Yeah, always a shame when the ol' scummy "It's just business" type of move is done by someone who generally doesn't seem liable to do such a thing. More than anything, I hope it makes models such as her more prone to getting these promises on paper. Think a lot of people outside of the industry would look at Donald Glover as "one of the good ones" but this just proves that even that type of person is still fully capable of making false promises and playing the paper game with those who are maybe less experienced with being screwed over like this. It's just a shame she didn't learn to get it on paper sooner, from a prior experience, as it's probably not every day you get offers to be a part of one of the most iconic album covers of a generation.
If it';s not on paper then it don't matter what they promised. I'm assuming instead of having a lawyer review the contract before signing, she blindly signed.
Why does she even deserve residual. All she did was show up, the designer/ make up artist/ photographers are the ones who did the work.
Not to mention that if her claims of a "promise" were true, there would be a contract....no contract it didn't happen. Plus she agreed to the rate she got paid. She could've easily said no. It's been 8 years and this is just now coming up.....she's clout chasing

Agree and if I had to speculate, I’d guess she had an option to either take pay on the front end for her work she did at the time of the shoot, OR take less on that day and receive money or residuals on the back end at a later date. She probably didn’t expect him to or the album to blow up like it did, and is regretting taking that front end deal, which I’m assuming she signed in writing…
I'm a photographer and its rare for us to get residuals from an album cover shoot. If you have a massive name, then yea you can demand whatever you want. But most people cant.

I've never heard of someone receiving royalty payments for appearing in an album cover. Also the label is the one who deals with the finance side of things for releases, and I can never imagine any label agreeing to something like this.

I am an entertainment lawyer. 1) I have never, I repeat never, negotiated or worked on any project where the model got residuals from appearing on a album cover or in any art associated with a project. 2) the model would have received a written agreement (ie something to sign) that outlined exactly the terms and what she was getting paid and if she didn't herself or have someone to review it before signing it, 7 years afterwards is pretty ridiculous. 3) her mentioning race is weak sauce, I'm black and I just rolled my eyes at that one. Race has nothing to do with anything here.

I think another important part to mention is how we naively trust our ppl in the business. I've seen Puffy, Jay-Z, and other celebrities bring up doing it for "Black Excellence " yet do their own Black artists dirty. I'm sure Gambino gave a similar "spiel" to those Black professionals. We have to be professional in all arenas regardless of race. Its business 🤷🏾♀️

All your lawyers statements were ignored because Gambinos lawyers are already on the case and clearly know what’s on contract and what’s not. Not only do I highly doubt she was paid a “low fee” I believe she’s exaggerating as many “models” do. I guarantee you she won’t put out the number they paid her because she knows it’ll make her look bad. Not to mention why drag any race into this - not only did she try to make this a race thing but she tried to make Gambino look like an Uncle Tom with that “white woman” statement.
Also what residuals would she get for being a model for something? I don’t understand what she owns in this situation that she would get residuals for. It would be like a video vixen asking for residuals on a music video they were in.

Everything revolving music has been implement through hundreds of years of artist making art, from copy right laws, to public 808’s and samples everything is very straight fowards and almost every project involved contracts, she just fumbled her own bag.

Man i feel this, the higher ups are always making empty promises. This literally happened to me, i was promised i would get my 40 hours when transferred to a different store in my company by the supervisor, but when the gm asked him about this he denied it, so i didn't get my hours and got screwed over...

You can get whatever want. If it's agreed upon prior and in writing. Usually, models or design artist are Work for Hire. Do the job and you're done. Paid for the work and able to say you modeled for Donald Glover within your portfolio, which should carry enough weight to get you more work.

As a record label owner, we 100% give residuals to models or artists that help create art work especially when the project is expected to do major numbers. Research the lawsuit Michael Jackson faced from the model/lead actress after the Thriller video was released. Many artists, labels provide residual agreements especially if the budget doesn't allow a major upfront payment.

In my opinion, people are seeing the legal side of this as objective which removes a lot of context. While yes, she should've asked for residuals in paper, it's also a breach of trust to say youll do something then contradict. If we're basing this on who is in the right morally, then it would be the lady, but on legality, it would be the people who didnt pay her.
At the end of the day, we don't know if she's telling the truth, but we need to stop this "perfect victim" mentality.

Yeah agreed. I think artists (of any kind from music to painting) can have a very idealistic expectation of working with other people, which screws them over in the long run. At the end of the day, it is someone’s business and there are only a handful (as in maybe up to 5 people) in your music or artist career that don’t care about money you bring and just enjoy the craft for craft’s sake. Nav is a great example, his features are free, they don’t ask him to pay because they’re friends or whatever.
So valuing your craft is also valuing your money because as the old saying goes, time is money.
So the claim is that Gambino's team/production finessed a model and 2 other artists who didn't do their own due diligence before agreeing to work together and who now refuse to accept accountability for their own mistake. This is barely a head line because this type of thing takes place on a daily basis in most artistic domains.

Not even, if you're not aware in the arts it is very common to not get paid for work in exchange for exposure/build your portfolio/reputation.
The industry is flooded with models and artists. It's highly competitive and everyone working in the arts is trying to stand out so it's not unheard of to be compensated in other means besides cash.
If you're at the point where you are able to make a living and provide for yourself solely off your artistic outlet then you've essentially made it because the majority of those in the arts work 1-3 other jobs to financially support themselves.

I believe her contribution to the album is notable, perhaps equal to that of the headpiece designer. There honestly aren't many album covers that I remember as vividly as 'Awaken, My Love.' That being said, I feel the backlash on Glover is undeserved. An artist should be allowed to focus solely on their art without having to go through every single contract of all contributors to ensure everyone is fairly compensated.
As far as Gambino is concerned, he possibly didn't even know what her contract looked like. Even if he were to personally check if the label delivered on her promised payment, he might not have been privy to the exact details of the deal, only that they paid her what she signed up for. One possible scenario where she is right for calling him out is if he told her himself that she'd get residuals, which indeed would be scummy to promise if he didn't plan on doing so.

As a musician myself I make it a point to ensure that for photos of album and song cover art, I definitely do it all myself.
But the lesson of ‘can you put that on paper’ is even beyond art. It’s a day to day business thing that I learned the hard way. I implore you take this as a lesson and fight for yourself

I’m tryna understand in what way would residuals be applied here. The album is made. The album cover is put on the album. The album is released. In what way would an album cover be continuously getting revenue from, especially many years later?!?!? Wouldn’t it be the album itself getting the money?!?!? If I can take a educated guess it would be almost like royalties. Since the album is going so well with streams they probably wanted to do a percent of the income since the stream shows the cover art (kinda like an exhibit of her photo) that’s what they implied
@@upscaleriotsofficial2166 exactly this. I've offered a model this for a book cover (once, and one time only). It's extremely rare for anyone to do this, because the value is usually the content/body of work, and not necessarily the art cover. Models usually end up getting a huge recognition boost when being on covers, and a one time fee. The boost in recognition is the added benefit, hence the reason people don't offer residuals.
Gambino really creates art and he’s not dropping 20 projects a year to overload this already declining genre with crap music. He should be appreciated and cherished. The album came out in like 2016 or something, why are you speaking after 7 years. It’s a shame if she did not get the money but ask for more money from the start, sign something so people can respect the payment deadlines. And yes, people are not usually getting residuals after appearing on the cover. Anyway, this industry is a monster for the most people if you are in it. Respect for this videos, Blacky! I got a question, I don't think an artist will directly pay someone who would work on whatever part of the album. Cause wouldn't be like the creator pays whoever their working with and then they'd pay the specific ppl who worked on it? So it wouldn't be glovers fault but who ever he was working with. Cause it wouldn't make sense he would pay her directly but the ppl Glover was working with would pay them directly. But idk how that stuff works so if someone could explain.

But that would have been due to my own ignorance in regards to situations like this. And I'm okay with admitting that. My appreciation is for the schooling I received - the knowledge I gained from watching the video. Now, going forward, I will be able to analyze situations similar to this much better. I will use my rational thought, instead of being swayed by my emotions. So I think at the end of the day, we all would want people out there knowledgeable enough to se the record straight and clear things up on our behalf, when darts are being thrown at us erroneously.

I don't think we can entirely disregard race as part of the issue here - yes negotiating skills are the best way to protect yourself but I've experienced it numerous times (along with friends having similar experiences) that when I negotiate for my worth, request everything is in writing before we begin, stipulate what's expected from me and what they are paying me for it etc, people still don't take me seriously. i.e. I and other black women have to fight for that constantly compared to my friends and cohorts who are white, other POC, or men. You can have all of your ducks in a row but employers will still take forever to sign off contracts, gaslight you, pretend your 'dealbreakers' are irrelevant or keep changing the priority in ways that show you they aren't threatened by whatever legal action you enforce. So I can believe the white woman who made the headdress was a stronger negotiator, BUT I also believe there is a racial bias that could have helped her be taken more seriously by the production team, but that's just my opinion.

I think the success of the album was mostly due to redbone, the album was very weird and different from his past work. As a long time gambino fan it’s probably my least favorite of his projects and most people who are familiar with the project probably listened because redbone was an inescapable smash hit. So to say she was the reason for the albums success is a bit of a reach plus I’ve seen many projects with great covers have terrible music (especially in the underground) and they’re not catapulted to success by an album cover much less the person in the image on it. I still think she should get payed if that’s what she was promised but you’re framing it like she made the album and did the marketing/promo for it

What bothers me is that she says she got paid a really low fee, but why would you not settle with a good flat fee before doing the work, unless thats why she accepted to be paid in residuals, but then that would be in the contract if that was the case otherwise she was incredibly naive to agree off of word of mouth from whoever in his team dealt with the payment, sucks but its kind of a live and learn moment I guess

IDK... My ex is a singer and got into a bad deal with a label. She had a couple of viral songs that she made nothing off of... Now she is stuck in a bad lease for a home that she was allegedly told was going to be 1 price, but turned out to be double... After all of her mishaps, I just now realize that she signs contracts without reading them and after reading her record contract and her lease, I realize that its all her fault. When I tried to tell her that she messed herself up by signing all of this stuff without reading it, her only excuse was "well they told me the contract said other stuff"--that didnt vibe for me. Nevertheless, there is a reason she is my ex... Everything is everyone else's fault but her own and that same mentality trickled down into other aspects of the relationship that made her impossible to deal with. Zero accountability for anything.

All legal binding business is best done in writing. Even emails and text are more legally binding than word of mouth promises.
