Today I am talking about filing previous years' taxes, also known as back taxes. I tell you how to file your back taxes step-by-step, how many years back you can (and possibly should) file your back taxes, and more!
There are many consequences to not filing your tax return, and it's generally in your best interest to file your back taxes as soon as possible. You should also be aware of the interest and penalties that accrue on back taxes because they can be significant, especially the penalties. Thankfully, in this video, I cover how the penalties are calculated and how you can possibly get rid of them. And even if you don't owe taxes, you still want to file to secure your previous year's tax refund. If you're wondering how many years back you can get a tax refund, I cover that too.

Excellent video.
The IRS is almost always easier to deal with if you are trying to comply with the tax laws than it is if you are trying to run away from them or thwart them.
Yes! And for that reason we always recommend people not ignore their IRS problem and get in compliance (at least filing compliance) as quickly as possible. In most cases, the IRS won’t even entertain a negotiation until that is done.
There ARE NO tax "LAWS". Title 26 is what the IRS quotes as the law but Title 26 is Prima Facie...color of law and can be rebutted with prior UNREPEALED ACTS OF CONGRESS. 😊The UNREPEALED ACT OF CONGRESS is 26 CFR 1.0-1 paragraph (d) which says TAXABLE years began December 31 1953 and ENDED AUGUST 16 1954!!! Let that sink in...... TAXABLE YEARS ENDED 69 YEARS AGO!!!!! This was passed INTO law AS law by the 83rd Congress on August 16 1954. So why are we so conditioned to file and "pay" an income tax that died/expired 69 years ago?!!.....by LAW....not some damn IRS. "rule!!" THINK ABOUT THIS....!!!
It's all about fleecing the people for their sweat equity. Shame on them all! @@dennishipsley8703

Love your video! Thank you so much! Liked and Subscribed! Question? I forgot to file 2022 taxes 🤦🏻♀️ mostly because it was my first 1099. Should I file that first before I file 2023?
Hi! It shouldn't matter unless there's something on your 2022 taxes that would affect your 2023 taxes. That said, since 2022 taxes were due last April, while 2023 taxes aren't due yet, penalty and interest are accruing on whatever you would owe for 2022 right now (but they aren't for 2023 yet other than a potential underpayment of estimated tax penalty if you didn't make estimated tax payments), so if you had to pick, I would say file and pay 2022 ASAP to limit penalties and interest as much as possible! LOGAN, what about filing EXEMPT?? I live in SoCal and work for IHSS and I am a live-in provider, so I filed EXEMPT in 2017, as we were told to. But do I then NOT have to file every year?? And also, on my paycheck stubs, they don't take out ANY taxes. I only pay my health insurance and that is ALL THAT SHOWS on my check stubs along with my hours and pay. Is that ok? Or is my work screwing me over?? I am so confused!! PLEASE help. THX!

So I ended up filling my taxes for this year, but later found out I never filed my taxes for the previous year. I know you talked about filing the earlier years first. Would I have to wait until tax season arrives again, or can I file the back taxes at anytime. What happens next?
You can file your back tax return at any time! It's just that sometimes it makes more sense to file them chronologically (but sometimes it doesn't...it really depends!).
Do you help with non profits that didn’t file their 990ez??

I know this comment is not about this video but last week I got an adjustment on my 2020 Illinois taxes because of the federal break on the unemployment income but have seen nothing on the actual federal refund. It is not even showing in my account status.
Will my parents have to add me to their household? I am an independent student but was thinking of filling a 8821 form to help them with their 12153 request for due process or equivalent hearing. My mom had identity theft paid off but still think what they owe is too high. How will this affect them from I?
What if you WANT to file those past taxes but you don't have the W-2? I'm missing some of mines. I tried looking online on my irs account but no luck because I think that's only for copies of years you already filed. That old employer is no longer available neither. @LoganAllec how do I go about reporting financial aid disbursements on my tax returns? This is the amount of aid that is sent directly to my bank account after the school pays my tuition and fees. What expenses count as educational expenses and which don't? For example , I used some of my disbursements to cover food, housing, clothing, transportation, and necessities. What portion of these are considered taxable ?
Are these disbursements loans, scholarships, grants, stipends, or a mix of some or all of these?

Thanks for this. Btw how does someone end up in jail for not filing? If someone doesn't file for a few years does the IRS give them a chance to fix the problem first before ever criminal penalties are a risk?
In the *vast* - and I mean *vast* majority of cases - someone who simply didn't file their tax returns for a few years will not be facing criminal charges, though it is technically a federal crime under Internal Revenue Code § 7203. Best thing for them to do is to file the back tax returns and get back in the tax system.
You can't pay a penny if you're in prison. You actually cost the government more buy imprisoning you. They want their money.
Joann worked at NAL ...
If I file my newest return first is it possible the IRS will use that against me and accuse me of fraud knowing later returns with possible penalties are still in my possession?
Probably not as long as you get in compliance with the other returns shortly after filing your newest one. That said, you may not have to file all of them, and it may in fact be advisable to not file all of them for reasons I stated in the video.
Thanks for informations unfiled 2020 and 2021. But,Allec , do it paper file or e- file.? Good d😢!
You can no longer e-file 2020; you will have to paper file that year.
You can e-file 2021 still if your tax software supports it.
@@LoganAlleccan we get a direct deposit for year 2021-2022 year ?
My boyfriend didn't file taxes for a while and then we start filing taxes couple years ago and the first year they said they took what he would have had for stimuluschecks and applied it for his back taxes last year he owed money when we filed just because he had a self-employment sort of gig and one of his Works didn't take out the extra that we'd asked them to and then this year he was supposed to get a refund but when I went to check it it said it was applied to back back taxes so then I was able to get into his account for the idemia thing that says he owes 12,000 + 1000 penalties + 5000 interest from 2012 didn't file that year and he didn't even make that much money anyways thank you for this video
You should determine when that 2012 tax debt will fall off. Call the IRS and ask when the CSED is. That will drive a lot of decisions about how to approach that debt.

How complicated is your 2019 tax situation? What kind of income did you earn / receive?
@LoganAllec it's not complicated at all .
Just I will file for federal taxes only .cuz I was working overseas in the year of 2019 .
@@samborolossi Gotcha. Were you W-2 or 1099 overseas? If W-2 possibly no federal income tax at all due to foreign earned income exclusion.
Allec, what will happen if I file my backtaxes, do my stimulus impact checks be release to me?
Yes, if you didn’t receive stimulus checks, you can get a credit for those amounts via the Recovery Rebate Credit if you file your 2020 and 2021 returns. However, unless you filed for an extension, you will need to file your 2020 return by May 15, 2024, to get a refund for that year!
What tax forms do I need for filing back taxes?
The same tax forms you would have used if you filed on time!
He Sir… in a more recent video done this year. … I commented …. You mentioned that you have 3 years to file and get a return. On this video you said “extensions do count for the 3 years “. But in a more recent video… you said it’s 3 years plus any extension.

You can currently e-file 2021, 2022, and 2023. However, not all software necessarily supports e-filing 2021 and 2022. However, most professional tax software does.

PLEASE HELP!! i have to do crypto taxes from last year. I have tons of transactions.. do i need to report all transactions on 8949 if i had an overall loss of 300 dollars?
You need to report because the IRS doesn't know your basis. We currently have a client who is being audited for the 2017 tax year for crypto transactions. Had an overall loss on his crypto but over $1,000,000 in gross proceeds...he did not report...IRS knew his basis because his transactions were through Coinbase, which reported transactions on 1099-K (Coinbase used to report on 1099-K)...IRS selected him for audit because they saw $1,000,000 in gross proceeds on the 1099-K with no idea of his basis.
