- Surviving Idaho roommate Bethany Funke is arguing she should not have to testify at Bryan Kohberger’s June preliminary hearing. Marc Klaas had to testify in a courtroom after his 12-year-old daughter Polly was kidnapped and killed in 1993. During an appearance on NewsNation's "Banfiled," Klaas shares his perspective on Funke.

This man is a hero. Can't think of a better way to avenge your child's than to go all-in helping victims.
I’m so sorry to Polly’s father. My condolences 💐 These things should never happen.
God bless you Mr.Klaas. I donated a good car to the Polly Klaas foundation. I remember that well.
This poor man.
That’s so wonderful of you to help out his foundation. Polly’s horrifying story has always stayed with me and I still get emotional thinking about what she went through. At this point the defense believes Bethany may have exculpatory evidence. If she does, it needs to be revealed. As hard as it may be, the two survivors need to be thoroughly questioned.

most of the people in this comment section completely clueless, so I think its you. To make it simple. Bryan Kohberger has subpeoned Bethany to come and testify on his behalf. Do you get it it now? Would you want to testify against your friends?

BF, is ,of course, traumatized by the murders, but as an adult, you have a responsibility not just to yourself, but to others. Not testifying isn't going to help her heal. Testifying can be an empowering experience and be an important first step toward healing.
Agree. I don’t understand why she wouldn’t want to testify. Those are her friends.

@@VeroStarlite she will have to testify at the hearing and there might not be a trial.
@@VeroStarlite The preliminary hearing decides if a Trail is warranted .
@Vero That's not true at all. At a prelim, usually the only person that testifies is the police officer and/or a surviving victim if there is one
@@shannonrusso3853 The case can be dropped at the prelim.
Unfortunately she’s has to testify, it’s sickening, but even the little victims of horrible crimes to themselves, has had to testify against a monster. Everything must be done to put him where he belongs, so he can’t do this again.
She may want to remind herself who the actual victims are.
She's testifying for the defense. Her testimony could get him off cuz it contradicts what the other roommate has said. She gave statements to police too about that night and they are different than what DM said so its his team calling her to testify to throw reasonable doubt in there and possibly find him not guilty
@@gern5168 well, there’s nothing anyone can do about that. She can only tell her truth.
@@noplacelikehomecrochet5335 Yes something can be done, she don't have to do it.
@@annwilliams2958 she's a witness, and if they want to call the police and other roommates, the defense has the right to call Bethany. Trials are meant to be fair. Even if Bryan Kohberger was arrested, right now he's an innocent man. We have to remember that. He's entitled to face his accusers and to put on a reasonable defense. If that means highlighting contradictions, that's his right. The prosecution can try to minimize these discrepancies in their own questioning. That's how this works... I'd bet the farm that the Judge will make her testify. And if they don't... Kohberger will get an appeal someday.
Omg. It’s obvious why she has to testify. They are making drama where there is none. SMH! She has to testify as she was a key witness. Do they just want this guy to walk? It’s unfortunate she has to relive the incident. It’s apart of the pursuit of justice.
I don't think you understand....they want BF to testify on behalf of Bryan Kohlberger. They want her to testify against her roommates. Would you want to do that? Now, this could simply be the defense wanting help painting the house they rented, as a party house where people were coming and going all day and night. Or they want her to say, I heard nothing, I never saw him. That would be the kind of things the defense want from BF. They don't need her to testify.
Actually thats exactly why they are calling her, to help get him off. Shes being called in his defense, not by the prosecution.
I remember when this happened, I was a teenager and lived a few blocks from their house in Petaluma. The whole town was heartbroken. Things like this never happened in our town. He is a brave man! Polly we will never forget you! 🧡
It is important for witnesses and victims to testify, but he raises such an important point, they should be able to prerecord it or have the defendant view it remotely and remove them from the actual room. It would be extremely traumatic for a victim to relive what happened right in front of the perpetrator/s.
It is the right to confront your accuser. Victims have no rights.
I agree. I understand how traumatizing & triggering it can be to face a murderer. With that said, the way our justice system works the testimony is necessary to put this murderer behind bars so no one else gets hurt. I believe a pre recorded testimony or even a zoom call testimony should be an option.
I agree with what all of you are saying but they aren't saying she needs to testify against him. She is being called in his defense. Apparently she gave statements to police about things she saw and heard that night and it contradicts what the other surviving roommate, DM, has said. He isn't confronting his accuser, she isn't giving testimony to help convict him or anything else you guys stated. She's being subpoenad by the Defense, his team, not the prosecution.
@GeRN5 I understand what they are asking of her. I was speaking my opinion in general, but as for this case I still believe what I said. Someone murdered her friends/roommates, she should not have to appear in person regardless of which side. She was there the next morning, she saw the crime scene, that alone will give most people nightmares for life.
@@gern5168 Well…she did identify him as the guy who left the house, didn’t she? I mean, ok, they have different stories. You are right, this is a hearing, not a trial. She can provide testimony without his presence.
And she is being called by the *defense* not because she can help the defense, but because they want to rattle a shaky but important witness. Obviously the prosecution doesn’t want to break her before the trial.
Personally, I think she needs to up her meds, and, in the words of a bad parent, find her story and stick to it. And get used to telling it.
Absolutely, she NEEDS TO take the stand and testify.
For Bryan Kohberger. You realize that right? You want her to testify against her murdered friends.
I would look forward to the day if I was Bethany to face the p erson who killed my roommates and give him piece of my mind!&I would make sure the court knew whatever would help put him away 4ever!
Mr klass is a very kind man. I remember him coming to my elementary school in the early 90s. I just remember giving him the biggest hug. It was probably that moment I told myself I didn’t want children. I couldn’t imagine bringing a life in to this world just to be brutally raped and murdered. This was the same time as Jon benet Ramsey. I’m grew up in a little town called linden. We had two serial killers living in this tiny farming community. It was an eye opening upbringing….the 80s were the last good ol days….
He’s such a genuinely good and kind person. I wish I could give him a hug, too! He has made something wonderful out of his daughter’s horrific tragedy. That takes such an incredible, practically superhuman, amount of inner strength. He has done his daughter proud, and gave her a beautiful legacy. He made sure her memory and legacy was about more than her final moments. He made sure the evil that took her didn’t win. It’s truly incredible to witness a father so filled with love, passion and dedication. God bless him.
And as a 90s kid, I’d include the 90’s as the last good ol’ days as well. I’d give anything to go back to the world and society that existed in my childhood. So much less hatred and division. We seemed to be the last generation that played outside until the street lights turned on to go and eat dinner. So carefree. The neighborhood was our playground. The internet was barely used (partly because of how slow dial up was lol), no social media to influence our every thought and action. I see children today and my heart breaks for them knowing the kind of world they are living in, knowing the kind of childhood they should be having but aren’t/can’t. Nobody really cared what political ideology you had. Being friends with people of differing ideologies and beliefs, and respecting a difference of opinion, was the norm, and rarely discussed. Personal beliefs were not weaponized. Your character and actions towards others was what truly mattered most, no agendas involved. It was just an all around happier, carefree and more joyful world to live in. Sure, evil still existed and there were still problems and struggles in society, but they were minor compared to the world we are currently facing. Then 9/11 was the catalyst of society’s downfall. The rose colored glasses of safety, security and freedom were officially shattered, never to be repaired. Everything seemed to escalate after that point. And now we’re here. A broken world so foreign to how things were 20-30 years ago.
I had alwyas wanted to be a parent, I longed for it. With health will likely never allow it, but even if I was healthy, no matter how much I longed for it, I’d be terrified to bring a child into this world. Threats are around every corner, and it just keeps getting harder and harder to parent and protect your child from being subjected to the evil trying to grab hold of them in every way possible. Predators are no longer just at playgrounds, they now exit in the palm of your hand right at your fingertips. I’d be a nervous wreck. I pray for any parent trying to navigate this world.
YES… the surviving roommate(s) should absolutely have to testify. It’s absurd to think that they shouldn’t have been subpoenaed, especially when of them allegedly saw the suspect. Sure it will be an uncomfortable and intimidating experience, but that’s not a reason to escape their call to the stand.
Polly Klaas situation and this situation are nothing alike.
Um, wait, an intruder breaks into your home in the dead of night and violates your safety, commits a heinous crime and gets away before getting caught. That’s awfully damn similar.
An evil person is out there, unidentified, for a period of time, possibly watching you in case you might help in his apprehension or testify against him at some point. You think these cases are nothing alike? Hell Yes these two cases are similar. Very much so.
Definitely not alike. Not sure why people are saying they are. Also Bethany allegedly was sleeping and was never mentioned until now unlike Dylan. The lawyers must have a good reason to force her to testify as they have access to more evidence than we do. There is a reason and her refusing to testify if she claims to have been sleeping till morning is suspicious
@@pattydonohue5452nothing alike. He wasn't in the home when Polly was killed right above him was he? I'm pretty sure she was kidnapped, and he didn't get called to testify for the defense did he? Nothing against Mr Klaas. , I like to hear his opinions but it's nothing even close to the same case. At all.
@@pattydonohue5452no, these cases are not similar at all except both cases involved a homicide investigation. Polly was only 12 years old, so a minor not an adult like the Idaho victims. Polly was kidnapped out of her mother's home. her parents were divorced so Mr. Klaas didn't even live in the house so his home wasn't violated. Polly was kidnapped from her mother's home and taken to another location. the Idaho victims were killed in their beds (mostly) but all in their own home. Polly was most likely s*xually assaulted because when he body was found her legs were splayed apart and her nightgown was pushed above her waist. there is no evidence that any of the Idaho victims were assaulted like that. Polly was strangled. the Idaho victims were stabbed. Polly's body wasn't found for over a month. the Idaho victims were found right away. lastly, the perp in Polly's case had a long criminal history. the alleged perp in the Idaho case has no criminal history. so I do not see how you can say these cases are "very similar" at all.
It's more similar than anything I've ever gone through

@@TJ-so9xo how so when his location pinged at the house and his dna was at the scene? Because the person on the bottom floor didn’t hear anything? That just leaves room for the prosecution to bring in previous tenants who said they weren’t able to hear upper floor noise from that room.. which brings back the probability that she really didn’t hear anything. Plus, if she was drunk or on another substance that’s a downer she could have very easily slept through it as well.
I honestly think she may know more.. maybe she met him at a party before or maybe she’s the one that he was DMing and maybe she answered a couple times not knowing what would come? They haven’t said the context of the messages and most people probably assume they were directly to a victim and also unanswered but has that actually been confirmed? The victim part.. the rest of the details they won’t let out. Say Bethany DID meet him at a party and they exchanged Insta handles and started communicating lightly… that’s more useful than not hearing anything and leads for more room for doubt.
All of that is a stretch maybe, but for them to subpoena her, and her to fight it, I really feel like it’s gonna be more than she didn’t hear anything or see anything.. And honestly, any of the roommates having a casual conversation or interaction with him could make room for reasonable doubt. “It was a party house and he was a party goer” “he just left late that night” it’s a theory I’ve actually seen getting thrown out since the police footage of the party going on with none of the girls home..
Thank you so much Mr. Klaas for having to relive those terrible moments of your life to speak up for these two surviving young ladies…folks need to just remember that it could be their loved one in a victim position and to please leave them alone…

Polly Klaas case was so so sad😞😔🙏🏼. Especially bc the cops helped the guy pull his car out of the ditch while polly just waited in the shadows THEN once his car was free he ended up taking her life...

She clearly said she was sleeping and so that is exactly what she should just say. If they( her and Dylan) didn't tamper with the bodies or were involved then there is no reason not to testify.
Bethany will testify at the TRIAL not at the Prelinimary Hearing. That's a HUGE difference. The PH is not a mini-trial. Anne Taylor is grasping at straws, the physical evidence against her client is overwhelming and the judge will not strike it during the PH. All of this nonsense about Bethany is being blown out of proportion as the judge isn't going to allow Anne to play her games in the first place. Her roommates were killed, she should want to be there to testify if she can add information to the case especially because the defense is claiming she has exculpatory information.

I’m sorry for everyone involved, but when you are accused of something you have a right to present a defense. If the roommate saw or heard something that could be exculpatory the defense absolutely has a right to subpoena her and make her appear. It’s not abusive or callous. It’s an unfortunate necessity.
Mr Klass is an extremely loving man . I think if I had to go through what he has gone through my life would've been over but instead he has helped so many people. He was truly put on this earth to do good. I hope he can help the survivors in this case. I'm positive they want justice for their friends but if that can be done without having to appear in person then I think it's the best way for their mental and physical health. If they have to give evidence then a written affidavit would surely suffice and if an identification of the person that was seen that night then a photograph would do. In this day and age of technology I don't see why virtual evidence from a witness in these kind of cases could not be admitted with defence lawyers being involved at every stage.
We don't know why She has to testify ....
I think this is the least she cd do. She saw the perpetrator heard her roommates cry and did nothing but go back to sleep. She shd look straight and not even at him and ans questions to help put him away forever. U don’t hv to look at him. U can look past him. Be brave and out that monster away
She needs to testify pre trial because it may exonerate BK. He is presumed innocent til proven guilty.
He continues to be a hero.
We've seen small children in courts testifying against their fathers.... its called justice
I'm confused why would Bethany not want to put this guy away if she could
I am sorry, I dont agree. 4 students was murderd, she was there, nothing more then right to testify.
BK is not found guilty yet, what if he is innocent??
She was present when her roommates were murdered. The fact that these kids aren't anxious to get on the stand, point at the murderer and say that's him, please lock him up forever, is absolutely disturbing.
You don’t understand trauma well. Yes its important that she testifys but if she’s forced victims in the future won’t.
@JC94🪶 this isn't sexual assault. If you are a witness to a murder you will be subpoenad to testify. This isn't a "victims coming forward" concern. I understand trauma very well but also understand having to do the right thing when you were present for your friends being MURDERED.
You guys have it all wrong about why she doesn't want to testify. She doesn't want to cuz its the defense calling her as a witness. They are calling her in HIS DEFENSE. She is being called to help get him off, not help convict him. She gave statements to the police that night too and they differ from DM's statements, therefore his defense is calling her to testify to help his case.
It's scary obviously you never been through anything of the sort. Physically it hurts.
@@gern5168 and she has an opportunity to set the story straight now.
Do we want the alleged murderer brought to justice or not? I sympathize with the girl but this is not about her feelings. She has relevant information related to this case and she needs to be questioned. It’s as simple as that.
She should only have to testify at the trial not the preliminary. This is his lawyers intimidating witnesses. Hopefully the judge will rule against it.
No, it is not. If she has info that could place serious doubt, or exonerate the defendant, she absolutely should have to do it. This is not harassment. Everyone in this country is innocent until proven guilty.
YES she should have to, why wouldn't she want to? She should be there first in line to try to get her friends justice, the families deserve that much, how do you think the parents feel every day
BF has a legal and a moral obligation to tell the TRUTH and the facts about what happened that night. If she has ANY exculpatory evidence she should and must present it, in a pre-pre preliminary hearing or at the preliminary hearing. This is not about Mr. Klass and the tragedy that befell him. This is about a unique information that BF has which may throw more light on what happened that day at 1122 King Road.
Did they reveal who's ID was found?
I feel for him and his family, but not testifying is not the way.
The take is:she either lied at some time and holes have been poked to her story, she was not asleep and she's afraid to commit perjury.
The fact that out of the two she's the one being called to testify speaks volumes and the only thing she can say if she's telling the truth is "I don't know, I was asleep", period.
Yes, there's trauma, yes she's a survivor but not testifying will open the door for him to appeal, if he's found guilty.
If there is contradicting evidence and testimonials she should testify and clarify whatever there is.
Also, by not testifying defense can and will dragged the hell out of her if there is contradicting evidence and testimonials and they will be able to play it in court.. That is even worse.
They will go after the detectives and everyone who talked to her and recorded her declarations to police.
This is bad and we have to stop putting emotions first when it comes to matters of law and order.
It can go south quickly, this is not the Murdaugh case...
And even if he's convicted by the end of this he will have many grounds to appeal. Don't make it easier for him and his lawyers: just testify.
Oh no Sir, we are talking about 4 murdered kids including your own and until whole truth is not known no one has had enough ... specially the roommates
That was a very very horrible horrible mess for everybody Mr KLASS. He show some class and he handled it better than anybody else could have the horrible tragedy
Bless you, Mr. Klaas
The truth needs to be told no matter what it may be
Regardless of her feelings should she have information that will exonerate him like he said he would be exonerated then she has a DUTY to testify and tell what she knows.
If he is innocent he shouldn't be imprisoned anymore.
That's the facts and ALL the families need to heal and LE needs to regroup and get whomever really did this.
Respectfully disagree with him. Like it or not, Brian is still innocent until proven guilty. If her testimony is either in favor of his guilt, or his innocence, she should absolutely be compelled to do as such.
Why did they show a pic of Adams father in the beginning?
Much respect Mr. Klaas. ❤
I’m sorry for Mr Klaas loss, but Bethany should attend the PH.
Really NewsNation!!! If this crime in Moscow had occurred to people of a different skin colour, there would be no qualms about demanding the others in the household to testify!! Many people of Bethany’s age across the country, are asked to serve as jurors for the most heinous crimes and do their services to justice...This pussyfooting and coddling of the pretty blonde girls is outright sickening already!
Love Marc!!!!!❤🙏
Something doesn't smell right. If she was there she should want to go and testify against this monster. I just think she's hiding for some reason we don't know about
With all due respect to Polly's father, Bethany is an adult not a child in need of coddling. Its been 5 months since the murders happened which is enough time to recieve enough trauma counciling to help her prepare to testify when requested.
These folks have no appreciation for the truth or the rule of law. Thank God none of these people are in the justice system.
She would not be testifying for Bryan, she would be testifying to the truth. If she wants justice for her friends, this would be the best way. Unless she knows something that would damage the probable cause against Bryan...so the question is why wouldn't she want to testify?
RIP Polly & Idaho victims.
Her parent can do the same for her, she needs to set things right. She isn't a victim of rape and kidnapping. Ashley didn't you see the stark difference? Huh?
I think she needs to, its probably mostly going to consist of, were you home that night, what time did you get home, did you see or talk to any of the victims, what time did you go to sleep, did you hear any noises. Then its going to be about her getting up, and what happened when they found them, and they might ask her about the parties at the house, had she ever saw Bk at any of them, could he had been at any of them before, did she know him. Did she know if any of the others ever knew him or had him over at any time, etc.....
Accused has the constitutional right to cross examine witnesses against them.
No sympathy for the roommate who “ it will be too stressful - B. S!”Deal with it! How come you went back to sleep? How come you and your fraternity friends took so long to call the cops?
No way you thought your roommates who were viciously murdered - were just asleep.
If I was that man that father I would have tagged him in the courtroom having no care about what any judge says
I'm struggling to understand why anyone would think it's ok to refuse.
Me too. If she’s telling the truth from her perspective nothing bad can happen. She’s a very sketchy witness.
Some domesticated people pretending to be too.,, goody shoes., they are problem with society this days
She isn't refusing. The motion to quash has to do with being improperly served.
She needs to talk. She lived in that house. Every suspect or witness should have to talk. I know she has been through a lot, but this is the law.
i am in NO WAY saying bryan did not do this.... but what happened to innocent till proven guilty.... imagine he didnt do this and gets out- his life would be pretty much over.. AGAIN NOT SAYING HE DIDNT DO IT!
