The case law presented in this video calls into question the attorney-shield LL and LIA have been selling. How can you talk to an attorney on the phone if it is against the law during a detainment to talk on a phone?

(Former police officer here) The fact that these officers received a "C" grade is preposterous.
Amen! He gives the citizens a "C" for not knowing their rights but rarely gives tyrants an "F" for violating rights. I beginning to think he does it to generate more comments, which boosts the RUclips algorithm. The only other alternative is that he's an undercover bootlicker.

Immediately stuffs the one guy into the back of a police car for having his phone in his hand while the other 2 guys freely use their phones throughout the rest of the encounter. Makes absolutely no sense.

You probably mean he can smell the residue from someone smoking in the car previously, but that smell goes stale quickly and a cop has enough experience with it to know when it's fresh and when it isn't. Since there was neither weed nor paraphernalia in the car we know it wasn't, which means the cop was LYING.

How do you give the cop a C-? They violated their rights by not letting them record, then lied about the stop, and even took down the driver who was being 100% compliant and cooperative.
The citizens did not have a Trifold or 5A Cop Card on them. That unfortunately is a big mistake on their end.
Facts! I don't even know if telling the PASSENGERS to get out was a lawful order. 10:10, he responded and spoke absolutely AMAZING. The officers clearly thought they were dumb! My thing is, I truly wish no one said ANYTHING and invoked their 5th amendment rights once the so-called weed Subject came up AFTER the INITIAL reason for the stop was addressed. You don't understand, that legal product in another state is CONTRABAND in his state. He is an incredible menace to society being in possession of candy that makes you feel good, these brave officers did their DUTY in aggressively pursuing the scent of smoked marijuana to find no actual marijuana or smoking paraphernalia. But they found candy that was made from a product that could have been smoked so his imagination is truly a crime solving mystery machine and you really need to let this super genius cop abuse people with impunity so we can keep gummy bears OFF OUR STREETS. Their job is not to prevent crime. It's to collect money for the controllers at all costs. And to protect THEM, if needed. Protect and serve applies to them.

Clear cut example of cops earning the hate they received from the public these days. This stop was 100% bogus from the get go. You can tell by the cops demeanor from the very beginning that it's a pretextual stop. Makes this whole department highly suspect in my opinion. Grade should have been an F.

Well, they were going 49 in a 35, so that is a crime. If that was indeed the case, then the stop was legitimate. The remaining actions of the cops were not.

We actually have no rights at all because the person or entity violating your rights will almost never face consequences. Doesn't matter if it is a cop on a power trip or a legislature writing blatantly unconstitutional law, they have the power to do what they want regardless of the Constitution and Bill of Rights.
All anyone can do is challenge the wrongdoing in court. This is very expensive and takes years to simply have a court say if you're rights were violated.
Meanwhile, the cop, legislature or whoever was involved in violating rights has gone on with their lives and has no reason to care what the court decides.
There really is no system in place to make sure the Bill of Rights is complied with.

any time a cop says some version of this is an automatic red flag that they don't like you exercising your Constitutionally protected rights, and they don't give a shit about their oath to the Constitution.

Investigations based solely on the "smell of weed" needs to end, also driving to a safe spot should be encouraged by police as it server to protect them as well.

The "smell of Marijuana" excuse needs to be aboloshed across the board. It gives them the ability to violate people's rights with a false accusation that cannot be proven.

Something you should have mentioned is that the United States Supreme Court ruled live streaming a traffic stop is covered by the 1st. Amendment. In other words, you have the right to live stream a traffic stop, despite what a pig cop tells you.

I want to thank this officer for not just blatantly wanting to violate this man's rights, but to retaliate against those rights. That is a wonderful way for this officer to voluntarily revoke Qualified Immunity.

They most likely didn't stop immediately because they knew the car smelled like weed and wanted some time to try and air the vehicle out.

The officer just wanted it out of the driver's hands during the search. You can even see the driver with the phone back in hand at 9:01. And even if it was "1 phones 2 phones 10 phones" - You are right, it doesn't matter. LISTEN. TO. ORDERS. Fight it in court. Entitlement will just get you hit with more charges, which will probably stick even when the ones you had an issue with are dropped.

I've seen SO many videos on this channel and others, in which people used their phones during stops. I was a police officer in WI. We were trained that subjects could not have their phones. Because they were likely calling other "bad guys" which is dangerous. I've seen this. Its ridiculous.
It is stupid it gives the cops the same work around as "I smell weed". It still amounts to abusing rights.

The fact that we just allow officers to blatenly lie about the odor of a drug is just insane to me. There is literally NO way to prove it and courts have just given officers blanket carte blanche to search people's cars.
At times I agree but in this case they clearly weren't making it up. Even the vehicle occupants accept the fact that it does smell like marijuana but come up with the excuse that "it's my sisters car and she smoked in it earlier" Sorry no ones buying that excuse. Unfortunately for them they weren't in a legal state and should not be smoking in the car as thats just a great way to get busted.

The 7th circuit needs to revisit the phone case. You don’t have to be on the phone to find out where the person is.
Everyone should be able to use the phone to talk to a lawyer while on a stop or record the police. Especially the crazy prices and redacted footage you get from police body cans.
This is why all drivers need 3-camera dash cams (forward, rear, interior) ! Better to have it and _NOT_ need it, than _NEED_ it and not have it!
And they the cops have a much harder time stopping it from happening.

Obstruction can be applied to certain non-physical challenges as well such as refusing to present ones' hands for handcuffing, refusing to lie down when ordered, refusing to get into a squad car, etc.

The basically lies of those cops:
- Smells like mariguana (it doesn't)
- Who smoke mariguana (obviously nobody).
- Stop resisting (The person is not resisting to justify their actions).

In WI. there are many counties that are known for violating citizens constatution rights & being corruct. Waukesha is a known county for this! When I envoked my 5th ammendment the officer noted on the ticket that I was extremely uncooperative. I did a lot to align my vehicle with the law through reserch after the ticket that prooved the officer wrong. My ticket was thrown out dispite the officers attemps to falsify the charge.
Yes! Throw all of Waukesha County in the trash bin! The girlfriend of a coworker of mine got pulled over by deputies one night on the way to pick him up from work. She had made it into the business park down the street from the job. I drove him to the scene to drop him off and go on about my business, and they STOPPED ME and demanded my DL to ensure I was driving legally. All three of us are black btw. My co-worker's DL was expired, his GF's license was unknowingly suspended. Mine was clean. They ABSOLUTELY REFUSED to allow him to drive their car back home. They said only a validly licensed driver could. I offered to drive their car, but the deputies said they'd have MY CAR towed if I left it there to drive theirs. So, i drove them home in my car and the Waukesha County sheriff's deputies had their vehicle towed. Absolute madness; as if their entire aim was to inconvenience them as much as possible.
We need a reason to search your car without reason: "It smells like weed"
"Can we film" - "Nope that's obstruction, you are arrested"
"But he has a right to do so!" - "You are interfering with our investigation, you are arrested too"

I was falsely arrested by the Brookfield Police department after one of their co-workers working a side gig at Goodwill acted like a complete Maniac in Goodwill and I told him to calm down. As a result of this the Brookfield Police department in went above and beyond to make me a victim to cover for their insane peer.
These officers should have received an F for violating these guys rights…..

For instance, if you score 58 points on an exam and I score 3 points, we both get an F. By your logic, however, you should be given a grade of C merely because you didn't fail as poorly as I did.
Makes no sense, right? How is that fair to those that scored 79 on the exam, which is a legitimate C? Maybe they should get an A because your C is worse than theirs. Then, how do we grade those with perfect scores? See where this is going?
As I said before, the way to distinguish the cops that fail to respect rights (and their oaths) from those that resort to unjustified violence is to award the first group an F and award the latter group a F- -, or as many minus signs as you like. But a fail is a fail. Either you did your job or you didn't. You can't give a passing grade to a sub-standard performance. Period.

Anytime a cop has an issue with someone recording them they prove they are corrupt. This entire stop looked suspicious. They stopped them for driving while black and then got offended they didn't pull over immediately. PD hate accountability.
They investigate not to find criminals but to criminalize non criminals.

They clearly didn't like the idea of being recorded and when someone challenged their authority they ensured they were arrested. The kind of person who would address someone just for questioning them should never be a police officer.
So many problems with this stop. 1) Because CBD, THC Delta 10, 8, 7, etc and CBD Bud is legal in the State of Wisconsin, the smell of Marijuana cannot be used as a pretextual basis to search a vehicle. There's no means, by smell alone, to distinguish between the legal cannabis and the illegal THC Delta 9 cannabis bud which would proffer the smell. 2) Gummies, as presented in the video and packaging, do not smell of cannabis. If that is the only cannabis item found in the vehicle, then the officer lied to the occupants, lied in the arrest affidavits, and furnished falsified official government documents to justify the arrests. 3) They extended the stop well beyond the scope of the supposed traffic stop. 4) Clearly racially profiled these black men. 5) Violated their rights to record and to be secured in their affects by demanding they leave their phones in the car and preventing them from recording the encounter. Each instance of which is a dual felony count under 18 USC 241 and 242.

yeah ATA you aren't perfect, and won't get em all right. However, this unbiasedly a F. The cops clearly profiled these kids, and rushed to escalate this entire situation. You could even argue the police was trying to escalate this in order to get them in cuffs to further their investigation.

Wonderful Menomonee Falls cops, I have lived and worked in this area most of my life, the white kids in this neighborhood race up and down Appleton Ave from Meeker Hill to North Hills Country Club daily but God forbid, one Black kid trying to make a buck driving Uber or Door Dash gets hassled by these awful cops; it's disgusting!

This is what happens when law enforcement cops do traffic enforcement. It's long past time for America to separate the two. It's perhaps the likeliest reason for some of the most simple traffic stops being used to profile and extend into potentially violent encounters where the cops (and civilians) take things down the wrong road. Law enforcement and traffic enforcement shouldn't be under the same command, even at the very top. Let's make traffic enforcement safer. Let's make it an entirely separate occupation.
