      ATA logic is funny. He'll tell you to get on the train and just comply, and you'll have your day in court. That's IF you can afford it and IF it doesn't bankrupt you first. Even if you win, the courts still got your time and your money. That means you still lose.

      Cops can’t arrest anyone they want, which is why if an arrest is wrongful they can be prosecuted in COURT, and if you’re innocent that doesn’t give you the green light to resist or fight them, if you do that you are now in the wrong and made it much more difficult for the officer to be prosecuted, if you’re so against police you’ll let them do what they’re gonna do and prosecute later so they can be held accountable, resisting just tells me you love police and want to ruin your life while also allowing them to keep their job

They could have been taking him somewhere to play target practice with him for all he knew. I understand that it may be the law but it is a very messed up law when you expect a person to fight their humanly instincts to survive. And then to go on to take him to jail anyway was just down right inhumane and I don’t know how they sleep at night.

      Your being able to prosecute the police later on, often requires that you have money available to pay for that. Many people do not have this money and whilst there are public defenders, they address the criminal charge, not necessarily the lawsuit later on. That doesn’t justify resisting in this scenario though.

    The legal system extends such courtesy to a police officer's honest mistakes, but they can't extend the same to a citizen whose only error was panicking for being falsely arrested.

      It was a lawful arrest.
      He committed a traffic offence and was pulled over. They thought he was a felon, we’re concerned for safety (proved right as he had a gun) and it is well established police can order you out of the car.
      Dude brought it upon himself and his life cratered for no reason. Sure it was a mistake / but if he had gotten out and spoken calmly to the police officers it would all have been sorted out.

You are driving home, you possibly commit a simple traffic offense. Police officers try to drag you out of your car and say you have a felony warrant. You don’t. In my opinion it is not only his right, but his duty, to repel this invasion of his privacy and his rights.
      None of this mentions the obvious fact that he is black. He has a valid reason, more so than most, to be afraid of the police. To be apprehensive.
      What the officers and the DA did is wrong. There isn’t any way around that fact. If that’s a lawful arrest, the law is broken.

Audit the Audit, as well as several other channels, and even several lawyers, have stated that if it gets down to it, you pretty much have to let the corrupt police officer have his way with you and fight it in court.       There is a odd philosophical/ethical conundrum that occurs w/ regards to types/amount of rationalizing for/against certain things...especially in regards to a 'relied upon system' such as gov...
      - I'd posit that it is no longer a 'legal system' but in fact a authoritarian regime, a la the 'inverted democracy' sort. There is a set of logic fallacies, thought traps, and conditioning that sees people think "the court needs to correct this", when in fact its all 1 system working together. The moment bureaus, independent agencies etc broke the very strict 'separation of powers'/checks n balances doctrine(s)...the system broke entirely, 100%.
      - The Constitution is not a 2-party agreement (state/fed), but a tripartite agreement. State(s), Fed Gov, and This is because it is a republic founded in representation (as a convenience only), and that the Liberty/Rights (of citizens) are sole reason other two parties exist or are granted power by The People.
      - IF the system sets aside 'exceptions' in majority of legislation ONLY for gov, almost never for Citizens...Its tyranny, the law is a arguably a convoluted front and subterfuge: meant to convince people "because it was passed into law, its legal BUT also moral/ethically sound". In fact if the law is non-uniformly applied (in gov's favor), then its restriction freedom of citizens + empowering authority, hallmarks of authoritarianism.

      Basically, uniform cops are not taught the techniques of an investigation. They throw around the words "my investigation" without having any idea about the methods of an investigation. I trained officers in the techniques of investigation and an arrest should not enter the equation until facts are learned and there is probable cause to make an arrest. Most calls and complaints can be resolved without making an arrest by knowing how to investigate instead of puffing up and end up to make unnecessary arrests, usually false. Bad cops become the adversary before they ever arrive on the scene and find out the problem. Unless the responding cop requests backup, other cops should not arrive at the scene. If and when backup arrives, the backup keeps his moth shut and listens. All too often the backup escalates the situation. Watch the videos for what I have pointed out.

    The problem with fighting an unlawful arrest in court, is that it costs, money, time, and effort. In the meantime you might be out of a job for months, while he cops still have theirs, while you wait for the court sessions date to come around.

      Shit happens, and cops were wrong, but how hard is it to just comply? Just because you are innocent doesn't mean you get to resist. Shut your mouth, comply, and it will be over with in 5 minutes, and you'll be on your way. Plus you get to file a lawsuit and get lots of money if you are in the right.

    It's not reasonable to believe they had the right person after he gave legitimate state issued ID that he was not the suspect they were looking for. The fact that courts allow for this is ridiculous and unconstitutional. The state of Texas having overruled a constitutional right is ridiculous

    You are never at more risk that when the police have screwed up, they will do everything in their power, they will go all out, to charge you with something, the courts, police, prosecutors (and so on) will all be aware of what's on the line, and will put enormous effort into your prosecution.

      It isn't just ego, but that is a big part of it.
      What DavyLordy is pointing out is very much part of the system. The City is the one pushing it though, they are the ones losing money in the court cases after all. If the police can find something, anything, to make the issue 'muddy' then the following civil court against the local government is a lot harder for people to win. If the cop accepted responsibility, which dismissing could be considered a sign of, then the civil case would be a lot easier for the innocent parties to win.
      A cop that costs the city money has what sort of carrier?
      We call this a perverse incentive, police interactions are filled with them.

    Once you talked about him losing his job, place to live, and possibly his children, I could not help but cry.
    This happens all the time. Whether real or not, often an individual will lose everything dear to them this way. It is disheartening to know that due just one individual's use/missus of our legal system can destroy everything you love and need to survive. Yes, it also happens due to poor choices made by a person as well. However, that is not what I am referring to here. (Or not completely so)

      fighting with the cops is a crime, that makes you not innocent. once the cop informs you that you are being detained, you are now at their mercy. even without the mistaken identity, he was stopped for a traffic violation and refused to exit the vehicle which the supreme court has determined is within a cops right on a traffic stop.

    "Comply now, complain later" is the most disgusting sentence I hear on this channel.
    No one, absolutely no one, should have to endure this abuse(and subsequent destruction of their livelihood) based on an opinion of a police officer.
    It gives the cops permission to do whatever they want whenever they want knowing full well that the court system has their back.
    The people need to stand up against this kind of tyranny and say no, and I'm ashamed that this channel condones such actions.
    I expected better from a, usually, well informed and impartial channel.
    The police MUST be held to a higher standard than the every day citizen, not a lower one.

    Shame on the Dallas police and the district attorney for dragging this out for 14 months. Yes he did not submit like a dog as they wanted him to, he resisted because he was innocent! Cops and Sergeant proceeded to press bogus charges agents him causing him to loose everything (his gun was legal and charged him on illegal possession to rack up charges). How does anybody come back from the trama Dallas put on Silverster. The guy lost his job as a security guard because his employer thought he was as guilty of criminal charges, he lost his income and ability to support, lost his home, lost his ability to gain employment, he was humiliated and disrespected because two cops and a sergeant could not just let it go on their mistaken identity! I hope he gets redemption in his lawsuit! PS: The security company should apologize for not giving him the benefit of the doubt and the wrongfull dismissal now that the truth is revealed!

    The reality is that even if the charges are bogus, most people will lose their jobs, they will ruin careers and it will take YEARS to get justice.     As a Norwegian I am appalled by the lack of communication and de-escalation skills I see in the American police force again and again. Had they just told him why they wanted him out of the car when they first asked, he'd likely be more understanding of the cops' situation. I mean, are they afraid that he's going to just act out? If that's what they're afraid of, they obviously got that from him, by not communicating to the guy why he's being detained.

      No shiver. The cops did the right thing. I met a guy who told me his name was SIlvester buy his drivers licence was Sylvester. I asked him, and he said it was to not get caught by the cops.

      This argument doesn't make any sense. It is entirely moral for the police to use force on you if you resist. They're people with families too. In worst case scenario just go with them untill the mistake is cleared up

      They are performing exactly as qualified immunity is intended for them to act. What the government does isn't wrong. You are wrong for getting in the way and especially thinking that governmental actions could possibly be wrong.
      You aren't entitled to making informed decisions. You aren't entitled to know why the government does the things it does to you or anyone else.
      It is all disgusting. Any reasonable, rational person can see the issues with any immunity for anyone. Especially those with power or authority.

    They realize they had the wrong guy then stood around trying to figure out ways to make his arrest legit instead of aplogizing and letting him go. They should be ashamed! I hope he gets millions from this lawsuit. My heart breaks for him I could imagine losing a job and home all while trying to provide for four children all because someone made a mistake that their ego couldn't admit to.

    This has to be gross negligence: they saw his name and it's a near match but don't check to see if his address, age, height, weight, race, etc. match.
    I feel really bad for this man. He went from being a LEO hopeful to homeless because a couple of officers didn't want to admit their wrongs.

    Ya know, i wholeheartedly agree that resisting wrongful arrests and still being charged is absolutely crazy. What I think is crazier is how much of this could be avoided if they cops actually did their job right and conducted an actual investigation from the beginning. Imagine just being told what to do without any information or anybody trying to figure out whats going on; and then when you're confused, they tell you it's "your fault" that they don't know what they're doing.

    That cop went in his window opening his door demanding he get out & detaining hilm from the start. All he asked was “for what” &cop went hands on. Cops think by going at a citizen at 10 max and not explaining things is just ok and not going to get push back. If a cop slung my door open demanding me to get out and detaining me id ask the same thing but i was arrested on a old traffic warrant couple years ago and i asked her to please reconsider(she treated me like some criminal over a traffic ticket) and she took that as i was resisting when all i did was stop n ask that question. She pushes me onto the cop car on my chest then conducted her search of me but you could tell she was pissed bc she “thought” i resisted all bc i asked a question🙄. Cops are so ego driven the second you question there authority they flip to max! Just like this cop did to this man. Which escalate the situation

      Because the government managed to turn the constitution into a document that restricts our freedoms, rather than a document limiting the power of the government. You can thank judicial review and "case law" for this. Checks and balances doesn't work when the branches of government are all conspiring against the people

It makes me sick that they picked up the WRONG person, got mad when he panicked after they essentially dog piled on it, AND THEM they drummed up charges to still continue with the arrest instead of realizing their mistake, apologizing and letting him go.

      Letting go without charges means they violated his civil rights for an illegal detention. You can't file for a civil rights violation unless the charges are dropped. Unfortunately he admitted to not signaling at the stop sign which makes the stop legal. I'm pretty sure that charge all stayed. I hope the guy wins.
