  • Erin Otis, who was previously a Maricopa County Superior Court judge, received an admonishment from the State Bar on October 20, 2022 for her misconduct on the bench. Additionally, internal emails and text messages show that County Attorney Rachel Mitchell was directly involved in recruiting Otis back to MCAO while she was still presiding over a death penalty case. Mitchell defends her actions after our ABC15 report.

      I actually ran across a court transcript once where the Judge ruled "I can't allow that evidence, it won't help the PROSECUTOR'S case."

      @@Steve_Hayden I did. Was told if it went to trial and I was found guilty, I would not receive my legally Rx pain and psychological medication, and I’d go to jail for a minimum of six months. For signing a paper that my now ex husband coerced me to sign under the threat of violence. I pled guilty and got six months probation.
      My ‘provided’ lawyer kept putting the trial off bc he hadn’t read the discovery yet. He had not gotten to the signed affidavit that proved that the witness to my signature was not actually witnessed by them. He claimed it had ‘dragged on long enough’ and I was too frightened to argue. I wish I knew back then that I had the legal right to address the court.

    This is great to see. Judges and Lawyers are walking all over citizens because the Bar Association has been on vacation for the last five years. You can search on RUclips for judges making calls that they are not to make or stating opinions that prove they are not impartial and they have never even received a complaint let alone disciplined. Dave deserves an award. I hope the voters appreciate the work he does.

      No offense intended but only 5 years? Seems like a lot longer than that. I agree it's a step in the right direction but more needs to be done. They need to be truly punished. Jail time at the very least. These people have been given a lot of power and need to be held at a much higher standard. We as a society have turned a blind eye to this for far too long. Most people don't believe it because it's not happening to them and most of the media won't report on it because it doesn't fit their narrative/agenda.

    This is exactly the kind of hard-hitting, investigative journalism we should expect regarding all of our public officials. This is regardless of party or political affiliation. I hate to use the cliche "They work for us." But if we the people do not hold them accountable, who will?

    That’s the same county attorney who withheld a video proving innocence in the death of a police officer. They almost made this single mom a felon and she was going to have to serve jail time for an accident where an officer ran out in front of her vehicles without checking the road. They had proof he didn’t check and withheld it purposefully during her trial. This county attorney was in charge of those prosecutors as well. Why is she still around? Clearly incompetent

What does that ex judge have on her? I didn't see a text mentioning any pay amounts, only two jobs, she could pick from! She shouldn't lie, when the info is in a text, for Dave to see!

    Nobody’s prefect. When the community has concern for personal safety with employees working in Maricopa county & governor elect discriminates it hard to believe in our justice department. Sad Adele died with these enabling each other while budget funds pay victims from negligence or violent inuries. Be nice if integrity actually existed amongst these folks it might become the norm again.

    I hope protestors don’t start picketing her as a prosecutor outside the courthouse during every jury selection. It could become difficult to sit a jury on any of her cases with jurors questioning her credibility as a prosecutor.

    Time and again over the past 5 years I am aware of, we've witnessed some of the worst misconduct and lack of transparency with little accountability from Phoenix LE and Maricopa County judicial system. This is a good report showing how much deeper this runs. That county attorney looks weak and apparently has much to hide. I am just sorry you didn't have all the information about this lead attorney sitting behind you during your interview. If you did, it would be interesting to call on her to come to the mic and account for this discrepancy in conflict of interest.

    These prosecutors are great arguments against the death penalty. Clearly integrity is not a part of their character.
