  • I stopped by the newly opened Chick-Fil-A on the corner of 17th & Tustin Ave. in Santa Ana taking video & photos from the public sidewalk. Shortly after coming around the drive thru side , I was men at the sidewalk by two separate employees from this location, with one of them threatening to call police to have them remove me from taking pictures of the building. Eventually, two units from Santa Ana police were dispatched. Kudos to these officers for not making contact with me,

    Officers get an A+. That is how an "investigation" is done. No contact if unnecessary and by observing. Not asking for ID, threatening, harassing and making you help with your own "investigation".

      It's never made sense. Footage of random public recordings are literally plastered all over RUclips. I can find 50-100 videos from the 90s and 2000s within my first 10 minute search. Neighbors with paid property/taxed to the fullest can't even rely on that kind of privacy. Hence why you will see people randomly making taller fences or see through proof BECAUSE WE CAN'T TRUST PAST our eyesight's. America is acting like individual tyrants on this subject meanwhile letting the government off lightly smh.

    I'm from the UK and I watch auditors here and in the States. The main difference I see between the two is,, in the UK members of the public mostly ignore auditors or give a thumbs up. It's just police and officials that get stroppy. However in the States it's very often the public who cause the issues and get the police involed.

      @@dkayflowers79 no, I haven't seen any of those, but I've watched MANY hours of debates on youtube at local talking circles around the UK and the level of critical thinking, perspective, and consideration compared to sidewalk debates in the US show a pattern of vast ignorance and myopia across the usa. Our thinking is so brick wall, unmoving, irrational ignorance that I dont have disappointment left to give when I watch my countrymen. I'm profoundly ashamed of our people. Adults in their 30s bullying other, more intelligent adults for being more intelligent. It's a sickness.

    I would love to see another video around their busy times noon or during their dinner rush. All three of those restaurants are pretty popular and it would be interesting to see the places fill up and which one is more popular in that area.

      So. Name one media organization that does not use videos with the public in them to make money with. Do you think when they do man-on-the-street news reports that they give a flip about the people walking on the street behind them? Do you say the same thing about dash camera videos that are posted?
      Public photography is not a crime. You do not need a permit to take pictures while in public. You do not need permission to take picture of people that you can see from public property.
      When you are on or in public property or out or in a publicly visible place where all of the bugs and the birds, mice and rats, cats and dogs, babies and toddlers, tweens and teens, women and men can see you and watch everything you are doing and hear you speak and listen to everything you say; you have no expectation of privacy and therefore no right to privacy. Specially if you are a public official or employee conducting your public duty.

      Where is the privacy these days? In most cases, a drive thru customers vehicle, face, voice and license plate are recorded prior to leaving with your order. If you enter a restaurant, you will further be recorded as you eat and interact with the staff or your guest. At no time will you be informed this is taken place, nor will you be asked if you consent. The arguement could be made that the videos taken are for security, safety, theft recovery etc etc and not for personal gain. The funny thing is the same rights which allow the business to film you also allow the public to do the same. If you wish to take away the rights of those you dont agree with, you must also forfeit your own. No, I'm not fond of being filmed, but I also recognize this takes place almost constantly from the time I leave my house until the time I return.

    I understand that the manager or whoever she was didn't know you but it so amused me how certain she was that she was going to school you, a well versed photographer, on photography laws.

    It’s So funny that the employee told you couldn’t record then when those people are recording you on their property pointing their camera phones at you The employee seems to be on their side. Their cameras would’ve picked up the entire transaction and what was talked about. And the person in the backseat of the car is such a hypocrite. Telling you to stop recording while they’re recording you. Some people are just mindlessly working their way through life.

      I never lived in a city with a Chick-fil-a until I moved to Colorado, but I had heard so much about it. I only had it once because my office ordered lunch every week and I was so unimpressed! It just regular ass chicken. I have no idea why people are so crazy about it.

    Well the employees got educated - sidewalk standing is open. You never went inside. They come out to YOU to say "don't record us" - same with those that rolled down their window to take a picture "you can't record me" - hello you are recording ME and you are on their property. Serve the food - buy the food - go about your business folks

    I never trust people who close their eyes when they talk to you it's kind of weird I have I've had a few people I've known in my past that every time they talk to you their eyes have to close and they're difficult to be around because the only true way to see someone's truth is through their eyes it sees in the soul and when you shut your eyes when you're talking to me oh that's that's politician's eyes

      I did security for many years and at one place a senior employee thought she could lecture me about some nonsense and she was also the type to close her eyes when dealing with an "inferior". I'd had a couple of encounters with her previously and was no longer amused. This time as soon as she got in my face and closed her eyes and began her karenrant, I quickly and quietly (for a big man I've cultivated moving stealthily- saved my buns a couple of times on the job & not) around behind her, sat on the security desk and grabbed my lunch and started in on the sandwich. When she finished and opened her eyes to make sure that I was properly chastised she was quite flustered that I wasnt there and then got beet red when she spun around and saw me reading a paperback and with a face full of sandwich. I acted like my attention had been elsewhere (actually not acting..lol) and with a big smile & mumbling around a particularly large bite: "Oh, sorry.... was there anything else?"
      She kind of gargled beginnings of a couple of incoherent phrases and then stormed out. Never had to deal with her again.
      Some days are just better than others. 😁
      I never trusted anyone who wouldn't make eye contact and only about half of those that did. Served me well. 😊

    Another great video by this auditor. Always polite. Always calm. Just exercising his rights and refusing to be intimidated. Cops were great. It is amazing how far cops have come over the last several years in terms of understanding the 1st Amendment and how to address complaints. There is no reason for the cops to even contact the videographer. Just put the complainant’s mind at ease and move on.
    As far as the general public, it might take a long time for them to get it. They have a right to be curious….that is totally normal. If someone was videoing me I would be curious as to why (I would not ask but I would be curious). It is alright for them to do cam backs, flip birds, ask why, get angry, cry or flee the scene. As long as they don’t grab, swing or attack the videographer, they are within their rights as well.

      @MrPiggyPeasus He was on a sidewalk with a camera. He said nothing. He approached no one. Yet the workers inside decided that they wanted to force their preferences upon someone else. Even then, he remained calm, respectful and polite. You say you don’t care if it is legal or not. Apparently you are a cop (or some other sort of bully) who thinks a certain few should rule the world and others should bow down to their desires. The law is important and everyone should follow it. The law is the social contract that civilized society entered into. Without it there is chaos. Keep in mind that videoing from public is rarely about what is being videoed but is a test of our government’s response to it. The cops responded perfectly and this is a great example of that and I commend auditors who show it when police or other government workers and entities behave as they should….like they did here.
      I often criticize those auditors who cuss and swear or belittle police or others. They do more harm than good because their own behavior (while legal) is worse than the people who they are auditing. The auditors like the one in this video are the ones driving the change. 3-5 years ago the cops would have been hassling or even arresting someone doing this exact same thing. Today, most of the time when the cops get called they do what these cops did and that is educate the place of business or government workers who are behaving badly to the fact that people have the right to free speech, or press, or religion, or to engage with government employees and redress THEIR government.
      There are still too many places or circumstances where there is confusion with police. Some agencies and or departments are worse than others. Some are outright corrupt and enjoy bending the rules and exerting power. Others are more innocent abusers who simply don’t understand the law fully but their leadership is letting them down. Consequently, the movement must not end until we get rid of the bad apples in both the agencies and the auditing world.

      @MrPiggyPeasus You make some valid points but seem to skim over the more important ones. There are hundreds, probably thousands, of these kinds of videos on RUclips. This whole thing did not begin because some “auditor” decided to push boundaries of photography. This all started because police overstepped their authority and attempted to turn legal things into arrests which in turn cost innocent civilians enormous amounts of money to defend themselves by the time things got to court…..only to have all charges thrown out because the police either acted without probable cause or used excessive force. The police also routinely approach civilians in anger and intimidation over little things like a minor traffic violation. When taken to extremes, events happen like they did with Floyd which threw the entire country into chaos for months.
      Auditors began videoing cops at police stops and had their rights violated virtually every time and it was far worse than the “ you’re welcome to take all the pictures you want but please take a few steps back” that you hear today. Auditors were beat up and arrested. It was law enforcement that earned the hate. Some civilians set out to hurt or even kill the cops because they were outraged by police behavior. As a good policing supporter, I was outraged by the people shooting cops but I also recognized why it was happening…..especially from those who seem (rightly or wrongly) targeted by police.
      Cops are not hated for arresting criminals. Cops are hated for the way they treat everyday citizens who have either done nothing wrong or did something minor like fail to use their blinker….or take pictures in public.
      The auditors are not the ones wasting police resources. The people who call the cops because they don’t like what someone is doing…..even if it is legal are the ones wasting resources. Cops get called out over all kinds of silly things like “I don’t like the way my neighbor cuts his grass or parks his car”. They get involved in domestic issues where no one has been injured because some mother-in-law hates her daughter’s husband or boyfriend. They get called because a black guy decides to jog through the wrong neighborhood. The list of nuisance calls is endless but the cops HAVE to respond. The only way to curb the nuisance calls is for police to respond and then hold the caller accountable. Unfortunately, their tendency is to take it out on the person who was called on rather than the caller.
      People have the right to carry guns down the street, to stand on the corner and spew obscenities as a form of protest, show provocative pictures like those of aborted babies, support or chastise religious groups, or take pictures. The police are their to protect those rights not to suppress them to make those offended “feel better”. If they need to “feel better” then they need to seek therapy or learn the laws or become more emotionally mature and learn how to walk away so,people can live and let live.
      I prefer auditors who focus on government entities…..or if they choose to focus on businesses at least focus on those who get government contracts etc. I have NO problems with the latter auditors. But I only have a little problem with those who want to audit Chucky Cheese since it is legal and within their rights. I would prefer to see 2nd amendment supporters walk down the street with a pistol strapped on than a rifle. But you see what “I prefer” is irrelevant to the issue because the auditors are following the law. Police need to follow the law too (like they did in this video we are debating) but that is OFTEN not the case. Until the cops behave as they should, this issue will not go away.
      I respect that others may have opinions different than mine. As long as they do not try to force their opinions upon others by restricting their rights, I will repeat my live and let live response. But when fault needs to be determined, an open minded individual will look at “who is behaving in compliance with the law”. Those who are not are the ones who deserve the criticism.

    Do these people ever stop to think for a moment? Do they tell customers to turn off dash cams? Do the store cameras film people not on the property? Do other stores have cameras aimed at their property? Do customers take photos of kids, people, etc eating lunch?
    ETA: If I were in the back seat of any of my cars and didn't want to be filmed, I would simply roll up my window. Your camera would not be able to see through my tint. Then again, had they not cam'd back and waved, he never would have seen them.

    Definitely one of your better, and BRAVER, videos. In particular, this particular chain is operated by bible-thumpers, and a disproportionately large percentage of their customers are as well - and they are notoriously intolerant of trans people. Whenever we trans people get assaulted, it's often by people blinded by religion.
    So.... that shit was BRAVE, sister! :)

    Most people don't realize that if you just ignore the videographer they will go away quicker. Like a fisherman who isn't getting any bites at a certain spot, they'll move on to another establishment where, hopefully, someone will confront them there. Eventually most people will learn this because of all the RUclipsrs doing these videos. At which point these RUclipsrs will need a new gig. Education complete! I have to admit, they are pretty entertaining. I love watching the cops just walk away. LOL
    I wonder what would happen if you went out there every morning for a couple of hours, say, for a month. Would it drive them up a wall, or would you just become "part of the furniture" and they wouldn't even notice you anymore?
