I was bullied like crazy at a job until I had a mental breakdown and got hospitalized and then they fired me for missing work. Of course, nothing came of it, I just had to move on with my life, I don't have the money for lawyers or any social influence to work with. So this is very satisfying seeing a big company actually have some sort of comeuppance for a very similar situation. I wish more people had access to the resources to fight back against abuse received within companies
There are free resources and many lawyers wiling to not take fees until after the case. At least in US, CA, and UK. Because cases like this are extremely cut and dry it is an easy payday for the lawyers.

The official reason I was let go from HR, after I put in a complaint, was "Poor performance." And that was what they stuck with. From an outside perspective it looks like I'm just a disgruntled employee trying to get back at my employers since my evidence amounts to, "They totally did it, I swear." The only other piece of good evidence I had was the three people prior to me in the same position quit or were let go for the same reason, all four of us within a year. They put a few of their remaining talents on a stream to smear her and more than likely broke their own NDA with her in doing so. And then go radio silent until the whole thing blows over. Ideally you would also pay the talent a sufficient severance package in order to buy her silence with an NDA and non-disparagement agreement. But failing that, the best option is to make all communication as non-offensive and diplomatic as possible. Do not justify your actions. Do not attack the other party. You are a corporation - nobody likes you. Don't give them a reason to hate you even more.

Ive never been into vtubers and only knew of Selen and the issue due to the hashtags spreading everywhere on twitter. I was recommended this video by the youtube algorithm and, out of curiosity about the situation, checked it out. Despite the lack of interest in vtubers you've gotten me to subscribe. You made it extremely easy to follow along for someone as casual as me, and your sheer enthusiasm in this video is incredibly infectious and makes you stand out over other controversy-based videos I've seen. Ive gotten to the point where I cant see those videos due to how (understandably) depressing they portray the situation but even extend it to how they present it in the video. You on the other hand showed a sort of love and investment in the topic that kept me hooked for the entire video and made me kind of sad the video was over. You did this while still making sure to not downplay the gravity of the situation due to your enthusiasm. It's been a very long time since a documentary-style vid made me feel that way. Youve even made 38 year old me consider looking at some vtubers in the future. You are amazing at what you do and as a new subscriber I now cant wait to see what you put out in the future

With the harsh firing of Zaion, Nijisanji showed themselves extremely unprofessional and willing to toss a talent under the bus to protect itself while ruining the talent's future, with things blown far too out of proportion by the company itself for behavior that would be considered standard across the board when compared to other talents. At that time the fanbase protected the company, which arguably could have had the inverse effect of putting pressure on existing talent as they could fear talking negatively of the company that people were simping for. In part this was reflected with Selen, as she clearly had mental issues that in part stemmed from a belief that the company trumped her in importance. And regarding that statement. Of course that's how it reads. They did it with Zaion and while some of the fanbase reacted negatively. The majority protected the company. This time around they expected much of the same. And honestly, since Dokibird recovered so quickly, they just might also come out the other side with much the same result. With a lot of fans of a lot of the other talents just pushing back because they would be too afraid that the company would be damaged and cause harm to their source of entertainment. And that's because like it or not the company does hold that audience captive and damage to the company would need to be indiscriminatory to be effective, which in turn means that noticeable damage to the company will by effect harm the livers.

BTW, regarding the “Japanese apostrophe”, it’s actually a “rich text font” style apostrophe that’s usually used in word processors, and by default Twitter apps use the simpler ASCII style apostrophes. So it’s basically a dead giveaway that a tweet was first written out in a document (probably so the corp management team could pass it around and groupthink it) and then copied and pasted into a desktop Twitter client after being approved.
While word processors are the most common way to end up with smart quotes, doesn’t the default Apple keyboard on iOS insert them everywhere as well? I’m on an Android phone and have to long-press quotes and apostrophes to get those on a third-party keyboard app, the stock Samsung one doesn’t even have them.
great video but I feel the need to point out that dokibird is probably not doing as well as your video suggests - as someone with depression that has been on suicide watch I know very intimately how using humor can help someone cope and allow others to brush things off. For example an employee that's Jr in both age and company seniority even questioning their boss is almost unthinkable. As an outsider observing from the sidelines, I feel like your video needs to have subtitles in Japanese and then shared to the JP Niji community. It's equal parts sad and hilarious how some of these JP comments keep saying "you don't know the whole truth, just let the courts handle it, don't speak like it's already decided" when in truth, they also don't understand just how much you EN guys know and discovered.
They just don't know English, so they are more biased by nijisanji's explanation. It's also possible that viewers from Japan don't care about EN Branch at all, and defend the company at all costs.
In Japanese Idol Culture, this kind of fighting back against company abuse is unthinkable, simply accepting it is culturally expected. Seems to me that the JP fans are more willing to "trust the system", which in this case seems insane. Might be some degree of "why is this crazy foreigner acting so unreasonably to perfectly normal behaviour", though I admit that I don't know if that's actually true, simply being biased by Niji's explanations is also likely.

I never watch Vtubbers and I knew NOTHING of this happened, but this video had me hooked and interested the whole way and I feel it explained everything very well, so great job on making it!
I'm a day 1 Dragoon and I can't understate how important Selen was not only to viewers of Nijisanji EN, but VTubers as a whole. The reason this blew up so hard in AnyColor's face was not only did they do a horrendous job handling this incident, their mismanagement had already been reaching a boiling point with fans with the same treatment they gave Zaion Lanza and the loss of 2 other linchpin members: Nina Kosaka and Pomu Rainpuff. So what do they do next? Punish their most widely beloved member when her only crime was working hard for them. She made all of her own opportunities without their help, even being recognized and appreciated by pro players and EA staff. She sacrificed SO much for her fans and Nijisanji. $200,000 of last year alone, and they threw it all in the trash with her VODs. "Nijibites" animated shorts, Wrestlsanji, Puyo Puyo Tetris tournament, her original song "Fly High", Nijisanji Minecraft mod, VR Chat models and maps, an original game, TSB Customs, the Lofi covers, membership wallpapers, several themed assets & milestone streams, her last amazing birthday concert and of course the tragically ironic Last Cup of Coffee cover. Not only does that show they had absolutely no appreciation or respect for all she did, but the big kick in the teeth is they gagged her and _chose_ to do all this to her _knowing_ she was in a mentally dark place. All of her work and even her freaking life didn’t matter to them and that’s what pisses me off the most. It's become increasingly clear that AnyColor sees their talents as little more than cash cows and does not care enough to give them even the bare minimum level of support.
This is the insane the thing that worried me the worst was about her mental health. I hope Selen has unlimited support rn irl and online and that she is in a much better spot now. Corporations make me sick.

I know we're not exactly meant to openly talk about this but this actually highlights the SEVERE difference between AnyColor and Cover, as one of Cover Corp's English talents, Nanashi Mumei is a long time friend of Doki's, and when this happened Mumei basically dropped everything and went to support her friend who made an attempt on her life. Not only was Cover okay with this, they assisted in regards to explaining for why she suddenly stopped streaming for two months. Mumei covers this in one of her most recent streams, saying that if this were any other job she would have had to quit to do what she did, but thanks to her fans and understanding managers, she was able to do it, and also take more time away to deal with her own mental health. Imagine being an investor and seeing these two *wildly* different approaches to the same event. I know who I'd put my money into.

This is a very good comprehensive video. I will say, a lot of this happened because of a difference in Japanese and Western laws that NijiEN did not bother to accommodate for. Firstly, Japan is very strict with copyright, and you need a dense paper trail to get permission to do anything like play a video game, cover a song, etc. In most Western countries you can just reach out to the creator and get verbal approval, doesn’t even need to be written. In addition, gaming and song cover content are considered “transformative works”and therefore inherently do not violate copyright in most Western countries. NijiEN did not bother to learn about this cultural and legal difference, and therefore seems to have bullied Selen into doing things the Japanese way, which is way too slow a process to actually get things done efficiently in addition to not being necessary in the West. Second of all, it has been speculated that the “emergency contact” was not Selen’s family, but the hospital Selen was staying at. This is presumed due to Selen having no idea about being fired, meaning she did not have a liaison communicating with Niji on her behalf. THIS IS ILLEGAL IN CANADA AND THE UNITED STATES. Your employer is not allowed to contact the hospital you are staying at FOR ANY REASON other than to inquire if you are alive and wish you well. THAT’S IT. Anything more than that is a violation of medical privacy laws. It seems as though Niji tried to contact the hospital ask when Selen will be back and about the music video. Again, that is illegal where she is, and so hospital staff did not give them any info, and probably also politely but sternly told them to f- off. NijiEN thus decided to fire Selen. As you have probably guessed, things are different in Japan, and medical privacy laws there are less strict and do not protect the patient as well; in fact, an employer can practically chase down your ambulance to ask you when you’ll be back at work. So, again, NijiEN management did not actually bother to learn the laws of the countries they hire their talents from and did not handle the situation in a way that is respectful in the culture their talents are from. NijiEN’s reputation absolutely deserves to be ruined over this. International Business 101: make sure management is open-minded about their multicultural and multinational staff. Selen was a contract worker, which can make things difficult, but I sincerely hope she has grounds to sue. Violating medal privacy laws, if that is indeed what happened, is no joke.
I’m just gonna add my personal experience here: I work in Japan, and go to the hospital monthly for type 1 diabetes. At my previous job, my managers would call my doctor all the time to ask about my treatment, how it would affect my work, etc. As an American, it was definitely a culture shock at the time. Working for a “white” company now by my standards, so it’s a lot better now 😊

Small correction. HYTE pulled their support from Nijisanji AFTER stating the financial impact would be negligible. The lead architect of HYTE saw it and posted in HYTE's discord channel "TIL HYTE is negligible" shortly after that HYTE announced dropping Nijisanji. There were a few more merch collab partners that would also end support for Nijisanji in a sort of domino effect.
Hyte was the only collab partner to drop niji. All the other studios that made announcements made fan merch. So niji never lost any money from them but will lose merch presence at cons.
Unfortunately, I have to tell you that Hyte is negligible in terms of business partners. They are what you could consider an artisan niche product company. Compare that to a partnership with the national league of baseball in Japan, or Sega. Hyte is a parts product company for computers, a niche market. Hyte had a lot more to lose by continuing to partner with Nijisanji, while Nijisanji had little to lose if Hyte dropped the partnership, in effect this was a PR move from Hyte to survive. As for the fan based marketplaces, the reported revenue/profit wasn't even in the five digits. So that is a negligible impact by all metrics. Note, i say that as someone who has criticized Nijisanji and will continue to do so. But I am also very realistic. The pressure is good, but if it does not last and cause noticeable damage by the next quarterly result. In effect, you all would just be screaming at the void. If you want to make some real meaningful result. End membership, don't buy the goods, don't superchat other livers. Whether it's words of worries, or encouragement, or grievances. Anything that puts money into Nijisanji recovers what losses they would incur from Selen's termination, because the livers are their direct sources of income, and in turn it means that the only way you can actually cause non-negligible financial impact on Nijisanji is to harm all the livers. And that is the unfortunate truth as well from how they operate. For the livers to get better conditions. You will first have to cause them all to suffer financially. And even then, supposedly based on reports, the investment in Niji EN is already fairly low, which has a lot of unfortunate implications. Also you need to consider how easily they dismissed the IN, ID and KR branches. It's hard to tell how much damage is the right amount of damage, and at what difference they would simply consider destroying the EN branch as a whole and restructure it all within Njijisanji JP.
UPDATE: Nijisanji got some of it's livers to do a 15 minutes long "live" statement (it was probably pre-recorded) where THOSE LIVERS OPENLY ADMIT TO HAVE READ CONFIDENTIAL LEGAL DOCUMENTS about Dokibird's case against Nijisanji. Not only that, but they also namedroped some of the talents that are in this document, so, in other words, not only they partialy revealy contents of that confidential legal document openly to the public, but they also further added fuel to the fire by giving the massive army of _slightly upset_ people more fuel for speculation. There are many other details I could add here, but honestly it would be better if you guys watched it yourselves, or if you don't have a lot of context to fully understand it, I suggest watch someone's video covering it end to end while commenting on it (my recomendation is Depressed Nousagi's video, he was quite more nuanced on his views than any other that I saw)
I'm not even into vtubers (though I was one of the first like 12k at her return stream before it began) and this has completely immersed me. It's like a live trainwreck, it's so terrible yet I can't look away.
The company is now worth $1.3 Billion. Down 10% relative to Cover Corp since 2/5/2024. 18% loss since 2/5/2024. They are dragging the whole V-tuber industry down with them. If I was in Holo-Live (Cover Corp), I'd be making clear statements that we are nothing like AnyColor. Not just to avoid bad press. Cannibalize their market-share. Prove your talent are being properly cared for. It doesn't matter if your publicity stunt costs $100 Million, you can easily make that back cannibalizing AnyColor.

You will need to make a sequel video. Nijisanji broke the promise of privacy their legal branch signed with doki and her lawyer by sharing a legal document with medical privacy information to livers and sent them to do a comment stream. Doki and her lawyer had prepared for this possibility though so that's gonna be worse for them now. Also, CEO made a video apology, that pretty much was a non-apology. On top of the language being straight out of ChatGPT (or at least feels like it), there's a tradition in Japan regarding apologies : the salute at the beginning. The more salutes you make, and the longer you stay down with each, the stronger you feel remorseful and feel the situation is serious. The CEO saluted once, for 2-3 seconds, which is short. HE STILL DOESN'T GIVE A DAMN !
Doesn't matter if he wants to live under the illusion that it doesn't affect him. It objectively does. If prideful Japanese investors and fans want to wank some old man's ego off, it's their money to throw away. I don't care, and you shouldn't either. You can't convince this kind of people of anything, so let it be. What matters is that Nijisanji failed at forcing someone to work to get them, at best, a few hundred thousand dollars, and by insisting on it, lost more than 150 million bucks in stock price. Best case scenario, they recover from most of the damage, but in the meanwhile the returns that could have been earned from the "lost" money won't arrive, meaning that they have lost the 150 million plus interest in the following years... Forever. Worst case scenario, this incident will never be forgotten, and while people may eventually start investing enough to make Nijisanji's stock prices start rising again, what happened now will always turn down part of the potential investors. We are talking about maybe more than a billion dollars in losses in the next 10-20 years. Sure, by then, who knows how many more billions Njisanji may be worth? But what else could be done? Force the company to shut down and let thousands unemployed? Nah. Moreover, you can't condemn a robber to death just because they think that prison is "too easy". If Nijisanji thinks that maintaining their conduct was worth losing so much money over, then so be it. As for who harassed Doki/Selen and who is behind impersonating her as a PRIVATE citizen of her country as well as disclose private information with third parties, those shall be judged and may be condemned to prison, but knowing how corporations work, I doubt that the CEO of Nijisanji had any direct involvement, even though he most likely supports some of this behavior, seeing by his lack of regret t. what happened to Doki/Selen.

They made it so much worse in the last two days. The stream Elira, Vox, and Ike had where they "volunteered" to give Nijisanji's side was bad enough - but in it they revealed that they'd seen legal documents that were only supposed to be shared between Selen, her lawyers, and Nijisanji's lawyers. Which would be bad enough on it's on, associating those three Vtubers with the situation and putting them in the crosshairs of legal action. But then Nijisanji made it EVEN WORSE by announcing that they had not in fact broken any NDAs by showing that document to those Vtubers - that they were legally permitted to do so in order to investigate the situation properly on their side. The problem with that, however, is that by doing so - Nijisanji is implicating Elira, Vox, and Ike are the Vtubers responsible for Selen's harassment.
Someone has to be the scapegoat aka fall guy in this situation, might as well throw some more English VR tubers down the drain. Corporations suck, and I've never met a CEO that wasn't a peice of trash with little to no morals.
If one were to try to interpret their statement favorable for Elira, Vox, and Ike it could be something along the lines of "hey these documents have the accusations against [third party], have you seen that happen yourself?". Its a HR/PR/legal disaster either way
What also didn’t help was the repeated controversies BEFORE this one. An EN concert in Japan that got canceled pretty much last minute for “covid” when the had just recently done a JP concert. All the performing talents had spent months prepping and had even traveled to Japan when the notice the concert was canceled was released. Multiple talents passive aggressively called them out on the “covid” excuse. Then the folding of other non-JP branches either into JP or just wiped entirely. An example being NijiID, a branch that has been losing talents since the folding into the JP branch due to mismanagement. Multiple EN talents leaving the company, joining VShojo, and then on stream saying how surprised they were at how accommodating the management was. The Zion termination, in which they were all too willing to make a list of reason for her contract termination, which Zion on her personal account made a twitlonger with multiple counterpoints and revealing things like bullying and recieving 1-3% of merch revenue. And with more controversies, the more Zion is proven right. So the Selen/Doki situation is essentially the boiling point for many fans of NijiEN.
To make it even worse, I heard ID management is doing well when they have mixed staff aka Indonesian and Japanese. Apparently after the merging all staffs became Japanese.
For those who don't get "graduation vs termination", think of it like in the military where you have a "honorable discharge" and "dishonorable discharge".

I avoid VTuber news videos because I actually do dislike drama because it usually makes me feel helpless. Not completely sure why i clicked on this one, but that was such a well made and researched video that I'm very glad I did. I do think it was a final straw situation, as before all of this happened, their mismanagement started to become noticable by a lot of fans. The treatment they gave Zaion (who spoke about their treatment later), and the graduation of two other showrunners, Nina and Pomu, people naturally started to speculate what's happening. So, for them to decide Selen is in the wrong and terminate her over a music video and an attempt is just the **absolute, purest disrespect I've ever seen from a company.** Selen has wished nothing but the best for her community, and it really did show in her personality, in her actions, in her projects. Least now we know NIJISANJI isn't the corporation we thought it was. I'm just afraid that the internal bullying is currently happening to other livers if it was already happening to Selen. Though, I'd be worried about answering the shareholders after the JP 3-day holiday if I were them. After all, they did lose 11% of their company in just a few days

For the astrophe part, some 4chan and users took notice about it and they suspected of them stealth suspension and it was management doing it. This isn't the first time Niji has done that as there was another person by the name of Zaion (now Sayu) got stealth suspended over talking to another manager.
Does the Twitter API not expose the name of the app that was used to make the tweet anymore? That would be a more reliable basis for assumptions about whether the tweet was done by management on behalf of the talent.
The framing of the apostrophe thing is just blatantly not true. It's not a "Western" vs "Japanese" apostrophe it's different for various devices, whether you're mobile vs desktop etc. You can look at people comparing other talent's apostrophe's and you'll see both used in different tweets.
Yep. On iOS, the default apostrophe is this slanted ‘ or so-called Japanese one in this video, unless you turn off the ‘Smart Punctuation’ keyboard setting (which is on by default), and I had it on here to illustrate this point. With it off, then it's now this apostrophe, which is the same as standard keyboards'. (I'm not familiar with Android.)

Kurosanji is in the stock market, and the fluctuarion blip in the tradings was a bit too visible, so they had to task one of their Financial experts to give a look at what news and events happened recently to cause such a blip. It was profit focused and it painted it as merely a momentary low. Though perhaps if enough Public pressure keeps happening (Such as a MASSIVE loss of audience and SCs/Memberships/Merchandise sales) and it becomes visible for february's financial reports.... The crack will form and deepend the downwards blip, opening the chance to force a 3+ month negative in the stocks

Not even a Selen fan, barely heard of her until this incident but you know what they about a person's true nature being revealed when pushed to their breaking point? The fact that Selen still looked out for her fans' wellbeing and wanted to leave the company on relatively amicable terms despite the *HARASSMENT TO THE POINT OF NEAR-SUICIDE* means she really was a good person... Good job, Niji, they not only threw away one of the best people they could've asked for, but shooting themselves in the foot is an understatement. This is the legal equivalent of an Olympic dive straight into a woodchipper.
You may need a part 2 for the response from the CEO, and the response video on Elira's channel. It is also a question whether Niji broke confidentiality by showing a internal legal document the livers referenced reading thoroughly to make the response.

Being a teacher at law school in the past years must be interesting cause celebrities, content creators and companies are basically jumping over each other to see who can be the best example of what NOT to do.
I was bullied like crazy at a job until I had a mental breakdown and got hospitalized and then they fired me for missing work. Of course, nothing came of it, I just had to move on with my life, I don't have the money for lawyers or any social influence to work with. So this is very satisfying seeing a big company actually have some sort of comeuppance for a very similar situation. I wish more people had access to the resources to fight back against abuse received within companies
There are free resources and many lawyers wiling to not take fees until after the case. At least in US, CA, and UK. Because cases like this are extremely cut and dry it is an easy payday for the lawyers.

You are a corporation - nobody likes you. Don't give them a reason to hate you even more.

Ive never been into vtubers and only knew of Selen and the issue due to the hashtags spreading everywhere on twitter. I was recommended this video by the youtube algorithm and, out of curiosity about the situation, checked it out.
Despite the lack of interest in vtubers you've gotten me to subscribe. You made it extremely easy to follow along for someone as casual as me, and your sheer enthusiasm in this video is incredibly infectious and makes you stand out over other controversy-based videos I've seen.
Ive gotten to the point where I cant see those videos due to how (understandably) depressing they portray the situation but even extend it to how they present it in the video. You on the other hand showed a sort of love and investment in the topic that kept me hooked for the entire video and made me kind of sad the video was over. With the harsh firing of Zaion, Nijisanji showed themselves extremely unprofessional and willing to toss a talent under the bus to protect itself while ruining the talent's future, with things blown far too out of proportion by the company itself for behavior that would be considered standard across the board when compared to other talents. At that time the fanbase protected the company, which arguably could have had the inverse effect of putting pressure on existing talent as they could fear talking negatively of the company that people were simping for. In part this was reflected with Selen, as she clearly had mental issues that in part stemmed from a belief that the company trumped her in importance.
And regarding that statement. Of course that's how it reads. They did it with Zaion and while some of the fanbase reacted negatively. The majority protected the company. This time around they expected much of the same. And honestly, since Dokibird recovered so quickly, they just might also come out the other side with much the same result. With a lot of fans of a lot of the other talents just pushing back because they would be too afraid that the company would be damaged and cause harm to their source of entertainment. And that's because like it or not the company does hold that audience captive and damage to the company would need to be indiscriminatory to be effective, which in turn means that noticeable damage to the company will by effect harm the livers.

As an outsider observing from the sidelines, I feel like your video needs to have subtitles in Japanese and then shared to the JP Niji community. It's equal parts sad and hilarious how some of these JP comments keep saying "you don't know the whole truth, just let the courts handle it, don't speak like it's already decided" when in truth, they also don't understand just how much you EN guys know and discovered.
They just don't know English, so they are more biased by nijisanji's explanation.
It's also possible that viewers from Japan don't care about EN Branch at all, and defend the company at all costs.
In Japanese Idol Culture, this kind of fighting back against company abuse is unthinkable, simply accepting it is culturally expected. I'm a day 1 Dragoon and I can't understate how important Selen was not only to viewers of Nijisanji EN, but VTubers as a whole. The reason this blew up so hard in AnyColor's face was not only did they do a horrendous job handling this incident, their mismanagement had already been reaching a boiling point with fans with the same treatment they gave Zaion Lanza and the loss of 2 other linchpin members: Nina Kosaka and Pomu Rainpuff. So what do they do next? Punish their most widely beloved member when her only crime was working hard for them. She made all of her own opportunities without their help, even being recognized and appreciated by pro players and EA staff.
She sacrificed SO much for her fans and Nijisanji. $200,000 of last year alone, and they threw it all in the trash with her VODs. Not only does that show they had absolutely no appreciation or respect for all she did, but the big kick in the teeth is they gagged her and _chose_ to do all this to her _knowing_ she was in a mentally dark place. All of her work and even her freaking life didn’t matter to them and that’s what pisses me off the most. It's become increasingly clear that AnyColor sees their talents as little more than cash cows and does not care enough to give them even the bare minimum level of support.
This is the insane the thing that worried me the worst was about her mental health. I hope Selen has unlimited support rn irl and online and that she is in a much better spot now. Corporations make me sick.

Even just acknowledging that there's an OkaKoro relationship behind the scenes, which as far as I'm aware spits in the face of Japanese culture and comes close to openly defying JP law? That just shows how much they're truly cognizant of what makes their company work. There's been stumbles, there's been hiccups, but as long as they don't do anything like what Anycolor pulled I think people will be able to forgive them.

I know we're not exactly meant to openly talk about this but this actually highlights the SEVERE difference between AnyColor and Cover, as one of Cover Corp's English talents, Nanashi Mumei is a long time friend of Doki's, and when this happened Mumei basically dropped everything and went to support her friend who made an attempt on her life. Not only was Cover okay with this, they assisted in regards to explaining for why she suddenly stopped streaming for two months. Mumei covers this in one of her most recent streams, saying that if this were any other job she would have had to quit to do what she did, but thanks to her fans and understanding managers, she was able to do it, and also take more time away to deal with her own mental health. Imagine being an investor and seeing these two *wildly* different approaches to the same event. I know who I'd put my money into.

This is a very good comprehensive video. I will say, a lot of this happened because of a difference in Japanese and Western laws that NijiEN did not bother to accommodate for.
Firstly, Japan is very strict with copyright, and you need a dense paper trail to get permission to do anything like play a video game, cover a song, etc. In most Western countries you can just reach out to the creator and get verbal approval, doesn’t even need to be written. In addition, gaming and song cover content are considered “transformative works”and therefore inherently do not violate copyright in most Western countries. NijiEN did not bother to learn about this cultural and legal difference, and therefore seems to have bullied Selen into doing things the Japanese way, which is way too slow a process to actually get things done efficiently in addition to not being necessary in the West.
Second of all, it has been speculated that the “emergency contact” was not Selen’s family, but the hospital Selen was staying at. This is presumed due to Selen having no idea about being fired, meaning she did not have a liaison communicating with Niji on her behalf. THIS IS ILLEGAL IN CANADA AND THE UNITED STATES. Your employer is not allowed to contact the hospital you are staying at FOR ANY REASON other than to inquire if you are alive and wish you well. THAT’S IT. Anything more than that is a violation of medical privacy laws. It seems as though Niji tried to contact the hospital ask when Selen will be back and about the music video. Again, that is illegal where she is, and so hospital staff did not give them any info, and probably also politely but sternly told them to f- off. NijiEN thus decided to fire Selen. As you have probably guessed, things are different in Japan, and medical privacy laws there are less strict and do not protect the patient as well; in fact, an employer can practically chase down your ambulance to ask you when you’ll be back at work. So, again, NijiEN management did not actually bother to learn the laws of the countries they hire their talents from and did not handle the situation in a way that is respectful in the culture their talents are from.
NijiEN’s reputation absolutely deserves to be ruined over this. International Business 101: make sure management is open-minded about their multicultural and multinational staff. Selen was a contract worker, which can make things difficult, but I sincerely hope she has grounds to sue. Violating medal privacy laws, if that is indeed what happened, is no joke.
I’m just gonna add my personal experience here: I work in Japan, and go to the hospital monthly for type 1 diabetes. At my previous job, my managers would call my doctor all the time to ask about my treatment, how it would affect my work, etc. As an American, it was definitely a culture shock at the time.
Working for a “white” company now by my standards, so it’s a lot better now 😊

Small correction. HYTE pulled their support from Nijisanji AFTER stating the financial impact would be negligible. The lead architect of HYTE saw it and posted in HYTE's discord channel "TIL HYTE is negligible" shortly after that HYTE announced dropping Nijisanji. There were a few more merch collab partners that would also end support for Nijisanji in a sort of domino effect.
Wasn't the CEO, but the lead architect that posted that. But still, yeah that was pretty good.

Hyte was the only collab partner to drop niji. All the other studios that made announcements made fan merch. So niji never lost any money from them but will lose merch presence at cons.
Unfortunately, I have to tell you that Hyte is negligible in terms of business partners. They are what you could consider an artisan niche product company. Compare that to a partnership with the national league of baseball in Japan, or Sega. Hyte is a parts product company for computers, a niche market. Hyte had a lot more to lose by continuing to partner with Nijisanji, while Nijisanji had little to lose if Hyte dropped the partnership, in effect this was a PR move from Hyte to survive.
As for the fan based marketplaces, the reported revenue/profit wasn't even in the five digits. So that is a negligible impact by all metrics. Note, i say that as someone who has criticized Nijisanji and will continue to do so. But I am also very realistic. The pressure is good, but if it does not last and cause noticeable damage by the next quarterly result. In effect, you all would just be screaming at the void.
If you want to make some real meaningful result. End membership, don't buy the goods, don't superchat other livers. Whether it's words of worries, or encouragement, or grievances. Anything that puts money into Nijisanji recovers what losses they would incur from Selen's termination, because the livers are their direct sources of income, and in turn it means that the only way you can actually cause non-negligible financial impact on Nijisanji is to harm all the livers.
And that is the unfortunate truth as well from how they operate. For the livers to get better conditions. You will first have to cause them all to suffer financially. And even then, supposedly based on reports, the investment in Niji EN is already fairly low, which has a lot of unfortunate implications. Also you need to consider how easily they dismissed the IN, ID and KR branches. It's hard to tell how much damage is the right amount of damage, and at what difference they would simply consider destroying the EN branch as a whole and restructure it all within Njijisanji JP.
UPDATE: Nijisanji got some of it's livers to do a 15 minutes long "live" statement (it was probably pre-recorded) where THOSE LIVERS OPENLY ADMIT TO HAVE READ CONFIDENTIAL LEGAL DOCUMENTS about Dokibird's case against Nijisanji.
Not only that, but they also namedroped some of the talents that are in this document, so, in other words, not only they partialy revealy contents of that confidential legal document openly to the public, but they also further added fuel to the fire by giving the massive army of _slightly upset_ people more fuel for speculation.
There are many other details I could add here, but honestly it would be better if you guys watched it yourselves, or if you don't have a lot of context to fully understand it, I suggest watch someone's video covering it end to end while commenting on it (my recomendation is Depressed Nousagi's video, he was quite more nuanced on his views than any other that I saw)

They are dragging the whole V-tuber industry down with them. If I was in Holo-Live (Cover Corp), I'd be making clear statements that we are nothing like AnyColor. Not just to avoid bad press. Cannibalize their market-share. Prove your talent are being properly cared for. It doesn't matter if your publicity stunt costs $100 Million, you can easily make that back cannibalizing AnyColor.

You will need to make a sequel video. Nijisanji broke the promise of privacy their legal branch signed with doki and her lawyer by sharing a legal document with medical privacy information to livers and sent them to do a comment stream. Doki and her lawyer had prepared for this possibility though so that's gonna be worse for them now.
Also, CEO made a video apology, that pretty much was a non-apology. On top of the language being straight out of ChatGPT (or at least feels like it), there's a tradition in Japan regarding apologies : the salute at the beginning. The more salutes you make, and the longer you stay down with each, the stronger you feel remorseful and feel the situation is serious. The CEO saluted once, for 2-3 seconds, which is short. HE STILL DOESN'T GIVE A DAMN !

Best case scenario, they recover from most of the damage, but in the meanwhile the returns that could have been earned from the "lost" money won't arrive, meaning that they have lost the 150 million plus interest in the following years... Forever.
Worst case scenario, this incident will never be forgotten, and while people may eventually start investing enough to make Nijisanji's stock prices start rising again, what happened now will always turn down part of the potential investors.
We are talking about maybe more than a billion dollars in losses in the next 10-20 years.
Sure, by then, who knows how many more billions Njisanji may be worth? But what else could be done? Force the company to shut down and let thousands unemployed? Nah.
Moreover, you can't condemn a robber to death just because they think that prison is "too easy".
If Nijisanji thinks that maintaining their conduct was worth losing so much money over, then so be it.

The stream Elira, Vox, and Ike had where they "volunteered" to give Nijisanji's side was bad enough - but in it they revealed that they'd seen legal documents that were only supposed to be shared between Selen, her lawyers, and Nijisanji's lawyers. Which would be bad enough on it's on, associating those three Vtubers with the situation and putting them in the crosshairs of legal action.
But then Nijisanji made it EVEN WORSE by announcing that they had not in fact broken any NDAs by showing that document to those Vtubers - that they were legally permitted to do so in order to investigate the situation properly on their side.
The problem with that, however, is that by doing so - Nijisanji is implicating Elira, Vox, and Ike are the Vtubers responsible for Selen's harassment.
Even if they weren't?! Holy crap, that's bad!

What also didn’t help was the repeated controversies BEFORE this one. An EN concert in Japan that got canceled pretty much last minute for “covid” when the had just recently done a JP concert. All the performing talents had spent months prepping and had even traveled to Japan when the notice the concert was canceled was released. Multiple talents passive aggressively called them out on the “covid” excuse. Then the folding of other non-JP branches either into JP or just wiped entirely. An example being NijiID, a branch that has been losing talents since the folding into the JP branch due to mismanagement. Multiple EN talents leaving the company, joining VShojo, and then on stream saying how surprised they were at how accommodating the management was. The Zion termination, in which they were all too willing to make a list of reason for her contract termination, which Zion on her personal account made a twitlonger with multiple counterpoints and revealing things like bullying and recieving 1-3% of merch revenue. And with more controversies, the more Zion is proven right. So the Selen/Doki situation is essentially the boiling point for many fans of NijiEN.
To make it even worse, I heard ID management is doing well when they have mixed staff aka Indonesian and Japanese. Apparently after the merging all staffs became Japanese.

"Without anything improving" implies you haven't made much of an effort to improve your life. You have control of your life (unless you have like, terminal cancer or are quadriplegic). Go on youtube and learn some skills such as coding, cooking, workout routines, etc. You having internet means you have all the resources at your disposal to make something of the time you are wasting typing comments on random vtuber drama videos. The first step to improving is to acknowledge responsibility for your neglect and own lack of effort, and to not blame outside sources for your failings.

I do think it was a final straw situation, as before all of this happened, their mismanagement started to become noticable by a lot of fans. The treatment they gave Zaion (who spoke about their treatment later), and the graduation of two other showrunners, Nina and Pomu, people naturally started to speculate what's happening. So, for them to decide Selen is in the wrong and terminate her over a music video and an attempt is just the **absolute, purest disrespect I've ever seen from a company.** Selen has wished nothing but the best for her community, and it really did show in her personality, in her actions, in her projects. Least now we know NIJISANJI isn't the corporation we thought it was. I'm just afraid that the internal bullying is currently happening to other livers if it was already happening to Selen.
Though, I'd be worried about answering the shareholders after the JP 3-day holiday if I were them. After all, they did lose 11% of their company in just a few days

For the astrophe part, some 4chan and users took notice about it and they suspected of them stealth suspension and it was management doing it. This isn't the first time Niji has done that as there was another person by the name of Zaion (now Sayu) got stealth suspended over talking to another manager.
Does the Twitter API not expose the name of the app that was used to make the tweet anymore? That would be a more reliable basis for assumptions about whether the tweet was done by management on behalf of the talent.
The framing of the apostrophe thing is just blatantly not true. It's not a "Western" vs "Japanese" apostrophe it's different for various devices, whether you're mobile vs desktop etc. You can look at people comparing other talent's apostrophe's and you'll see both used in different tweets.
Yep. On iOS, the default apostrophe is this slanted ‘ or so-called Japanese one in this video, unless you turn off the ‘Smart Punctuation’ keyboard setting (which is on by default), and I had it on here to illustrate this point.
With it off, then it's now this apostrophe, which is the same as standard keyboards'.

Kurosanji is in the stock market, and the fluctuarion blip in the tradings was a bit too visible, so they had to task one of their Financial experts to give a look at what news and events happened recently to cause such a blip. It was profit focused and it painted it as merely a momentary low.
Though perhaps if enough Public pressure keeps happening (Such as a MASSIVE loss of audience and SCs/Memberships/Merchandise sales) and it becomes visible for february's financial reports.... The crack will form and deepend the downwards blip, opening the chance to force a 3+ month negative in the stocks
