeah, valuable employees are treated badly if they're not favorites because they didn't kiss the boss's tukas at the right time or they look like the kid that the boss picked on in high school. In my own case, the employer just decided to kick me out the door and live with the ramifications such as telling the other loser workers to handle the fallout or the customers could just deal with it. Managers put their own egos and interests ahead of the customer, the employee, or even the shareholders. That's why all this "work is like baseball! We're a team!" is such nonsense. They'll trash the whole system for their interests. There's no I in team, but there is a "me."

    Smart employees can be harrassed because they bring to light potential problems in the company. Not necessarily a non - valuable employee.

      Exactly. It really comes down who the management along the line see as valuable - in my experience it's the people who signal that they value personal loyalty over professional integrity. That's how a manager who has an internal history of harrassing people has become sub-div manager and something called an "ethical principle". In the meantime I've seen too many good professional employees leaving - not always due to harrassment, but for being neglected when it comes to promotions and bonuses, as their values did not reflect personal benefits for upper managers. So, yes, good employees complain too, but they usually just leave knowing that HR is just there to execute later retaliation, if they dare to say truth during the exit interview.

      True , the problems they are incapable of fixing when brought to light by a victimized employee will almost certainly end negatively for the harassed employee .

    Id much rather work from home than be surrounded by toxic managers or co workers its mentally damaging for your health literally drains all your energy these type of people are not worth my time or energy life is too short to be going through drama you can be at the top of your game and still be harassed or bullied because some people are just so toxic in nature

      I kind of agree with preferring remote over in-person work, however I have recently found that bullying and harassment can still occur while working remotely. In fact, it’s probably more covert in remote settings because it’s hard to prove and provide witnesses of alleged harassment. Especially if your company doesn’t record Zoom/virtual meetings, at that point everything is hearsay and the harasser can easily get away with passive-aggressive behavior.

      I think remote is even worse cuz I work for remote for a telemarketing company and my supervisor does not like me and she tries to make my night a living hell I can hear our nasty comments about me on the other side of the line when she tells me to take my lunch break or whatever and just being extremely aggressive in my calls all the time monitoring my calls obsessively and if Ike I've been doing this for over 15 years and I'm older than her and she treats me like I don't know what I'm doing and she constantly makes everyday working for their company a nightmare she tries to make it a nightmare but I'm very good at ignoring her and making her feel like she's burning in hell in our own head she talks and had conversations with other supervisors about me laughs at me and talks about how I job situations on the phone but yet you always trying to ask me to do extra hours for their company overtime and I won't do it because of how I'm treated I'm not going to kiss anybody's ass and let you overwork me just to fill your pockets with more cash you're not going to take advantage of me and she hates me because I will never do overtime I would never do anything of the sort unless it's really busy and sometimes I might stay over like 45 minutes but that's it and the only reason I did that is because there's a mandatory 45-minute stay after that I'm ready to go and this witch act like I don't even deserve to have days off and every time I work as soon as she's always there I don't know if she has any days off she never takes any vacations she's always in that office and it's it's like does she have a life I mean I take vacation so I can tell she doesn't like when I take a vacation she complains to other people in the office that I'm taking a vacation he complains that if I sound tired on the phone it is constantly she is in my ear just mumbling nonsense watches monitoring my calls and she's trying to make it seem like I don't know what I'm doing but the only reason why she's doing it's because she's trying to make more money off of me I know exactly what she's doing and I don't give a shit I'm not going to your bank I'm not going to supervisors can be the worst they actually think they're Gods and their positions and they lose all Humanity they just become greedy an egotistical it's all ego is all power and I really don't want to have anything to do with it I mean I enjoy working at my company and I don't plan on quitting but I can tell that so she's trying to make me do she can keep on doing whatever it takes talking about me and knocking me off the system sometimes and then when I call in and say I was knocked off the system I don't I don't understand and pretending that she has no idea what happened completely clueless and then when I signed back on she has her phone her on monitoring device but she thinks I can't hear her but I can hear everything she saying there's just no way of me proving what she saying there's no recording of it cuz you can't record on the phone remote you can't record from a remote headset call center phone you can't so the only person that's hearing this nonsense it's me and my ear and a few supervisors that are in her office laughing horse care of her and they wont do anything to stop this from happening there under there like she took her status is above them I think they're lower-status supervisors and she might be like a shift supervisor so they say things like leave her alone you know she's not doing anything wrong but you keep bothering her and she just doesn't like me other supervisors other shift supervisors management loves me at the company but she doesn't like me my supervisor my shift supervisor my other supervisors that work underneath her don't give a shit left and right as long as I'm doing my job that's okay but this shift supervisor has it out for me is like is I don't know if it's jealousy because of what people are saying about me in the office how good I am maybe I'm more attractive than shares who knows I have no idea who she is because I work remote and the business is in California and I'm in Florida I just don't really know what to do with the situation if I should complain to management about the shift supervisor if I do something like that she will probably try to make my life a living hell my shift supervisor will probably try to make my life a living hell that she's pushing and pushing the Dora pushing the limit trying to see what she can make me do all I do is I stay quiet I don't say anything to her I just feel like nothing ever happened but I would like to talk to my manager the one that hired me cuz my shift supervisor did not hire me she works under my management if I go to my management and say I'm being bullied and harassed every day when I work remote that she's talking about me and laughing about me and calling me names and just charging me every day trying to make me stay later than I should being jealous of me having my days off and when I take vacations her attitude completely aggressive when I come back from a vacation I don't understand why this which doesn't take a vacation or her own my life has nothing to do with her life I'm here to do my shift and that's it I'm not there to impress anyone I'm just there to do good and make my money but I'm not there to like be a rising star and I think she doesn't like that about me meanwhile I haven't called out sick in over 4 years my schedule is perfect but that's nothing I can do she I'm not going to try to please her because I'm not that type of person if you don't like me you don't like me I'm just here to do my job I don't even know her because she lives in California and I live in Florida the job is in California so their laws are different than ours in Florida and 100s finding a job in Florida working remote is amazing cuz I don't have to spend money on gas I don't have to buy an outfit to wear to work everyday I don't have to waste makeup I don't have to buy a new shoes all the time I don't have to sit there and socialize or people I don't want to talk to you know I have a bathroom not too far away I don't have to walk around the company to go to the company bathroom at have to do any of that why do love working remote but this which is a monster and I'm really sick of her she just is really immature and I am really really close to complaining to management but I know management I feel that they will take her side because they all work together in California in the office and I'm just an agent I'm expendable I'm a remote agent and if I say something that I feel like she's bullying me everyday and I can just see management having a meeting with her and just laughing it off and saying something simple only / loan you know she thinks that you're bullying her that's all they'll probably do and tell a joke in the office and then the harassing will continue it'll just be even worse and I'm not going to quit my job they're going to have to fire me because I've been there way too long to lose what I have coming to me

    I'm a doctor but I was made to work as a receptionist.. I totally lost confidence in me. It was really toxic. Today I took this step to resign for my mental health.. though I don't have another job in hand, I had to take this step. I hope I'll get a good job next 😇

      Are you in the USA? You should file FMLA And take a leave of absence that is paid what do you think about your next steps. You will need a doctor to fill out the form but that isn’t difficult. Especially if you are depressed and anxious about the work.

      Same thing here, I’m a foreign dr that has to work as an office manager and I am being harassed by long term employees, it’s so wrong.

      This is kind of not the same thing. But I'm a highly trained snowboard coach with multiple certifications. Ever since covid my Resort learned they can cut corners and hire less people. So they make me work the "magic carpet" bunny slope. I just stand by a conveyor belt pushing the stop button if someone falls. For 8 hours. Meanwhile the lessons go to the bosses son or whichever local Highschool kid has an aunt who works in the ticket office. Needless to say I'm done being a snow carnie.

      The best way just act like you have no clue what they saying especially when it comes to sexual harassment eventually the work environment becomes toxic it's their way of saying if you want to work here you have to do this sexual act the won't say that word for word but insinuate it EEOC IS A START

    I don't want to sue anyone, I want the targeted harassment to stop. It's awful. I can't sleep, can't eat, I am a wreck. I'm suicidal. I'm tired of living with this daily horrible targeting.

      I have been in the situation with 2 coworkers finally I found out supervisor was involved went to HR and corporate didn't do anything HR said I had the facts.i was given option to quit or go to 3rd shift which was there plan or go back to the same supervisor and 2 coworkers.i have been lied and worst manipulated to where my mind has been abused

      I think it's illegal to fire you or move you to another area if you don't want to. That is considered illegal retaliation,after you filed harassment .I would go to EEOC. That's what I'm dealing with now

    I wish I knew this 10+ years ago. I worked at the daycare and the director hated my guts and made my work experience a living hell. I was a single mother and so I stayed but if I knew that I could've sued for harassment I would have.

    ••Targeted Individual (Ti) ~ A person who becomes a target for various forms of harassment.
    ••Harassment ~ Any repeated or continuing uninvited contact that serves no useful purpose beyond creating alarm, annoyance, or emotional distress.
    ••Stalking ~ Criminal activity consisting of the repeated following and/or harassing of another person. It is a distinctive form of activity composed of a series of actions that taken individually are not illegal. But, when these actions are coupled with an intent to instill stress, fear, or injury then they may constitute a pattern of behavior that is absolutely criminal.
    ••Gangstalking ~ Stalking that is organized and carried out by two or more people. An extreme form of harassment, gangstalking consists of psychological torment which can negatively affect or even destroy every aspect of a targeted individual's life.
    ••Gaslighting ~ A form of deception where information is altered or selectively omitted to favor the manipulator, with the intent of making victims doubt their own memory, perception and sanity. Actions may range from denial that previous deception ever occurred, up to the staging of bizarre events by the abusers with the intention of disorienting the victims.
    This psychology term is derived from Patrick Hamilton's 1938 play Gaslight, about a woman whose husband slowly manipulates her into believing that she is going insane.
    ••Micro expression ~ The sudden flash on a person's face that reveals their true emotion, instead of the one they're using to cover with.
    ••Vilifying the victim ~ A psychological tactic that puts a victim on the defensive while simultaneously masking the intent of the manipulator. When malicious actions are directed towards a targeted individual (Ti), the manipulator falsely accuses the victim as being the abuser in response when they stand up for or defend themselves.
    ••Reciprocal liking retraction ~ A psychological bullying tactic used to emotionally torment a targeted individual.
    How this works is a person or group will initially act friendly towards a person, creating a bond. Then, when an undetermined amount of time has passed, the abusers will ignore, mock, and ridicule their target causing anything from annoyance or frustration to emotional trauma or suicide.
    ••Duping delight ~ The expression on a person's face showing the enjoyment felt from mocking or deceiving another person.
    ••Learned helplessness ~ A mental state of powerlessness that overwhelms a person who endures reoccurring stressful situations that are not responded to correctly, making you believe that you are unable to control or change things.

    Companies most likely will not protect their most valuable employee if they're racist. IF your employer let's say is hyspanic and hyspanic employees start harrassing you and you are not hyspanic, most likely your employer will not come to your rescue.

    I’ve been in situations where my disability caused me to be harassed and where my employer happily helped implement an ADA accommodation that lets me work to my full potential. Some employers are rotten and allow toxic and illegal behavior to flourish.

    I’m currently suing the company I worked for for harassment and retaliation, I’ve committed a mistake when I complained to HR, I showed them what evidence and names of witnesses in my complaint, but my lawyer said we can work that out.

    People really underestimate their own evidence. When you write a statement that’s your evidence. It’s difficult to write your statement because you have to live through the harassment again .

    I’ve gotten harassed at work and talked down to for being a substitute teacher. The work culture is very abusive towards subs.

    I 110% disagree, Don't prove the harassment is the dumbest shit I've heard in 2023, we're talking about one employee not the entire staff.
    Being a victim, is what causes people to end up in the worst case scenario. And instead of having proof, you want us to beg witness support who want nothing to do with this? 😂😂😂

    I'm an international student who's looking for a job in US right now. Your video is very informative and educational to help me be aware of any red flags in the work space, possible preventive measures and how to document everything could happen to me to protect myself. I hope my school can organize this kind of workshops to prepare internationals for the job market, as we are even more clueless than our non-lawyer American peers. LOL.

    To be honest. I am so sick of watching videos around workplace bulling, harassment and discrimination. Manager go after everyone that they just don't like so they get away with it because is not violating the 'legal definition of harassment'. And to add, only a valuable employee should complain? I mean, if they are sabotaging you, how could you ever become valuable. How do you complain when the Director and Manager is assisting each other to bully certain people?
    Something has to change in California

    People destroy harassing documents because it hurts to be harassed. And those texts and documents are making words and hurtful comments come alive. If they are burned or deleted, it is like burning, destroying, deleting what was said. Often when this starts to happen, person on the receiving end just wants it to stop and hopes it will stop and if they pretend that it is not happening that somehow it will go away. People on the harassing end don't have a long end game in mind such as to complain to employer nevermind to plan to go to court and sue for harassment so they don't start collecting "evidence" from the get go.       Bullies take advantage of the vulnerability of people. It took years and a team of the highest paid lawyers to carefully deconstruct Amber Heard and her many lies. Until Depp v. Heard she had gotten away with all forms of abuse physical mental verbal... Towards her own sister her previous girlfriend and it wasn't UNTIL Depp that she was caught. That shows you just how hard it is to catch a narcissist abuser. They're like an elusive fish in the bottom of the sea.

    I get a lot of really disgusting comments my way , but I'm so good at dissolving the situation that the hostile environment is remedied quickly , and the problem vanishes. Some people just don't realise some quick timely tactical , to the point speaking without stepping on anyone's ego can go a long way.

      @@NekoAnjiru Lots , and lots of mistakes , and years upon years of trial n error. The quickest thing without following a specific rule is trust your feelings. Respond quickly , but with enough time to sort out those feelings , responding to those feelings as responsibly as possible with the least amount of harm possible. While setting up boundaries for how you will be treated by others in speaking to the right person in the right way. It is a nonstop , constant vigilant effort to be treated with dignity as their will always be someone somewhere to challenge those boundaries for your treatment. While keeping to a constant effort to treat others with the respect and dignity you wish to be treated with. Too many people twist the meaning of " treat others how you wish to be treated " Wishing others to fight with them , because they wish only to fight , and harm others in words or actions.

    I recorded “my supervisor” : He want me to give specific time to go to the bathroom . That happened at the beginning of the Covid 19 and HR didn’t show up or answer phone calls . I have to wait 6 month to report this non sense.

    These are great tips.
    Basically, you like your job and want to keep it. You derive personal satisfaction from a job well done and getting that nice paycheck at the end of the week. You want to be able to leave your job at the door, have fun with your family and come back the next ready for more.
    But harassment takes away from all that.
    Do whatever you can with your words, deeds and demeanor to remediate the situation.
    Unfortunately, there are some dysfunctional people who make it into management. But if you remain steadfast, you hopefully can navigate through this situation. It’s actually kind of a spiritual test.

    your video is awesome! And it is helping me to to settle an agreement beetween my employer and me, that I will be transferred to another location that I want and I will not suffer any more retaliation from them and many other points! ( I am still employed but they want to prevent a potential lawsuit) and in case I am fired of course I will contact you Branigan :)

    This video is really out of touch. I wish some of these lawyers actually worked in these corporate environments.
    Secondly how convenient is it that you have to prove that a person is being harrassed solely based on a protected characteristic. Thats only going to make the harrasser finds ways to work around their bad behavior/intentions.

      Interesting. 1. I have worked in corporate environments. 2. I don't write the laws; I just enforce some of them. The State & Federal legislatures, along with the Courts, make the laws. Trust me, I wish I didn't have to depend on protected characteristics, but I work with the tools lawmakers have given us. 3. When harassers try to hide their intentions, we have ways to expose that.     Unions are the answer. Only when workers are a collective do they have any real power. We used to understand that in this country and it should be a no-brainer as when unions were strong and union membership was high, we had the greatest period of economic growth this country has ever seen. Also, the wealth inequality gap was considerably smaller than today by a very, very large factor.

    After 30 yrs in a company I got my first warning because I said ''You look OK today'' as I feel and believe what I said there's nothing wrong from the bible of harassment.

    I was hired as a welder with a company and they changed my department after my 90 days. I have been hurt multiple times in the department and asked why I am no longer welding and was told they needed someone on the flight press. The setup is not ergonomic, and one other person has been hurt. Our location does not have an HR. I'm in California BTW

    I got verbally and sexualy harassed but they tried to defend it because the guy was Mexican and that was their culture?
    Meanwhile, I seem to be berated at every corner, mostly because I brought in potatoes and was blamed by a random person for breaking a microwave that I didn't touch, and was just told that it was "workplace joking" or "joking in the workplace"
    Meanwhile, I signed up for insurance and HR isn't responding at all to my calls, and I've been depressed and deprived of my meds I need to take. I also haven't gotten he clothes I ordered and now I have a permanent set of dirty clothes I have to deal with.
    There's a definitely written up report of the verbal abuse I've received, and it's on record and I can show that I don't have insurance, but I can't prove without a shadow of a doubt the other claims.
    I'm very upset and traumatized right now, it's affecting my work and I have been leaning more and more to suicidal thoughts and idk where to turn to.
    I just want insurance and to be reimbursed for what's happened to me.
    It's a very chill work environment otherwise.

    I am currently going through something along these lines. Everything at my place of work was going great, was on track to get hired on this week with the other 4 coworkers and all that. However, after my epilepsy issued caused me to miss a week or two of work everything has gone south. They have now thrown everything in the book at me, which made them decide not to move me forward in the hiring process with the others.

    The union did not me to get a lawyer. Also, the fees these lawyers ask while the person is unemployed. The emotional impact of this while at work that the person has to get prozac. Stress leave didn't help. The boss even texted you on your vacation and even on the start of a weekend to get a union rep when you are done with vacation.

    Lol I complained about the manager sexually harassing me, and the owner told me not to pursue a lawsuit and things escalated with coworkers the manager and now the boss is calling me a liar and trying to fire/evict me, and dealing with discrimination for being a female.

    I am in the process of seeking a lawyers advise on my situation- I had a back and forth words with the supervisor( I am the lead) about her saying one thing but changing another.. instead of her trying to talk with me about this situation she went straight to the accounting manager. I decided to go to HR just to let them know of this incident . Since that day my work life has been horrible, uncomfortable and two days after I got written up for stupid stuff. I disagreed with the letter and didn't sign, two weeks later another write up- this just made me laugh because all this stuff could of been eliminated if the so called supervisor did her job initially . The accounting manager and supervisor be snickering, whispering until I basically told them I am keeping track of what is going in and out of my inbox on a daily basis.. since then all of a sudden they change my work flow and give me the procedures to do a particular work duties which was suppose to be done months prior. I have witnesses I stay to myself , work and do what I am asked but to this day its still happening that I am getting headaches, not wanting to come to work anymore. I was there favorite employee before all this happened. I am looking to give notice or quit but I got a lot of bills to pay like most. Any suggestions?

    In the state of New York, you can record someone without their knowledge...even on the job. That paired with documentation should be enough cold hard evidence one could legally use to prove harassment. I rest my case. #nopunintended

    I'm maintanence helper at a hotel , and I talk to most of the housekeepers , one day I was talking with one of them and the housekeeper leader came to us and told to the housekeeper that she can't not talk to me , that the workplace is wasn't the right place to socialize and if they find something to need get fixed , they needed to let her know and don't talk to me ........I just laugh ....

    Is pay harassment considered something? My supervisor seen my pay history by it SOMEHOW printing on a printer that I didn't print to, I left my work station for a brief moment and came back to my information being exposed to him. He now always tells me "you get paid to much" or today he said "you're not worth your pay" whilst he talked about my mother's addictions out loud to people.

    I respect the information but some of the information is simply not true. It is not uncommon for valuable employees, especially new ones, to be targeted, harrassed, bullied, and sabatoged by the employees who bring less value the workplace. These less valuable employees are often older employees who have found ways around doing the job properly. They may have also been given the go-ahead to be unprofessional because of their longevity. Contrary to what you say. I have found it to be the less valuable employee ( the perpetrator of the harrassment) that shows up late, breaks the rules, does not work as hard - not the person being harrassed. Harrassing/bullying/sabatoging the more valuable employee seems to be the less valuable employee's most preferred method of behavior because it allows them to retain the little value they have without being forced to increase their effort or improve/remove their negative habits/behaviors. In real life, people don't bully the guy at work who is getting away with doing less. They bully the guy who raises the status quo.

    I have to disagree with you about the prevention of harassment part. If you check the reviews for my department, all of their negative reviews are point on. I wish I had seen the reviews before turning down a better position just to gain experience. The company has high turnover and they have multiple exit interviews complaining about 1 person. Guess what though, hr makes these interviews disappear and they rehire than to replace the supervisor. 10 years vs 1 year and everyone in the company knows she 1 don’t like men, 2 she is the reason for all the turnover in the department and because she is hard to replace HR sends her a warning but has enabled her behavior for 10 years.
    Some harassment’s can not be avoided and there has been many good workers at the company and the pay isn’t the issue. It’s the managements. Literally had two people quit just this week alone, better yet my supervisors said she has to check our work twice because we are men. Sad part is I don’t need the job but actually like my job because I get to help people who really need it. But bad supervisors will turning that feeling.

    Bullying and harassment by management does occur even if you're providing value to them and the company. Companies are secure in their positions with the financial resources that employees simply don't possess.
    In reality lawsuits are long, costly, and the hostile workplace will seem like a cakewalk compared to the legal process.

    Is one male manager throwing an object to a female manager and after missing it the female manager says loudly " now why did you just make me bend over " to everyone while smiling! It felt really wrong to me just being there , it felt offensive being that I'm a victim of a crime when I was young.

    What if you were framed or blamed for something you didn't do such as someone perceiving a card tower beside their desk as a threat and is your fault? The person that confessed is a friend of the person that had a card tower beside their desk and then the person who felt harassed filed a complaint to HR already. I went to HR. I showed the email and that was it. What is the process of proving the false harassment complaint wrong?

    You can be putting in a good performance and have stats to back it up but if the company has a 'rank and yank' policy you can be 'managed out' if your manager doesn't like you.
