  • The CSIS Southeast Asia Program and Asia Maritime Transparency Initiative are pleased to present the Fourteenth Annual South China Sea Conference on Thursday, July 11, 2024, from 9:00 am-4:00 pm ET. This full-day conference will provide opportunities for in-depth discussion and analysis of developments in the South China Sea over the past year and potential paths forward. Panels will address the state of play in the South China Sea, legal developments and dispute management, evolving alliance networks, and the role of outside parties, such as the Quad, AUKUS, and Europe.

    It’s a straight forward, follow international law, no one is above the law. It’s not because China is a big country with big military force that would make them turn white to gray or black.
    Why is here international law for? Is it only for big counties ?

    The Chinese participant clearly did not read the 2016 Arbitral Ruling that addresses the issues she presented. China's Position Paper and non-appearance in the Arbitration sufficiently represented its stance in the matter, so it should abide by the decision.

      @@tongwu4667 As I mentioned, China submitted a position paper to represent it's view on the issue. UNCLOS also has provisions that allow for parties to apply for exemptions. China's rationale for exemption was insufficient and was thus denied. It isn't the fault of the Philippines that China lacks the capability to present legal evidence for its claims.

      The history must be respected -
      The Philippines was allowed to be independent in July 1946 by the US, but the South China Sea was not included because -
      The 11 dash lines in the South China Sea were published by the Chinese government in 1934 but were captured by the Japanese invasion in WWIl. In 1946, the US navy gave the Chinese Navy 4 battle ships to help the Chinese Navy to reclaim the 11 dash lines and renamed the 4 major/largest islands with the names of the 4 battle ships ... Respect the history!

    I sort of feel sorry for Hong Nong from ICAS in DC. I remember a Foreign Policy article by Isaac Stone Fish who was the Asia Editor at FP from 2014-2016. The July 7, 2016 article. "Beijing Establishes a D.C. Think Tank, and No One Notices: China is trying, and mostly failing, to build U.S. support for its claims in the South China Sea." Although Hong, according to the article, maintains that ICAS is independent, it is clear in this panel 8 years later that her hands are still tied by Beijing and that she still hasn't figured out how to get an untenable, illogical legal position accepted.
    I do admire her steadfastness, though. Too bad Beijing doesn't seem to reward such loyalty to the 9-dash-hopeless-cause.

    the Ayungin shoal by using
    donated transport helicopters
    from USA and Japan to be
    secured by at least 3 assault

    The chinese expert (that lady over there) conveniently skirts over the real issue of China's continued violation of UNCLOS that it signed in 1982. She also ignores that China is more powerful militarily and economically than the Philippines, and thus, bilateral relations between the two is useless when one of the two parties always works in bad faith. The Philippines has had 17 years of bilateral negotiations with China, and yet not once did China budge or compromised or met the Philippines in the middle, while PH was always on the receiving end of aggression similar to Vietnam. I also notice how she pulls away the mic from her mouth whenever she is about to say something controversial and clearly pro-China stances. And how is she an expert on the issue when she leads efforts on climate change? I would rather have a level-conversation with someone who really knows how arbitration process works and how international law is always RIGHT vs. MIGHT. Always remember that China is engaged in disputes with 14 other countries. It shows you who the real aggressor is. I hope ASEAN members realize this soon. They have their own stakes in the South China Sea. Siding with the Philippines means siding with their own maritime interests in the high seas.

      You seem ignorant. The USA is a Pacific nation. Japan and the US literally share a maritime border (Attu). We have more shoreline on the Pacific than China has shoreline and have more territorial waters in the Western Pacific than China (if you discount the illegal 9- and 10-dash-lines)
      We're not 5,000 miles away: The CCP's China is our annoying, mobile-home-owning backyard neighbor.

    Chinese rep. Ms. Hong Nong seems surprised about the negative public attention theyre receiving Internationally as if illegal, coercive and intrusive actions by China does not deserve condemnation. at the very least, China can complain about reputational damages all it wants, but it isn't the one suffering from actual intrusions and violations of a country state's legal and sovereign rights. China does not get to play as a victim here.

    I just want to add a few words on the last words of the panel, in particular to miss Hong Nong's answer:
    If this non-existent gentlemen's agreement was the main reason that China is citing on why it is picking on the Philippines this time in particular, then why just bring it up now? It only started getting brought up in the spring of this year while China has started the brazen bullying of the Philippines since 2022.
    Even if this gentleman's agreement exist, so what? Does it supersede actual international law and legally binding ruling like the arbitration ruling in the Philippines favor exactly 8 years ago today in 2016? It's a very disingenuous and intellectually wrong justification. It's literal 'he said she said and the Chinese intellectual foreign relations community can do better than that.

      The laws and agreements between Spain and USA, which decided Philippine territory, didn’t include any reef/island in the South China Sea.

      Answer: You clearly didn't read the whole UNCLOS provision. A party's refusal to join an arbitration is not a bar to the proceedings. And China's signing and ratification of UNCLOS binds it to the said provision by default. Therefore, the arbitration ruling is legal, final and binding.

      Answer: That is true, with regards to the Treaty of Paris. Then, a Spanish outpost in Sulu Sibutu refused to vacate despite US demands because the former alleged it is outside the limits of the Treaty of Paris. US says ALL Spanish possessions that comprise ALL Philippine territories must be CEDED. Hence, they signed the Treaty of Washington where it clearly specified -- all other Spanish possessions that comprises the Philippine territory OUTSIDE the limits of the Treaty of Paris is further CEDED to the United States. AND...
      that includes Scarborough Shoal and the Spratlys. Proof - Spanish Verlarde Map of 1700s which bears the Royal Insignia of Spain, showing the Scarborough and Spratlys as Spanish colonial possessions in entirety of what is now Philippine territory.
      Chinese ambition in the South China Sea has no historical and legal basis, only motivated by pure, unabashed greed.

      @@marieclaire3670 Sometimes people need a remember of reality. There has been many judgements and claims made against the US and lets not forget its many war crimes and invasions. Nobody is going to attack the USA and those that tries don't do well. China today is peer to the US, if not a stronger opponent in its home tuff.
      This confrontational approach by the Philippines is not going anywhere and very likely suicidal. It is placing itself between 2 superpower who are playing chicken, in a number of possible avenues for the showdown. The war weary Vietnam takes a less confrontation approach even after actual war with China. This is a no win situation for the Philippines.
