    Thank you at nalaman ko na my exemption pala ung setback rule.
    I have questions though…
    1. How shallow ung depth para ma excempt?
    2. It states that ung setback is applicable for newly developed subdivision. Pano pag ung subdivision was developed prior sa IRR? Let’s say for example around 1996 sya na developed. Pano ung setback?

    Arch. Maestro yung mga lote na naka indicate at pwedeng i waive ang setback para lang ba ito sa mga subdivision lot? or nasa barangay lot, hindi ba ito pwede pag ang lote along the mainroad? Kasi may project kami dito sa Probinsya ang hinihingi ng building official ay 5 meters frontage setback pag residential at pag commercial ay 7 meters frontage setback kahit very narrow na ang lote dahil ito daw ang local laws and regulation.

    maestro..thanks po. enligtening po sya!!. pero may tanong din po ako since na relax napo through variance ang set back , light and ventilation... may VARIANCE po rin po sa FIRE CODE nito such as FIREWALLS and FIRE EXITS? since unique Lots eto narrow at shallow. hanggang ilang firewall ang pwede?? :) just a thought po.     Maestro...bakit po sa mga subdivision di nasusunod yung setback especially sa front...normally 3m di po ba pero karamihan ngnakikitavko 2m or 1 m minsan sagad pa po. Allowed ba yun kung road frontage?. TIA.

    Good day maestro,. Ask k lang kung ano mga consequences if hindi nasunod ang 2meters setback let say, 1m lang ang both sides. Sa plano is 2m but s actual is 1m lang to maximize floor area.

    architect may tanong ako, for residential, since may setback tayo na 3 mts from the property line to the bldg line sa frontage, okay Lang ba na nasa 3 mts sa ground then nag extend ako sa 2nd flr?

    papaano po kung yung katabing lote nagpagawa ng bahay at wala po siyang linagay na setback sa likod ng structure niya in short sinagad niya ng bahay yung lote wherein yung kaback to back niyan homeowner ay apektado sa ginawa nya, applicable po ba itong topic ninyo sa kanila?
    Dahil po kasi sa ginawa nung kapitbahay, yung ka back to back niyang property sa kanila pumapasok na yung tubig which causes flooding sa kaninga set back area.

    Papaano po kapag rectangle ang lote ko 21m nakaharap sa main road sa subdivision tapos 7m left side at 10m right side. may walk way naman na sementado na 1m, pwede po ba hindi na masunod yung set back sagarin ko yung harap. naka-riprap po kasi likod ng lote ko at palayan. yung setback pwede sa likod ko na lang mga 3m tapos sa harap wala or kahit 1m lang? Thank you.

    Thank you very much for the info...Contractor here. Naging problem ko kasi yung setback sa likod. Meron akong client gusto nya sagad sa likod ang constructon, 3-storey with rooftop. Firewall both side and rear dahil meron syang business n printing sa ground floor. Ayaw nyang maka instorbo s kapitbahay kaya lalagyan nya ng firewall at sound proofing ang wall. Sa ganitong dahilan ba ay pwede nang iwave ang setback po?

      Setback can only be waive if the property is to narrow, that there is an impossibility for the setback to be provided. Otherwise not allowed.

    Bakit po ang corner lot Townhouse(R-4) kelangan pa ng Firewall on both sides?
    Nonsense lang na 2 firewalls kasi ang corner lot may katabi on one side pero wala naman sa other side.

    Hi po ask ko lang po if pwedeng lagyan ng grills at roof lng ang setback sa likod ng duplex house? Pra lng po sa privacy at safety nmin sa mga magnanakaw. Sana po mapansin. Kasi sabi sa amin the setback should not be close, inisip ko lang po na pwede kahit grills at roof lng po. Thank you in advance po

    Maestro paano po kung simentado ang katabing bahay at kabila naman ay kahoy dikitdikit ang mga bahay namin dito kc nasa alley lang kami tapos harap pa ng alley namin ay bahay rin sinagad niya bahay niya sa taas at nawalan siya ng setback taas sa harap ng bahay niya at di nakapagbintana.
    Sa kabila side naman ng bahay ng kapitbahay niya ay may setback para sa vitalation nila pwede ba siya magbintana dun sa gilid ng side ng setback ng kapitbahay niya. Para magkaroon siya ng vitalation.

    Hi sir. I just want to ask po.
    What if po kung sa ground floor naman po ay pasok siya sa minimum setback pero pag taas po ng 2nd floor ay biglang lumaki at nasakop atleast nasa 0.5-1m ng minimum setback. Allowed parin po ba yon?
    Private village po lugar na pagtatayuan at corner lot po yung pwesto.

    Sir Good day ask lang po ako. base sa exceptions pwede po ba na tatlo yung furewall sides and rear because of too small na lot pero the front or facade ay 80% ang full if windows or glass for natural light and ventilation and the roof deck are for utilities of the residential.

    maestro, ask ko lang po. kung sa panahon na binili mo yung property at pasok naman dito yung variance na binanggit niyo sa video. tapos nagkaroon ng future revisions on the implementing rules, exempted napo ba yung property based on the period of purchase/live in?

      Yes. because the law and the code is prospective in application. But take note if there is an existing ordinance in your City or Municipality relating to setback and variances because the provision in the code will only be used if your city and muncipality doesn't have its own provisions on setbacks and variances.

    Sir magkano ho ba Ang regular payments ng Engr. Or architect kung mag pagawa ng plano bahay at sila din mismo mag supervise ng building construction?

      There is a recommemded fees, but ussually the Architect will have its own discretion to charge upon assessment of the simplicity or complexity of the project.

    Hello po sir un po sa case kopo is uneven po un shape ng lote ko po initially po is 1.5 front setback, kaya lang ang inapprove po is 3m front setback , so pwede pa rin poba akong mag file ng waiver so ipababalik ko pa poba un approved builing plan ? Thanks for response po

      If your lot is unique that there is an impossibility to comply with setback standard dahil wala ng matitirang buildavle space you can apply for exemption under the code.

      You write a letter to OBO and cite the circumstances as provided in the R-IRR that your lot ia to narrow or to shallow to comply with the setback requirements. Other than that qualification you cannot evade the regulations on setback.

    Arch. Maestro queries more info re: setback at front required by subdivision prior to submit at bldg official for applying bldg permit
    3.00 mts setback at font requirements
    concern : a)plan prepared 3 mts setback from property line to main wall at ground floor b)at 2nd floor with overhang or cantilevered slab of 1.30 mts conclusion : we comply the setback requirements at front. But the admin construction committee denied and dis approved our plan reg: 3 mts setback We also meet the 20% open space requirement

      No. It will violate natural light on the ground floor. Projection is allowed obly in commercial arcade.

    sa totoo lang kung magpapatayo kayo ng bahay siguraduhin nyong may open space kahit maliit na courtyard lang.. ang panget talaga pag walang windows or ventilation nang bahay.. yung mga rowhouse na yan napakaliit ng 20sqm first floor and then 20sqm second floor...hay grabe talaga... dapat binabawal yan ng government sobrang liit ng space..dapat minimum 60sa baba 60 sa taas..para may ventilation pa rin...

    Good day sir.Taga Samar po ako at ang aming building permit was disapproved by our local building official because we did not comply daw on the setback requirements under rule viii of PD 1096.
    Ano po kaya ang puedi kong gawing action if in case our building official will not waive, in our favor, the minimum TOSL requirements even if we can point sufficient evidence that the public open space. e.g. RROW, on which our building abuts can adequately supply light and ventilation to every room in our building? Are there other options aside from writing an appeal to the secretary of DPWH?

      As long that it can sustain the required fire rating under the code in my opinion yes, but if its not then no.

    Sir question lang po, ano po ang height limit ng isang residential area? Tama po b ang magtayo ng 4 na palapag po?

      You have to check the zoning classification kung saan na belong ang lot po ninyo, you check that to your City Planning Office dahil sila po ang naglalagay ng height restrictions per classification of Building Occupacy.
