The cops could literally have said this is the way it is, we have a felony and we suspect you have evidence, you don't have to comply but if you choose not to we will get a search warrant and that will disrupt your life further when we come to your home and seize your phone with a warrant. We will get that video one way or another and if you delete it that is in fact a felony. We don't want to make an issue for you and we don't want to seize your phone but this is a serious charge and it will be pursued. I apologize for the inconvenience. That sounds pretty harsh but it's all the facts, it's courteous even though it's blunt and it just lays out the situation, you don't need to get into a fight or threaten arrest and should she decide not to comply with your request then you just follow the enshrined procedure, get the warrant and seize the phone. Don't step for a second or by an inch outside the bounds of your power as established by law, you don't need to be rude but you also don't need to acquiesce and drop it. That evidence is fairly crucial and there's no legal reason it wouldn't be collected one way or another.

How is it the woman’s fault that none of the cops had bodycam on ? Are citizens supposed to do their jobs for them? Off duty or not, that’s not her fault.
Nah dude thought he was gonna bully an older lady, but she pulled the reverse uno and stood her ground. These cops think they can scare us, buy knowing your rights renders them helpless.
I’m even confused to what the initial arrest is for. The guy had a knife and then they went after him? So seems like they arrested the guy for what reason?
They treated her like she was a criminal for simply being nearby. Why did they come at her like that and threaten her? Well , I know WHY, they believe they can do what they want.
ATA is being a bootlicker again. He gave the cops a "C minus" because they didn't beat up the witness, steal her phone, and arrest her? The part where they put their hands on her and demand she "back away from them" as if she's the aggressor while they actively approach her and try to bully her away from her own car made my blood boil.
Reminds me of a time a cop slammed my bedroom door in my face because I had the nerve try to enter it when he was inside with an EMT because my girlfriend had a seizure. My own freaking bedroom!! It slammed my forehead and nearly broke my nose.
Why a C-? The plain clothes cop rolled up on men arguing and inserted himself in a situation unnecessarily. How can you say the woman was verbally and physically aggressive after how she was approached. Complete BS rating!
The ratings are all over the board on this channel. There is no rhyme or reason to how he decides - his "grades" are complete bullshit, hence the reason I have usually stopped watching by the time he gets to them.
I do not agree with ATA’s grades often because he chastises, comments and downgrades often due to citizens exorcising their 1st amendment by using offensive words. To be honest, his comments about not complying when someone doesn’t need to or using language that may offend others aggravate me. Thats why I find myself watching other YTers more and enjoy their videos more.
The problem here is that the cops didn't approach her nicely. Then if she refused after their nice request, they simply could have explained the subpoena procedure politely. If she still refused, they could have obtained a warrant or subpoena. Instead, the escalated..
Yup, there were MANY ways to have handled this MUCH better. They could've approached her like HUMANS and asked if she got it on camera, offered their card to her to email it to them, and warned about destroying evidence. They could have also noted her license-plate. They didn't need to act hostile from the start, demand to STEAL her phone (and of course, the PIN and access to everything on it), try to lie about it being a fake traffic-stop, threaten to arrest her, and force her to ID. 😒
Yep. I think the Chief was aggressive because he wanted to watch the video AND conveniently delete it. The woman said several times she never saw the defendant with a knife.
She probably would have just given them the video if they had been nice. Cops bring this crap upon themselves, but they are so blinded by their egos they think it's all a conspiracy against them.
They know they're guilty and they want the evidence of it. Then they try to create their own Narrative. THE CHIEF IS ONE OF THOSE GRIMMY ONES. WE SAW IT WITH OUR OWN EYES!

I can virtually guarantee if the video showed that the cop was wrong, then the video would have disappeared. NEVER cooperate with the police. They were ready to bring this woman to jail and she did nothing wrong. Despicable.
And cops continuously mute or turn off their body cams, thus altering and deleting evidence. Should request all the videos of them to see if they tampered with evidence.
The witness would have probably cooperated if the cops weren't total dicks to her. They never seem to understand or care about that and act like we owe them something. Treat an innocent woman like a criminal and wonder why she doesn't want to help them. Worst part is this jackass is probably already working at another police department. Although I agree that the policemen did a terrible job, the grading that ATA uses goes from the worst case to the best case actions that each party does. There are realistic examples of the policemen arresting her purely for not giving her the evidence, or using unreasonable force for believing that the woman was gonna use her fist against her. I have to reiterate that yes, I agree that the policemen were bad, but there are worse things that they could have done to get an F.
I was also rather surprised at this rating. A "C" rating should be considered as what it is: acceptable but not noteworthy or above average in any way. For law enforcement, that should mean understanding the law (including individual rights) and respecting the law. This is a baseline requirement of the profession, *not* a superlative behavior. These officers made several statements and actions indicating that, at a minimum, they did not understand their authority. At best, they were ignorant. Worse than that would be *knowledge* of authority but disregard of it. It may be difficult to ascribe intent, but it seems likely that there was minimal ignorance. I think this goes to at least a D, if not an F. And let's not make the mistake of limiting an F to only the "worst case" scenario. I've never seen a video on this channel that displayed a "worst case" scenario, and I've watched all of them. Furthermore, that's not the baseline of comparison, because that is not the *expectation* of the profession (or any profession).

I dont understand a passing grade for harassing some random citizen that decided to film. These ratings are off
Awhile ago* they had a change of narration, slowly but surely the cops started to become better and better rated for worse and worse interactions
Completely agree. An F is being nice

Then Got In Her Car ...
And Just Drove Away .
They COULDN'T
Stop Her.

They would have just arrested her, the phone would have been confiscated and the video would have disappeared.
The law might say that they can't do things like that, but the cops clearly don't care either way about anything the law does or doesn't say.
They do what they want.
Holy crap, New York hires a lot of tyrants. They better get better at dealing with the public legally.
Remember all you get is 2 weeks of training, then giving a gun and badge and hit the street and you have to pick it up from superiors who also only had 2 weeks of training.
And they can get rehired on the SPOT somewhere else.
Meanwhile Lawyers atleast take 5 years of law school, studying the law and processes and need atleast a year of internship to even be qualified as a lawyer.
So even a law student who finishes 1 semester is more knowledgable of the law then an officer. Think about that!
All cops are tyrants
This happens when a state votes blue consistently. They voted for more government, and that's what they're getting.
Especially elmire
How did cop become a chief treating people like this¿¿¿Why would anyone help him
This woman is a hero
This is a BLATANT attempt to sway a potential witness's account. OFF the charts wrong.
This lady’s response to the cops was hilarious. After they explain why it doesn’t matter that it’s not her phone and she should just give it to them, because their patrol car doesn’t belong to them and instead belongs to the city, and she just says “ok cool, can I have it?”
Best part of the video, she brain check mate him so hard
Love your dedication to research, and citing all the legal codes. Thank you for such an informative and important channel.
I am completely shocked the City Manager did his job and fired the chief.
But he didn’t get fired over this video it was a separate video of another incident plus this one. He was showing a pattern. I think he was an adrenaline junkie.
Just the fact they support their supervisor blindly says all that needs to be said. This is the guy who is suppose to keep them in check and to make sure they does as required
They are bullies and abusing their power.
C-?! Those cops harassed the hell out of her, and if if she didn't give ID, they would have arrested her.
The lady gets an A, the cops get a F.
You're more qualified to be doing these ATA videos, apparently..
They deserve a big ol fat *F-* not a C-..
@@Hmclaren-vc8vfagreed
Agreed. They violated her 4th and only because she jerked her phone away it didn’t get confiscated. All the officers involved need to have LEO certs revoked and fired.
Remember that it's about rights and what they can do. ATA tries to be unbiased but I do dagree C- is too high. More like a D- as they kept threatening a false arrest. F would mean they trampled over her rights over nothing and she be in handcuffs much earlier as the police points out. They aren't good, but they are better then the worst examples. And yes that does sound like "defending them" but it's not. After all we are comparing someone who assault and arrest you for disagreeing, with someone who will assault and arrest you for not giving them what they need ultimately. One is waiting for YOU to make the mistake so they can move in freely (as you saw with the "Fist motion excuse") the other doesn't need a reason but minor annoyance.
Wich is worst? That's opinion! @@Hmclaren-vc8vf
And he gave the last officers who bust through the home on a wrong call DV call with the father and son the same grade as the witness in this video. His grading is horrible. Should just stop grading or give pass or fail scores. He needs to just stop the grading system period. It’s wild and all over the place.
That whole department is following that chief's example of escalating and violating people's rights!
She will become a witness for the Defendant.
I hope so. Because I believe that the chef is a liar and I have yet to finish the video..I am at 7:45 into it
I love this channel. Whenever i feel sad because of the injustice in my country. I Whatch one of your videos
crazy how the police are given every benefit of the doubt, hold all the power, and control when the interaction begins and ends, but the citizen is the one thats required to know everything and show all the restraint edit: i strongly disagree with the grades given in this video
People need to start defending themselves against police. There was so much assault in this interaction
Yeah, that's a great idea. 🙄
Funny thing is that even if a police officer just starts assaulting you out of the blue, without even saying anything and without you having done anything or being anywhere where you shouldn't be, you _still_ can't defend yourself, no matter how brutally the officer beats you. If you defend yourself you'll find yourself in jail. Or worse.
Funny how that works, eh?
Dude she simply pointed back at the cop and the cop tried to say she was threatened by her making a “fist” and then tried to arrest her for obstruction. Even when you do stick up for yourself, they have no problem making things up even on camera.
Yea honestly it is. Stop thinking bc they have a piece of tin on their clown suit gives them the right to act illegally and against all natural law that’s been in existence long before the modern age. Touch me as I’m a free citizen you’ll get touched back.
@@brnfrmjts05 what's the alternative? Allow another person to assault you?
Man give that lady an A. U be tweaking sometime. Cop was totally being a narcissistic tyrant
The woman told the cop she didn't record the part of his actions he wanted to see. That should be the end of it. If the cop didn't believe her that's his problem, not hers.
She blatantly lied to his face. When he first approached her, she said she started recording when he pulled his gun out. Supposedly, the guy already had the knife at that point, which would have been in the video. But then at 9:46 she said "No I didn't film it, I seen it with my eyes." So she either lied from the start or changed her story.
@@traesnoozy9807Doesn't matter none of his damn business what she recorded
Well you also miss a point, Citizens aren't REQUIRED to assist them in their investigation.....@@jimthrowaway
That just shows his guilt he couldn’t take her word for it because the risk was too great
Man, police really want "contempt of cop" to be a crime.
Imagine walking up on this scene and seeing your wife or daughter cornered by 2 armed thugs like that. Imagine how u would respond.
Here's the proper understanding for this situation.
I would either be on trial or eulogized.
I hate seeing abuse of power.
I love when Justice comes to those who feel are above the law.
