      Mine unfair dismissal email accusing me of misconduct came with a £6000 gesture of goodwill payment . At first I thought how kind of them but after speaking to people I realise is was hush money to stop me from realising it was an unfair dismissal with NO dismissal process followed or appeal opportunity given and I was not present at any dismissal proceeding nor was I invited . That’s when I realised what the £6000 was for ! To stop me from going to ACAS . I have now requested a DSAR from my employer and applied for Early conciliation 🙏 I am terrified as this is a massive corporate company with plenty of legal resources and I am pretty sure the bully tactics will be used 😢😢

    This is exactly what my employers lawyer is doing with me. Cost warning letter. However, they just sent me their defence bundle, statutory defence of course. It was so weak, 7 year old training certificates, employees inductions signed at the bottom with a line drawn though 30 odd sub headings. So I my write to them about a strike out.

    After I amended my cma just before my prelim due to doing my list of issues poorly. The employer solicitor encouraged me to either email my list of issues correctly or bring it up in the prelim. When the prelim was pushed back a few months, the employers solicitor read my amended issues and said I did it too late, but I know only the judge can decide. They then offered me a small settlement in the same email instead but said it was not based on the fact my case held any merit. I am not as interested in the money. This was for unfair dismissal. I have my prelim in September.

      @@phyllisb-chronicles3358 postponed again until March. Because I'm on holiday. I gave them a revised settlement. Waiting for their solicitor to respond.

      @lawofthesun I did take a settlement if 10k out of court in the end. They offered 3k In the beginning but I pushed them to 10k as solicitor fees would cost them up to 12k either way.

    You forgot the 3rd option that employers try, they offer to write you a big cheque if you agree to drop the case.

    I’ve just asked acas to start mediation for me my work won’t me to relocate but the buses won’t get me there on time they won’t me to cycle 160miles in 5 days and the last one I refused to except a lift of a work colleague which I didn’t I said I should not have to rely on people when they can be I’ll or on holiday or even leave so any option I will lose my job

    Really helpful thanks, I’m in the process of a whistleblowing/ unfair dismissal claim. On my online HM courts & tribunals account it shows my previous employers haven’t responded yet by the due date, will this make a difference?

    I missed the tribunal deadline by less than a month, But I put in a grievance and was waiting for my employer, the second thing is I didn't know there was a time limit, I have depression and anxiety issues and am currently on medication, is there anything to help- Valla?

    Does the tribunal award costs for the employee?

      They can. You typically have to apply for this and it's up to the Judge's discretion if it'll be accepted.
