Yup 100% I've been driving tow truck for 12 years and I have done damage to people's vehicles a few times. Company I work for paid out of pocket to avoid a claim but accepted liability for the damage and got the customers car fixed.

Or it could be that the Sheriff's Department has opened an investigation into what happened and the towing company for some reason. At that point the video would be considered evidence, and most departments will not release video while there is an open investigation/case pending.

That's not exactly true. It was still on private property at the gas station. You can see it in public, but it's still on private property. Interesting how they always want to blame law enforcement. i work in auto insurance, its not the insurance companies fault, its agero, they are the worst to deal with.
Should never had gone through her insurance company, now her insurance will go up, tow company has insurance for a reason
Of course, she should have gone through her insurance company. If she is not at fault, then her insurance premiums WILL NOT go up. Her company will pay for the repairs and rental car. Then they will collect from the responsible party.

@kokie382 it is wild how people think their premium wouldn't go up just because it's not their fault. Claims stacked on your record, whether your fault or not, hurt your premium. And most insurance companies go 3 to 5 years back on your history. Try buying a house that has had claims in the last 3 to five years, your premium will be higher because of the previous homeowners' claims.
@kokie382 You're wrong. It all depends on the state insurance laws. You have no fault state laws and some states don't have those laws. In a no fault state law if you're determined to no be at fault, and your history is good. Your premium will not increase.
@mac4782 Not true. Not Fault is personal injury, which means your own insurance pays it. Meaning it raises your premiums.

The Tow Company has to pay for ALL the damage to her truck. If they don't she can sue them for every penny including ALL court and legal costs.

The problem here is she went through her insurance company already... so even if she tried to sue she can't cause yep... HER insurance took care of it. Now that company will have sue the tow company for the money. She should have waited but I'm sure she needed her truck. She probably would have got a pay out for a new truck. Guarantee you other stuff got messed up but she won't know till it's too late now.

Never never file a claim like that with your insurance provider. Tow truck companies have insurance for incidents like this. If they balk at paying, tell them you'll contact a lawyer. That usually lights a fire under them.

Yup 100% if the truck was in the ditch wrecked and got more wrecked coming out of the ditch that is different (wreck ain't over till its on the truck) but if it's a breakdown and got damaged during the tow the towing company is shady for not looking after it right away.

I drove a rollback off and on for nearly 6 years. We carried 500K insurance due to we might have a Ferrai on top, but seriously I think most states have a 200-350K min insurance.
For those that do not know, the vehicle on top of the rollback is "cargo" vs on-hook. And insurance requirement varies if it's cargo or on-hook. A vehicle tow behind a tow-truck is treated more like a trailer.
I it sucks that 2 insurance companies did nothing for this lady.
Switch to AAA for Roadside Assistance!!!!

Called my insurance because of a broken window claim from a vehicle break in. Decided to just fix it myself. Found out later that they started a claim, it raised my insurance premium, and there wasn't shit I could do about it. Couldn't get it removed, changed insurance companies because I was livid about it.... didn't matter. I got hit at the next insurance company because of that claim. I've learned..... kind of like calling the cops. If you don't want to get arrested, don't call the cops. If you don't want a claim on your record that you can't get removed, don't call your insurance.

This is a terrible incident to happen to a person who is putting their vehicle and their safety in the hands of a towing company, I have driven tow trucks for many years in the state of Wisconsin are tow trucks had to have a minimum of a million dollars coverage for any possible damages that may occur while that vehicle is being told by the towing company. So for a property and vehicle damage that resulted from negligence on part of the towing company the towing company is totally and completely responsible for all damages and making sure that property damage and vehicle damaged are covered completely and if there is human injuries involved in this they are also liable for that., it's basically once your vehicle is attached to the towing vehicle everything is their responsibility they are the ones in control and they are the ones that have to take care of properly attaching any vehicle to a tow vehicle for safety. Apparently this is not the way it is with this company I would say this company needs to be investigated and reprimanded or whatever they need to do to this company so that this company follows proper and sufficient safety protocols !!!!!!!!!!!!!

My neighbor got a new vehicle. It's not that uncommon, he was happy his clutch had gone out and then it fell off the roll back and was totaled. They didn't give him a runaround
Soon as you said liberty mutual I was laughing ,theylll say they'll pay for it etc etcetera and then when the repairs are finished, and done they'll leave it on the customer to pay..so drop them immediately and switch to something else. Liberty will do everything to get out of paying and find legal loopholes

She had a choice of what tow company to use, but she was too cheap to call a tow for herself and get reimbursed by her insurance. So she went with one from her roadside service. You get what you pay for. The companies that Agero uses are bottom of the barrel cheap tows. Agero probably paid $30 for that tow.
Insurance towing is basically DoorDash drivers… they look for anyone in your local area that is willing to pick you up and tow yourwhip but it’s completely up to them and you were completely at the mercy of this person who is not a employee of your insurance….
Let's see the inspection sheet before the vehicle was on the tow truck. Any new damage is the responsibility of he towing company.
I was Young and driving my first car. The was 1979. I was driving a 1974 javelin 401 4 speed. Black beauty. It was 12 noon. On a hot August day. A elder man in a 40 ft land yacht pulled in front of me. Zero reaction time. My car was totaled. The elder guy was drunk. The police told me they can charge him with DUI. But told me it's makes him insurance void. And all i could do was sue. So he gave me the choice. They just charged him with the fault of the accident. And i got full recovery for my car. 1200 hundred dollars. Today that car is worth six figures if in top condition.

Don't get them to pay the deductible, they should pay the whole amount so she doesn't have to pay higher premiums for the claim.

Had an instance when a vehicle ran a red light,hitting my Standard Cab Ram in the right front wheel; the Dodge was totaled. The other insurance company tried to low ball me, my insurance company (USAA) had a $10,000 value. So I filed a claim through USAA & received the $10,000, while USAA took the other insurance company to court to recover the money.
This was @ the end of the model year, so I found a 2001 Ram Quad Cab valued @ $28,500 marked down to $22,500. I made a $10,000 down payment & made payments on the remaining $12,000.
I would have a dealer fix the truck and the cops are protesting the tow company by not releasing the video !!!!

IDK, if it was just panel damage, i'd be fine with the repair I guess, but getting dropped like that, I would not feel comfortable driving my family in that thing even after the repairs, who knows what else will creep up later. Technically it's not a new car anymore...

And legally the tow truck company is liable for all damages she can legally sue the tow truck company and her insurance company because the insurance company is liable for the tow truck because their license with them
I was in the process of moving, and despite the rent being paid through the end of the month, my crooked landlord decided to lock me out mid-month illegally, and hired a tow truck to come in and remove my vehicles from my garage while I was in the process of moving into the new home. They also refused to let me in and get my car out of the garage, holding it for ransom if I didn't pay another month's worth of rent. Thankfully, I called the Sheriff's Department who informed them that they cannot do this. The tow truck company they hired to try and remove the vehicle, damaged both the attached garage and my vehicle when they hung the quarter panel up against the side of the garage. It took 4 years and a lawsuit, before they finally came around and paid out the claim, because they knew they were completely in the wrong.
