Bodycam: Arkansas Man Tasered By Cop Sues For Excessive Force

A civil rights lawsuit has been filed in a case which a Blytheville Police Officer is seen using a taser on a man on the 4th of July. The lawsuit claimed the officer used excessive force during the encounter. It all started when officers confronted Chardrick Mitchell at an apartment building on East Main Street. Mitchell had reportedly locked his live-in girlfriend out of their place. “If she’s living there, you can’t stop her from getting her own clothes,” the officer is heard saying. Seconds pass and the officer asks Mitchell’s name, but he refused.
“You need to give me your name. If you don`t, I`m going to arrest you for obstruction.” The body camera covered, you hear Mitchell yelling at his girlfriend, then he began walking away. Mitchell told WREG he was heading to open the door, but police said they thought he was going to run away. That’s when you hear the officer shout, “Hey, turn around, you`re (( he fires his taser here)) under arrest.” Attorney James Harris, who filed the lawsuit, said at no point did the officer ever tell Mitchell he was under arrest prior to pulling out his taser.
It was only after shooting him, he said, that the officer said he was under arrest. Harris also pointed out the police didn’t match up with the police body camera footage from the scene. The report claimed the officer told Mitchell he was under arrest before he was shot with the stun gun. Mitchell was charged with obstruction of justice, disorderly conduct and refusal to submit to arrest. Mitchell is expected to in court on August 2. The officer is also reportedly still on the force.

Officers putting their life on the line everyday, going right at the spots where life threatening danger can arise. I can understand their need, for always being on edge. Two sheriffs deputies came to my house with my ex wife who claimed she lived with me but she didn’t. She never even stayed one night here. I am in law enforcement and that was to fast to the punch. The cop never warned that he would be tased. Had the suspect turned around toward the cop and made a fist or took a fighting stance.. Taser deployment would of been justified.

Funny enough in my academy we had quite a few people able to fight through the taser, I wasn't one but I was able to atleast crawl a few feet, which imo is an achievement worthy of a damn trophy when you get a good taser effect (which means one probe above one probe below the waistline, spaced approximately 1 foot apart) cause god damn, that shit locks everything up, I'm sure I could have put my hands behind my back though, or atleast as close to behind my back as any reasonable officer would expect

I'm not sure about the laws in Arkansas but in Texas detentions are voluntary. You don't have to ID unless they place you under arrest. You never have to speak to a cop. You always have the right to silence. It's a good idea to ask to be allowed to leave but there's no law stating you have to stay until arrested.

Secondly, what imminent threat did the individual pose to the Officer? Did he provoke or threaten violence? No? After all, "it's all on cam," right? Thirdly, "You don't just turn your back and start walking away from a police officer?" Correct, however, simply turning your back and walking away isn't enough to construe fleeing or evading, right? I mean, he wasn't charged with either of those.

It was excessive. You can't tell somebody they're under arrest while the taze darts are in mid-flight. The officer was too impatient and overreacted. If you can't do your job in a professional manner then don't be a cop.

Officer was clearly in the wrong. He didn’t have to tase him. He should’ve said your under arrest and arrested the Individual, if he had RESISTED, THEN you tase him. But to go straight to taser IS excessive and not protocol.
"Protocol" depends on the department's policy. Some departments are stricter than others in the use of a taser. This officer may or may not have been allowed to use the taser in this situation, depending on his department's policies. With that said, just because you can do something, doesn't mean you should do it. The taser was pretty unnecessary.
