    To some extent this is true, but if they use an HR consultant like Peninsula and have followed their advice, and have insurance, they know they are not really in a financial position. My view is that that kind of cover just encourages bad behaviour by employers.

    Remember also, the time limit for bringing an ET claim is only paused during the conciliation process, once ACAS issues a certificate concluding the Early Conciliation process, you usually have to make a claim to the Employment Tribunal within one month of the certificates issue date. If you miss this, ie you file after four weeks of being issued your Early Conciliation certificate, your employer may try to argue your claim is 'out of time' and should be 'struck out' (dismissed). The tribunal can extend time where it is 'just and editable' to do so, but that is something you would likely need to convince the judge of.

    Can you do constructive dismissal if acas conciliation fails?
    Or do yoy need to do it before?

      If early conciliation fails, you can file a claim to the Tribunal. It's not really possible to do it the other way around!

    What happens if you are going through the grievance policy but they are dragging their feet even though they haven't heard your appeal

      You need to watch very closely your timings.
      Your employer might make you wait long time for your appeal and if this waiting is stressful for you - say so to them.
      Talk to ACAS about it⚖️
      Meanwhile however do not miss your ET 1 deadline to file your complaint in ET⚖️
