  • *Sexual assault is discussed in this video*
It's Always Sunny in Philadelphia is home to some of the sketchiest characters in television history, which has earned it some pretty strong criticism. But the show actually has a pretty strong moral compass when compared to one of the biggest sitcoms in recent memory, How I Met Your Mother.

For the most part I think this was another great video, and job well done. One thing that stuck out to me is that at 4:50 you state firmly that Barney's brand of pick up artistry is "both morally and legally sexual assault", but you never even attempt to make a case for it being morally wrong. It stuck out to me because I'm not sure that I would consider it morally wrong. In this day and age I feel that the the majority of sexual encounters have some form of lie somewhere in the seduction process. If I tell a girl that I brush my teeth 3 times a day and later we bang, is that sexual assault by fraud? If I say I'm a lawyer when I'm really a lawyer's assistant, is that sexual assault by fraud? If I pretend to be the bassist from Cheap Trick and she believes it, is that sexual assualt by fraud? If your answers aren't the same for all 3 questions, where is the line drawn?
You also never really went into anything deep on the laws in the red states. In those states, which of the above 3 examples qualify as sexual assault by fraud? Your video makes it seem as if all 3 are, so are the majority of sexual encounters sexual assault because of white lies that they told? Is it sexual assault if I lie about how much I brush my teeth? If not, at what exact point does a white lie become assault by fraud? This is necessary to define for laws, especially if you're using the laws as justification for the moral implications of these actions.
Your analysis of the meta presentation of morally questionable things in each show was great content and I enjoyed the video, but when you said "both morally and legally sexual assault it really took me out of it, because it seems like you're equating Barney and Dennis' actions both morally and legally, based solely on the fact that in some small areas of the world the basic wording of laws MAY suggest that Barney's actions are sexual assault by fraud in those small areas.
But again, loved the concept of the video in general.

why would you tell someone you brush your teeth three times a day

.... the difference is that she probably would sleep with you regardless if you told her you brush your teeth 3 times a day.

I would say the line is drawn at the point where knowing the truth would cause a reasonable person to not consent. This is itself is vague but wording like this is quite common in a lot of laws. I don't think it would be considered reasonable for people to withdraw consent if you didn't brush your teeth two times a day but saying you are someone you're not is much more of a grey area. The specific examples in this video are not particularly realistic but if you simply consider Barney's apparent motives then I think their is a case for it being rape by deception. He knowingly mislead the woman so that she'd sleep with him, the fact that he goes to all this effort implies that he thinks she wouldn't sleep with him otherwise. Unlike with brushing your teeth the consent is dependent on the misinformation and therefore invalid making the act morally reprehensible.
