      Any moron could see that the dates didn't match on the documents. They were not "fraudulent" as much as they were just "fake" and a single glance would have shown the issues. There is a big difference.

      Suit filed. Plaintiff lies and claims the defendant was served. When the defendant doesn't answer, plaintiff files motion for default. Given no record of an answer, the court grants default without considering the merits of the case. That's how the rules work. It's not special treatment.
      But, the rules also allow the defendant to reopen the case and show there was a defect in the service, and it sounds like that is happening here. The judgment will be (or likely already was) reversed, and the plaintiff will be sanctioned, although that may be a moot point if he has no assets.
      And despite the tone of the news story, it isn't up to the clerk to verify that a process server isn't in jail on the date he claims to have served someone with papers. It isn't up to the clerk to dispute and verify every notary stamp, and make sure people were in the right places for that to be valid. Good job on the reporters for digging into this, and the publicity definitely helped the situation, but there were no failings on the part of the court or it's personnel -- this was all on the scammer/plaintiff.

      Dr. Beau Hightower, although not a subscriber, I have always enjoyed your RUclips channel and I feel the work you do is truly amazing. It saddens me the only time our paths cross in this life is here... I see your comment denotationally takes no position but connoted it does. Please keep a few things in mind when digesting this media broadcast. First, "the dead woman" is Wendy, my common law wife. The "family" I sued was for medical bills along with other damages I have endured awhile trying to find the chance to grieve the loss of Wendy. It will not allow me to post pictures here, but I was trying to include many things Mr. Eric Ross left out of the story. For instance, the restraining order or felony charges against the "family" for all the abuse they have inflicted upon me. The "family" never showed any interest in Wendy until her death because they thought she had a large monetary amount to pass onto them. Mr. Ross saying, "I lived in a dead woman's house," although may not be the most sensitive choice of words could hold some truth, so long as one realizes it was a home, I solely paid the mortgage on in addition to all the other bills because my deceased wife was a stay-at-home mother. Litigating a defamation claim is a difficult task within Colorado as our laws are arranged to allow media to do as they please unlike many others that fetter such. I appreciate your taking the time to leave a comment and I apologize for the bitter taste this has given all of us whether and weight is given to my words or not. I did sue KOAA in the Fourth Judicial District in 2019CV150 Cole v KOAA. It was decided by the Honorable District Judge Kane that my complaint was lacking. I amended it multiple times where I agreed with Kane the complaint was lacking. The final Amended Complaint filed around December of 2020 took me 3 months to draft and around 2k pages of reading. The grammar was nothing to write home about but now looking back with having some formal education in law, it had to be one of the best pro se complaints regarding defamation written in Colorado. KOAA offered to eat the $20k in attorney fees a losing plaintiff normally is liable for so long as I waive my right to appeal. The case skirted multiple lines drawn by the Colorado Supreme Court and I now regret not filing the appeal. After writing this reply to your comment I have it on my mind to request a tardy appeal filing. It is not sought to fetter the media, but the average Joe has no chance at prevailing pro se in a defamation claim here in Colo. if his name is tarnished by a negligent reporter. Along with the family stating I did not know Wendy, they also stated I injected/drugged her so I could rap her while she was incapacitated. The police soon learned those were all false statements. Two years later, almost to the date, a lady (I'll call "A") that I had spoken with a few times prior on social media and such called me and claimed she and her bf had lost their home and was stuck out in the cold, could I please help. I did not realize she was friends of the "family" and I offered them a few nights on my sofa. On Dec 19th, 2019 I was woke by my female roommate (Nikki) in the middle of the night. Nikki stated that A claimed I drugged and rapped her in almost the exact same way the "family" claimed two years prior. I immediately called the Colorado Springs Police department. I was arrested and given a court appointed attorney. I waited in jail for 7 months to get my day in court pleading not guilty the entire time. Months went by and my court appointed attorney stated each month that she had had no luck in locating any of my roommates/witnesses. Without any witnesses it just came down to her word against mine and Mr. Ross was right I did have a prior felony conviction in TX for drugs. The DA offered me to go home the same day if I would just sign this agreement for probation. Seven months at CJC (El Paso County's jail) is a rough situation to say the least, I wasn't guilty but was ready to go home and took the deal. A week later I realized I wasn't honestly allowed freedom that the offering of probation was merely a scam to get me to plea guilty because the DA had no case, and it was the only hope for a conviction. After a week of freedom, I am sitting in jail thinking ok I will be home in 30 days after the first time I go to court because my probation will be reinstated. What gave me that idea was we are in cells with 40 other people and half of those were probation violators. Not 8 out of 10 or 9 out of 10, but 10 out of 10 of those violators that went to their first court date was then on their way home as their probation had been reinstated. Some had caught new charges, some had failed a UA, some never reported, yet each one went home. In the one week on probation, I had attended 3 sex offender therapy group sessions (yes because I was now a sex offender), obtained a replacement ID and SS card, obtained employment, maintained a place to live, never missed a probation meeting where I had already had two or three, never failed a UA, never got in any new trouble, ext. Anyway, I wasn't out five minutes and had located every witness possible but now am on my way to prison. My only hope of removing this false conviction and not having to register as a sex offender is by the grace of the Co. Court of Appeals which is coming up soon. By the mercy of God, I have been blessed with appointed counsel that is effective. The first time I spoke with him, he said, "I've read the case file and it looks as though you did not commit this crime." I was like no shit that’s what I’ve been trying to say this entire time. His name is James West and the first thing he did was file a CRCP Rule 35b which had me immediately released from prison with a completed term. Graced, my prison experience was short lived (few months). Now, if the court of Appeals will allow me to file an appeal in the KOAA case as its late, and the felony conviction is overturned, my life could be worth living as it will never be back to normal. It’s all been one hellish nightmare, but I know Wendy wouldn't want me to give up and I have two boys Peyton and Bryce (perfect babies, perfect kids, and now perfect adults) that would want the same as Wendy and my fiancée Bella Hope DeVere-Cole which may be pregnant (but no one knows that yet) is always amazingly at my side no matter what the press must lie about. I apologize for the ramble I just went on; I didn't intend to explain this much. JCole 11/21

      Did you watch the entire video? The county clerk and the judge were fooled by the paperwork. It wasn’t like he just chose to let the guy win, it was a default judgment because she didn’t show up to the courthouse. It should be cleared up once the paperwork has been filed to nullify the award.

      It’s actually not the judges fault. It’s what’s called a default judgement. It is an automatic process that happens when the other side doesn’t show up. The inmate is a sneaky POS and the clerks office should have caught it before it was approved to be put on the docket. Defaults are automatically entered.

      Why? He followed the LAW. He is NOT an investigator. He is required, by law, to assume the documents before him have been properly vetted by the court clerks. The ONLY way he could have known was if the papers were properly served and the defendants showed up. They did not show up so the LAW says he must find for the plaintiffs. You folks need to get some understanding of how the law works. You are very ignorant.

      I agree but somehow a lot of places have laws that favor the squatters. The best advice I've found since watching a bunch of these squatter videos is: don't call the cops or approach the squatters asking what is going on. Get some buddies, pull up late at night, break into the house, and corral the squatters out. Do not let them use a phone. Then once the house is clear call the cops and report they broke into the house, you woke up to noises and found the door/window broken and these people rifling through your stuff. Claim you have no idea what they're talking about, stick to your break-in story. That's the only way cops will treat them like criminals.

      @M J He was asking questions and getting answers on a subject or story he thought was relevant and/or affected his community. At no point did he say that he found any evidence to convict anyone of anything or that he solved any crime.
      He brought up mistakes that our judicial system made and after investigating, he demanded accountability. I think he did exactly what his job asks him to do and he did an excellent job, especially without spouting any of the right or left wing bull that most stories are spun with.

    What my friends and I did with a house in the neighborhood that had been taken over is that we started watching the house, seeing who goes in and who goes out. We finally found a time when everyone had left. We told the owner what we were doing and..... Myself and two friends moved in, took all of their possessions out of the house, threw them on the sidewalk (large amounts of stolen Amazon packages), and placed our furniture inside. We changed the locks. They called the police on us, but it was a civil case so the police could not do anything. We claimed that we moved in when we found the house 'abandoned'. Not sure how legal that was, but they did not argue it... The additional crazy thing was that Amazon had already replaced the stolen merchandise, so they did not want the packages back and would not file charges. So the owner had a mess on her hands, but she had her rental back..... and the neighbors helped her clean and paint. We stick together, like neighbor's should.

      Problem is anyone can make a lease . What needs to be done is any documents related to renting, selling or otherwise be transfered in person by the owner and the other party at the county clerks office and recorded.

      Those scumbags Jack and Travis don't know it but I have falsified DNR cards and other power of attorney documents for them as well.
      I have full power of attorney over both of these scumbags if they are incapacitated due to cardiac arrest or any other life-threatening medical emergency.
      I have DNR cards and power of attorney orders over several dozen convicted scumbags, squatters and thieves all across the US and that number is rapidly growing.
      And I will admit that I am trained in first aid and CPR and I knowingly refused service to a couple of homeless criminals within the last couple of years.

      Fortunately or unfortunately, he is still entitled to due process, but it's more than just a frivolous lawsuit, there were crimes committed to even get it in front of the judge. This Cole guy doesn't care. What more can they do to him? He's already being locked up for a lengthy period and has all day to go through with other schemes.

Writing, _I shall not file frivolous lawsuits,_ 1000 times and being barred from filing anything civil without going through a licenced attorney is a good start.

      Because they LOOKED. Courts don't look unless someone tells them to in the form of a court filing, which the defendant couldn't make because the defendant was never served with the notice of the lawsuit. It's not the court's job to investigate in a civil suit, it's the plaintiff's job and the defendant's job. Even in a criminal case, it's not the court's job to investigate, that's what police are for.

The squatter who was suing didn't use an actual process server but listed his criminal friend as the server and his friend was in jail when the papers were allegedly served. They never were served. The court screwed up here. Its not the ladies fault.

      But more than that, the legal system should be changed.
      There shouldn't be any default judgments. And lawsuits should be served by the court itself.
      It's a very common tactic to falsify the conditions under witch a lawsuit is served, especially in family court.
      Lawyers know this trick and it's often used to get a default ruling, especially involving child support.
      And it's incredibly hard and expensive to get the default ruling overturned. Victims of this fraud are often forced to pay so much money that they don't have any money left to pay for a lawyer themselves. As all their income is being taken under the threat of imprisonment. This is also how they make men pay child support who are not even the father. And it's done thousands of times every year.

    What we used to do with rental property whether it was a squatter or a tenant that stopped paying rent, we would simply take the door off and take it with us. It was like an $800 ticket, but a lot cheaper than them not paying rent for months and destroying the house/apartment. And they would usually leave quickly.

      Absolutely....as well as the court staff that moved the document through the system and placed it before the judge. There should also be charges against the felon for filing a fraudulent legal document. One of the problems with prison is these felons have nothing but time on their hands and access to law libraries where they can spend days...months...years finding loopholes to exploit.

    The homeowner should sue the city and the court judge I wouldn't pay that jerk a dime. Get your lawyer and file a lawsuit against the city and the court judge to have him remove from office

    It's amazing that if I break into a house steals something and leave I could be charged with breaking and entering. But if I break into a house AND STAY, claiming I own the house, the owner has to prove HE owns the house.

      In most places ALL you have to do is have mail delivered to the address with your name. Once a cop sees that, that is proof of residency as far as they are concerned.

It's been five years, and I've never looked back. I'm a proud Army vet, and I miss certain things like Thanksgiving, certain foods and conveniences, but I've adjusted well in Europe. For me the best times were childhood, then the 80s, college there, and Mom when she was still alive. God Bless you, and the USA. :) PS) What's stopping you, Pam?

      @@22ergie I’m tempted all of the time to leave. I have to get into a better finically situation first, still getting on my feet after college. But it’s just a mess here. Living in SF, we keep having side shows where people are getting hit and killed. No arrests, they just chase them away and leave it at that. But if I go 20mph over on the freeway, they’ll take my ass to jail real quick for “reckless driving”. Doing donuts in the middle of an intersection is not reckless enough for them... The legal system is broken, 99% of car breakins go unpunished. They drive around smashing and grabbing dozens of cars in a single day, no one ever gets arrested. It’s lawless here and it feels like you you are punished here for being a law abiding citizen.

      First, anyone can file anything. Second, litigants can file FALSE proof of service and get a default judgment. This is perpetrating a fraud on the court. This con will not be able to collect; the judgment will be set aside.

      @@onradioactivewaves what this guy he don't know very much inmates get a paperwork notarized in prison on the f****** time you leave the inmate locker since it to the secretary at the front office where inmates are not allowed and the secretary you really got a notary on staff to legalize documents either the prisoners documents for the court and stuff like that or inmates and she turns it over to the lock Court who brings it back to the inmate maybe within 24 hours this guy's stupid as hell there's always a notary on staff the federal court said so long time ago that inmates document must be notarized by notary at the prison

      Actually, squatters do have some rights and the fact that they "squatted" can lead to eventual ownership under certain circumstances, the key factor of which is the lack of a claim by the original owner within a certain amount of time. The legal concept of squatting is well established in the common law. However, no one has the right to smash their way into someone else's home no matter what they do afterwards. That is a crime in itself. That, and the fact that they committed further crimes in the residence, make them burglars, not squatters.

      @Roger Correct, squatters' rights are VERY limited. In my home state, a squatter must be in the home for 10 years before they can claim it as their own. Breaking into the home disqualifies them as a squatter, they are a criminal.

      A judge who only looks at what clerks and other administrative people process and present him. Like any other judge. It's not up to him to investigate on anyone's behalf. He does need to 'clean house' among his clerks and those handling the paperwork though.

      It is not the judges fault. Blame the prosecuter. It is the prosecuters job to present a good argument and to prove that those documents were fake. The judge is handed evidence and arguments from both sides.

      It’s not the judges fault. A default judgement is entered automatically when the other side doesn’t show up. The judge has no say. The inmate is a sneaky POS and the clerk should have caught it before putting it on the docket.

      @@billd.6847 no I’m sure he didn’t, but because he filed, that’s all he needs to do. That’s why that page showing service of the paperwork is so important. You can think of the lawsuit as a hot potato. He ‘threw it’ by filing, and because he filed something showing they caught the potato, they are suppose to respond, or show up to court to respond the day the court case is seen by the judge. Because they didn’t (though that’s not their fault at all because this prisoner is sneaky and found a loophole that shouldn’t have been there due to the court clerk not actually verifying the documentation and telling the judge it was good to go) they were then left holding the hot potato and the song ran out. Same as a ticket you get for your car. If the officer writes a ticket, and you don’t pay it or show up, the judge has to automatically file a default judgement against you because you didn’t fight it and say it was wrong. Again, not these guys fault, but that is the way the court is set up. With how many people sue, these courts are absolutely swamped and this shows why each step of that process is so important. One lazy person can have a massive domino effect. But the judge cannot do it all, and it’s not their job to verify the initial documents. That’s where the clerks office messed up.
