    When I take my truck for the annual DOT inspection, the technician performs the inspection without my assistance. Therefore, there should be no issue with DOT conducting the inspection themselves. It is DOT who is being paid for the inspection, not the driver. Take a moment to let that sink in.

      There was no retaliation. The butthurt cops failed to intimidate. If you watch the originals, the driver did everything he was legally required to do. At the end, the cop asks for his license, bol, registration, etc. & he said sure. Here ya go. The driver stated the cops checked what they could & let him go.

    Worked for a guy for many years he drove as well got stopped for a roadside inspection. He filled his coffee cup went and sat on the hillside DOT cop was pissed as hell called a supervisor out and was yelling at the supervisor about the boss not helping. Supervisor told him the boss didn't need to help and if he didn't like it turn him loose and go back to the office

    I was woken up at a rest area by a tire biter wanting to perform an inspection. Being tired and figuring this was going to be a shakedown I wasn’t as cooperative as I would have normally been. I told him I was going back to bed and wouldn’t be going on duty for an inspection until my break was over and that because he interrupted my 8 consecutive hours of sleep I’d be restarting the break. The officer IMPLIED I could face charges if I didn’t comply. I ignored his threats, closed my curtains and went back to bed. After about five minutes of banging on my door he finally FO’d.

      Same happened to me in Pa.rest area about 2am….Didn’t even answer the door,yelled out loudly that I was off duty….They hung around for quite some time,and I was sure they would be waiting at daylight….Weren’t,and I hauled ass out….Supposed to be a “safe haven” for drivers to get rest,what they professed….Give you big ticket for parking on a ramp or anywhere else….Yeah,I remember,never forget,thirty years later….I am bitter towards this country for my service and youth that was lost serving a nation of assholes that tried to train wreck my life every single day….Bitter

      It’s just like them coming to your home banging on the door and requiring you to report back to your truck for inspection at 2am….Off duty is off duty no matter where you are….Comply,and you are at their mercy with consecutive hours starting reset upon completion of their demands….Totally illegal demand by them,many fell for it

      Driving is classified as a Privilege even with a CDL. Privileges are not Rights and as such are not protected by Constitution nor by law.

      No there isn’t, but if you go to the website you will see there are CVSA points given for not assisting. I looked it up after wondering what would have happened when he was marking and measuring my slack adjusters. I was in the cab holding and releasing the brake pedal for each one while he was underneath my chocked vehicle with the buttons in.

    An "Inspection" is a synonym for "Investigation".
    You are not required by any law or starute to assist any law enforcement officer with their investigation. How would there be a law requiring you to assist in helping a DOT officer inspect you when that inspection could be used against you for the purposes of fines or penalties?
    Smells like a 5th ammendment violation to me.

      I know nothing to very little about this topic but if you decline to help then the dot man says OK I'll go ahead and turn on lights etc..... but before that tells him to move aside or get off truck..... would that be a violation of that they cannot go in your vehicle and touch your stuff with out your consent? but after that all that you would have been held up for a while after them discussing everything..... sounds like just a waste of time but idk

      @@jerrywilcox9890 Thats why you fight every ticket and dont just pay a ticket or send a lawyer in your place to represent you. That lawyer will always take the fastest route to getting out of the court room. I fought a stop sign ticket along with 5 other drivers that was written at the same stop sign on one day. All 5 of us walked out of the court room scott free with no fines because we were able to show the pattern that it was scam being done that day by the cops. Never ever just pay for a ticket. We didnt even have an attourney and we won.

    I had a buddy go through an Arkansas weigh station, and they pulled him in for an inspection, The DOT officer wanted him to check his tire pressure, and he declined. Nothing happened to him.

      We have this in Commiefornia now. The Tire Anomaly and Classification System (TACS) They will ticket or report you for having low tire pressures or tire defects

But 5th Amendment in no assisting is a good angle, but also 4th Amendment which means the DOT officer may not enter your Truck without permission. Turn it off and lock it up tell them to come find you when they are done.

    I found out years ago that half the time DOT officers will contradict each other and they tend to interpret the rules however they want, Just like that Texas DOT officer did with the personal conveyance use of trucks years ago. There are plenty of DOT cops that'll put you out of service at a scale and give you the # of their son- in-law that runs a mobile repair service

      Greatest compliment I ever received was from a Texas DOT officer. Bobtailing home to odessa from Fort worth and got pulled in, he claimed I was the first driver ever that he had seen use PC correctly.😊

      Register your all caps name. This gives you legal standing. Then anytime they bother you, demand to see their business name registration. None of the Troopers are registered, to conduct DOT Inspections.

    I had a coworker in California refuse to help the technician at the scale house inspect his company tractor. They even called in the Sargent and he wouldn’t back down. They ultimately gave in and told him to sit outside of the truck while they did they’re full inspection. He stood his ground and he won.

    Okay I will just give you my take on this. Good for him that he is not assisting. I have been out of this field for a few years but I know when I used to be in the field years ago. I was younger naive and was always willing to help the dot officer. I was told on multiple occasions by dot officers in Colorado, Wyoming and New Mexico that I as the operator am under no obligation to assist them they preferred that I did not. The Colorado DOT inspection was extremely blunt of ordering me out of the seat and I was to stand outside at least 60 ft away from the truck while they were doing their inspection. They needed to see the equipment how it is operating excetera without the driver's interference. What I learned to do after that is ask. More often than not I was told we prefer that you do not assist. We can do our inspection faster if you are standing over there out of the way. 👍 Got it. Works for me.

    Legally you do not have to help them do the DOT inspection it's faster if you help them and you're polite. I've had some of them let me go on minor things just because of helping them and having a nice attitude. If the dot came up to me with a chip on his shoulder to begin with I would refuse to help him explaining that I've already done my inspection and had no help from someone else and he should be able to do same. I have been doing that since back in the 80's but only if they've had a bad attitude when they walk up to me. Remember drivers and DOT officer's alike kindness and respect can go a long way God bless you all and please be safe out there.

    Mutha Trucker great video,The Dot safety book use to say a driver doesn't have to be present during pre trip inspection,I was in Ohio about 10yrs ago a state trooper told me that I didn't have to be present for the dot inspection and I could go and get some coffee,I would call the local dot office and ask about this question,If the dot trooper put you out of service for refusing to help them,I would call the local FBI office explain to them your rights have been violated and they will come out make sure log book and your paperwork is updated because they will check all your paperwork.

    I was getting an inspection and it was raining that day . When he came up to me and told me i didnt have brake lights i asked him to get in and hit the brakes for me. He did . He was right . A fuse had blown while driving . That allowed me to change the fuse and not worry about someone ending up under my trailer . I thanked him and was on my way . DOT officers and their inspections do help sometimes.

    If you refuse to assist with the inspection the FMCSA says that an inspector cannot operate your CMV because of liability, they don't want to get blamed for breaking your equipment. That CDL comes with privileges and responsibilities not afforded a regular driver's license. You will, like Alex said get everything put Out Of Service and it will affect your CVSA Score.

      @@Freedomishere-im6ug Part §396.9 Inspection of Motor Vehicles and Intermodal Equipment in Operation does mandate that drivers must allow the vehicle to be inspected. The CVSA is a coalition of industry, manufacturers, law enforcement and the FMCSA establishes the inspection process and out-of-service (OOS) criteria.
      Having attended the NASTI course twice I know the CVSA procedures requires the assistance of the driver in operating the vehicle’s systems, i.e. air brakes, lighting, etc. I suspect that had the officer in the video took the stance the vehicle was not allowed to depart until it was inspected then the driver would have been more cooperative. Technically there isn’t a “law” that says the driver must assist; however, there is a regulation and procedures that requires the driver’s assistance in operating the vehicle’s systems.
      The Fifth Amendment does not apply to safety or administrative laws, i.e. 49 CFR Parts §100 through §199 also-known-as (a.k.a.) the Hazardous Materials Regulations or Parts §300 through §399 a.k.a. the Federal Motor Carrier Safety Regulations.

    I understand why some drivers refuse to help with inspections but I always helped and I was in and out quickly. I drove for a Fortune 500 company the last 15 years of my career. DOT would tell me we’re inspecting you just because we need to train the new guy. Plus I had Hazmat loads sometimes and they are red light magnets.

      @@joshuarichardson3612 I consider just a paperwork inspection that takes 5 minutes in and out. If they do both inspections = paperwork and equipment it usually averages 15-30 minutes. That’s not long considering how many hrs I’ve spent in traffic jams. But the macho men with a chip on their shoulders and a bad attitude might be there a long long time because they’re looking to get you on something.

      Gotcha just saying from experience a real full blown DOT inspection takes longer. Trust me I have done them. It’s the things drivers don’t check that get them in trouble. Like a bolt that hold down the air tank on the trailer. I have seen Indiana do that to many drivers

    This would be a good reason to have a big dog on the truck. I do. And at my last DOT inspection, he gave the inspector a very clear message, “This is my house and you need my permission to enter!” He’s friendly, but he’ll also stand his ground. He’s a Black Lab.

    Probably depends on what the state laws say. I imagine that most states have a similar provision that FL law has applying the FMCSR's: "(b)Any person who fails to comply with an officer’s request to submit to an inspection under this subsection commits a violation of s. 843.02 if the person resists the officer without violence or a violation of s. 843.01 if the person resists the officer with violence." Those are state criminal violations. Not something that would go lightly on the CDL record. The Supremes have spoken on the applicability of the Bill of Rights to the operation of a CMV. Without getting too wordy since it is a wordy issue, the trucking industry has been held as a "highly regulated" or "pervasively regulated" industry and the government has a compelling interest in the safe operation of the industry. Random stops for the purpose of conducting safety inspections and other regulatory schemes have been held to be permitted under the constitution. There's a lot more to all that but the bottom line is that I'd be very careful in following the advise of the dude in the video.

    4 days ago I got stopped for a headlight out (Pretrip it was working fyi) it was the first time I had ever been stopped by DOT and being a new truck driver only driving about six months. I was nervous when he stopped me and did not immediately put the truck break on. I had my foot on just a regular break. Go to Officer walked up to my truck got inside of my truck. I was basically almost halfway in my cab asking me for my paperwork when I took my foot off of my break and all of a sudden we heard a rash didn’t move the shot too much. Needless to say, the DOT officer was only parked about a foot away from my truck, so he was at fault as well as myself, and my truck rolled into the front of his Vehicle. So note to new drivers, make sure you put the goddamn break on.😂😂😂😂😂 also me not having an attitude jerk saved me from getting a ticket for my headlight but for when I hit the DOT officers vehicle didn’t get a ticket for that either. And I contemplated arguing with him that he was parked way too close to me. But I guess that probably would’ve made a difference because my truck was rolling. So I figured if I am because him and he actually was pretty nice and it saved me from getting tickets. So I don’t think you should be an ass to the DOT officers at all honestly but that’s my opinion..🤷🏼‍♀️

    I drove into a weigh station with half a load and the guy ran out the door to flag me for an inspection merely for being a hazmat vehicle. Not one infraction and he gave me a sticker for the windshield to tip off inspectors on the road i aced it. Months later my rear brakes were giving me issues. They were *finally* addressed by my employer.
    Those of us who have been around for decades remember the days when you drove til the cams flipped 🤫 I never had a problem stopping😁

    I am just a rookie I have only been driving for 30 years. But I found during my 30years of training the more flexibility that you show the DOT the more flexibilty that they show you. For example I was only driving for 3 weeks and I got pulled over in up state NY. The DOT officer wanted to check my axle weights so I helped the officer unload the scales and set them up after that I was weighed and found to be over weight on my tandems with no room for adjusting. The ticket went to the company because of my attitude. Another situation I was pulled in for inspection in Indiana the office found my air tanks on the trailer were not secure but again because of my attitude not tickets issued but repairs had to be made before I coud carry one. I was pulling an oversize load in Indiana I was stopped at the scale On In30 and told by the dot officer that I was not to be on the highway with wind speeds over 25 mph, So I stuck my thumb in my mouth and pulled it out and stuck it in the air and told the officer that I was only getting a reading of 22mph and he let me go. Your attitude toward the officer dictates whether you are getting a ticket or not unless it is abolutley positive that you deserve it

    Like it or not the truck driver is 100% correct on this. It's no different than getting your car inspected the place inspecting your car doesn't tell you to do anything.
    Law inspecting a vehicle is an investigation, as such you don't help them investigate you.
    If they want to say they aren't working without proof sure they can but you'll just win the lawsuit.
    It's the same as arresting someone for DUI for refusing to take a breathalyzer. You've been falsely arrested. Whether you were or might have been isn't valid they haven't proven you were but did it anyway.

    I remember the post from 8yrs ago and wondered how that finalized. The later model trucks have a light tester for drivers to do pre-trips that they can offer or the inspector can initiate. I would love to hear from the previous guest, the retired state trooper, who switched to DOT safely auditor. I can not remember his name, but he went over driver logs with great detail on PC status.       DOT cannot (is not supposed to) use the pre-trip light test. They need to see lights activate from normal input (turn signal active, brakes active, etc), not a "simulation". The pre-trip light test only shows that the lights work when power is sent to them. They need a second person to actively perform the inputs to ensure that the entire system is working properly.

    When I worked on my Class B Passenger Endorsement I read: “You have every right to refuse to assist a DOT officer in the inspection of your CMV, but you risk serious consequences for your company - it could result in multiple out-of-service orders.” FMCSA Handbook

    I was a spoiled driver. Basically, I got into a different charter bus every day (it's more complex, but let's keep it simple.) As a CDL driver, I had to take all of the tests everyone else did plus a passenger endorsement). Have you ever tried to inspect the travel on the slack adjuster on a motor coach? I know how it is supposed to be done, but I was wearing a white shirt and black slacks. We skipped that part of the precheck. If DOT wanted to do an inspection, let them crawl on the ground. There is no way I would help them out on that one. I did the basics, axle oil, fuel, engine oil, cracked windows (we had a lot of them), lights, clean toilet (not DOT required), tires, air leaks, etc. Grabbing that slack adjuster and pull it to about an inch....no!

    Honestly after a Georgia trooper busted the center on one of the hubs of my trailer to put me out of service, I wouldn't trust a Georgia state trooper touching any controls inside my truck

    There’s a difference in “helping” a DOT cop do an inspection and complying with the law. FMSCA and CFR’s require a driver to submit to an inspection when required. As an ex DOT and a current driver, you agreed to it when you got your CDL. I’ll give them what they ask for (logs, papers, medical registration, etc.). That’s is not helping, that’s doing what is required. It’s been that way since the ‘80’s. Taking this sovereign citizen role will haunt you. There is a charge, at least in the state where I was a DOT, for “Failure to submit and comply with a federal inspection.” At that time in the ‘90’s, it was $3k. And 8 hours OOS (different log regs then). So sure, you can refuse, but have fun explaining to judge why. They’re always going to side with the law. Back then, drivers were different anyway. More respect for themselves and their jobs.

    I was on jury detail last week,and the judge asked if any had “problems” with accused being on probation and multiple felonies at time of arrest for present charges….My hand was the first up with four others….Out of seventy potential jurors….Don’t/wont support law enforcement?….Then,don’t expect them to help you

    If they mark something as not working without testing it, that's falsifying a document. Which in turn, would be illegal for a DOT officer to do that. So, I don't think they can put a vehicle out of service in that case. They should mark it as, driver refused to assist with check. If not then perform the check without assistance of the driver to accurately complete the inspection.

    Not a trucker, but here is my 2c. Yes you can refuse to help, and for them to get in your truck I would think they will need a search warrant, but most likely they will just get you towed. You might win the battle, but you will lose the war.

      They do not need a search warrant to hop in the cab. Vehicles engaged in commerce are not legally treated the same as your personal vehicle. This is well established.

    I say this because my company trained as such: level 5 we can go get a coffee; levels 1 - 4 it is Mandatory to be present. They had us highlight it in the hand book.
    I wish I could see how this ended. And, I’m waiting to see how many truckers do this. No more talk of low rates - this will thin the herd.

    The DOT may or may not be charging you for a burnt out light, not a murder! I have always cooperated in the past and never showed an attitude. The worst violation that I ever received was a "Fix it ticket". All I had to do was submit proof that the item had been fixed. If I remember correctly, I had to have the item fixed before I left that particular state. I was never put out of service. Although a few times, I could have been.

    I remember in the 80's getting at the scale in TN out of KY. (don't remember Hwy). this DOT officer was putting me and a team couple with a brand new Pete out of service. The service truck out of KY side had the same name on the door as the DOT officer..

    2 things can be true at once; that clearly applies here.
    Do you have a legal argument to keep from possibly incriminating yourself? Sure, but why on Earth would you do that in this given circumstance?
    You will not prevent the inspection from happening by refusing to assist. It'll likely take longer. The officer will be put off by the non-compliance and will likely "find" something to lawfully put you OOS for now, or at least fine you. Etc etc etc.
    Just because you legally CAN do something doesn't mean it's in your best interest. This is an obvious example.
    I may be correct in an argument with my wife, but is an argument about who left the toilet seat up really worth all the vitriol that comes with that argument? Is my wife more or less likely to buy $300 worth of items at Target as a result of that argument, even though I was right? Am I more or less likely to get laid that night?
    Choose your battles, folks. Use common sense.

    I'll tell you what I think drivers should do is simple. Make sure that all your items are in good working order and do your daily pre trips. Then DOT wouldnt be out here throwing their weight around. Its always the bad apples that cause all these regulations to be in place. Whether it be rookie drivers or even veterans it's just laziness I think then there wouldn't be all these issues just saying.

      whether its bad apples or not, the govt cannot infringe on our rights. That's why you have to take a stand even if its the bad drivers causing the issue. Youre upset at the wrong entity.

      @@orion2250 sheep! You can take responsibility without having a DOT pig breathing down your neck. Whether the officer is nice or not he’s pulling you over in search of a crime he has no evidence you’ve even committed. It’s an unlawful search.

    I think most DOT just want to make sure you and your truck are safe to be out here on these roads most of the time when I do get inspections I'm in and out in about 30 to 40 min and you get a sticker that let's other DOT know you passed insp

    In the 70s I was hauling steel had been hauling real heavy for weeks, someone dropped a dime on me and I was met at a get off ramp by the PA DOT . had 5 sets of portables. Did their inspection then told me to pull onto the scales. I refused not going to help you give me a ticket. They jacked the truck up and weighed it. I was light that load light and legal , was told I could leave my response was you put the truck on the scales you can take it off. Got to the terminal was going on vacation for two weeks told the owner of the truck might be a good time to put a paint job on it

    For me, it depends on a couple things (namely the attitude of the officer up to that point, how comfortable i am the truck will pass inspection, and if have the time).
    On the one hand, the trucker is right.
    On the other hand, one thing ive learned with dealing with cops is this; If you're upfront/honest & you help them, they are more likely to reciprocate (meaning they might not meticulously inspect every little thing and give you a warning on something tickatable). But if you make shit harder for them, they'll go outta their way to screw you as hard as they can.

    I got written up six months ago for no windshield wiper fluid and it went on my safety record. They’re just out of control out there. I even had some in the truck and he wouldn’t let me add it.

    Once you submit to an inspection, the burden of proof falls directly on the shoulders of the DOT inspection facility and not the drivers.

    When I drove over the road, I had several opportunities to interact with DOT agents at coops and on the roadside. They varied widely in personality...some genial and cordial, others taciturn and "all-business"...but to a man (only encountered a couple of females,,,this was 20 years ago), they were professional, polite, and doing their job. I always made it a point to be cooperative, because if there was something wrong with my rig, I wanted to know it.
    Later after moving to the safety desk, I encouraged my drivers to cooperate with enforcement at every turn. There was nothing to be gained by adopting an adversarial stance. They wanted us to be safe, I wanted us to be safe, and any driver who wasn't willing to put safety first was a driver our company did not need.

    Dot cant put u out of service without proof of nothing
