      You can't sue the police for inaction. See SCOTUS Gonzales vs Castle Rock. Until that is overturned they don't really have to do anything. The average American doesn't know this. BTW, they also say don't take the law into your own hands. I say blast em.

As for this instance, unfortunately, it is a civil matter because all the squatters have to say is the owner gave them permission to stay there before she passed... and there is no way to prove it is true or false.

      @@joemarvelous234 no, the police have no legal duty to protect you. It was a supreme court ruling in the 90's. Now, unequal protection under the law is a different story. And for a squatter to claim adverse possession, they can't be told they have permission to stay. These FACTS are easily looked up.

      @@ab935 Not sure your read what I stated, so I'll state it again, Law enforcement have a duty to act, if they dont they can be sued. That is the oath every law enforcement takes, and if they dont act, they will also lose their state certification... I never said anything about "legal duty".
      This situation IS a Civil Matter, no matter how wrong it is. It's his word vs her word... That's why its civil. Maybe you need to look then up?!

      @@joemarvelous234 AB is right it has gone to the Supreme court and the court stated that the police do NOT have to act, a movie was actually made on incident that brought case to the supreme court, woman was brutally attacked stabbed and beaten, cop prevent anyone from helping her during the attack, she attempted to sue the cop and department case went all the way to the supreme court and it was ruled that cops did NOT have to act cops have zero obligation to help despite oaths that they take and what they paint on side of patrol cars.

      All they did was check the obituaries(has all the information they need to know),then they cased the house for a few days, few weeks.. when they seen no activity! House,all her possessions,her car..free and clear!

      @@troyb.4101 No you guys just havent read the record. The court, by law, is supposed to act as my agent and serve process for me as an inmate. I bent over backwards trying to serve her before I resorted to the inmate server. All of you think she wasnt served, and you maybe right, but one thing I noticed was in the interview with Eric she claims she had no idea about the law suit when she opened her mail. Now look at the date on that, now go look at the other youtube news story where Michelle comments in multiple places when people ask for an update she says "now hes suing us" and notice the date. She lied, she already knew if the suit. The attorney Genreal is much more aware than you guys think

      I just looked through some comments and it appears that what you are referring to is when they first received notice of a default judgment. I understand time stands still for prisoners but try to catch up. You're a small man for continuing to harass this family. I guess when one is a small, unimportant and uneducated felon they can say whatever they want because to turn around and sue for harassment...well, like has been said, can't get blood out of a turnip.

      It is probably because the owner is deceased and all of her property becomes an estate issue, which civil rather than criminal. If the mother becomes executor of her daughter's estate, which requires a lengthy court process, she would then be able to get the car or have it towed away from the folks who took it.

      Auto Theft Definition by LAW is " Cease and Exercise control of Motor vehicle - With out the permission of the owner" -AUTO-THEFT.
      Second : Unfortunately they have to have a Person Actually driving it, to be that person.. so They cant just take a report for Auto theft. For One; NO Victim.. The Owner has Not called to report it. HER MOM should be responsible enough to go pick up her Daughters car instead of just leaving it there now that is Located..Next of KIN.. She's NOT going to get into trouble, IF SO , The Auto theft Detective will Investigate and the Investigation will lead him to whoever may have taken the vehicle and had possession of the keys. POLICE JUST BEING LAZY TO A POINT. !
      MORE MEDIA PRESSURE TO THE CHIEF OF THEM NOT RESPONDING AND WHAT LAWS NEED TO BE CHANGED OR INDUCED TO PREVENT THIS FROM OTHERS.

    The family needs to sue him for destroying her daughter’s house and for the theft of the car and contact her State Representative and attorney general. Something is seriously wrong with the justice system. So when a family members pass away you better get some else to stay in the house until the family decides what to do with the house.

    I heard about something similar to this. The police wanted to pretend it was a civil case, till the family member told them the "squatters" were stealing stuff out of the house right then, and he was going to go confront and shoot them if the police failed to respond (a Texas locale). Suddenly, it was a police matter and officers were there within 15 minutes.

      More than likely the real owner aka the mother now had the power turned off since no one was living there so the alarm wouldn't work. I own several rental homes and from time to time they may sit empty for a while I alway's go around to the neighbors and try to find one or two who will either agree to contact me if they see someone trying to move in without my permission or I will pay them like $25 a month if they do it for me and i've caught squatter's trying to move in everytime I get a call someone is moving into my home I call police and tell them i'm not home right now but my neighbor called me and told me someone is breaking into my home the cops so far have arrested the person or people as common burglars.

    This news should really call on their viewers to bombard that police station with calls and demand they as a community who cares and are concerned for them to immediately investigate this!
    This can happen in there own neighborhood next or worse to themselves. If these criminals learn, which seems to be, that this is a crime they can continue to commit and it'll go unpunished in this town.

I've had three trucks and two motorcycles stolen in my lifetime, two major home invasions where electronics and jewelry were stolen, and I've never had anything recovered. I just had a truck stolen from my in March and the police have given me nothing but trouble about it. I even know who stole that one.

    My heart goes out to the mother and her family, this is clearly criminal, it sounds like the police department there is too, they need to clean house starting with the police and get a new crew that really want to uphold the law, making her go through a civil suit only gave the thieves time to take everything and wreck the house, the truth is the truth and stealing is stealing, they had no lease no claim to the property but were allowed to get away with it, so I guess if I go to a dealership in Co. Springs I can take a car drive away with it and the dealership will have to use their time to take me to civil court, make as much sense. (sarcasm)

    Clearly this is not just a civil matter. Since they were squatters unfortunately that is a civil matter and you would have to evict them which is bs because clearly they broke in and that should have been labeled as breaking and entering but the police failed. Then to top it off the low lives stole all this woman's possessions and destroyed her house that has the last of this poor woman's memories. And they steal her car which would be Grand theft Auto but once again Colorado failed this family and will not help to get her car back or help with an insurance claim that clearly should have been able to get a police report but nope the DPD is a piece of shit department. Remind me never to move to Colorado since they treat their residents like this

    Was there any additional follow up on this story? I would have at least expected a lawsuit brought against the police department for refusing to take a report on a burglary and still currently STOLEN vehicle.

    My family dealt with squatters who knew the system. It's a nightmare. A family of strangers lived in our house for 10 months for nothing AND managed to get restraining orders on my whole family. Lot more details but the point is, it's easy to do with almost zero consequences.

      @Catnip The guy that was caught stealing the stuff admitted and apologized to me and provided written of same to the family. I declined to take further action idk if the family did. Thats all i know on that issue.

    As a 30 year veteran of law enforcement, I never heard burglary and vandalism was acceptable behavior for squatters, The Colorado Police Department has always had questionable practices, as far back as 2002 that I am aware of. This case gives law enforcement a bad name. As a retired LEO, let me apologize for them. Shameful.

    Call the Governor’s office and then sue the police department. Squatters have more rights than the legal home owner? I’ve seen so much of this, laws need to be made to protect ppl. This is insane!

    This is when you grab a shotgun and take care of the squatters.
    Then you call the police and say they broke in and threatened you - you feared for your life.
    You don't tell them you got squatters, you tell them you shot a criminal.

    Insurance claim is easy. Document the case with a 3rd party, summit insurance claim, wait for denial letter, then file a lawsuit against the insurance company. They shouldn't let "company policy" prevent from having justice, albeit civil matter. Again, don't EVER let "company policy" stop you when you know you're in the right.

    He later sued the family using false documentation and won a default judgment of $400,000.oo. If you are willing to break the law, you can do must anything.

    Perhaps some of the squatters were related to the police. Or had some other personal or business relationship with them. That would explain the lack of action, the lies and the stonewalling.

    At 1'40", the real story slipped through ... if the homeowner invited that man to move in and live there, then he's not a squatter, he's a tenant ... removing a tenant is a civil matter and not something the police can do ... it's a shame what happened, and the surviving family should have retained a lawyer right away and they could have saved the estate ... in the USA, we have a precept called "due process of law", everyone is entitled to a fair court hearing ... blame rests with the executor of the dead woman's estate, if there is one ... if not, the police can do nothing until the probate judge says they can ...

    Of course not. The police don’t want it to come out that they didn’t want to do any work, instead insisting that they couldn’t do anything legally. I wonder if it was an officer that this happened to, would they have said they couldn’t do anything?

    The vehicle theft is not a civil matter. I would sue the town not just for that but for Openly attempting to deceive people attempting to get public records.. Cops in that area better watch out for citizen reprisal if that’s how they treat the community.

    I don’t understand why the police couldn’t arrest those squatters for breaking and entering, auto theft, and burglary. If the homeowner was at work and her alarm system or even a neighbor called to say the home was being broken into, would the lazy cops do nothing? I’ve watched plenty of police programs on tv, and I’ve seen them investigate burglaries at vacant properties. I hope the police department gets sued for not doing anything to help this mother. It’s bad enough to have lost her daughter so young, but to lose everything that belonged to her daughter, is adding insult to injury. I’m so angry!!!

    A lot of police departments don't want to deal with personal conflict's. Someone has to die or be caught speeding. They look at squatting as a way to survive for those who don't have a home🏚🤨.

    That is pathetic! That man sjould have been in jail. How many times had they been to the house on calls from neighbors. That beautiful home vandalized like that. The police did not check anything!

    Take the police department to court. Sue for damages both emotional and physical, and lack of response to their legal obligations. Failure to act on information relevant to a case that would see a person criminally charged should be seen as aiding a criminal in this case. Police department, and the system both need a huge revamp.
