      The courts award custody of the kids to the mother 98% of the time, so I doubt the kids can stay with him. The courts would tell him no.

    Great call, all young men out there. Listen to it a couple of times. The system will expect you to do stuff like this. You heard Rachel said “just trying to be a good dad“ cosigning a mortgage with your ex-wife that can’t pay it is not being a good dad it’s being a dumb man. Don’t do it.

      They act like their “rules” matter, but they don’t. I wasn’t allowed to file my taxes the last year of my separation. Because my ex stamped his feet and got the lawyers to agree we would wait until after the decree. In the mean time, one of my grown kids lied on her taxes and claimed head of household when I was supporting her . iRS was like oh well she lied and we accepted it so you owe us. Horrible system.

      I elected to automatically pay my state taxes in Louisiana- set up the EFT and gave the LA dept of revenue permission to pull the taxes whenever they wanted. They pulled them in full from my acct 2 days prior to filing deadline.
      6 months later I received a letter saying that I “didn’t pay on time” with 32% interest and penalty fees added by the Dept of revenue. I called and asked why… the agent told me (and I quote) “well, early is not on time, so it will be easier to just pay the fee and move on otherwise we will have to open an investigation and continue to accumulate fees and interest”.
      In any other scenario this would be fraud and extortion but since it’s the completely immoral and unaccountable govt employees involved, no justice will be done. Thank God it was only around $1500 all in, but it just felt evil. The government has become evil.

    Ugh, what’s the point of getting divorced if you’re going to have your finances entangled? If she was so concerned about having a nice house to raise the kids in, she should’ve stayed married. Great advice from Dave. Good call.

      I never received any child support but bought my own house while fully supporting my two children to adulthood. As a single mom, I don’t understand anyone who does not pay their own way. Responsibility for one’s own actions is a requirement. That way we have no one to blame but ourselves.

    No. Just no. If I had an ex with this problem, I would take the kids full time until she gets her business in order. Never would I cosign a mortgage with her, especially if she's an ex. She's an ex for a reason. If she gets foreclosed on, then she gets foreclosed on. At least I'll give the kids a place to stay for the moment until she fixes her own problems or the kids age out, whichever comes first. This is assuming I got divorced in the first place.

      Only Dave simp Ramsey advises men to pay stupid taxes to women in a case like this. No, he should play hardball and go for full custody in court and get the family court to remove her off the home with a court order. The lender can remove her off title with a court order.

    The guy who used to do my house repairs had a history of cosigning loans for friends. Every so often someone would quit making their payments and he'd have to start paying off the loan of someone he often didn't even know anymore.

    If you are on child support then there is no room for any type of sympathy from my part, even if you are the mother of my children. The fact that you had to put me on child support rather than us working it out tells me everything I need to know.

      On child support does not mean he wasn’t voluntarily paying. One of my friends had money straight from his check to his ex. His lawyer even suggested it. It just means it was part of the divorce process

    No fault divorce and the courts are responsible for this. A woman should not be getting any kind of custody right if they can't afford to pay their bills. Only a simp co signs for a house that his ex wife is going to get smashed in while getting child support payments.

    For anyone else who find themselves in the callers situation and wants to help because of the children.....what he should have done is buy the house outright, then charge his wife rent. I'd assume he could deduct the rent from his child support payments, but if not, then even if she neglected to pay rent, at least he is only out the rent, and not out the entire house.

    A divorce can leave it for her to pay all if you leave her the house.
    Just pay child support. Give her the house that she has to continue paying making payments. She has to work.

      Family courts are not finance people; mom gets the kids 90% of the time… they make sure dad covers any shortfall.

    He is financially able to take care of his kids. He needs to offer to stop the child support, help her sell the house, and give her $20k to do it. His other option is to push the IRS to sell the property, but that can be difficult.

      No he did not say that. The lien is 100k. Dave says sell the house and use proceeds to pay the lien. Not sure what the 10 or 20k would be for, honestly.

    When my son got divorced, the judge said they needed to sell their home that they bought together and then each buy or rent separately what they can each afford separate from each other.

      He's a softie and wanted the kids to live in a nice house. Would have been better if he'd bought the house, she made payments to him and he could later transfer house to her if she'd kept up. I hope he doesn't help her again. They're divorced after all.

      @@genxx2724 The custodial parent needs to be able to provide for the kids. Part of why I got my daughter in the custody battle was because her birthmom wasn't able to provide for her financially.

      @@Astro95Media No. The non-custodial parent contributes a greater proportion of support. There are even cases where a very wealthy parent has to pay a vast amount of child support so the poorer parent can have a better home, car, etc. to lessen the difference between the homes so the children are not affected.
