The prosecutor will spend a straight hour or more establishing how frustrated and angry the driver was in order to get the jury to believe that the driver was angry enough to do this. UPDATE: He was found not guilty of driving around the barricade. Pleaded no contest of improper start of a vehicle, receiving a $164 fine. And no proof of insurance was dismissed

As a nurse, that statement to justify his actions/attitude infuriates me. We get patients on a daily basis who are hostile to us while we are actively restoring their health.. the expectation and overwhelming reality is that the quality of care a nice patient gets is not superior than that of a disrespectful one. Here's my hypothesis: Cop was didn't even notice the car when it first signalled or pulled up beside him. Probably asleep on duty after last night's shifter. He only woke up as the car tried to get around him and everything else that followed was the cop over-reacting to cover his dereliction.
The cop accused him of "screeching" his tires when he left. Upon replay, that's a lie, he didn't. He revved the engine a bit as a f***-you but he didn't screech or even chirp his tires. I would tell the cop straight-up, "Hell yes, let's take this to court. I will make you look like SHIT in front of a judge." What the hell is up with this cop, is he a desk jockey that gets out once a month to keep his cert current? If he thinks that guy was being belligerent, he's a little princess that needs to stay in the office.
When the deputy said, "get the hell out of here" he was the one copping the attitude, the guy just wants to get home. Obviously the deputy was not paying attention to his own road block (sleeping?), or he might have prevented the encounter.
My guess is he was on his freaking cell phone like every cop I see every day parked on the side of the road. They all pay no attention to traffic anymore and just rely on the radar buzzing when someone is speeding to do the policing for them and spend all day on instagram looking at thirst traps. I see the same cop parked 40 feet up the road from a turn I make every day at the same time (I'm a mailman) where people constantly use the shoulder to turn right, even though it's checked off (meaning you can't do precisely that). I've even almost been hit by a few of them because I make that same right turn, but I wait for the light when there are people going straight in front me, because it's illegal to use the shoulder. Never once seen him pull over anyone for it, even the people that almost plow into me when they come hauling ass up the shoulder as I go to make the turn.

Don't think it should be overlooked that the officer lied so quickly about his driving. He was not fish tailing as he drove away. This alone should have the officer face some form of reprimand. If he'll lie about this chances are he'll do the same for others. Hoping the driver takes it to court to show this officers true nature.
The “C-“ was probably based on his assumption that what the cop said about the guy “peeling out” was truthful. It clearly wasn’t. The only one that peeled out and even possibly fishtailed in the video is the deputy.

Cops do it a lot. I remember one person asking "Am I being detained?" and the cop said no. The person started to leave and the cop was like "Now you're being detained!"

The driver asked if he could go to his house. The deputy clearly says “yes get the hell on.” That’s permission for the driver to go home. Everything after that is officer dishonesty, officer ego, officer retaliation.

Nah. One of the insurance cards was valid; He did NOT squeal his tires when he left, UNLIKE the cop; and he did not drive around a barricade. He stopped to get permission to go, and the cop didn't seem to be aware the motorist was even there, in which case I'd have proceeded also. That is kind of weird and it makes a lot of sense. There is no creative aspect of being a cop. You are given a rule book, told to understand it and memorize it. You are not asked to improve a system, just be a cog. Grind away for 20 years and retire. Sure there are other units, like detectives and special crimes units, but your patrol officer... just a cog.

I live in Pasco County Florida. These officers are all an embarrassment to law enforcement. I called them once and was treated like a criminal even though i was the victim. Bunch of little guys with big egos and horrible attitudes!
1:40 This is the whole problem, right here. The officer answered: "Yeah, get the hell out of here!" Which immediately made the citizen frustrated, and caused further escalation. That sentence alone should be a reason to punish the officer. That's not a proper way to treat a citizen. Officers need to learn to be polite. After all, they are public servants, not the other way around.

I don't agree with the officers conduct throughout most of this, but the driver was pretty hostile from the word go. Probably annoyed with the detour and the cops failure to acknowledge him when he stopped- but let's be fair also, we have no video to be sure the driver did any of this. At least that none that was shown here.

Yeah, the cop was sitting blocking the oncoming lane and there was no signage indicating to stop or that it was resident only traffic or that there was no through traffic due to the blockage at the other end. Was the cop forcing traffic coming out of that area to go around him into the oncoming lane too? Doesn't seem very safe either.

I disagree with the officer's grade here. There's an obvious lack of professionalism and the tickets were excessive, if lawful. The officer's refusal to call for a supervisor is evidence enough that the officer was operating in bad faith.

I think a C- is fair enough. The D and a F grades should be reserved for the worst of the worst such as the officers who lie, attack, arrest, and/or wound citizens over minor infractions. The officer sure as hell made up the fishtailing and he eventually did allow him to leave. EDIT: I should clarify that I’m aware that the officer lied. He not only lied but retaliated too. I think a D or F would’ve been fair if he arrested him and/or hurt him in the process. But the tickets are a d-bag move. So maybe a D+ is a better grade then.

I feel like it's worth mentioning that Lapointe only had one side of the road blocked off, specifically the opposite side than what the driver was on. So he didn't even drive around the barricade. The road was open.
Just because Lapointe SAID the cop blocked only one side of the road doesn’t make it true. Same with his claim that he stopped when right next to the cop car. The fact is that based on information provided in this video, there are major uncertainties over what happened and who was at fault.

Professional or not, it was an official end to the traffic stop. The second time was not actually a traffic stop as the guy was already parked and out of the car when he arrived.

Yeah, they ask all these extra questions and their whole job is to find you guilty for as many crimes as possible regardless of what you've actually done. Then, they expect people to want to talk to them. Sure, some are nice, but the issue is that the other half (probably more like 95%) then pretend to be nice while trying to nail you for stuff. It's hard for someone to determine what the officer is attempting to do (be polite or nail them for something maliciously) and when to exercise their right to speech. Cops get upset when people exercise their right to remain silent and say they could just answer the simple questions and not be "difficult". The issue with this is even then a lot of police officers will play the "you are being difficult" game while also being the same officer who is trying to vigorously investigate for whatever they can get on someone. Only answer simple questions to confirm your innocence. If there is a robber in the area and they stop you, simply explain you aren't a robber and maybe give a little detail about what you are doing in general. After that, you've done due diligence in dispelling their concerns, and any further repeat questioning means they already suspect it's you and you should exercise your right to remain silent. The issue is that most citizens don't understand these guidelines and either talk too little (rarer though), or they talk way too much and risk incriminating themselves. They need to be teaching classes I'm high school about police encounters and rights citizens have. They need to teach traffic stop rights and ways to not incriminate yourself in drivers education. Nobody should be put in a car where their rights can easily be violated and they can easily falsely incriminate themselves. High schools need to be teaching this shit and it needs to have it's own standardized test to prove that the schools aren't leaving their students out to dry. Pathetic in my opinion.

We have it up here in PA as well though you don’t see it nearly as often as you do down south. Only thing that can get you a bad grade on this channel anymore is murder basically. I don't get it. First off, I’m a retired police officer going on 24 years now. I’ve been watching several of Audit the Audit videos. Although it seems the majority of the videos are of negative encounters with police all over. I am appalled and embarrassed to even say what my occupation used to be to anyone anymore. When I was an officer, my thoughts were: 1. Treat people the way I want to be treated. The State Academy I went to also instilled this thought. I was born with it already. 2. De-escalate, not escalate the situation. I’ve seen so many situations go from bad to worse mainly because of “some” not all police officers ego’s getting in the way. 3. There is no room for rogue police officers. They should be reported by their peers when it is first noticed that your partner, trainee, supervisor, etc. are stepping out of bounds. We had one or two out of one hundred like this during my time. Usually they were noticed during training phase. Needless to say they didn’t last long because it wasn’t tolerated. 4. Lastly, know the laws and Amendments and what constitutes lawful and probable cause detainments or arrests. Not ego trips because they wear a badge and gun. I have had encounters with the police since my retirement and have had more “You got to be kidding me” moments than good ones, but there is some damn good honest and caring officers still out there. Try not to let the negativity sway your heart. There is good and bad in all cultures, races and occupations.

According to the diagram shown he was blocking the side of the road leading out of area as opposed to the side of road leading in. You either block the side leading into area or over lap both sides while standing out there or stretch police line tape across where you're blocking. That's traffic control day 1 stuff.
That cop dude at the "barricade" should've been demoted. He should've had an easy to move barricade in the incoming lane, while he sat in the car with his door or window open, and gotten out of the car the moment he saw someone start turning towards the barricade, and then ask to the person what their intentions were for turning towards a barricade. Once it had been found that the person was going home, the cop should've wished them a good day and remove the barricade to let the person pass by, then place the barricade back.
@John::: You are on point. If the deputy intended to prevent nonresidents from entering, the deputy's vehicle should have blocked or partially blocked the entry lane, not the exit lane. That would force people to stop but instead, he is forcing people exiting to stop and when they drive around him they are facing oncoming traffic.
Yes. In my neck of the woods, roads were washed out and homes literally cut in half by flash floods. Police "barricades" blocked many, many roads, including routes in and out of the flood zones for months. Cops (Deputies) would wait in the middle of the road and wait for you to stop next to them. A short; "I live at 123 canyon dr. Can I get there?" was enough for passage. We also relied on the cop's judgement to prevent looters and "lookie-loos" from getting through. This cop was obviously ignoring his responsibility to the public.
LaPointe told the driver he could drive down the road to his home, only to then immediately jump into his cruiser and pull the driver over *again* and ticket him for doing exactly what he had been given permission to do. I'd be freaking pissed also!
I was wondering why the driver never brought that fact up to the extra sheriff that showed up. The whole time the driver was talking to him, I was like “dammit, tell him that you already had permission to go through from the officer that pulled you over!” Also, it’s a shame the driver didn’t say anything about not being the one to peel out either. As a retired LEO, I PRAY that I never have to encounter ANYONE in uniform, at any time, due to the UNPROFESSIONALISM & abhorrently low level of standards evident in today's personnel.
I don’t know how police training videos look, as I’m not LEO, but I think they 100% should be just a playlist of this channel. Very informative! they should all just have their officers watching replays of all real interactions with complaint forms filed on officers, just so they can learn from others mistakes or blatant disregard for law.
The problem has nothing to do with training. They have qualified immunity, a public employee union that violates the legislative process, a criminal fraternity, and legislatures who hate you and their support-codification that allows-encourages this behavior to back it all up. There us no duty to protect so the "serve and protect" mantra is a lie to lull dumbass citizens into obedience. Their job is to ENFORCE. Why should they give a shit about your Rights when YOU are TRAINED to suck it up and fight it in Court? It is a human condition when given so much unchecked power. We can police against crime and protect the citizenry without all of this but it would require a complete upheaval of the institutional norms and too many boot lickers won't ever let go of their "thin blue line" wet dream fantasy.
Speaking as someone currently going through a police academy, that's not a particularly good idea. There are actually a good few videos from the channel that get some things wrong and even misinterpret some of the things we are taught to do and why we are taught to do them. This interaction itself is not a bad video however. The moment the Officer said to go past him he had no right to cite the guy for going past the barrier, and in my department that I am joining I know my Sergeants would chew out my ass if I would interact as that officer did.
Sounds good in theory but the problem is a lot of cops dont care what the law is, they only want to enforce their own personal beliefs, feelings and emotions. They dont respect the fact that people living in America have certain rights and privileges.

You missed this, the cop told him to go past his barricade. The cops barricade was lacking at best, cop was pissed off for having to get out of the car. If he was doing a correct job of blocking there would no room for passing. Then the cops feelings got hurt so he left his road block, exposing the workers to dangers of cars and trucks entering the construction zone unaware that it is there. My guess is he was on his freaking cell phone like every cop I see every day parked on the side of the road. They all pay no attention to traffic anymore and just rely on the radar buzzing when someone is speeding to do the policing for them and spend all day on instagram looking at thirst traps. I see the same cop parked 40 feet up the road from a turn I make every day at the same time (I'm a mailman) where people constantly use the shoulder to turn right, even though it's checked off (meaning you can't do precisely that). I've even almost been hit by a few of them because I make that same right turn, but I wait for the light when there are people going straight in front me, because it's illegal to use the shoulder. Never once seen him pull over anyone for it, even the people that almost plow into me when they come hauling ass up the shoulder as I go to make the turn.

Depending on the law of the state, the officer doesn't have to provide that information at that point. Don't construe this as my defending the deplorable actions of the officer, just stating there may not be a law requiring such.

I have a lot of friends in the military. It’s a common joke that if you can’t take instructions and physically can’t pass boot camp, you become a cop.
There's something to that. If you ever meet an intelligent ex-cop, as I have, they'll likely tell you that they had to quit because it just wasn't the right job for them.

That is kind of weird and it makes a lot of sense. There is no creative aspect of being a cop. You are given a rule book, told to understand it and memorize it. You are not asked to improve a system, just be a cog. Grind away for 20 years and retire. Sure there are other units, like detectives and special crimes units, but your patrol officer... just a cog.

I live in Pasco County Florida. These officers are all an embarrassment to law enforcement. I called them once and was treated like a criminal even though i was the victim. Bunch of little guys with big egos and horrible attitudes!

Probably annoyed with the detour and the cops failure to acknowledge him when he stopped- but let's be fair also, we have no video to be sure the driver did any of this. I think a C- is fair enough. The D and a F grades should be reserved for the worst of the worst such as the officers who lie, attack, arrest, and/or wound citizens over minor infractions. The officer sure as hell made up the fishtailing and he eventually did allow him to leave.

I feel like it's worth mentioning that Lapointe only had one side of the road blocked off, specifically the opposite side than what the driver was on. So he didn't even drive around the barricade. The road was open.

Yeah, they ask all these extra questions and their whole job is to find you guilty for as many crimes as possible regardless of what you've actually done. Then, they expect people to want to talk to them. Sure, some are nice, but the issue is that the other half (probably more like 95%) then pretend to be nice while trying to nail you for stuff. It's hard for someone to determine what the officer is attempting to do (be polite or nail them for something maliciously) and when to exercise their right to speech. Cops get upset when people exercise their right to remain silent and say they could just answer the simple questions and not be "difficult". The issue with this is even then a lot of police officers will play the "you are being difficult" game while also being the same officer who is trying to vigorously investigate for whatever they can get on someone. Only answer simple questions to confirm your innocence. If there is a robber in the area and they stop you, simply explain you aren't a robber and maybe give a little detail about what you are doing in general. After that, you've done due diligence in dispelling their concerns, and any further repeat questioning means they already suspect it's you and you should exercise your right to remain silent. The issue is that most citizens don't understand these guidelines and either talk too little (rarer though), or they talk way too much and risk incriminating themselves.
They need to be teaching classes I'm high school about police encounters and rights citizens have. They need to teach traffic stop rights and ways to not incriminate yourself in drivers education. Nobody should be put in a car where their rights can easily be violated and they can easily falsely incriminate themselves. High schools need to be teaching this shit and it needs to have it's own standardized test to prove that the schools aren't leaving their students out to dry. Pathetic in my opinion.

We have it up here in PA as well though you don’t see it nearly as often as you do down south. Only thing that can get you a bad grade on this channel anymore is murder basically. I don't get it. The bar has been set SO low, that a cop can act disgustingly petty and dishonest, and still get a C because "Well we've seen worse". I know it's nitpicky, but at this point I'd almost recommend he do a two-tiered grading system; one for strictly legality, and another for their demeanor, professionality, and more intangible factors. There's all kinds of cases where they don't TECHINCALLY break the law, but act extremely unprofessional and in bad faith.

First off, I’m a retired police officer going on 24 years now. I’ve been watching several of Audit the Audit videos. Although it seems the majority of the videos are of negative encounters with police all over. I am appalled and embarrassed to even say what my occupation used to be to anyone anymore.
When I was an officer, my thoughts were:
1. Treat people the way I want to be treated. The State Academy I went to also instilled this thought. I was born with it already.
2. De-escalate, not escalate the situation. I’ve seen so many situations go from bad to worse mainly because of “some” not all police officers ego’s getting in the way.
3. There is no room for rogue police officers. They should be reported by their peers when it is first noticed that your partner, trainee, supervisor, etc. are stepping out of bounds. We had one or two out of one hundred like this during my time. Usually they were noticed during training phase. Needless to say they didn’t last long because it wasn’t tolerated.
4. Lastly, know the laws and Amendments and what constitutes lawful and probable cause detainments or arrests. Not ego trips because they wear a badge and gun.
I have had encounters with the police since my retirement and have had more “You got to be kidding me” moments than good ones, but there is some damn good honest and caring officers still out there.
Try not to let the negativity sway your heart. There is good and bad in all cultures, races and occupations.

The cop is the one who revved his engine like NASCAR and screeched his tires because he was all pissed off. I'd want this one to go to court, he'd look like shit in front of a judge. According to the diagram shown he was blocking the side of the road leading out of area as opposed to the side of road leading in. You either block the side leading into area or over lap both sides while standing out there or stretch police line tape across where you're blocking. That's traffic control day 1 stuff.
That cop dude at the "barricade" should've been demoted. He should've had an easy to move barricade in the incoming lane, while he sat in the car with his door or window open, and gotten out of the car the moment he saw someone start turning towards the barricade, and then ask to the person what their intentions were for turning towards a barricade. Once it had been found that the person was going home, the cop should've wished them a good day and remove the barricade to let the person pass by, then place the barricade back.

If the deputy intended to prevent nonresidents from entering, the deputy's vehicle should have blocked or partially blocked the entry lane, not the exit lane.
That would force people to stop but instead, he is forcing people exiting to stop and when they drive around him they are facing oncoming traffic.

Yes. In my neck of the woods, roads were washed out and homes literally cut in half by flash floods. Police "barricades" blocked many, many roads, including routes in and out of the flood zones for months. Cops (Deputies) would wait in the middle of the road and wait for you to stop next to them.
A short; "I live at 123 canyon dr. Can I get there?" was enough for passage. We also relied on the cop's judgement to prevent looters and "lookie-loos" from getting through. This cop was obviously ignoring his responsibility to the public.
I suspect the cop may not have noticed the car since he was about to finish the next level of Candy Crush.
LaPointe told the driver he could drive down the road to his home, only to then immediately jump into his cruiser and pull the driver over *again* and ticket him for doing exactly what he had been given permission to do. I'd be freaking pissed also!
I was wondering why the driver never brought that fact up to the extra sheriff that showed up. The whole time the driver was talking to him, I was like “dammit, tell him that you already had permission to go through from the officer that pulled you over!” Also, it’s a shame the driver didn’t say anything about not being the one to peel out either. As a retired LEO, I PRAY that I never have to encounter ANYONE in uniform, at any time, due to the UNPROFESSIONALISM & abhorrently low level of standards evident in today's personnel.
I don’t know how police training videos look, as I’m not LEO, but I think they 100% should be just a playlist of this channel. Very informative! they should all just have their officers watching replays of all real interactions with complaint forms filed on officers, just so they can learn from others mistakes or blatant disregard for law.

They have qualified immunity, a public employee union that violates the legislative process, a criminal fraternity, and legislatures who hate you and their support-codification that allows-encourages this behavior to back it all up.
There us no duty to protect so the "serve and protect" mantra is a lie to lull dumbass citizens into obedience.
Their job is to ENFORCE.
Why should they give a shit about your Rights when YOU are TRAINED to suck it up and fight it in Court?
It is a human condition when given so much unchecked power.
We can police against crime and protect the citizenry without all of this but it would require a complete upheaval of the institutional norms and too many boot lickers won't ever let go of their "thin blue line" wet dream fantasy.
Some of the officer grades are far too high for violating proven Constitutional rights. Maybe don't include those.
Speaking as someone currently going through a police academy, that's not a particularly good idea. There are actually a good few videos from the channel that get some things wrong and even misinterpret some of the things we are taught to do and why we are taught to do them. This interaction itself is not a bad video however. The moment the Officer said to go past him he had no right to cite the guy for going past the barrier, and in my department that I am joining I know my Sergeants would chew out my ass if I would interact as that officer did.
Sounds good in theory but the problem is a lot of cops dont care what the law is, they only want to enforce their own personal beliefs, feelings and emotions. They dont respect the fact that people living in America have certain rights and privileges.

Just because the information in this video doesnt match what you are being taught doesnt make it incorrect. You would need to back up your assertion with laws and facts to show how this video is incorrect. Just saying you are taught differently doesnt make your way correct or legal.

You missed this, the cop told him to go past his barricade. The cops barricade was lacking at best, cop was pissed off for having to get out of the car. If he was doing a correct job of blocking there would no room for passing. Then the cops feelings got hurt so he left his road block, exposing the workers to dangers of cars and trucks entering the construction zone unaware that it is there.

You can CLEARLY hear on the video that he never "peeled out" at all. In fact, the only one who did was the cop. ANYONE who claims he did peel out is clearly just lying to cya.

Not only can you hear he didn't "peel out" but the cop went from telling the citizen he peeled out to changing his story when the backup got there and said he fish tailed.
Definitely heard him peel out, it’s hard to hear but it definitely happened. Dude was frustrated and all he had to do was just drive normally. I think the cop deserves a B+ instead of a c-.
