I really like how this video is another example of law enforcement breaking the law. The EPA's Military Munitions Rule puts the responsibility of ordnance from cradle to grave in the hands of the military. Graduates of the FBI's Hazardous Device School aren't authorized or qualified to identify or render safe, military ordnance...

A Pasco County Detective left his handgun behind in a Burger King, and it was picked up by a homeless man. I think I know who has it, but I decided taking this game wardens' advice is in my best interest. I'm probably better off just avoiding all of it.
They turned off social media comments and you have to report all tips or complaints in person. You can still commend an officer on the website though. There is no way I'm walking in their department without a lawyer.
He's the kind of guy that if he had a flat tire on the side of the road and you stopped to help him out, he'd write you a ticket after because he noticed your vehicle inspection sticker expired last week.

It is impossible to know the laws. There are more laws than you could even read, much less understand, in an entire lifetime.

Personally I'd like one of the standards to be evidence the citizen knew what they were doing was illegal before arrest or criminal charges allowed in most cases. As in you can't punish someone for breaking a rule they can't reasonably have known about.
@@alastermyst Criminal intent is an element of the crime. If they go to court, the judge can take that into account and reduce (or waive) their fines.
@@alastermyst The legal standard you're talking about is called mens rea, and it does exist in some cases, that the prosecution must prove that the defendant knowingly intended to take an action that is a criminal offense. However, and IANAL, for some reason it doesn't always apply.
@@furtim1 one of my law professors in college said there were over 50,000 laws, statutes and regulations on the books. that number is a little over a decade old. one of the largest problems with trying to memorize the statutes is legislatures can amend them in any bill they pass, so laws as they are written today are not guaranteed to be permanently written that way.

Exactly! And these police are able to use discretion and never do! Only for their friends and family! So corrupt and infuriates a lot of Americans! Myself included! I can't stand people who blindly praise police simply because if they didn't , the police would have no backing and no choice but to enforce the law appropriately and hiring officers who were not fit would seldom happen. I can't wait to leave the US because it's a fraud in almost everyway imaginable. I'm on my wife's yt account now and we hope to move to Spain but would also like to come back and possibly work and live while visiting family. I'm pointing out that I am on her account simply because I wouldn't put it past our government to hold this comment against her being able to become a citizen. They have already denied our claim because I'm too poor and my father apparently is too to become her sponsor... We married for love march 18 last year and now she can't go see her family. It's discrimination and I'm extremely fed up with seeing good people pay the price for bad people and immoral laws. I could be getting disability from debilitating anxiety, phobias, depression, but I still try to work because I was raised that way. But now I'm being punished. They also threw me in prison with no criminal record on hearsay and for basically being born in a poor disabled family... I pray daily for change and for strength from God because when you are truly trying your best and meet roadblock after roadblock, it's demoralizing and i believe that's what their game is. For anyone else struggling out there, stay strong, find God/or not, but never give up! You are worth it and you are loved!! don't know you personally, but I pray for everyone daily! ❤️

That warden was SO happy to be giving them tickets and giving them the lecture, you could hear it in his voice. Also, why is the river being used as disposal for these kinds of items? that water travels off base property and its really concerning this is how they dispose of this kind of stuff.

When I was a teenager I got pulled over and cited for doing 42 in a 35 zone even though I was only moments prior stopped at a traffic light and the car to my left arrived at the intersection as the light turned green. That vehicle was speeding. When I pointed it out the officer became aggressive and asked me if I wanted him to inspect my car for other issues. I took the ticket.
Days later, while at work in our local movie theater, the cop we all knew (he provided mall security) brought in his fellow cop in to ensure we gave him our police officer discount for his upcoming date. We had a policy of free movie admission and refreshments for cops because of the security they provided. I promised our familiar officer I would not forget him because, as you have guessed, he was the cop who wrote me the ticket a few days prior.
When he showed up with his date, I deftly asked the ticket seller to let me handle it. The cop shows me his badge and said he gets a free ticket. I told him, that would be inappropriate and charged him full price. He begrudgingly paid for his ticket and moved to concessions where I followed and “took care of him” again. He got so frustrated and eventually said, “Young man, don’t you remember me from the other night with Officer XX?” I leaned over the counter and said, “Sir, don’t you remember me from the 42 in a 35 ticket in front of the mall?” He slammed the money on the counter and stormed off.
Few days later, our usual officer showed up and ask me why I didn’t take care of his comrade. I told him why. He shook his head, said something disparaging about the other officer and tried to get the ticket thrown out on my behalf. Hope that story brightens your day, it was nearly 40 years ago.

As a state trooper, this a*hole of a warden makes my blood boil. I can’t stand when officers go on power trips. We have discretion for this very reason.
“Hey guys I appreciate you trying to clean the river, it’s a bit dangerous to do that considering the items you’re pulling out of the river. I’ll make sure to let the Army command know they need to get this cleaned up. Have a nice day gents.”

@@encarn Soldiers coming out of the field for the weekend dont want to waste an hour on ammo turn in and waiting on the ammo count that needs to be done for the unit that is turning in. Soldiers when they go out to the field have ammo disseminated from the Designated ammo person in the unit. He is the one responsible for signatures and dispensing of ammo. Whatever ammo is not used, needs to be turned in. Thats when soldiers be like "oh shit, get rid of it" and gets tossed. I was stationed there for 6 years and I seen all kinds of ammo being tossed. I report it and they look at me like im stupid. Then you wonder why the army retention is at an all- time low now. I am glad I am retired. I couldn't put up with the bullshit ANY military installation puts out.
@@hristiyandelisyarov6487 Reserve/Guard go through another area of the installation. Misfires are tossed in a dud pit, not in a river. They just dont want to turn in the ammo at the AHA when it comes time to come back in. its complacency at its finest.
I am a retired LEO and agree with you 100%. Back in the day I was guilty of buying the down and out a sandwich and coffee once in a while and even taking them home. I must have missed the lessons on bullying people. A ticket or an arrest isn't always the best solution.

When I was in college in New Brunswick New Jersey, my apartment was burglarized and I called cops. They searched my apartment for drugs. Threw mattresses off of beds, dumped contents of all drawers on the floor. They were never called for subsequent break-ins.
Never ever ever call cops for something like that in particular. Never give them permission to search your apartment. It's not going to help with the investigation that they're not going to do anyway, because the vast majority of thefts are never solved or even looked into.

Judge Threw out the case and dismissed the citations - DNR Officer was in the wrong and the case was tossed citing - Illegal Citations by way of Out Of Jurisdiction

The lesson I took from this: don't ever contact authorities for any reason, no matter how good your intentions are, because it's pretty much guaranteed to end badly.

This is a fact. The only time calling for the police should even be considered is if YOU are WILLING to allow everyone involved in the situation be murdered, arrested, or fined. Innocent or not those are the only 3 outcomes.

The game warden completely changed the dynamic of the situation. He knew before he even pulled up that he was about to ruin these guys day, he didn't evaluate anything on the ground before coming to a conclusion on what to do. Re-training is needed I think.

This guy literally thought "why are these guys finding stuff on my river without asking me permission. And unlike the other cops who had zero attitude initially, they came up, talked to them first, before making any judgements. The warden made his mind up he was going to give them a citation no matter what as soon as he got the call.
Those guys are the type that give cops a bad name. They just love ruining people's day, and exerting their power.

The Game Warden arrived on the scene with hostility. Every officer who showed up prior was cool, he came in hot for no reason, only had a fraction of the info and already had his mind made up before he even got there.
A trend I noticed in these videos is it's usually the chubby officers that are the most irritable.

Weird military bases you have over there, here in Sweden we have fences and signs around them. Figured the military budget could maybe cover that.
He could have been a little less hostile yes but it did not carry through the whole interaction. Given the situation he acted accordingly imo. I think his approached showed that what they were doing wasn't just something as simple as cleaning up although that's what they intended to do.
As a vet and DoD civilian of over 30 years, never call law enforcement unless absolutely necessary. Even if you are trying to help, sh*t will be turned around on you somehow.

Just don't call them -- 99% of the time, they'll either make the situation worst or you'll end up in the situation that you weren't originally a part of. I've never found resolution or even partial resolution to a problem by inviting the help of the police. They're a gang of thugs sanctioned by the city / county / state.
You would probably have better results asking your local gang member for help than a cop. That's how backwards it is. I've had better interactions with thugs than I have cops.
Don't call cops. Don't talk to cops. Avoid cops. Cops will only cause you more problems. Cops are statistically dumber than you. Cops are evil. Cops will end up shooting your pet dog or your neighbor's dog. Don't purposely call them. Never invite them into your home. Avoid them at all costs.

Working in the LE field: I concur. Do not call police unless absolutely necessary or last resort or to file a report when required by law.
Happened to me in the UK too. The police will just look for a reason to write anyone a citation, no matter where you are or what you're doing; they don't serve the people, they serve themselves.

I agree. Equating it to bank robbery and then calling the police was really stupid because everyone knows it's illegal to rob a bank while it's probably certain that 99% of people wouldn't have thought magnificent over that bridge would have been illegal especially after they called and asked about permission.
And finding the 10 lb of weed was just as dumb or dumber than the bank robbing scenario. In his eyes there is nothing a citizen can do that would be considered being a good citizen when you call the police to report something.
In my 50 years I have never met a game warden that wasn't a prick.

I’ve met some federal game wardens that were super cool. Let a buddy of mine pick up some litter around the parking lot and buy a license online real quick instead of issuing a ticket.
I've met lots of wardens that were good guys. Of course, when I've talked to them, I've always had my licensing and I wasn't breaking any rules, so maybe that's the difference? I dunno. I guess it could also be a matter of location? Most of my interactions have been in the South East US so, good ol' boy syndrome?
MN DNR are relatively chill but the boat launch inspection officers are all pricks
@@watchyourtimeco1 Game wardens have an _immense_ amount of power compared to any police officer or any individual federal agent. I can't remember exactly why this is, but there's something fundamental about the job that makes this the case.
....and so I guess when it does corrupt someone, they go hard enough that the general public actually notices.
Imagine finding a weird bag of rockets, and then the military is like we gonna right you tickets instead of thanks guys we are going to take this investigation from here. The first military guy seemed more interested in learning about the bag and why it was there than the last guy who was only thinking about writing tickets.

Something that always sticks in my head everytime I get a ticket or a law enforcement official is just dead set on giving me a ticket, is the thought that city's, counties, states and the federal government are not in the business of making money, but the business of collecting money. Hence why the DNR officer will always write a ticket, when he is called out.
A classic case of how anything can be made illegal purely depending on who arrives and picks a violation out of a hat from overregulation. There was nothing wrong in this case and helping to discover dangerous materials should be encouraged. Instead of attempting to prosecute.
This seems like one of those things that could have been handled with “thank you guys for cleaning up the river and having good intentions and calling us, but please don’t do it again”

This is exactly why the general public reacts negatively to law enforcement. A simple warning could have sufficed but he was on his high horse and would not see it any other way. The next time they or anyone else will find something dangerous who has seen this video will think twice about contacting law enforcement
Didnt even really need a warning. Every police department that actually had business being there all commended the guys and thanked them and said they did the right thing. Why the hell Game Warden even showed up to begin with is beyond me

And while I do not agree with the tickets, I do agree that it is dangerous to pull shit up that you don't know.
Its just overall easier but at the same time its unknown how those things got there.
But that's when the police come in to give judgement. Laws are a moral stand point of safety and fairness. Designed to punish poor negligence and those who do not abide.
And its up to the officers when situations like these should be taken as informational warning that achieve the same goal. The purpose of fines and jail is that the punishment serves as a method to make people abide them.
So if giving an informational warning achieves that same affect judging on intention and character and situation. What point does the fine give besides unnecessary back lash.
And eventually there is going to be that guy to do it if you morally find it just because it's illegal. And the guy who might enforce those laws much more strictly will probably just eventually find them and enforce then. But a warning. All it takes. To save them the trouble even if it is morally right.
Also if someonne was misinformed, or there is no clear sign of unwanted activity that should always be a warning. School doesn't teach us laws, and we are only human. Even if someone did misinform them perhaps it was through misunderstanding rather than their own lack of knowledge

Situations like this frustrate me. Why not just give them a warning? Seems cops always ticket and fine you if possible. I have had three speeding tickets. I have never been given a warning. Besides those three tickets I have a spotless record. One of them I even got a diversion on when I went to court. But I know, if I get pulled over, I will be ticketed. Feels like they just want my money, not to serve and protect.
I mean not speeding is also an option

In many areas, if not everywhere, police have a quota of tickets they must write every month to bring in revenue. That's why they rarely, if ever, give warnings.

Honestly, that line rt there explains why he's so hostile. He's pissed off bc he had to get off his lazy ass & do some work, while on the clock. He said if he had to "come out here" he was writing a ticket no matter what (as if going outside is expecting too much out of a DNR/Forest Services Agent). Even if its the mayor or governor. Which we all know is a blatant lie.
He's gotten soo lazy that if someone found a 10 lb brick of weed or coke, & tried doing the (so-called) "right" thing & reporting it. Because it's in his job description. All recreational activities fall to the game wardens on military installations. If you are driving through publicly accessible roads on a military installation and you pull over to the side, they can ticket you.
I agree that these guys should have been given warnings. They made a good faith effort to follow a complicated and confusing set of laws, and they called the authorities to make sure that the stuff they found was disposed of properly. All around, they did behave responsibly.

Even though this is just a ticket, the video shows that the officers even acknowledge there was zero criminal intent behind their actions. Everything they did was with good intentions. They were attempting to cleanup the environment. They contacted who they thought were proper authorities for permission. They avoided areas marked “No Fishing”. THEY called law enforcement to the scene when they located what they believed to be hazardous items. The Game Warden was the only LEO there who was “out in left field” with his reactions. Hopefully, the Judge will see the totality of the circumstances (and this video) and rule in favor of these young men.
The Game Warden is just less than he always wanted to be. Badge heavy and out to impress his authority on anyone and everyone.

Here's a couple of lessons from this: Don't expect praise from law enforcement for being a good citizen, they don't care. Find a gun or ammo or explosives that aren't in a public, populated area? Shut up and keep them or shut up and leave them alone. Don't call the cops. The first thing they're gonna do is be suspicious of you.

Just a little update on this case. All three gentlemen had all three of their tickets each dismissed.
After 32 years on the job I am glad to be retired! I get so frustrated to see this. These guys were not harming ANYTHING, they went to an area that appeared to be okay to do what they intended and that was to clean metal debris from the river. They found military ammunition and immediately called authorities. Prior to doing any of this they even called a government agency to see if it was okay. They were told it was okay. How in the heck are they know any jurisdictional authorities with the way things are in this country? Even a single agency cant agree half the time on it’s own rules or laws are. These guys got punished for doing the right thing! The MP’s should have pulled that fish cop aside and explained to him it was time for him to leave. Inform that fish cop that these guys actually did something good!!! This crap leaves a bad taste in everyone’s mouth.

As a soldier in the army while stationed at Fort Polk Louisiana, I was told by my sargeant to throw out unused ammunition cannisters in the bayou prior to returning from field exercises. The army supply officers would not issue the same allocation for the next training exercises if our initial ammunition cannisters we're not "empty". Government and efficiency should never be used in the same sentence as the sheer amount of wasted ammunition tossed over bridges on military bases is staggering.

This is another reinforcement of a massively growing public sentiment of "don't call law enforcement" when morality is in a situation, which is a huge issue in this country. Warden said it himself, "Should have dropped it and left". He was really saying, "Thank you for incriminating yourselves, here's your fines dumbass", despite it being a public health concern.
You are literally NOT supposed to call 911 for ANY reason unless it’s ambulance or fire. The police are not trained for handling any circumstances that isn’t murdering people. The correct course of action for these guys would have been to do their fishing then just leave all the bombs on the side of the road. Calling 911 for this is just begging to be arrested, shot, or fined. Thankfully these guys were white so they were only fined. Never ever call 911 for police unless you are willing to have everyone involved either die, be arrested, or fined. There is never a positive outcome when police is involved.

There are non-emergency numbers for most departments that I would've expected to be more appropriate to use for when immediate help isn't needed. Unfortunately in this particular instance they presumably used those first by calling the bomb squad, who then directed them to 911.

I had a bad interaction with the DNR a few years ago. Driving my well marked company ComputerTech van to a customer's home, on a dark unlit road. Passed a DNR truck (didn't know it was a DNR Vehicle at the time - covered in mud and night time) heading the opposite direction. I saw the truck quickly do a U-turn and chased me down with a tiny little red light blinking inside their vehicle. Since I was within 300 yards from the customer's house and didn't really know who these guys were, I elected to go to the house and let them talk to me there, where there was an actual street light and I could see them, instead of on a street with absolutely no light, except their bright headlights and spotlight. When I exited my vehicle, the 2 officers jumped from their vehicle and pulled their guns on me and tried to arrest me, for failure to stop. When I asked them why were they attempting to pull me over, they said they suspected I might be pit-lamping. I refused to allow them to search my vehicle and told them to get a search warrant now that I was on private property. They took me to court and the judge threw out the case lecturing the 2 officers to stop wasting court time!
He lost me with his attitude, but when he made that little comment about always writing a ticket if he gets called out somewhere... There is no finer example of why law enforcement gets a bad wrap.

Down here in Florida it’s a possibility of finding a bundle of cocaine or weed while out fishing off shore in south Florida. I know a few people who have found bundles and they called into the coast guard/ local law enforcement and they just come out and get it and thank you for calling them for it.

I am a 75-year-old resident of Arkansas. I used to be a sportsman and have friends that are sportsmen. I have never heard of a game warden issuing a warning. Even a small infraction of the law.

Yep, so this Warden cost the state money by issuing 9 tickets when a warning would suffice... but the person really at fault is whatever game office clerk gave these young men bad information about where they could/couldn't magnet fish. Why does the state map of the green zones include federal military base property if it really isn't part of the same jurisdiction?
I think that warden should have been spanked! His "When I come out, I am writing tickets!" attitude is not what a public servant should have. These boys meant well and a verbal warning would have sufficed. I think that guy should be 'retired ' out of his job.
As soon as it was dropped they should have sued for damages. I would just got cause and I would go for his license in the court proceedings plus damages. Loss of time and money.

I understand that the U.S. education system is in shambles, but seeing as you have the entire human history and knowledge at your finger tips it's no excuse to be a moron.
For those who are ignorant to Army operations regarding ammo disposal, the Army does not throw ammunition away, and especially into the rivers around a post. You will typically find lots of unfired bullets and shells in streams and rivers around military bases. It gets washed off of ranges and other areas where live firing exercises are conducted.
I would cite the game warden a $130 ticket for not having a permit for running his mouth on military grounds! I’ve seen people shoot the wrong deer before, call the game warden and only get a warning. My hats off to the MPs that were cool and professional!

However letting them carry on could mean they encountered unstable ammunition that could hurt them and anyone driving past at the time.
Even if this officer is completely right, the fact that he says you shouldn’t call the police if you find drugs just shows the sorry state our police force is in. He’s right that if you report drugs to the police, you can be completely innocent and still be punished in some way. A good samaritan trying to prevent curious kids from overdosing should not be discouraged from helping

I understand why they needed a permit. Its dangerous to pick up old munitions. When I was in the 82nd Airborne division, my friends and I would go treasure hunting on drop zones. We would find a lot of military equipment including firearms. We would turn the weapons into the range control office. We would never touch munitions, instead we would mark it on a map and turn it into range control, they would send out the EOD . I don't know what they found, fired or unfired target rounds or live rounds, it's best left alone. I think the serious attitude of the police officer was justified.

But “ignorance of a law, is no excuse for breaking the law” however the Supreme Court has established that a law enforcement officer has no obligation to be right about a law they “reasonably” believe to be correct. Meaning you have to be trained to enforce the law for it to be permissible to not know the law.

An explanation and a friendly warning was all that was required.
Lt. Hollmen - upon walking up to the scene and having heard no explanation - says: "The good news is that none of you are going to jail. The bad news is that you all are getting tickets."
This is not a fair minded person. This is a man justifying his paycheck to his employers - and validating his own self-perceived importance to himself.
It was within his discretion to give them a warning - but exercising power won out over better judgement. These are the kind of people who have no business wearing badges.

Sounds fair to me.. they all could be in cells, or dead. Even worse they could have gotten others that drive by killed by their stupidity. They should be happy all that came out of it was citations and they aren't in a morgue or cell.
@@Grisbane The “treasure hunters” had absolutely no reason to suspect that they would find pounds of live ordinance in a river which is publicly accessible and bears none of the standardized warnings typically found at DoD ordinance dumping grounds. Their conduct was perfectly reasonable, the only reason their actions potentially justified the citation was because the river was technically under federal jurisdiction (again, despite any of the typical signage to that effect) and *not* because the river is a known ordinance dumping ground. Combine those facts with the decision of these people to immediately request assistance from the authorities in properly disposing what they did find, and there is an overwhelming amount of evidence to justify this warden exercising his discretion and giving these people a warning rather than a ticket. Your comment suggests negligence that goes well beyond what the circumstances justify
@@Grisbane The judgment of the situation and the need for the tickets should have changed when they explained that they had called and been told about green and red zones and had passed by bridges that were marked. These were not cowboy going just anywhere doing whatever they wanted, but were trying to do it the right way. They knew something was very off because of what they found and called for help because they couldn't very well leave the munitions behind responsibly.
This guy came in already decided that these were a bunch of delinquent punks and his attitude reflects that. He doesn't take into consideration that these guys had incomplete information about the green zones and tried to do their due diligence. Doesn't change anything about anything to him, he stays just as hostile even when these men explain they had maps of where it was supposedly alright for them to do this. That's not recklessness by any measure. That's getting bad/incomplete information from an authority they should have been able to trust. Huge difference, doesn't even register.
A warning went out the window when they continued to fish unexploded ordinance out of the river. As if the first unexploded rocket wasn't warning enough to say "hey maybe this isn't a good idea and we should call someone," they proceeded to fish not 1, not 2 but 86 test rockets out of the river plus other UXO...
@@kpro8908 If you watch the source clip, its clear they expected to find UXO and other military equipment... Besides they removed not 1, not 2 but 86 rockets, not to mention the other UXO BEFORE calling the authorities. The argument that they had "no reason to suspect" what they would find and their conduct was perfectly reasonable goes out the window as soon as the first UXO was pulled from the river and they decided to continue their activities.
They created a public safety hazard and were rightly fined for it... Also the original source video shows them absolutely giddy with excitement over their "finds" and overall poor, negligent handling of UXO.
The military cop was cool. This reminds me of when I got cited for driving an RC car in a public park without damaging any property whatsoever while they allow junkies to shoot up drugs at the same park and do nothing

Thanks to this helpful law enforcement officer for teaching me that if I find a big bag of drugs I should just keep it.
Complete disrespect and excessive action by this extremely hostile and egotistical warden. This could have easily been solved by granting a verbal/written warning, as they were unaware of the laws and regulations in that area, and were clearly not there to break any laws and cause problems. They called and treated the warden with respect. I understand they can go to court to fight the tickets but that shouldn’t have to be the solution here.
Laws are meant to ensure social order and discourage unwanted activities - and these guys were doing good natured activities, and reported dangerous materials that should NEVER have been dumped in a river to begin with. To be punished for laws they weren't aware of is contrary to the premise of the laws. He's establishing that if something isn't right, you shouldn't get involved, and if you do something that you arent certain the legality of, dont ask the government if its okay - meaning continue breaking the law in intentional ignorance for fear of the consequences that come with trying to be transperant. I'll bet you that warden, if he has kids, they dont talk to him for the same reasons.
Well, he's not abusing his power at least and everything done was within his authority, so I personally have no complaints. Plus that's how it's always done, you fight your citations, tickets, or any complaints against a cop in the courts, not on the streets.
