In court, you cannot opine on the mindset of another, but it is still the duty of the prosecution to establish mens rea. Which is essentially the mindset that the defendant intended the crime. Of course, people rarely admit they wanted to do bad things - but you can establish it through a preponderance of evidence. In the case of Trump, it is overwhelming: he knows he lost.
Because the guys mind was completely melted by Trump. And he had no clue just because he magically decided he’s not a Trump supporter. He was doing whatever he could to magically say anything that went against him could not be known yet anything that made his points work, was always knowable.

Taking a social science class taught me that it's very easy to get lost in the sauce of academic knowledge and end up with a conclusion that no one but a small portion of people agree with.
That just means that whatever evidence that was brought forth to lead to that conclusion wasn't compelling enough, such as using evidence that lacked credible sources or evidence that was circumstantial/hearsay....like when someone uses phrases such as, "I don't think that / I believe that." That really depends on how small the minority group is and who makes up that minority group. If the minority group is very small and primarily made up of people with little to no experience in the field then it's probably a poorly supported viewpoint. However if the group in question is a notable minority made up primarily of experts in the field then it's a different matter all together. For example in economics Neo-Classical theory is the dominant school of thought and method of study. However other methods of study such as behavioural economics, social and institutional theories and game theory based analysis all have value despite being less established and more contentious fields of study pursued by a minority of economists.

It's difficult to argue against an unsupported argument. If Ben had said that democrats are perfectly okay with authoritarianism as evidence by x y and z, then Destiny could disagree and explain why x y and z don't support the claim. You can't attack someone's argument if the only thing you have is the conclusion. This is why the person making a positive claim usually goes first in a debate. I'm in the exact same camp as Destiny. After hearing Ben's claim, I wouldn't agree or disagree unless he gives some evidence to support the claim. I also wouldn't be surprised if he gave some example that I agreed with, but I'd expect to mostly disagree.

I joined on the Israel-Palestine saga, so this is my first time seeing destiny debating conservatives. It's insane to see the levels of double speak they have. These people are claiming they hate Trump and that he's insane, but they're also really invested in proving that he is innocent. Which would also allow him to run for president. It would be interesting to have a stream that isn't happening in debate mode where Destiny could actually question why these people give a shit if they supposedly think Trump and Jan 6 are bad. My theory is that these people are retroactively trying to defend their own credibility as people who went along with Trump's lies up to Jan 6. In court, you cannot opine on the mindset of another, but it is still the duty of the prosecution to establish mens rea. Which is essentially the mindset that the defendant intended the crime. Of course, people rarely admit they wanted to do bad things - but you can establish it through a preponderance of evidence. In the case of Trump, it is overwhelming: he knows he lost.
Because the guys mind was completely melted by Trump. And he had no clue just because he magically decided he’s not a Trump supporter. He was doing whatever he could to magically say anything that went against him could not be known yet anything that made his points work, was always knowable.
The difference is that you have to prove he knew to convict, but you don’t have to prove he didn’t know in order to have a reasonable suspicion and therefore acquit.

I am infuriated by these arguments every time I hear them. They all talk so fippantly about those votes that they wanted rejected. They talk about Trump's right to "fight the government". Those weren't "the government's" votes. They were Arizona's votes. That means it was MY vote, my daughter's vote, my Mom's vote. You get a whole lot less flippant, and start taking it a whole lot more seriously when it is your vote. They know this was a scam. The head of the AZ Republican party held regular streaming meetings where they came up with this scheme well before a single vote was cast. It is all on video....they were planning this for months before the election on video. Yes, a solid portion of my state government was absolutely in on the scheme. Kelly Ward, Andy Biggs, and Paul Gosar were all in the video sessions planning this scheme. They are all corrupt. We fought hard here in AZ to make sure our votes got counted in 2020 (they didn't in 2016 when thousands of us, all Democrats, had our voter registration changed without our knowledge and were unable to vote) and then they tried to put the plan in motion anyway when they got to D.C.

That really depends on how small the minority group is and who makes up that minority group. If the minority group is very small and primarily made up of people with little to no experience in the field then it's probably a poorly supported viewpoint. However if the group in question is a notable minority made up primarily of experts in the field then it's a different matter all together.

Just because Trump has a long history of being a conman, and has gotten very good at it, doesn’t mean that he’s actually intelligent. My heart hurts when I listen to this and is a great example of someone that has been properly programmed. Great example of Pisco trying to restate whatever everyone else says but doing an awful job and condescending when people get mad at him for trying to jerk himself off for being a lawyer. All he does is restate what people say, poorly, and then lawyer trap their language while he's the one not understanding anyone's positions. @@michaelmikita3953 Just a bit of Destiny's biases showing, is all. Ben isn't wrong that Dems are perfectly happy with authoritarian policies if it suits them, but Destiny isn't going to sit down and affirm Ben isn't wrong, so instead, once Ben says something he disagrees with, he goes all in.
It was particularly funny here because Destiny then had to indirectly admit Ben had a point a bit later because Dems are comparing the Don to a certain rejected artist.
Same thing when Ben does a debunking video. Oftentimes he'll just ignore any potentially correct points and hone in on something he disagrees with.

It's difficult to argue against an unsupported argument. If Ben had said that democrats are perfectly okay with authoritarianism as evidence by x y and z, then Destiny could disagree and explain why x y and z don't support the claim. You can't attack someone's argument if the only thing you have is the conclusion. This is why the person making a positive claim usually goes first in a debate.
I'm in the exact same camp as Destiny. After hearing Ben's claim, I wouldn't agree or disagree unless he gives some evidence to support the claim. I also wouldn't be surprised if he gave some example that I agreed with, but I'd expect to mostly disagree.

I joined on the Israel-Palestine saga, so this is my first time seeing destiny debating conservatives. It's insane to see the levels of double speak they have. These people are claiming they hate Trump and that he's insane, but they're also really invested in proving that he is innocent. Which would also allow him to run for president. It would be interesting to have a stream that isn't happening in debate mode where Destiny could actually question why these people give a shit if they supposedly think Trump and Jan 6 are bad. My theory is that these people are retroactively trying to defend their own credibility as people who went along with Trump's lies up to Jan 6. They really want us to believe that there was a reason to believe there was election fraud, because if there wasn't, that means the entire republican party and their base are compromised. It would make them all impossible to trust and they won't get any votes.

My understanding is that the VP didn't have the power to unilaterally send the votes back to the states, even before the 2020 election. They just added more clarity to law, afterwards, because the wording wasn't sufficiently clear about that.
