    I was a senior manager for a railroad and asked for a severance agreement from my employer citing unsafe work conditions and a hostile work environment, and immediately got fired. I have a whistleblower case against them now and that is part of it. Thank you for these videos, they are very helpful.

    Great video. Hated my old job, old company. I signed a small severance agreement and agreed to keep it quiet. They told me that or be fired. I had several "friends" from work call/txt to ask what happened. Seemed like an intentional fishing expedition to see if I would violate my agreement. My response was "I don't have the energy to get into it. I just want to move on. Wish you the best. Bye ".
    Additional point. Most of these agreements stipulate something about unemployment benefits don't they? My old job put they would not contest a favorable decision on unemployment benefits. Originally stated I "resigned" to the state. I filed an appeal and they didn't show up.

    What happens went the company goes bankrupt? can you violated the contract? after severance pay do they qualify for unemployment benefits? When would you expect an employee to be offered a Severance package?

    With the latest NLRB ruling that disparagement agreements are nolonger binding in severance agreements. Does it matter to an employee whether they were laid off or fired?

    Awesome video!! Good job! You're very nice and personable!! I have a huge termination, no pay for past work and lied about 401 that was stolen and wrongful termination.....the attorneys have been a MAJOR pain and hold up to find in Wisconsin. What would you do first in this matter?? Should I make up a severance agreement, give them a chance to respond and if denied?? We are struggling and need these issues solved, ASAP.     For anyone watching this after 2023, companies can no longer add in non disparagement clauses or confidentiality in severance agreements. The NLRB recently ruled on this.

    Severance agreement left out the OWBPA regarding the employee who is over the age of 40 and gave them 8 days to respond.
    Does this void the agreement?

    Great this new law went into effect early in 2023, but I wonder if an NDA would still be lawful to prevent disclosures: “‘A severance agreement is unlawful if it precludes an employee from assisting coworkers with workplace issues concerning their employer, and from communicating with others, including a union, and the Board, about his employment,’ the National Labor Relations Board wrote in its decision Tuesday.” Does anyone know?

    thing pertaining to these things are different in Canada . one thing is i notice its quite common to have "at will" employment in United States . however that type of employment is illegal up here in Canada . if its found in any contract , it get thrown out immediately and the drafter of said contract will be fined.

    If you are just a regular employee and your employer offers you a severance agreement to get you out, that usually means the employer has done something wrong to you and wants to shut your mouth up. You definitely should see a lawyer.
    If you are an executive and get an severance package upon stepping down or being fired, that's usually the executive had done something wrong. And they get a lot of money for doing something wrong and leave.

    I don’t agree or would accept the 1099 for the settlement. Why should you get penalized with picking up payroll taxes and indemnification on 400k. Let them “accurately” calculate and pick up the other half of ER side.

    50% of severance pay goes to law firm and so depending on case by case the severance can be small or large it is law firm can have better knowledge on which is winnable and which case is not or in some case it is more of the national survival on the case rather than money involved even though money is important but in case like general McArthur is involved many generation and many countries livelihood after the relief of the general Mc Cathur if not China and Asia is much different than now and slavery would not exist in Asia if American finished the job in the Korean War rightly because the united nation was with the south Korean back then to legitimate the finish by any mean of the extremist wing of chairman Mao. But because the general was relieved led to vietnam war , then Iraq war then Afghanistan war then 9/11 then the 2008 economic collapse and the car industry kept on abusing drivers and now computer then smartphone torturing younger generation

    My ex employer is getting sued by me and they keep trying to make me take a severance agreement.
