@@spuriouseffect It would have been worth it if they responded to the companies' request within those 15 days. By waiting so long, now the courts have to cut a check for the tow companies to make them whole even after the car sale. The longer they drag their feet, the bigger the check.

My freind had her car stolen and when Apd found it they towed it and charged her to retrieve her stolen property these towing companies and Apd are full of 💩
I had a client whose vehicle was stolen, located, towed and it took her two months just to FIND it due to the paperwork nightmare.
When she finally did locate it the impound fees were over 5k.
And she found the car had been utterly trashed. Windows broken, seats and major engine parts missing, wheels missing, ect. She found the towing company that impounded the car and, according to their photographs, ONE window was broken, the vehicle had power and could be cranked (i.e. the engine functioned). The towing company, of course, took photos prior to towing and subsequent to drop off, detailing all damage.
She's been fighting the impound lot over the extra damages they claimed were caused prior to the vehicle arriving... despite the photographic evidence.

It does not matter what your budget or staffing is. If the State says they have to be responded to in 15 days, then you have 15 days.
If a Judge tells any other respondent in their court that they have a certain number of days to complete an action, will they allow a response tha tthey do not have sufficient budget or funding to comply? That would never fly.
They don't care! They have defendants sitting in jail for years without a trial date; The state had to pass legislation to either indict or release them after 180 days. They still dont...

Fulton County, Georgia had 1.065 million residents as of 2021. So, there is potential for thousands of abandoned vehicles being towed in a year. Furthermore, those who are responsible for processing the paperwork associated with those vehicles are not in control of the budget to cover the salaries of those employees. And, dealing with abandoned vehicles is just one small part of their job responsibilities.
The problem is obviously more complex than this brief news report could possibly convey.

I think it's kinda funny, alot of these tow companies are damned jokes, I work with them 40+ hours a week as a dispatcher for many insurance companies.

If the law says they must be done in 15 days then it’s the judges problem if they have budget cuts. If you can’t do the job, don’t take the job. Work on your day off and sign a hundred of them. The problem will go away in short order.

The main reason they might need to read it just a bit is to insure numbers are correct and certain data lines are filled in. Minimal stuff. But your underlying principle is right on. I knew someone that worked at a tow yard in another state, he told me that if a car came that one of them liked they would send the registered owner an empty envelope via certified mail, then auction the car off and buy it for themselves. This sounds more like karma for the tow yards.
How can any recipient of an empty registered envelope from a tow company, who is also missing a car, have trouble figuring out they should contact the tow company quickly themselves?
According to my source, they had no return address on the envelope and it was sent certified mail return receipt requested so they had proof they notified the owner even though they only sent an empty envelope. @@BonannoCM

The tow company's are anxious to sell the cars while the prices are high money is always behind this
my car was stolen and then abandoned and then ultimately towed away. when i was notified it was days later.
the towing company only wanted their towing fee. more than anything they wanted my car to disappear because they did not have room to store it. the towing fee was the least bad thing that happened to me, and it would have been a whole lot more if i had to pay storage fees.
It's likely a similar problem, people just abandon the already low value damaged cars if the storage fees are added, and then tow company has to keep it for two to three months before they can make anything out of it, but it could also be years if the government ain't doing their job as seen here. Better to just quickly get rid of the car by the owner and at least receive the towing expenses in return ey? Even two months seem quite long if they are lacking space and there is an abundance of towing jobs, they could run through a dozen cars using that space and make much more profit in the meantime.
Move the cars in question to the courts parting lot, specifically the parking reserved for these judges.

I was born and raised in Raleigh NC... Predatory towing for profit has been an issue FOR DECADES (Brentwood Towing I'm looking at YOU!!!)... Mayor after mayor, City Counsel after City Counsel... Police Chief after Police Chief and NOTHING has changed. Color me SO surprised that this has been happening in OTHER places!!!
What surprises me is that people are blaming the judges for trying to give the owners more time to pay off their debts and get their vehicles back, as if that's some sort of atrocity.

I had a car towed by Futos a few years ago from an apartment complex because it had an expired tag but it needed repairs before it could pass emissions. Cost me about $480 to get it released even though it was only there for roughly a week and a half. They wanted current insurance, registration, towing & storage fees when obviously I couldn’t get it up to date with those issues. I was furious!
We are dealing with the exact same thing in Missouri and YES my friend..it is extremely UNFAIR AND INFURIATING! None of us would have voted for such a cruel law to target us low wage earners just trying to make a friggin living! Much love and prayers for you. Thank you and I hope these predatory tow companies don’t thrive as well because they are indirectly ren by corrupt bureaucrats working for or with cities making money by selling vehicles they tow. They know most times people can’t afford those crazy towing and storage fees which often end up being more than what those vehicles might be worth if older or are immobile by some reason.

here in Maryland you get 30 days and then if you don't pick it up they get rid of it immediately
Same thing in CA. After a month of a car being abandoned, a new title can be applied for. The fun thing is that it doesn't even have to be a tow lot owner. Any private property owner the car sits on can do it, so long as the police have tagged it, and it can be proven attempts were made to contact the owner.

I have a great idea for the tow companies. If you’re losing money dealing with these type of tows, then stop doing them.
There are plenty of tow companies who don’t do police tows for this exact reason.The fact is that these guys make tons of money towing cars for the city and for the police, but it’s just not enough money and it never will be for these greedy tow truck companies.

I worked in a small construction company office and a small furniture and appliance store as a file clerk. These company’s office staff would lose their jobs if they didn’t do it well. Once in awhile mistakes are made and might fall through the cracks. Not this many cracks with more than one company. On the other hand, the department the motions go to can cause a lot more screw ups because of negligence. Even more as you go higher up.
The judge seems to think she can get away with implying it is because of failures by the companies. Bull💩.
If an online or purchased form is used, it might be hard to prove they sent the motions. Even with a screen shot. I suggest sending them via certified mail and file the cert and copy of the motion with the vehicle’s file. Or take them to the appropriate office and take a receipt book. Old school but you have hard evidence in your possession.

The problem with judges is they can and often do interpret the law in ways that aren’t written down in the law. We often see 2 tier if not 3 tier justice systems currently.
Law Enforcement Officer towing the vehicle can check the "junk " box on the CHP 180 Tow form and put less than $500 as the vehicle value and the tow company can dispose it immediately and send it to the mill. Why wait 35 days (not 60 days if valued less than $4000) for it to clear lien if it's truly abandoned.

Wouldn’t it make more sense to take the cars that are towed ( Abandoned vehicles Etc) to a central location then the vehicle can sit on city on property and city and the tow operators can workout contracts and the tow companies can continue to business.
As far as where this could take place, I’m sure there is free standing location in Fulton where the upgrades would be minimal ( hell it’s giant parking lot and a admin building) it doesn’t need to be swanky.

But you can be sure enough you would get a SWAT rapid response team flash banging into your home at 2am if THEY sent something requiring response in 15 days and it was day 16.

Interesting how it is done in different states. In Washington State abandoned vehicles are sold with a notarized statement from the tow company that they have followed all the required steps followed up by State Patrol inspections that there are postal receipts for the required certified letters sent, the time periods are followed, and any surplus funds have been turned over to the state.
The big problem here is finding VINs on all the crap motorhomes and trailers so we can identify who the owners are.
This is not one particular person problem it’s the system!
If my car was towed, I'd be in touch in no more than 3 days - and that only assumes it was towed on Friday evening. So who are the owners who leave their cars in the towing lot for more than two _months?_ 🤔
My car was towed while I was on vacation outside the country. I parked it on the street in front of my mom's house and left on a 7 day cruise. It was legally parked but a neighbor got fussy, and it was towed. It cost a lot to get it out of the towing lot, all cash. It was really frustrating. But I needed the car, so no way I would've left it for months.
Atlanta is the uninsured capital of America. If your car is totaled in an accident you aren't going back to pick it up. There's also a series of fees, etc. There's a whole show called Parking Wars about it.
Friend had a car towed, spent less than 7 hours on the tow lot. Lot denied having the vehicle until after midnight when they were called a second time, after the police said that the vehicle was reported as abandoned and gave the name of the tow company. It cost just under $500 to reclaim the car. If a car is towed and isn't or can't be reclaimed within the first day or two the cost will quickly escalate to the point that it isn't viable to claim it. When you consider just how few people in the country have money to cover a $500 emergency it shouldn't be surprising that towed cars would never be reclaimed.

Clearly those judges are in breach of the law. If the losses are more than $5k it is a federal crime. A federal judge should decide what amount of fines or time they serve.

It needs a complete overhaul
Nothing could ever make me feel sorry for any of these thieving vulture towing companies.
The tow yard is happy to tow in abandoned vehicles, and afterwards, it resells them for storage and tow fees and excess is returned to the state. Usually, that sale is less than the fees, so no excess is ever returned. The point being, tow yards have no problem collecting too high fees. If they lowered the fees, they'd incentivize the state to act, and poor owners to collect their maybe broken or stolen cars bc the fee is way less than the value of their cars.
Tldr: greedy tow yard meets greedy state, and want us to feel sorry for them.😂

The judges need to get off of their asses and address this instead of just letting criminals out on bond which seems to be their priority
So why not just move the multitudes of cars that aren't a part of the lawsuit? They just want the judges to rule they can have your car after 15 days.
If they can move the car they move the car. Those are all cars they don't have the title to.
That's why you have to go to the state is to get the title.

They try to blame the Judges for the lack of room on their lot, whilst admitting only a few dozen cars are there because of the courts.
If they bothered the courts for the junked car titles, they could move them. They are only worried about running cars they can actually sell.
They can get title bonds on the vehicles, along with placing an ad in the papers, and the state will send them a title in their name. 🤷
The non wrecked non police 🚔 cars are pulled from apartments and housing complexes for noncompliance, things like no tag, flat tires, abandoned vehicles, expired tags, etc. Futo has regular auctions for these cars. Most go to pick and pull junkyards, some are sold to individuals or car lots, and the rest go to scrappers. RUclips channel TowTrucker.
@meansnowflake they get the exact same amount for running as non running cars. $175 tow fee $25 a day storage. These fees are set by the state. Any money collected over the amount needed to settle the tow and storage bill goes to the state.
@@ManMountainMetals Yeah, for a year for the owner to claim (most people don't even know they have money pending). Then the tow truck company collects the money. They make plenty of profit off of this, including their "fees" for selling it.
Either way, my point was that they are using "space" as an excuse, whilst admitting most of the cars taking up space aren't a part of the issue. So why not do something about the rest of the vehicles they have abandoned on the lot?
just simplify the laws to once the vehicles are in yards the vehicle owner has 21 days to pay or the vehicle is sold to the tow company for all money owed.
That is essentially the law in most states. When you pick up cars after an accident not everyone has insurance on it. Then they won't pay the tow bill for a totalled car, so you can only get the scrap value. You can only sell the car to the junk yard after you get the title.
The state isn't giving them the title.
Where I live, after 30 days the lot owner can apply for a new title in their name which takes about 3-5 weeks. It isn't really a problem with unclaimed cars, because most cars that come in are insured wrecks and/or still owned by lenders.
