    Very relevant points. I was posted in Nagaland as an Army officer in the 90s, and have to say that the people of the NE deserve much better treatment

      The people of Nagaland state and all rebel political organization headed by people based in Nagaland..and in negotiations with the GOI are demanding an early political accord based on already mutually agreed points. When will the GOI make the move?.. that is the question. AFSPA is not the lone issue but the accord that everyone in Nagaland has been expecting is not materializing even after two decades of negotiations.

      There is around 11 factions of rebel groups who are in ceasefire with the govt of india. Each of them claim itsrlf as legitimate govt and collects tax. Then there is the state govt that loot funds since being a so called sensitive state there is hardly any accountability. Then everybody misses this big picture..the army and the other security agencies also enjoys unlimited powers and funds under the guise of national security.
      Pick your poison.

    Indeed AFSPA is an addiction. A short fix. The Indian army and the Central Govt are hooked to it.
    Manmohan when he was PM siad that the greatest threat to India were the Naxals. How come no AFSPA in these areas/states?
    AFSPA has been in operation since 1958. What solution has it brought? But India lacks the courage to repeal it.

      @@vm3306 that you're conflating the two betrays your ignorance. One sees the Nagas as a valued minority with distinctive customs, while the other lazily treats all Nagas as 'hostiles'.       @@vm3306 I ask the 'Christian question' because quite a lot of my countrymen believe that there is safety only in homogenity. So, are Christians anti-nationals?
      On the issue of article 371(a), it was not given to Nagas as beggar's alms. It was a commitment by the people in power who recognised the unique peril that that Nagas were in, having minor but distinctive cultural and traditional systems. Whether this should continue in perpetuity is a matter for discussion. The HM Amit Shah, an avowed 'patriot' took pains to reiterate that 371 (a) would in way be tampered with after the abrogation of 370 in Kashmir. Why he did so after the brazen move in Kashmir defies my understanding. However, it in no way constitutes as a talking point when discussing AFSPA.
      A nation exists not in the minds of delusional, screaming hotheads, but in its ethos and it's spirit. Perhaps you disagree with me on this point too, but the modern idea of justice and equlaity do not exist because it is convenient, but because it is right.

    Northeast doesn't need the AFSPA. Only if you consider northeast a legitimate part of India.
    The more you tighten the string the more it is likely to break.
    It's only been 70 years or so, stop acting like the british. We have a long history of driving away the intruders, do not push us towards the opposite side of the fence.

    The central Govt should make sure they support and enforce Good political leaders, who are willing to bring development, security and prosperity to their people in North East region. If they can do that, they need not worry about any internal affairs from the region.

    A democracy like India does not need AFSPA. I feel our Armed Forces are professional enough to work without the need of a law like AFSPA. Working with impunity behind the shield of AFSPA does not add to the glory of our Armed Forces.

    Ask any civilians in Nagaland aged over 45, if they have ever been harassed by the armed forces. Atleast 80% (as many are death and gone and the rape victims won't talk either), if not all will affirm that they have indeed been harassed. Ask if anyone there know have been killed, you will know the horror of AFSPA.

      I'm 30 and back in late 90's, I still rememberthe Assam rifles gathering the whole of my village males above 30, lined them up, beat them up with sticks and later marched them up in line with blindfolds to another village alleging that the villagers are keeping mum on the whereabouts of the insurgents.(nscn-im)

    Thank you sir for understanding the most crucial and sensitive situation of our problems and plights. Most of the mainland Indians wouldn't know the grave situation and suffering of the north eastern people living under the draconian law of AFSPA. This law or act has taken away all the freedom that we are supposed to enjoy under the democratic constitution of India. We live in a so called largest democratic country in the world where we live in fear for our lives each and every day. We live in a situation where our physical features and appearance,our dressing styles,our daily activities for survival,the way we interact with others determines our lives whether we live or die from the bullets of our own protectors(from the so called friends of the hill people). We are shot down dead in the market square because we turned left where we are supposed to face right or because our hands were inside the pocket and it looked suspecious.

    Indian democracy is strange to be very honest. We are the only democratic country that gives blanket immunity to military killings(without going into the merit of whether they were justified, sops followed), we carried on with sedition laws and worst of all we have preventive detention as part of Constitution.

    AFSPA in Kashmir, i can understand.
    AFSPA in North East, i cannot understand.
    If it stays long, more destruction is ahead of our nation.
    There won't be a good unity among us with the North East region.
    This AFSPA makes me think its imposed based on Religion and Race differences.
    Both Kashmiris and North Easterns looks different from the rest of indians.
    Sorry, it just come up.
    We are not in a position to continue with the law, else more hate will garner more problems and we have nothing to gain.

    Nagaland Ambush shows only one thing - government intelligence was outsmarted by double crossing.
    Army blindly walked itself into a perfect trap set for it. It was a very well planned and very well executed trap including the follow through riots. I admire the perfection, deploring it at the same time.

      @@bbb7467 Central Government has a lot to do with it. They have AFSPA in place and the Army and other central agencies working at their behest in Nagaland. The state government is helpless in such a scenario. It is an open fact that the current dispensation at the centre can go upto any extent to win elections, from the killing of 50 CRPF personnel just before the LS elections, to killing of innocent civilians and attempt to brand them as terrorists just before UP elections.

    Amongst several flaws, in my opinion ASPA in its application is arguably a form of racial discrimination. Where applied, people are ethnically different from other parts of India.

      India is not ethnically homogeneous and so there will always be difference in ethnicities. The law has been applied wherever the law and order had broken down completely under the civil administration and the army had to move in. It was once there in Punjab and Chandigarh too.

      @@ekkas1036 It has been put in places where the civil administration completely lost control of law and order and the army had to move in. This has happened in places which border other countries and there has been flow of weapons in. Chattisgarh not being a border state has meant that the availability of weapons and other external support is not as bad as in kashmir, Punjab and north east.

Try applying AFSPA in “wild Wild West” of Uttar Pradesh, Haryana, rajasthan, mp etc. SG got it right - AFSPA is still acceptable because it’s being applied to places that are far away from the politics of Delhi. It’s being applied on people who’s vote don’t make it break a national election. It’s being applied on people who don’t comprise a large abstract homogeneous group- ethno-linguistic.

    The indian govt will never remove AFSPA from NE. Nor has it ever paid any attention to the region. All it wants are the votes. But UP for them is much more important than the whole of NE combined. After all this alienation, mainland indians wonder why there is secessionist tendency among the NE people.

    The saddest thing that we learn from this episode is that the mainstream media despite knowing the ground realities of our situations is that they go on creating such false/prejudiced narratives to the already ignorant sections residing in mainland India.     BSF is one such unit which lacks discipline. Have lived in Assam and thag too in Karimganj. We have seen both Army regiments as well as BSF jawans. Army has always been disciplined, non-provocative but BSF will fight, argue with any civilians, including school children. I still remember we were in 8th standard and going to school with bicycles. It was end of school and children were flocking out which stopped the BSF trucks. A few of them drew their guns out and shouted "bc, mc hatt jao warna gand main daal dunga". Not much kids knew the slangs but were shit scared when guns were drawn at them, including me. This is why BSF is and now they got jurisdiction increased from 5kms radius to 50 kms radius which is like they r can search entire districts of Karimganj.
    Have voted for BJP for two times in 2014 and 2019 and its like choosing the lesser evil. You want to tackle insurgency, have better relationship with civilians and a better network, not provide more supreme power to people who knows that guns have brought food to their house and not an education

    In Chhattisgarh we have achieved peace in many areas where we have earned the trust of local tribes, empowered them and have integrated them to the main economy. The circle is vicious but someone has to break it.

    As my friend Rhiddhis Chakravorty says that AFSPA should be enacted throughout India as everywhere there's some kind of antisocial element disturbing the peace. Of course, it's in sarcasm but the point is that the Army is not trained for Internal Threats and other trained forces are trained to face the consequences in such cases.

    Chhatisgarh is a hindi speaking state from the Heartland with a Hindu majority. Nagaland is a NE tribal state which is too far from the Heartland and mostly Christian. This is the only reason a mostly peaceful Nagaland is brutalised under AFSPA where as inspite of murdering more Indian security personnel than Kashmir and all North Eastern states put together, Chhatisgarh gets a pass. Will any government of any party have the balls to impose AFSPA in the Gadchiroli region of Maharashtra ? No, but they'll still keep entire Assam under this draconian law.

      Do you have figures which corroborate that more security personnel have been killed in Chattisgarh than in kashmir or the north east ? Seems an obvious lie driven by some motive. To my knowledge, Kashmir is where the most casualties happen every year.

    SG’s suggestion to remove from AFSPA from less troublesome areas is sensible. Which government will bite the bullet. Modi, as in the case of Farm Laws, might make the sudden announcement if it were to bring electoral dividends which anyhow is most unlikely.

    Two laws have been in news recently which need to be amended to say the least; the NDPS Act, now the AFSPA. Both have some clauses which need to be changed for good.

    You must not say with confidence that the law will not go. If it is not in national interest, it will have to go.
    What is the reason that it is still around? This will have to be debated by the policy makers.

      Most of Northeast state are now under BJP this shows that how they are allied with our central govt, Northeast is not a Kashmir that demand for separate country what we need is just peace and development, Ok I agree that still there is some insurgents group exist

    The analysis should have addressed the hypothetical question, had this erroneous ops taken place without AFSPA, what would have happened to the soldiers? What protection they could have had ever if its an ops error which always is a high possibility in any such ops.
    The local help was not taken, perhaps the reliability of these sources was a concern.
    A deeper examination of flip side of AFPSA would have given a 360 degree view.
