  • The Visa Bulletin for October 2023 left many Indian applicants disappointed. The dates for EB-1 (which includes EB1A for Extraordinary Ability applicants) did not move forward as much as expected. Let's talk about what has happened over the last months and what can happen next.

    30k more visa numbers are remaining for FY 2024 for EB1 category. So there is definitely chance that FAD for India will move to 2022 end by June 2024.

      Just curious to know , where are those 30k from for EB1?

      @@ganeshpamulapati3573 For each year employment category gets 140k visa numbers. EB1 gets 40k visa numbers, EB2 gets 40k visa numbers, EB3 gets 40k visa numbers, EB4 & EB5 get 10k visas each. So if you consider for EB1, for each quarter of Fiscal Year, USCIS uses 10k visa numbers for all countries put together. So if rest of world is not consuming, India & China get the remaining visas for that quarter. Current visa bulletin reflects assignment till FY 2024 Q1. From Dec 2023 to Sep 2024, 30k are remaining visa numbers for remaining 3 quarters for EB1. Rest of world is current. So further movement is strong possibility for EB1 India.

      Yes. But there are only 800 visas / quarter available for EB1 India and it’s oversubscribed. So even though it is going to advance, it will very soon end up as the next EB2.

      Also is there a note that the unused ROW EB1s every quarter will be utilized for India and china backlogs?

      @@andyvirtualThat’s the number India will get by default. Plus it gets unused visa numbers from ROW in EB1. I have not seen such note. But that’s how it works based on last 2 FYs observation. If not every quarter, on the last quarter, they will apply all the unused EB1 from ROW to India and China EB1. You can definitely expect significant movement by Sept 2024.

    Hi Oscar My PD is feb2013 in eb3 india. What is your expectations on eb3 or eb2 movement for the FAD or FD coming year 2024.

    To confirm Oscar, the Priority Dates are not only determined based on pending AOS applications, but also based on predicted incoming applications based on a quarterly basis. If they don't receive as many, they can advance. Do you know if they only progress the final action dates to help ensure people stuck in the queue who have filed AOS to get green cards by keeping the initial action dates constant? My PD in EB-1 is Oct 2021. I have filed the AOS in June 2023 based on availability. I got my EAD and now the dates retrogressed. Do you know if they will clear the filed applications to ensure they don't get stuck due to immigrant visas not being available by keeping initial action dates constant?

      Based on my experience and many others, they strictly process on priority date basis. So its unlikely that they will process your GC till the FAD reaches your priority date, regardless of how things were when you filed. Specifically, visa numbers are allocated at the end of the processing and only when they are immediately available

    my question here I am a self petitioner and I am applying as an Entrepreneur for EB2 NIW. my question is the funding for my project work is necessary to show by professional bodies or Govt. bodies or should any private person or normal business holder who don't have business in the relation or propose endeavor can he fund to my project by showing legal documents from my own country. ?

    My PD is May 2020. I moved back and came to USA in September 23. But as per current Oct 23 bulletin, PD date is Jan17.
    My question is: when is likely that my PD May 2020 will be current, so my visa processing can be started. Thanks.

    Hi Oscar, I would like to know if my PD through EB2 PERM can be used for NIW petition in the near future? For my country is waiting is about 5 years and my older PD is 11 years ago before I left the country.

    the recommendation letters and expert opinion letters , how old they should be when submit with NIW petition ? is those letter should be under 6 months before submiting a petition or time period doesnt matter in recommendations letters.
