      It shows how weak legislation is. The courts can only punish according to sentencing guidelines. That bunch of fascists who claim to be a democratic government for the people in Westminster are not at all interested. Law is something they prefer to ignore.

      You need to look at the actual legal definition of what it is you think applies, then you will see it is not correct.
      A death is not always a murder or manslaughter. The CPS do not help much by insisting on mis-charging people in order to guarantee a plea bargain and the need for a trial in which the evidence would be flimsy or the person would be found not guilty.
      For example, a person defends themselves on a night out after an attack and the other person dies from the injuries caused. That person can not be charged with murder, it would be manslaughter. So the CPS know the jury might find the person not guilty of manslaughter and he will walk free or could agree to say he caused S18 Wounding. If it is in the public interest or someone has an agenda or axe to grind, they will mis-charge with murder and force the person to say they accept manslaughter just to get a conviction. I see mis-charging all the time, it is a waste of public money when CPS decides on cases based on how good they will look for the public and NOT on the actual facts and evidence in the cases.

    A few days ago, my wife received a infringement notice in the mail for speeding.. it was picked up by a speed camera. Due to the fact that, during holiday periods, here in Australia, the fines and demerit points are doubled, she was fined $900, lost 6 of the twelve points and lost her license for three months.
    However, on checking the date of the infringement -(after she had paid the fine), she realized that our daughter had borrowed her car on that day.
    She went back and told the traffic authority that that was the case.
    Their answer?... "If you try to change it now, you will be arrested for lying in the first place and will face three months in jail".
    A day or so later, our daughter revealed that she was caught speeding two days before that, in her own car and was fined $900, lost 6 demerit points and her license for three months!
    I am now forced to be their chauffeur and I'm not very impressed.

    If the Law doesn't take it seriously these selfish, ignorant drivers won't either.
    Driving that endangers others by gross violation of the highway code should be called what it is "dangerous driving" with a compulsory ban of varying length.

    If its the police , well done . If its public , I dread to think of the knock on effects that could result from these postings , how long before someone is spotted on the offenders dash cam and battered to death , this self policing idea does not work far too open to exploitation / blackmail / bribery . This will go wrong.

    • @PeterBee911
      @PeterBee911 2 года назад +4

      If you wait until it's on a "police dashcam", those retards will never get caught and will potentially end up hurting someone. The only effect I'm seeing there is some dangerous people getting karma and the fact that they'll probably now think twice before pulling such moves.
      Road police is less and less present, the only option left is self-policing.
      And it's a really good thing that those public dashcams footages are received in court. I hope more countries will adopt it.

    • @pjay3028
      @pjay3028 2 года назад +5

      I agree, this is not acceptable. How do we know that people aren't deliberately goading and provoking other drivers into doing something stupid and then filming their reaction in order to get them fined.
      It's not the general public's job to act as vigilantes.
      And what about bias, will people seek out particular individuals in order to try to catch them doing something wrong? Or what if they happen to film a family member doing something wrong, would they submit that?
      Then there is the blackmail issue mentioned by the OP, which is a very good point.
      Plus, if this becomes widespread, the Police will reduce the resources they put into policing the roads even more and rely solely on this method.
      Completely ridiculous.

      @Nehemiah Scudder that's so not the point here though. People should only be prosecuted based on evidence that has been collected in a fair, reasonable and consistent manner. That's exactly why the police have so many rules and regulations regarding the way they collect evidence and prepare their case for the CPS. And even they often fail to meet the required standards, meaning prosecutions have to be dropped.
      With this initiative they're basically ignoring all those standards and using any old video evidence, with no corroborating information, to proceed with prosecutions. It's pathetic.
      How would you feel if the police decided to follow you round every time you got in your car, filming everything you did and everywhere you went, ready to pounce on you as soon as you did something wrong?
      Yet, with this, if a private individual decided to do that to you, they could. And the police are actually encouraging it!

    • @pjay3028
      @pjay3028 2 года назад

      @Nehemiah Scudder it's a matter of consistency and equality for everyone. Why don't we get rid of the police and just have gangs of vigilantes?
      All the protections against police bias grew up over many years because people realised there were significant discrepancies in the way the police were behaving due to significant inconsistencies. If you sweep them away we'll be back to square one and things will just go wrong again.
      The problem with attitudes like yours is that you haven't learned from history and you just keep going round and round in circles repeating the same mistakes.

    The U.S. is beginning to use roundabouts, but there are only two of them within 20 miles of my home. They are more dangerous here at the moment because otherwise good drivers here may come upon one and not only have they never used one some have never even known that such things existed... and hilarity ensues. in simple terms... the zigzag lines at pedestrian crossings are supposed to provide a safe zone around the crossing... eg you can't park there as it restricts view. it should be punished with 3 points on your licence. 12 points is supposed to mean an automatic ban, but some lawyers have successfully argued that the driver needs their licence for work... which in itself is ridiculous... if you NEED your licences then not driving like a knob will stop you from losing it.

    It was not so long back that I sat in a community forum where Warwickshire police stated categorically that dashcam and similar evidence would only be regarded as heresay. As a lawyer I suggested that they were wrong and that in the UK at that time plenty of webcam, action cam, dashcam and other footage and stills had been used in successful prosecutions. They refused to accept this.
    I have the misfortune to live in a country where the police are only interested in finding reasons not to record crimes so that their clear up rate can be boosted by easy pickings.
    They were of course wrong on the evidence front but the police are like right wing politicians when it comes to truth imo ...

    At 1:21 how could an unknown driver be disqualified from driving for 6months?
    You can fine the registered keeper for not providing information as to who was driving a vehicle at the time of an offence being committed, but you can't ban that person as you have no proof it was them and they will not say who it was. I know it probably was them, but that was a very stupid legal advisor directing a Magistrate.

    • @Graham196
      @Graham196 Месяц назад

      It is an offence not to disclose the identity of who driving at the time and the registered owner must provide those details within 28 days and it is a serious offence. It falls under the Road Traffic Act 1988 section 172.
      The penalty for failing to provide driver details is six points and a fine of up to £1,000. This is quite serious considering most minor motoring offences attract a penalty of less than six points. You may not have even been driving yet you could still receive six penalty points for failing to provide the relevant information to the police. So the registered owner would have already had at least 6 points on their licence already and the 6 points for this would have been suffice foe a disqualification.
