    Question:
    Can I submit my petition for both Advanced Degree/Exceptional Ability options together and let the USCIS to decide which one get qualified? If yes, where should I indicate that?
    The reason I am asking is- I have US equivalent Bachelor degree and over 10 years of experience with a Commended Salary.

      Hi, thanks for the support. No, do not do that. If you have advanced degree, just go with that (bachelor and 5 years of full time postgraduation experience qualifies).     Hi Oscar, thanks for the informative video
    have one question, generally any time line to get RFE from USCIS?, if we don't receive any RFE before October is that any good sign? never mind may be my question is silly but i am curious to know, it would be great if could throw some info, thanks in advance.

      No, there's no trend there. You can get an RFE very quickly or a year after submission. It really depends on when they get to your petition

      Thank you Gilberto. That sounds like something that can be justified as having national importance. Make sure you find government articles, speeches, laws, executive orders, where the US is interested on that. Also, it would help if you have a proven record on that topic with examples of how your products or standards have been used by people in the field (or beyond). Promises only are typically not sufficient unless you have a history of success in that sector. Good luck!

    If you pay for I-140 premium processing, and you receive an RFE, will the response to RFE be processed under premium processing as well? Thank you for all the information!

      yes, the clock stops while you prepare the response and resumes when you submit it. But to be honest, USCIS is very fast to issue a decision after they receive an RFE response even for regular (non premium) cases

    I got an RFE that basically ripped through all 3 prongs! I am here wondering why they didn't just deny me?! It's like when the teacher strike your entire paper and tell you to do it over! If they found an issue with all 3 prongs, should I just cut my loses?

      RFEs can be won. It's free to try and worst case scenario (denial) you will have a better case to resubmit

      @@OscarsGreenCard thank you. I have taken a few days to get over the initial shock of the looong letter. That is what scared me. I saw another video where a lawyer said that is common for them to repeat laws and what you wrote. I have taken the time to highlight what I think they are asking for, and it came down to less pages. The bright side is they gave me the maximum time to respond. My only extra cost is postage from outside America, so I guess it won't hurt to give it another go. Typing this was therapy, so thank you lol.

    Please tell me can I file a petition as a single applicant and then got married during the processing on the i-140 and add my spouse later on? Will it have any impact on the decision? Can we both travel together after approval?

      if you know you are about to get married, I would wait until then. If you marry after I-140 is submitted you can still include him for AOS or consular processing. You can consult this with a lawyer

      There is no way around it. If you apply for a green card on a visa without dual intent, you risk your renewal. You can try to switch to an H or L visa before doing this

      @OscarsGreenCard I am applying for Pakistan and now submitting I-140 form along complete dossier. I have 5 dependents who never been to USA or any other country. What I should write in the form I-140 under section "Non-immigrant status of my dependents". Plz also guide me if I have to fill additional forms for this purpose

    Oscar, maybe you will know. I485 was transferred to Notional benefit center, and I have not submitted with I-693 form. Instead of waiting for them to ask for RFE I want to send the form but I'm not sure to which mailing address I should send it too.

    Do you have any Video about the EB2 NIW Petitioner family visa processing time? One who is on J-1 and as you know J-2 visa is quick to get for a family abroad, but not sure if 1-485 was filled and then proceeding to the family through Eb2-NIW (In i-140 petition family info was included) will take longer or shorter? If any video or info, please. Thanks.

      I don't understand your message fully, but generally adding derivatives does not make the process longer or shorter. Today I am releasing a video about family but it does not discuss time, as it is kind of irrelevant

And if the J-1 has approved EB2-Niw then J-2 can be applied for Green as well. But I am not sure if your family is back home and you applying for Family when you get your EB2-Niw based green card will take longer or shorter time.

    Thank you for your videos. Subscribed. :) I really wanna apply BUT my profile is tricky. My education and work experience do not fall under the same domain. I have Master's in philology (English/French) and 6 years of experience in IT Cyber security as a Identity Access Management analyst for Air Canada. I do not have any patents or major achievements. It will be quite difficult to obtain any recommendation letters either. But there are more details that i do not mention here that would benefit the US and this will have to be really thoroughly explained in the petition letter. I am still eager to apply. What is your opinion on my situation? Wondering if anyone here got approved with very minimum paper proof.

      Hi, my course is for everyone, not only scientists and definitely not only in my area (biotech). The course teaches a process, how to put together your own petition. It's not a copy/paste effort, you need to understand how to craft it and build your case

      Yes it is spouse and family visa, family details are part of the I 140 form
