    As a Labour Minister in the Viceroy executive council between 1942 and 1946, Dr. Babasaheb Ambedkar was instrumental in bringing the Mines Maternity Benefit Bill for women in all over India. Under this act, a woman working in the mine is entitled to maternity benefit for a period of 8 weeks. This period of 8 weeks is divided into two parts of four weeks each, one part preceding delivery and another part succeeding delivery.

    My wife has applied for a maternity leave salary but she has not yet received a salary for the maternity leave. she has started working after maternity leave. Due to child responsibility & travel restrictions due to covid, it is becoming difficult for her to continue working. I want to know if she stops going to a job still will she get maternity leave salary which she has already applied for? or do she have to stick to her job till she gets her maternity leave salary from ESIC?

    Mam, my wife lost her job just 1 month before her delivery, due to covid ( transfer given by co. to another city). Unfortunately we lost our baby at the time of delivery.. Do she is eligible for maternity benefit... Plz suggest..!!

      Maternity leave is given only when there is a continuous job.
      But you wrote that your wife had already lost job before one month.

    Mam agar school me 3 years se Job kr rae hai & Probation par hai....To Due Deleivery Date k kitne din pehle apply kr sakte hai Maternity leave k liye aur Exact Deleivery k kitne baad tak chutti milegi.Please Clear this🙏 I am very thankful to you because I am so much confused for this.

      yes, On probation period also one can apply for maternity benefit. It will be 12 weeks' leave to 26 weeks. The pregnant employee can bifurcate the leave as post and pre-delivery. 8 weeks of leave can opt before the delivery and remaining post-childbirth. And it will also depend upon your school policy.

      In order to get maternity leaves, woman employee needs to have minimum 80 working days.
      or you may ask your employer if they allow

      @@learnwithparul yes this test is to recheck our ability for work. I had given the test 2 yrs back too. They are conducting it again if we are eligible for the job or not

      Test is conducted from commissioner orders and she is even intimated about our maternity leaves through the details of employees.

      As you are on maternity leave so your employer has not asked you for the test.
      May be after completion of leave he may ask you for test.

    Creche facility is mandatory for establishment having 30 women employees or 50 employees....but what is the rule for establishment having less than 30 employees??? Can mother keep her child with her at workplace in such organisations???

    Sounds good information. New Rules: What happens if employer or hr community under labour law do not maintain maternity benefit register book
    or do not labour law registers, labour law form, labour law abstracts, cards
    Registers to be maintained under companies act 2013,
    Contract labour law registers,
    Abstracts of labour laws to be displayed,
    Bare act books of Industrial law,
    Muster cards, Esi card 37, Attendance card etc
    Books of accounts to be maintained by society
    under Maharashtra Cooperative Housing Societies Act 1960 Section 79(1)
    Avoid penalty and fines from non compliance to acts and laws
    Get compulsory law stationary in newest format today,

      My EDD will be in December. They are not giving any maternity benefits even we are asking for leave without pay. They even not giving this. I m so worry please give me a reply

    Sir aap lawyer hai ek question hai yadi koi probation me hai banks me usko service ke ek mahine baad miscarriage hota hai wo 5 din ka off leti hai to kya wo loss of pay hoga sir maternity benefit ke tahat cover nhi hoga jisme leaves with wages milati hai

      Any employee whether contractual or on probation, can avail maternity benefit, provided she has worked in the establishment for 80 days in the 12 month preceding the date of delivery.

      The employee (women) must have worked for the establishment for at least 80 days in the last year to be eligible to receive benefits under this Act.

      As per Act in a firm if ten or more persons are employed, or were employed, on any day of the preceding twelve months, then only be eligible for benefit.

      Employee has right to quit the job (if she wants) after availing leaves.
      Employer has no right to do any legal action, unless there is any bond.

      In addition to the break timings given to her, she has a right to receive two breaks in the course of the day that are prescribed for the nursing of her child, for a set period of time until her child reaches the age of 15 [fifteen] months

    Why paternity leaves are very less? Even males also face a pregnancy pressure in family and upbringing of children, he also goes through a lot of pressure.
    Today in a nuclear family culture, males also take equal pain to raise children, in fact sometimes more.
    So why there is inequality for this chapter, if there is policy of equal employments?

      Sir, because you don't carry the baby in your belly and go through labor pain as a man. Or, breastfeed your child during maternity leave. So, paternity leaves are less.
