I think there is a difference between exercising your right to remain silent to not incriminate yourself, and not reporting a crime in progress; because the crime was still in progress and they directly participated in the destruction of evidence by not reporting Gabby’s location. They knew that not reporting Gabby’s location would result in further deterioration of her body and be far more distressing for the family members when she was found, if she was found at all.
@@gwens5093 Courts also use common sense. If they had knowledge that Gabby was dead and that her body was left beside a creek in Grand Teton days before her body was found, then I think you would have a very hard time convincing the court that the Laundries did not know the condition of her body would deteriorate left exposed to the elements and wildlife. This may not have carried any weight when they made their decisions, but it does not mean they did not have that very common knowledge. It is my understanding that the attorneys have a letter confirming that Roberta knew Gabby was dead, and more than likely knew where her body was located.

It's simple, If you knowingly withhold information that you know could potentially be seen or deemed as evidence in a crime, you should be held accountable. If you don't offer that information freely than you're lying and withholding evidence, which is an offence. On top of that, (in my opinion) if they were helping Brian in any way whatsoever after knowing what he did, they were basically harbouring a criminal. The problem with them remaining silent is the messages from her family and the timeline of events. If they lived at his parents house and they left together, and he came back without her, and even if he said she went home; wiuldn't the messages from her parents saying they didn't know where she was indicate Gabby is a missing person. She didn't have her cell phone or debit card because both were in his possession. Once finding this out, why wouldn't his parents turn the van and all her possessions over to the police? They know a crime happened, because they hired a lawyer and have not ever, at any point, said a single word, till they called in police to rescue THEIR MURDERER SON! And even worse of an insult to not only the parents of Gabby, but the rescue people, the police, in several states, looking desperately for a woman they hoped to save, and likely hundreds of thousands of dollars spent to find her dead body! they hired an attorney after she was reported missing and they knew something had happened. why hire an attorney at all unless they knew something for sure, you dont hire an attorney because someone went missing unless you know something bad happened. he must have told them something happened to her, probably blamed her for it, or said he had to kill her to protect himself. They went on a family trip while Gabby was laying under the ground, decomposing, and they all knew it. they sat around a campfire, took pics, laughed, and had family time, making memories. who does that knowing she was gone.
Petito's will need to prove the Laundries knew where their son was and obstructed the search to find him. And will the standard of proof is lower in a civil suit, it may be very difficult to prove. If I was the Petito family, I'd be more likely to sue the police that encountered the couple and failed to investigate and take steps to separate the couple and to follow up. Plain and Simple they can’t prove that Brian told his parents he killed her, this is all under the assumption he told him. I think it should have to be proven that Brian's family actually knew Gabby was dead, that their son killed her, and where her body was before they can move forward with this case. I'm just curious as to how they can say without a doubt that Brian's family knew what happened before that statement was made by their attorney.
@@yeahB It's not true that they had "lawyered up before their son had come home from the trip." Gabby's parents make that allegation in their amended complaint in this lawsuit, but they also seemingly admit that they are just guessing. There is zero public evidence of when they "lawyered up." And the only thing that the Laundries and their attorney have said about that was that the attorney literally never spoke to Brian a single time, not even on the phone. That probably means they hired the attorney pretty late in the game -- most likely a day or two before Gabby's parents filed the missing person report. If I'm right about that, they hired the attorney only about four days before Brian killed himself.

This may not have carried any weight when they made their decisions, but it does not mean they did not have that very common knowledge.

How about searching for a young woman that YOU KNEW YOUR SON killed, while every search team possible is looking for this young woman that their son killed! And just as they wouldn't speak on what they knew, they showed how they feel about the law applying to them and theirs by not even showing up in court!
How do you know they knew?
They knew that their son committed a murder, and that there was a hunt in several states for the woman their son murdered. They covered it up, Lawyered up, and time and money was spent looking for a live woman when they had knowledge that she was DEAD! They covered it up, took him camping, and when their son became missing, With a gun from their home, how long till they reported that?! They knew exactly where to find him because he TOLD them where he was going. I hope Brian's family feels the same grief as the family of the woman he murdered, but in my opinion, they brought it on, and their silence killed their son. Someone needs to ask their lawyer why he NEVER insisted that Brian turn himself in? Maybe Brian's Parents should sue him!
Totally agree
Based on the premise that everything you said is true, The moment they helped him, they became an accessory so they now have a constitutional right to remain silent to avoid incrimination. I'm not arguing that they weren't wrong but I am saying if that's the case, they can't sue for them not speaking up, maybe a wrongful death but I think they would need more for that. They're in pain and want someone to pay in some way. It's very sad.
No one cares about either of them.
@@lazydaisy2292 Except they are not using their right to silence, as they have not been subpoenaed, or testified to this matter to police. So they haven't pled the fifth. They have not been charged with a crime, so they would actually have to walk in that courtroom, be sworn in, and invoke it. They in my opinion, are not much different than the Crumbley's who bought their son a gun, and, when he drew pictures of dead kids, refused to take him home even though they knew he had his gun in his bag! They left him there and children are dead for their actions. The only difference is Brian's family, is free to live their life with no consequences beyond the fact that the gun in this case, took the life of their son, and maybe for them, it was easier that, then to watch him go to prison for murder.
@@lazydaisy2292 Brian did pay. He isn’t out living some life of luxury. And the poster saying they had lawyered up, maybe Brian told His parents that he had not harmed her. Wouldn’t you get a lawyer for your son if he was telling you he was innocent? And some people saying that they had cell phone service in that area. I don’t believe it she had texted her mom and said she didn’t have service where they were staying
Of course the Launderies have an obligation to speak. The criminal charge of Accessory After the Fact exists for exactly this scenario. If your kid tells you he killed someone and left her body in the desert, and you don't report that, you are now complicit in the crime.
Are you going to tell me that your son comes back from a cross-country trip, in his gf’s van without her, and no parent is going to demand some answers? Get out of here. Then you secretly go camping with him?
They knew SOMETHING, and all they could say to Gabby’s parents was “Hope you find her”? That’s a safe, non-incriminating statement when you want to hide something.
Maybe he came home with paperwork from Utah police and said they're taking a break from each other. She never drove the van anyway so it's not suspicious. Maybe they got a lawyer because of DV, but they cooperated with police and didn't secretly do anything. The media exploited this for profit. There's no evidence they knew. All of a sudden you think Brian was honest with his parents right off the bat? You know he killed her, but you think he tells the truth?
Gabby’s mother broke my heart watching her. They zoomed in on her, and her eyes were just so sad (of course), the dark circles, my heart just aches for her! To their entire family. The Laundries are despicable and poor excuses of human beings.
It gets less sad every time I see it, it's all about money now.
My heart breaks for the Petito Family. RIP Gabby.
This case presents some very interesting arguments; I appreciate the Judge’s responses and questions.
Ok..hold on….so if someone comes to me & tells me that they killed someone this guy says BY LAW I DO NOT have to report that immediately?! BUT if my friend or brother or whoever has a warrant & I know about it & I let them stay at my house-I can be charged with aiding & abetting!? You’ve got to be kidding me.
I think the laundries are as guilty as sin. They had a moral responsibility to speak up . They are friggin cowards.
Rest in peace gabby😢
Why am I not surprised the Laundries didn't show up!!
I wonder why though
@@1Luv87 the dirty Laundries are probably embarrassed & feel guilty for what happened for what there own son did too gabby.

There is no reason or duty for anyone to show up.
From a legal standpoint, Petito attorney did present direct precedent on several of the arguments for dismissal. While I think he may face evidentiary hurdles at trial, this case should survive motion to dismiss
The Laundries should be forced to be there, imo.
I agree 100%
Why didn't the Police consider Laundrie a Suspect as opposed to a person of interest? FFS, he took her car and drove across the Country, where TF did they think she was...certainly not alive or Gabby would have contacted her family. The Laundrie parents are as guilty as their son, what callous people they are.
OMG!!!! These parents knew where this poor girls body was literally rotting away and they said nothing except pretty much “good luck finding her”
Holy 💩 These people are filth. The reason they did this is they were hoping that Gabby would only be bones and there would be no evidence left. Unfortunately they were successful to a degree. Gabbys parents pretty much received her bones. That is absolutely gut wrenching. It seems to me, by their attorneys statements, that they did know much more then they told law enforcement.
I agree and it's also disappointing that Brian took the easy way out.
Unfounded speculation. You have no idea what they did or didn’t know.
Absolutely!!! 100% You are correct!

What’s not extreme about hiding a murderer??? Good judge!!!
I saw on the news after Brian came home that there were police watching the Laundry’s home and never saw Brian leave? They hire an attorney then days later report Brian missing? The fact that he came home without Gabby and cleaned out the van? I would definitely be asking my son some serious questions. Gabby also lived with them. You can’t tell me they knew nothing about their relationship. Really! Come on!
Why would it be unusual to clean a van that has food and bedding that has been slept on for 2 months?
@SR You show yourself to be one who deliberately tries to incur or provoke hostility ' in and towards others . By asking someone to answer a question that is only in-part of that statement ,
and not allowing the whole understanding of that statement to be applicable .
Your question is irrelevant .
The parents may have not known. It appears those two fought all the time. Maybe the parents were sick of the drama and didn’t bother to ask or didn’t want to know. Their son is an adult after all. It’s not like he’s 5 yrs old where his parents need to question everything in his life. Do your parents question your adult relationships and are you obligated to tell them?
@Jen C . Your speculation shows that you have not done an extensive ; indepth search in the case , to keep yourself from making such comments . Without a fuller understanding .

Definitely awkward alright. I don't think the judge was amused. 😀
Love how the judge keeps interrupting and questioning the Laundries' attorney
I lost track of this case so thank you very much!!
Gabby will haunt the Laundries family for the rest of their lives, because they knew their son was guilty of Gabby’s death. R.I.P. Gabby gone but not forgotten 🥲
Nope.
They found out when everyone else did.
This idea that you people have that parents know everything their kids do is absolutely ridiculous.
Let's say they assumed he did it, and?
Then let's say they called the police and said we THINK he did it. And?
He was already a suspect, which mean the police are already ASSUMING he did it.
So what would that have changed?
NOTHING!
Their own son is dead.
they hired an attorney after she was reported missing and they knew something had happened. why hire an attorney at all unless they knew something for sure, you dont hire an attorney because someone went missing unless you know something bad happened. he must have told them something happened to her, probably blamed her for it, or said he had to kill her to protect himself. They went on a family trip while Gabby was laying under the ground, decomposing, and they all knew it. they sat around a campfire, took pics, laughed, and had family time, making memories. who does that knowing she was gone.
They hired the attorney before she was reported missing.
If you helping and hide a murder , you are guilty!! They knew and helped him. Both of them to jail!
Oof that actor joke fell flat
Lol!
Sure did. 😄
Ugh. I wish the greedy, money hungry Petito Family would just go away. They need to let Gabby rest in peace 🙏 🪦.
That’s the longest two minutes by the Laundries lawyer that I’ve ever endured 🤬🤦🏽♀️
The fact the judge allowed them to not be there is BS.
Gabby’s mother crying in the background is heartbreaking. I, too, am
a mother of a Gabbie.
What did Gabby's mother do to help her out of that toxic relationship? A real mother would not let her daughter suffer so much.
Aunt of a Gabby here. I would be beyond devastated if someone hurt my girl.
Maybe, this is just a tragic case, and the one responsible for Gabby's murder is dead. We can't always get legal relief.
They tried that. Gabby refused and was becoming hysterical. Leave those cops alone. Thye did the best they could under the circumstances.
@@m.e.d.7997 Big clue here: " Gabby was becoming hysterical."

Kinda difficult when they're on a road trip. If the Petitos win, it's going to set a precedent where officers take extreme punitive action in even seemingly minor argument disputes because who knows? Maybe one person will end up dead.
Well you sure can tell that this attorney WAS NOT AROUND WHEN ALL OF THIS WENT DOWN. UNBELIEVABLE. STILL WATCHING BUT UGH…..
The mob scene outside their house for months certainly was counterproductive!
Plain and Simple they can’t prove that Brian told his parents he killed her, this is all under the assumption he told him. Denzel said it best in Training Day *Its not about what ya know, it’s about what you can prove*
While I feel terrible for the Petito family, the fact remains they are not liable because Brian could of hid it (although highly unlikely).
Naturally! Yes, all of us are showing sympathy toward the Petito family, but we have to be prudent.

We need to put ourselves in the Laundries’ situation. There is a murderer in the family and they would have a difficult time coming to terms with their predicament. To see these parents watched their son leaving to die and had to be searched for just like Gabby is heartbreaking.
Justice for Gaby.

I have 2 adult boys and will and have always backed them if they were in the right. But will be the first one to hold them accountable. I Love them no matter what, but if I knew they did something so horrible, I would be there to take them in to tell the truth and face what is ahead. It is not a thought. It is what is the right thing to do.
I’m so curious why some people just assume that the parents knew things and chose to withhold them. We have no idea what they were told.
Why aren’t the laundries there?? They think they’re so entitled to everything
They aren’t required to be there. Has nothing to do with entitlement.
I don't understand how they aren't Criminally charged. They aided and abetted a murderer. It makes ZERO sense that the parents weren't arrested. They helped him. They knew what happened. They didn't answer calls or texts from Gabbys parents because they knew. Its disgusting. Brian's sister even said her parents were being weird and wouldn't speak to her.

Great lawyering by the Petitos attorney. Put it in front of a jury.

And the only thing that the Laundries and their attorney have said about that was that the attorney literally never spoke to Brian a single time, not even on the phone.
