@@pandoratheclay My understanding is that if the right of an individual is not clearly established then the official who violated said right is immune to litigation. But the way it's used seems to me to be something more like "If the official had no knowledge of a possible rights violation then they are immune". But often it lies somewhere in between. They use case law rather than the constitution also which means "clearly established" doesn't mean "written into the freaking constitution" it means "we've gotten in trouble for this before" because of the case law. That's just part of my understanding at least. It's made even worse by not teaching cops our rights under the constitution. The term should read be called "ignorance immunity" but then they'd be too apparent in their hypocrisy as "ignorance of the law is not an excuse for violating it"..

It wasn't over 4 candles. That was the justification. The cop didn't like that a law abiding citizen was telling him to back off of violating his rights. Too many cops see themselves as some sort of lord in the streets and they often take exception to anyone who challenges their "lordship."
Notice how the female cop asked “why aren’t they lit?” When referring to the candles, the male officer didn’t bother bringing up the reckless burning charges to her cause he knew it was bullshit and would’ve made it clear to her his intentions.
Damn near made me cry, it's such a simple and human response to someone grieving yet it caught me fully off guard. It's sad that officers like her aren't more common.
The summer burn ban must be strict in Washington because they have forested islands that are difficult to access. And the law might stupidly apply to the entire State. Canadian Gulf Islands to the north it's normal for a month of not even electric tools permitted outside. We have to be strict about this - yeah even a jarred candle on asphalt - because we can't have idiots testing their own judgment about what they imagine is safe. Cop was not genuinely concerned about the "reckless burning", as he disregarded offers to extinguish and gave no lecture on the topic.
The scary part to me is that the cop only backed down because the female officer didn't approve of what he was doing. If an equally bad officer showed up it would've gotten even worse.
What about the hostility from the 2nd cop? "Are you causing trouble?" That is a pointed implying statement. As opposed to. "Good evening, I am Officer XYZ. What's the situation here?" No accusation. Allows people to affirm their stance and doesn't make it a zero-sum game... Not to mention that you would think that in a small town, your sergeant would inform you of matters like vigils during roll call/muster... Yes if you are a person capable of empathy and compassion if you see an individual sitting at a park bench in the dark with lit candles you might first suspect that the individual is not mentally well, in this case it was grieving, but other cases might be that the person is depressed or something like that... Definitely should have given the female cop a grade too. She deescalated the situation pretty much immediately, understood the context of why the man was there and was polite to him the entire time. I get the feeling if she hadn't shown up and been a calming presence this would have gone a very different way. She did exactly what she was supposed to do and should get credit for that.
Yes, she seems like someone who has taken the time to get to know some of the people in the neighborhood she patrols. At least enough to know that there was a vigil for someone lost to the community. If she would have been first there, I could see her mourning with the guy instead of harassing him.
Just happened to me yesterday while I was leaving a 7Eleven in Washington state after buying a Coke and Doritos and heading home on foot. My Coke got spilled all over me and my Doritos got crushed. All because I didn't supply my name when harassed to
most times it doesn’t get record by the person being questioned. from my experiences and seeing this happen is they try to record and the cops would quickly escalate the situation and take their phones before they could.
The male officer deserves an F grade. The only reason that the situation didn't get violent is because the female officer de-escalated it. "What does it look like?" offended the male officer, but it is a question he really needed to think about before he did anything. It looks like candles burning after a vigil. It doesn't look like a man trying to burn down buildings.

It's the same in any profession. I've had to deal with rude and abrasive customers in my profession, were I in my own time and someone spoke to me like that I would tell them where to go, but as I'm on the clock and representing my employer, I've had to bite my tongue and be professional. Public servants should be held to an even higher standard than that, especially cops where it's expected that they will recieve verbal abuse during the course of their duty. Grief can really mess with people. The year following my father’s death, I picked fights with people and got pissed about minor shit. It almost cost me my job and all my friends. I made myself see a grief counselor, so I didn’t destroy myself.

The female cop gets an A- She started out aggressive but then dialed it back when she assessed the situation. I also believe her condolences were sincere.

This trend or whatever you want to call it needs to be reversed immediately. If the so-called “good cops” want to be recognized as not one of the “few bad apples” as they like to say, then they need to refuse to allow other cops to act in a tyrannical way and they need to stand up to any and all cops not upholding their oaths of office.

In fact, I think it says a lot that instead of getting a biased story from the other officer she went right to the victim to allow them to explain whats happening and never really backed up the other officers behavior outside of the use of the light.

"I got someone else coming" That's not what he ORDERED YOU TO DO. He specifically said "BRING YOUR SUPERVISOR", a command that YOU, as a police officer, have to comply with.
Actually, no law or right that requires a police officer to bring their supervisor to a scene if requested. Some departments have policy to do so, others do not.

“If you want to talk to me like I’m dumb…” is very telling of the fragility of that police officer. He went into that situation with a chip on his shoulder and it didn’t take a whole lot to make him feel threatened that it was about to be flicked off. He was looking for an excuse to puff out his chest. People like that have no business being police officers.
You notice how the officer's hand keeps dropping? That's a "Reaching for a gun" movement. It was VERY obvious the reason he kept saying "You want to go there??" And constantly trying to escalate, rather than de-escalate, was that he was looking for an EXCUSE to shoot. He called the second officer to use as his excuse as well. "If this other officer backs me up I can kill this person without getting in trouble." It is not inconceivable that, once back at the precinct, this guy got in the face of the fellow officer to scream at her for not "Backing him up"
Love when cops admit to acting differently because they didn't like how they were spoken to. So many of these interactions escalate because cops are trying to control a suspects' speech. I feel like the first thing that should be taught in police academy is that citizens aren't obligated by any law to be polite to cops.

The police department has demonstrated its serious lack of judgement by not firing him. It's not about de-escalation tactics or emotional intelligence, it's about ego; and his level of ego is dangerous. No one with that level of ego should ever be allowed be a police officer.
In a way I don't blame them, if they fired every police officer who acts like this we would have very little police patrolling the streets, no one wants to be a cop these days. They already have a hard time showing up to 911 calls.

The second office demonstrated perfectly why community policing is important. She: 1) Was familiar with the defendant. 2) Knew there was a vigil going on for a woman AND who the woman was. Even if there was a safety issue with those candles that encounter would have opened and closed in a completely different way.
The way the cop responded, I could tell he was on a power trip. Instead of trying to deescalate the tension, he continues to increase it. I wouldn’t be surprised if the cop had previous complaints against him prior to this encounter.

Missed opportunity to grade the female officer, she was very cooperative and familiar with what’s happening in her community I wanted to see her get an A
Also, when the female officer arrived, she immediately said “are you causing trouble?“. Her intention was to back up her fellow officer, assuming she was called there for a reason, and this guy was causing trouble. I could understand why she would assume that, but she had the wisdom to watch and listen and quickly determined that the man was doing nothing wrong and then de-escalated the situation. She definitely deserves an A in my book. I bet she is a kind spirit and a good officer.

Unfortunately, it is because of fear from the majority of people. Many are afraid and ignorantly believe they have to just do what a peace officers says because "IT'S THE LAW!" Due to the fact most are not educated on legal matters, they just go along with the flow of others. And as a result of this, peace officers feel that it can be justified because so many have simply complied for so long. This forms the "ILLUSION OF TRUTH!" I was once informed by an attorney I had on retainer that, "police DO NOT know the law! They ARE NOT LAWYERS!" This is why most of these cases get dismissed or overturned. Officers, in most cases, have very limited knowledge of the actual law. Thus it is wise on the part of the citizen to know their own rights, and not simply trust that the police have your best interest at heart. @@pandoratheclay My understanding is that if the right of an individual is not clearly established then the official who violated said right is immune to litigation. But the way it's used seems to me to be something more like "If the official had no knowledge of a possible rights violation then they are immune". But often it lies somewhere in between. They use case law rather than the constitution also which means "clearly established" doesn't mean "written into the freaking constitution" it means "we've gotten in trouble for this before" because of the case law.
That's just part of my understanding at least. It's made even worse by not teaching cops our rights under the constitution.
The term should read be called "ignorance immunity" but then they'd be too apparent in their hypocrisy as "ignorance of the law is not an excuse for violating it"..

The summer burn ban must be strict in Washington because they have forested islands that are difficult to access. And the law might stupidly apply to the entire State. Canadian Gulf Islands to the north it's normal for a month of not even electric tools permitted outside. We have to be strict about this - yeah even a jarred candle on asphalt - because we can't have idiots testing their own judgment about what they imagine is safe.

Yes if you are a person capable of empathy and compassion if you see an individual sitting at a park bench in the dark with lit candles you might first suspect that the individual is not mentally well, in this case it was grieving, but other cases might be that the person is depressed or something like that... The officer here should have been concerned about the individuals mental health, not about whether he has committed a "crime" by lighting candles wtf? A cops job is not only to arrest people for crimes, sometimes their job is also about looking out for their fellow human beings if they see a person who might be suicidal for example, to step in and help in those scenarios. most times it doesn’t get record by the person being questioned. from my experiences and seeing this happen is they try to record and the cops would quickly escalate the situation and take their phones before they could.

I've had to deal with rude and abrasive customers in my profession, were I in my own time and someone spoke to me like that I would tell them where to go, but as I'm on the clock and representing my employer, I've had to bite my tongue and be professional. Public servants should be held to an even higher standard than that, especially cops where it's expected that they will recieve verbal abuse during the course of their duty. You notice how the officer's hand keeps dropping? That's a "Reaching for a gun" movement. It was VERY obvious the reason he kept saying "You want to go there??" And constantly trying to escalate, rather than de-escalate, was that he was looking for an EXCUSE to shoot.
He called the second officer to use as his excuse as well. "If this other officer backs me up I can kill this person without getting in trouble."

IDK being forced to give a presentation to the people you work with is pretty embarrassing. He may not feel he did anything wrong but he will still think twice before doing it again.
This is what you get when you can become a Police Officer with 15 weeks of training. Sometimes less. In real civilized nations it takes AT LEAST three YEARS to become a police officer.

Not making excuses for the officer, because what he did was uncalled for 100%, but I can confirm first hand that this town is boring af, and there's actually nothing to do. I used to live in Longview, granted it was when I was a teenager, but there was nothing to really do aside from going to the Y during the day and the times they had dances, and then going to free metal concerts.
It is just astonishing how these officers are willing to escalate a situation within seconds of an interaction.

The police department has demonstrated its serious lack of judgement by not firing him.
It's not about de-escalation tactics or emotional intelligence, it's about ego; and his level of ego is dangerous. No one with that level of ego should ever be allowed be a police officer.

I love how citizens are expected to know every law and statute, and ignorance to those is never a defense for breaking them. Yet when it comes to police and politicians they are always let off because, "they didn't intend to break the law or violate rights."
Makes perfect sense to me. The people who need to know all the rules as the core element of their job are granted qualified immunity when they break those rules, and everyone else isn't. This reminds me of the video of the guy breaking down after finding out he was being cheated on and the cop was trying to give him a sobriety test (sober) and the second cop immediately recognized what was going on and had compassion. If you’ve lost your humanity you shouldn’t continue to be a cop.
The profession attracts psychos. The people that have empathy and compassion don't last that long from what I have seen.

I know a topic. In California in 2011 it took me 1600 hours to become a licensed cosmetologist, now 1000 hours. In CA it takes a minimum of 664 hours to put a deadly weapon in a narcissists hand and call them police officers.

The second office demonstrated perfectly why community policing is important.
She: 1) Was familiar with the defendant. 2) Knew there was a vigil going on for a woman AND who the woman was.
Even if there was a safety issue with those candles that encounter would have opened and closed in a completely different way.
The way the cop responded, I could tell he was on a power trip. Instead of trying to deescalate the tension, he continues to increase it. I wouldn’t be surprised if the cop had previous complaints against him prior to this encounter.

Also, when the female officer arrived, she immediately said “are you causing trouble?“. Her intention was to back up her fellow officer, assuming she was called there for a reason, and this guy was causing trouble. I could understand why she would assume that, but she had the wisdom to watch and listen and quickly determined that the man was doing nothing wrong and then de-escalated the situation. She definitely deserves an A in my book. I bet she is a kind spirit and a good officer.

Unfortunately, it is because of fear from the majority of people. Many are afraid and ignorantly believe they have to just do what a peace officers says because "IT'S THE LAW!"
Due to the fact most are not educated on legal matters, they just go along with the flow of others. And as a result of this, peace officers feel that it can be justified because so many have simply complied for so long. This forms the "ILLUSION OF TRUTH!"
I was once informed by an attorney I had on retainer that, "police DO NOT know the law! They ARE NOT LAWYERS!" This is why most of these cases get dismissed or overturned. Officers, in most cases, have very limited knowledge of the actual law. Thus it is wise on the part of the citizen to know their own rights, and not simply trust that the police have your best interest at heart. They are seeking to gain as many arrest and write as many tickets as they can, that is how they get paid!
Happens when people treat them like they're above everyone and holier than thou. It was a mistake for people to start treating them special.

1) there are two surrounding streetlights on either side of the bench. Plenty of light.
2) the supervisor kept her vehicle headlights on when she started to walk back to the vehicle. She just didn't need to turn on her brights and police lights to blind someone
3) did the lights help in any way deescalate the situation kr garner any further information about the criminal activities? Excessive brights would somehow prevent, motivate, prescript or prescribe against the alleged crime...reckless burning?
4) the pig doesn't have flashlights like they use in any traffic stop?
This pig used every Escalation means in the book and failed to serve and protect our citizens. He saw a black man on a bench and chose to escalate. He didn't even ask the gentleman if he was okay. Pig immediately jumped to conclusions and I'm shocked he didn't pull out a weapon.

The scary part is that had a different Police Officer arrived at the scene that had the same attitude as the Male Police Officer, things could have turned very nasty for the innocent young man.

Notice how the male officer's demeanor changed when back-up arrived. He immediately became less confrontational as if he knew what he was doing was wrong. He went from "Do you feel tough?" to "I'm not issuing a ticket." very quickly.
I think it was because it was obvious the 2nd officer was informed. If the 2nd officer was ignorant to the vigil he would have stayed hostile but the second officer said enough to make him realize he had f*Ed up.

Its not well known outside of Law enforcement circles. Alot of the non academy payed LEO training classes that are sold to police officers looking to be better at the job, just teaches them to approach every encounter with the public. The problem with this untrained officer is that instead of deescalating the situation and showing more compassion towards this man's situation, he failed completely as an officer! This is why people hate cops these days for a situation just like this one!
