  • I was recently in Santa Ana Ca. recording & taking pictures from the public sidewalk outside a local Raising Cane's Chicken Fingers, after getting some footage of the vehicles in the drive thru, we were met on the sidewalk by two employees claiming we needed consent to record people on their property, after being explained that we don't need to obtain consent while recording on a public sidewalk, they then went back towards the restaurant & proceeded to call Santa Ana Police. Two officers eventually showed up & gave what seemed to be a lengthy explanation to the individuals who called police. Santa Ana police did not make contact with us.     I was at Disneyland once and had to get written permission from 80,000 people who were in the background while filming my kids. It took awhile.

    The fact that most of the general public still believe that you need permission to record them in public is crazy... Whoever it was that originally started this rumor of misinformation... Has done a disservice to society... How can grown adults still believe that this is true... There are cameras everywhere in the world today... How on earth can they still think that they have any kind of privacy in public... It's totally mind boggling to me.

      Well, I knew the end of the USA's incredible public education was neigh in '75 when the illegal Dept of Education was created by congress to dictate to the states what they would teach. I was right. 95% of college grads I tested in 2001 could not pass what used to be 5th grade vocabulary tests nor 8th grade physical science tests. Forget about math above fractions.

      Lol. I think it’s amazing, and it happens alllll the time, when someone approaches an auditor “you CAN’T record people without their permission”. I mean they always say it without doubt like it’s the law and they know the law. Even security guards will make a statement like this.

      They got the idea from "consent forms" for people making commercial films where you have to get permission to broadcast images of people. You don't even need the consent to record them, just to use them in a commercial film. They likely saw it as a part of some old tv show. None of that applies to the general public in public areas, especially for news purposes. No media needs consent forms to show people they interview on the street. Ironically if you had a news van and big camera on your shoulder doing the exact same thing people would be like oh wow the news is here.

      It's only if someone is HOLDING the camera that you need permission. Disguise yourself as a wall and bolt a camera to you, no problem.

    For the love of god, if you don’t want to be recorded, the last thing you should do is stand in front of someone with a camera, who happens to record.
    Just ignore and move on.
    It’s literally the easiest thing to do.

      It's often a litmus test of how stupid and degenerate a society becomes based on how they react to camera. Most non-america/anglo places you go in the world no one cares and just goes about their day and if there is any interaction it's usually neutral or positive.
      I went to a mahjong store while in Hong Kong once and the shop owner just started taking out and arranging various sets of pieces to show me as well as showing how he hand carves them.

    This is exactly how the cops should respond to every call about public photography -- respond to the scene, educate the caller that public photography is perfectly legal, and then leave WITHOUT CONFRONTING PEOPLE WHO AREN'T BREAKING ANY LAWS. All of these other encounters where the cops come up to question and intimidate the auditor are the result of nothing but the cop's EGO and them wanting to enforce their will on others (which is basically the reason they took the job, and it's a blow to their ego when they can't do that).

Afterward, the cops would not be able to escalate situations to the point of violence, arrest, and shooting. What this video showed is an extreme rarity in policing.

Not that it should ever matter (I'm trans myself), but doing 1A audits "while trans" HAS to be tougher on you than on other auditors, as shown by that last couple of idiots in the drive-thru.       @@MrWargw Nothing you've said is wrong, but there are whackos out there in all walks of life who just don't care if others know they're transphobic. And they beat us up and kill us. All other things being equal, a trans person faces a higher risk of being assaulted or killed just walking down the street than others do in their same demographic (ie: race, nationality, religion, age, and so on). It's just one more reason for yahoos to lash out against what they perceive to be as "woke society".
      And it really sucks.

      if they knew, then there would be less arrest in America. Which also means less court dates, and less money that citizens have to pay for violations that are unlawful. They know citizens don't know that they can get a lawyer and fight unlawful arrest, so they push it for money. But, I think auditors are helping ppl understand that. Just wish there were commercials or education on a broader spectrum. Like, how hard would it be for police to send out a letter to all businesses or residents about rights or public photography.

      @Mark Warner you miss the point, the reason raising cane can video is the same reason the auditor can in regards to law. Raising cains doesn't need anyone's permission because the customers have inherently waived their right to privacy by leaving their homes to go out in public and do business at a restaurant that offers public access. The auditor doesn't need permission to record for the same reason. As far as you " feeling" some kind of way is about just that, feeling. What entitled you to feel like you have a right to demand answers from someone out on a street.
      If you don't want to be on ANYONE'S camera, leave the veiw of the camera, what or who ever gave you the sense of control over anyone's actions other than your own.
      You sound just like every other entitled nobody expecting others consider your feeling towards arbitrary actions. Someone with a camera isn't impeding anyone else from conducting their activities, but people upset about a camera are trying to imped the camera man from conducting his activity when they try to stop the camer man

    We need mandatory dispatcher certification. Dispatchers should be mandated to spend 24 hours with an auditor before they get certified to be a dispatcher.

      they should have a set of questions to ask across the whole system nation wide. .
      CALLER-someone is taking pictures and i didnt give them permission, it is making me uncomfortable
      911- Is someone being harmed physically? Are the photographers on private property ? Have they initiated verbal contact with you or others in a threatening manner ?
      if the answers to those simple 3 questions are no then dispatch should de-escalate and inform the caller that they are within their legal rights to take photos in public according to the first amendment of the constitution. . Of course you will get those who lie and be dramatic and of course dispatch is obligated to send an officer in some areas .. but i betcha that those simple questions and the dispatchers reassurance would deter many from insisting someone be sent .

      Well if there's signage telling people that they are under video surveillance then that is called implied consent if you decide to stay after reading that conspicuous sign then yeah you're giving the establishment permission to record you. It's really kind of a stupid argument

      Private businesses have the right to video on their property. There’s a big difference between private property and public property. Business is like target are private property. They can video record all they want. Just the same if you’re on public property you can video record all you want. If I’m standing on a public sidewalk I can video record anything I can see with my eyes.

If Walmart wants to videotape you they can do it all day long. You are going to a post office now that’s public property and they are also videotaping you so why does the post office not make people to ask permission on government taxpayer dollars property?. The same goes for police stations, fire stations, any thing that is public and funded by the government and taxpayers. If I walk into target in an employee tells me I can’t film and I have to leave. Because it’s a private business. If I walk into a post office with a camera I am allowed by federal law I can do it. It says right there on the poster seven.

It takes about 5 seconds of critical thinking to realize that we are being filmed without our consent constantly by dash cams, security cameras, people taking selfies and tourist photos, by street photographers, etc.

      That's one of the things that bugs me the most but the more I think about it the more I think I know why. The police are part of the government, the constitution is there to protect our rights from being violated by the government and some in government hate that. It doesn't make it right, but it seems like a kind of connect the dots thing. That's my take on it.

    I would love to know what the cops said to the employees. It's also interesting that they never made contact with _you._ Normally when they show up to these situations, they contact the alleged "criminal" first before even finding out what the actual _complaint_ is. And, the fact that they handled this correctly by talking to the complainants first and never even talked to you indicates to me that _these_ cops apparently know the laws (at least concerning videoing in public).
    I also love the two people who could have easily solved the "I don't want to be recorded" issue by simply rolling their windows up! Not like you were recording the driver's side where they had to have their windows down to place their orders. Also, whoever was in the back seat of that Nissan didn't mind being filmed, they lowered their window and waved at you!

That is, the employees reported a guy filming people without their consent and the 911 operator said they'd dispatch the police. I'm interested in the conversation between the cops _on scene_ and the employees. Now, assuming the cops were wearing body cams (and they were on), _that_ footage would be revealing...
      Perhaps the OP, as a party to the complaint, could FOIA that footage and post an update.

    This video confirms the idea that when people defend their Constitutional rights other people become enlightened and aware of the First Amendment and what it means. The ignorant employees called the cops because they mistakenly assumed, without basis, that public photography is illegal without the consent of every person in public spaces. The cops, having been informed of the Constitutional rights provided by the Bill of Rights, apparently told the snowflakes that public photography is not a criminal offense and, hopefully, that they need to stop calling 911 because their feelings were hurt. Keep it up! And thank you for defending everyone's right to assemble in public and take pictures or film in public. ❤

    Actually have to point out a good job by the cops in this vid ... explained situation to snowflakes, actually parked in a parking spot instead of blocking traffic, and didn't even come over to give unnecessary directives .....BTW who was with you on this audit?     It really gets me thinking, was it a famous movie, or some famous court hearing, or some famous newscast, that ALL THESE PEOPLE think that someone would need consent to take photos or video of someone in PUBLIC?
    I vaguely remember a time when it was mentioned somewhere, but, it soooo got engrained in millions of dipship peoples heads that it was a REAL THING .
    Where did they get this notion?

    That female employee who is wearing the scarf may be in violation of the employer's dress code, as a scarf that is that long and of a thin material could easily get caught in some equipment, or catch on fire. That could be a horrible accident if it caught on fire and then started her hair, hat, shirt on fire.

    I enjoy what you do and support you by watching and liking your videos often. More people need to learn that photography is not a crime.
    Having said that, I disagree that if you were on their property, you would need someone's consent. Do not forget that Google reviews is a thing.
    ANY publicly accessible area of a private business can be recorded unless there is something like a sign stating that you cannot, in my opinion. If I see one in a place, I'll definitely be asking someone if I need blindfolded. lol
    There is no law that I am aware of that prohibits photography in publicly accessible areas, either private or public property. What they can do is demand you leave the property of a private establishment, all be it would show them in a bad light. You do a great job of that from a sidewalk. At the same time, they could have a lawsuit against them for doing so, possibly.
    Title 2 of the Civil Rights Act (Public Accomodations) 42 U.S.C. §2000. This definitely applies to private businesses.
    I assume this would be difficult to get to pass due to the wording of the title but I'm sure it is completely plausible. You could always say photography is your religion. I am no attorney and this isn't legal advice. This is more of an awareness thing. Please feel free to refute what I am suggesting with something reputable. I would love to know more.

    I like how they explain that there is no law against what they are doing and the knee jerk response is "I will call the police". I wonder how many of these folks actually call 911 for this? That is supposed to be for life threatening emergencies. "A pretty lengthy education". I assume that's because of this persistent belief on the part of many people that you must obtain their permission to photograph them. She probably needed some extra convincing that there is, in fact, no such law. To the contrary, there have been court cases specifically saying that it is permissible in public.

    The police might benefit by using the Internet and TV to disseminate a Public Service Announcement on the subject of public photography. Education on the right to free press is needed in a big way, and running an ad on heavy rotation for a few months would probably reduce the "someone has a camera" nuisance calls to 911.

    The thing that always gets me about fast food places, they are 90% staffed by kids under 25 years old. You know they grew up with cameras recording everything they do. And they have social media pages filled with all kinds of silly and emarrassing photos.
