"Costa Mesa Police Tries To Serve Directives At Chick-Fil-A" First Amendment Audit

  • I was recently in Costa Mesa capturing video and images just outside this local restaurant drive thru from the public sidewalk. I was yelled at by an irate woman in the drive thru, who didn't want me to record her . Sorry, if someone's yelling at me, I'm gonna look in that direction along with my camera. I was also met by two restaurant staff who wanted me to leave, even though I was on the public sidewalk the entire time. Eventually, Costa Mesa Police were dispatched, the Officer was cordial aside from the unnecessary directives he tried to give, so I gave them right back .

    Employees were very unprofessional. I hope the company sees this and knows how badly it was represented by rude and childless employees. Just terrible.

    You captured some amazing stupidity this time, especially the blonde SUV driver who threatened you with THE POLICE...haha. I like that you counter the inevitable employee remark (the one about THEIR cameras being allowed because they are for security) with the perfectly truthful explanation that YOUR camera is for security too. Someone is bound to forward this video to Chick-Fil-A corporate, and I expect corporate will contact this franchise and the franchisee will talk to the street sweeper. So, the consequences are going to be THEIRS, not yours. Officer Trevino was a smart-mouth, but those two guys at the very end were respectful and friendly.

    When cops start giving orders, I think you should just ignore them and turn away from them. Then, when they try to get your attention to confirm if you heard them, pretend that you didn't hear them. "Oh, were you talking to me? I didn't hear that." Repeat as necessary.

      @@RaineRed Please take an objective look at crime in America and the effectiveness of cops at preventing and solving crime. Annually the FBI publishes summaries of this. The average American a bit less than a 2% chance of being a victim of a property crime in a year. About 1 in 50. So, most people are victims of property crime about once or twice in their life. And for about 6 out of 7 of those property crimes, cops never arrest anyone.
      Violent crime is more rare by a factor of about 5. Thus, most Americans are never victims of violent crime. In those crimes, police arrest someone a bit less than half the time.
      The national, average police response time is about 11 minutes. Of course, in rural areas like where I am, it is much longer. The expected response time at my house is 25 to 60 minutes.
      Even when police do arrest someone, nationally about 1.8% of arrests result in a conviction and about 70% of felony arrests are never even prosecuted.
      So, I don't plan to call 911 if I become a victim of a crime. Interacting with the cops will make a bad situation even worse. And it is impossible for the cops to make things better. Even in the extremely remote possibility that the criminal who victimized me is convicted, now he really knows who I am. And it isn't as if he will pay any restitution. Out of all the people who interact with the Criminal Justice System, the victims are treated the worst.

    Two cops for lawful, public photography. My local sheriff's office continually reports the calls for service that they respond to. Consistently, about 95% of the calls are for reports of suspicious persons. Meanwhile, nationally, about 84% of property crimes are never solved. Which illustrates how poorly law enforcement agencies are managed. Their focus is on activities and not on results.
    In this case, two cops were dispatched to a report of lawful activity. Including their transit time, to and from the scene as well as time spent writing some reports, about 1.5 man-hours of police time was wasted. How about if instead, those two cops had parked at two different busy intersections in Costa Mesa. Most drivers would notice the patrol vehicles and would focus on obeying traffic laws. Even if for just a few minutes. Of course that is not something that magically changes the world for the better. But, even that minor effect is more beneficial to the community than dispatching two cops to a report of lawful activity.

    3:40... like most people, I used to work fast food. Never in a million years would it have crossed my mind to go outside and tell people they couldn't take photos or video. I also would not have gone if a manager asked me to, I'd have said no, it isn't safe for me to go out confronting strangers. Beyond that, it is just odd. The poor guy says we don't allow that? Who is he collectively speaking on behalf of? Fast food doesn't have super secure safe secrets of cooking. This is just absurd. Someone someday will get a PhD in psychology by studying audit videos. It's like the Doors song, people are strange.

    Some auditors go to police stations. Some audit courthouses or federal buildings. Some hold cops accountable at traffic stops. You audit a Chick-fil-A. Way to go.

      @@FirstAmendmentRights Thanks for putting content out there. If I sounded upset, it's because there are too many "auditors" out there who film anybody just to get hits. It demeans everything you do to expose corruption within public employees. I'll check out more of your content.

    Funny thing is. People get excited about a person with a cell phone or go pro. But if you had a great big camera with "CBS News" on the side they'd have no problem.

    using "care" as a guise for harassment is not only morally wrong but also legally considered to be slander/defamatory.
    its the same as someone not liking you and calling the police to do a
    "welfare check"

    On a scale of 1 - 10, this video was a solid 9. Auditor was a little rude a couple of times but not bad. He did have people coming out from the restaurant questioning him, customers making demands and cops following up on a illegitimate report and all of that can be a little annoying even though that is why auditors audit. If no one did that, auditors would have to find something else to do and hopefully someday that will come to pass. The customer at the beginning of the audit was the worst person for being both stupid and rude. All she did is attract attention to herself by demanding not to be videoed. That is really counterproductive to her goal of privacy. She may as well pull her shirt up over her head, flash her boobs at someone and then yell at them for looking. The restaurant worker was curious (as most workers are in a private business when their company is being recorded) and came out to see what was up. Had he done so without the little “screws loose” insult, I would find no fault with him at all. If someone was videoing me, I might ask “why” even though I know he has every right to do so. I would make no demands nor would I call the cops but I would see no harm in asking “why me”. I see that as a normal action to take. The cops have to follow up on calls so I see no issue with them coming to the scene and making contact. He was polite even though he felt the need to offer up some unneeded directives at the end. It annoys me a little when they do that but after hundreds, perhaps thousands, of videos I am becoming desensitized to them. They are harmless and I am starting to think that is just how they end a conversation…..kind of like saying “travel safely” or “take it easy” to a friend heading home from your house. Similar to “how are you doing” or “how have you been” when greeting a stranger as you pass on the sidewalk. No one really cares or listens to the response….it is just a greeting. Cops give directives and they can’t help themselves. It is just their way of saying “OK….the conversation is concluded”. That said, there are other times when a cop is totally off the charts a jerk and then they get put in their place by someone who knows their rights. The directives after those encounters are a futile attempt to soothe their butt hurt egos by getting the last “official” word in. In those cases I love it when the auditor calls them on it and makes fun of the dumbass cop for even trying it. Anyway….nice job and good video.

      As soon as they say " Right here" when asked for their name and badge #, its not going to get any better . I have a shirt with "ID" printed on it . When they say " show me your ID " I say " Right here "!
