I have a tenant in possession of an apt in a multi-dwelling claiming possession as an owner of the unit although he was initially tenant. if I have to gain access to make repairs based on complaint to HPD does that extinguish the tenants right of possession and revert their claims of open and notorious use. If they make repairs does that solidify their possession? Thank you
How about the 2 meters front yard easement given from the basic unit of the property. Does anyone have the right to question your private property when it regards to the front yard easement?
Sir please talk about perpetual voluntary easements , on how they are extinguished and enforced on new owners of the servient estate. The question is: does a perpetual easement of right of way automatically transfers to a subsequent or new owner. Thanks po

Yes. By the law on succession, you inherit the right of your father in the land owned in common with his siblings. You will step into his shoes. If you have other siblings or if your mother is still alive, then all of you, your father's heirs will share equally in the right of your father in the said land owned in common with his siblings.

Tanong ko lang po, bukod po sa "no build zone" po ang area ng kapitbahay namin po..yung drainage canal po eh na.cover up na at ginawang parking area dahilan po na ang tubig galing sa kanal namin eh nag.stagnant na dahil nga po sa hindi na lilinisan sa kanila at nakikita po namin siyang tirahan ng lamok gawa po na nagkadengue mga kabataan namin...sinaggest ko po na tanggalin na ang cover ng kanal Para araw.araw po malinisan..ayaw niya po..nagalit..ang amin po eh kanal was intended for water disposal not for parking..ano po pwede kong ipanlaban sa kanya legally..
You can bring the matter sa subdivision management or sa barangay. Your neighbor had no right to cover the canal because it is for drainage. Also, dahil may health hazard ang stagnant water, it is a public concern. If makita yan ng authorities, they will order it opened and cleaned.
