  • I was recently in Tustin, Ca. documenting (capturing photos & video) outside this local credit union from the public sidewalk. I had multiple interactions from various employees & customers regarding my reason for recording, eventually Tustin Police arrived on scene & briefly made contact with me before making any contact with the bank.

      When he suggests that she go inside and talk to the caller there's a brief moment of indecision. She's thinking whether it would be better to drive over to the building than walk all that way. She's left the car _right in the way,_ as most law enforcement does. Laziness overcame her desire to assert dominance by parking in the way. I swear they train them to leave the car in a travel lane whenever possible, instead of parking in a space like a mere mortal.

    It always amazes me that these companies think it's perfectly ok to film the public in public or private, but they don't think the public have to right to film them in either place. If that dude was a "network engineer" I'm the next president.

    That guy wearing the Wachter shirt tried to intimidate you with his credentials (i.e. "I'm a network engineer. I used to work for the Fed..."), but all he accomplished, with every word he said, was to make a fool of himself. When you tell people that your camera is for your own safety and security, just like the ones used by the businesses, you make one of the most excellent responses possible.

    The sheer stupidity of walking up to a camera and insisting on not being recorded never ceases to amaze me. Or understanding the concept of cameras for a building's security but they look at you like you have 2 heads when you tell them your camera is for your security. Great clip as always.

      The key word in your comment is "business" You see the auditors have worn out police stations, courts, and libraries to audit so now go after private businesses and institutions. The credit union is actually owned by it's members who are private citizens. What is the point of auditing non-public entities ? Distract my employees from their jobs and get your ass kicked.

    At 7:15 she left after being pretty cool and minimalist in dispensing her duties. Good job so far. That network engineer made a fool out of himself though. The question he should have been asked would be "Do you take pictures at major sports events and if so, do you get everyone's permission who is in the frame?".

    Can I say that you are extremely polite and calm. It's a shame that people you interact with think that their feelings are more important than your rights. Here in the UK we don't have The Constitution, but our public photograpjy laws are pretty much the same. I like taking my camera out and photographing street furniture and architectural features, but my enjoyment gets spoiled by the idiots who stand in front of a man with a camera and say they don't want to be filmed.. Anyway, great channel, keep safe.

    8:14 So many people think that they can trespass someone's eyes just because they look at their private property through a lens. Even though you stand in public, they think it is illegal to film something private or someone's person, and that you need their permission to be legally allowed to film. The idea that it is really up to them, that they should not make themselves visible to a camera (like walking up to it) or create their own privacy (like closing doors and using curtains etc) seems to elude them.

      To be fair though there is a requirement to get somebody's signature if the video is going to be used for monetary gain. Most people just forget the last part.

      @@randallsmerna384 That is a big misunderstood area. Being in a video does not require someone's signature or consent even if it is making money.
      The term Editorial Content if most often used. Where you start to need consent is if a persons image is being branded to specific product or company. Placed on Tshirts, mugs, or even used in an ad to sell an item, then consent would be needed.
      Being in a monetized RUclips video, consent is not needed. It's the same as National Geographic taking a video of a crowd. They did not stop everyone to get permission and they generally do not blur faces.

    I've watched thousands, probably tens of thousands of cop videos and First Amendment audits and such things on RUclips over the years. I'm always amazed at how people can approach the camera and say don't feel me! Unfortunately, that is the level of idiocy among much of the public! I am also amazed how many officers, in some of these videos, show up for a camera and then violate people's rights! This just tells me we are paying way too many totally ignorant public servants with our hard earned forcibly extorted tax dollars!

    Only a dope walks up to a camera then they say I don't want to be photographed. That always makes me laugh especially when it is an undercover cop. The female police officer did a marvelous job. For all, you male cops in the world watch what she does then do the same thing. She seems to be good police and does good police work. I'll bet we will never see her in the headlines for being a thug. Law enforcement needs many more like her.

    NO CONSENT REQUIRED TO USE HIS IMAGE. One thing that causes confusion is the concept of requiring releases to use a photograph for a “commercial” purpose. A lot of people (understandably) take this to mean photographs taken to make money for someone. However, in this context, commercial really means something more along the lines of for explicit advertising or marketing purposes, e.g. the photo will be used in an advertisement. Most other uses are considered editorial, even if it is some supermarket tabloid. The photos still, at least in theory, need to be taken in a place where there is no expectation of privacy i.e. public venues.
    Generally, courts have held that while in a public area that is viewable by third parties, there is no reasonable expectation of privacy. “There is no law in the US that prohibits making video recordings of people in a public space without their consent. In addition, if the purpose (commercial or otherwise) is in the nature of journalism, the First Amendment kicks in and overrides the personality issue. This is why paparazzi may take photographs of famous people, even without their consent: the photographs are of journalistic merit and thus may be used, even commercially, without the consent of those photographed. Anything shot in public is free to use for editorial or artistic use. And anyone newsworthy is editorial.
    There are some limited exceptions, but in general, a photographer can use any photo they take on their website, in an art gallery, or sell prints of that image as a work of art without a model release. You can resell it, you just can not use it to promote a product. Anything shot in public is free to use for editorial or artistic use. And anyone newsworthy is editorial. In the United States, photographs that are taken for editorial use in a public place generally enjoy Constitutional protection under the right of free speech. Even though the laws vary from state to state, all privacy law must permit uses that are protected by the First Amendment of the U.S. Constitution-freedom of press and freedom of expression.       The major networks normally have people sign a release form when filming for movies, shows and documentaries. They do it so not to get sued for using people's image for profit making. True it is legal to film in public but many have sued and some have even won if they could prove they didn't give that kind of permission and they made tons of money off my image. I think they confuse that because of the "I heard it on TV mentality". Two different courts to worry about. You can do everything legally but still get sued.

      lets also not forget that if i sell a photo to a company and that company uses it for commercial purposes...
      that company broke the law and not I, the photographer, who took the photo.
      they accepted responsibility when they purchased my art.
      had that one thrown at me and i just laughed and said
      "i didnt use it commercially, so youll have to find the company who purchased my art."

    It always amazes me when people like that last guy are so confident that you need permission to record someone and put them on the internet. How do they think paparazzi or news crews get away with doing it without permission? How about video recording your kids at disneyland (on private property btw) and getting hundreds of people in the background and you can put that on the internet? And police bodycams are also public domain and their interactions with private citizens can be put on the internet.

      My point in saying what I said or what I commented, was that at times law-enforcement really do have to take the bull by the horns. I will admit that the vast majority of them believe themselves to be the muscle arm of the state and that’s all, and that is very very unfortunate, as they are supposed to be out there defending our rights which is the law. But for someone her size and many officers are even smaller than her to try to take down someone who’s over 6 feet tall and weighs over 200 pounds is a laugh. I’m 59 and weigh 175 and spent 21 years in law enforcement. And I can tell you unequivocally that people who are do not measure up physically should not be in that position. They are going to get themselves hurt, and others hurt also because they are not qualified physically to do the job. I freely admit, and I saw this this morning when I was driving through the town I live in as I am retired, a lawn Forssman officer who if you were to take his unit his wrinkled excuse me his wrinkled uniform off of him and put dirty jeans and a dirty T-shirt on him he would look like a transient. He had long hair and a beard and he looks so unprofessional it was unbelievable. How sheriffs allow that I will never know or police chiefs I will never know. It’s very very sad to see police officers who not only act like transients or homeless people but look like them also.

      So many times I see these audits and the female officers who come out are about 5 feet tall and look like they barely weigh more than a hundred pounds. Even as a woman, I think that there should be a height and weight requirement for field officers, but if they did that, women would be screaming “sexism”. I feel that the height/weight requirement should apply to men as well. You don’t convey authority if you look like a 16-year-old boy!
