Hey the bar is within their rights if they trademarked the name. That's business 101 image is at fault here for publishing issue #2 unless they issued a royalty for using the name dead rabbit which they did not. As for the comic book collector snatch up as many copies as u can 😁
I can see both sides and I appreciate you taking the time to explain the situation. I think it's quite petty of the bar but I think it's ballsy (but very much like him) for MacFarlane to publish 2 after the cease and desist. The bar should have embraced the comic but I guess they're just stubborn and it hurt their egos.
kachoong thank you. I get it from the point of view from the bar that they have a comic that is for sale on amazon now. It’s a huge problem for them to publish this book that they’ve obviously had the intention to do for years. But why the hell wouldn’t they have trademarked it earlier. I can understand an oversight but then to run off and trademark it...I get it but it seems a little vicious

I’m not happy with how the bar handled this. To me they are trying to control the name dead rabbit. I get if image was a knocking off the bars comic but the title can be interpreted to mean many things. I hate when people show up some place take something that has history and significance already (they technically took the name dead rabbit which essentially was public domain) and then want and trademarked it. I have no respect for this bar.
I own copies of both 1 and 2 but I have to side with the bar owners here. People trademark names for a reason and just because Image decides to use the name doesn't mean the bar owners should just roll over and say "ok". It can cost THOUSANDS of dollars to trademark a name and they deserve the right to exclusivity. Putting out 2 after being told to cease and desist puts Image 100%%% in the wrong. I'm sure if I decided to start using the name Image Comics they would have my ass in a sling pronto.
Coffee With Comics I understand too but they only trademarked after they found out Image was going to release a series with the name so it seemed like a bit of a trap but then again. Image should’ve trademarked. They’ve been in the game long enough
@@KeyCollectorComics I agree waiting to trademark was a bad move but I think it prompted them out of honest protection of their brand, not setting a trap for Image. It is one of those things where you don't realize there is a threat until it presents itself.

Excellent recap, thank you! Why not just change the name of the comic and keep publishing? BTW How did Image get to use the name "Walking Dead" when Aircel had a similar comic by the same name a few years earlier??
SuperJoe They probably will change the name which means these early issues will be even more sought after especially if the series takes off.
Maybe aircel didn’t trademark the name or maybe the trademark becomes fair game again after a certain number of years. The aircel series was only 5 issues I think. Good question. Hopefully someone knows for sure

This comic book value is all over the place
I'm not happy the govt let the bar trademark the name of a historic group. To me that's akin to disrespect, same as a private enterprise using Rough Riders or Easy Company.
However, the govt did approve the trademark, and that gives the bar legal control of the name regardless if anyone else feels that they should not have been given that trademark. They are within their rights to present Image with a cease and desist order. Image's legal team should have done their due diligence with the name before publication.
Was the bar's insistence that issue 2 not be published when Image asked for an extension purposely to put Image in a position to be sued? Possibly, and this may have been what the bar wanted all along. If Image had not published #2 they would have lost money, but that would be a guaranteed loss while there is still a chance they can win the lawsuit.
This is quite similar to the issue with the Captain Marvel name between Marvel and DC.
One thing Image may have going for them is the fact that it is a historic name. Another is the bar's version contains a character that looks strangely like a character from the Donnie Darko film.
I'm going to get a bit off subject here and present a couple scenarios.
1. Larry Flynt of Hustler (does that name violate the movie trademark by the same name?) makes a caricature of a famous, religious person. Flynt is sued by this person of defamation of character, but Flynt wins the lawsuit cuz of 1st amendment rights.
2. Todd McFarlane is sued cuz a mob character he created in his Spawn comic was named Tony Twist, which happened to be the nickname of a hockey player. The Spawn character was NOT a caricature of the hockey player, but the hockey player did not want to be compared to a mobster and felt "Tony Twist" was his name to monetize.
Are satirical caricatures defamation of character or free speech? Should people be allowed to make money off such caricatures? Is using a name for an original character grounds for a lawsuit? How is the Flynt case different from the McFarlane one?
The bar comic looks pretty cool, lol!

Why cant they work together- build a Bigger Fan Base. Or get a kick on the profits. Everybody here is greedier than the other. The only thing this does is hurt fans of both. Still - glad I had Multiple copies! Lol
Oh we definetly wouldve takin it back 120yrs ago, whether i was with Image or the bar... somebody wouldve caught themselves living the comic instead of reading it!! Gives a fuck if your bar been here for a 100years and been in a movie, dont let your lawyer deceive you into throwing your life away i'd plead to them before i go rogue on them and their laws, hey its america and those are the laws we live by one might say and i'd say no this is my home and I aint part of your system, your laws is nothing but idea's on parchment paper backed by the threat of force, and i can go on lol but nawwww
Haha fuck them I just bought a 2nd copy today of #1 for a dollar less then cover price cause it had 3 spine ticks I love the story and they need to bring it back. Besides isn't the bar's title THE dead rabbit and image comics is just dead rabbit. There's the difference, now keep the issue rolling.

For me as a COLLECTOR, it gives me & adds to GREAT "Comic NOSTALGIA " with running to obtain a "PRIZED COMIC" whether KEY APPEARANCE, error, ETC and I love it!!🤗🤗 I mean isn't that one of the reasons for collecting >> to CLAIM the PRIZED COMICS 😎. But for the companies involved, IMAGE SHOULD have JUST canceled the distribution and did a RECALL. ☝️ESPECIALLY when they're ALREADY short on the "SPAWN MOVIE " BUDGET 😣😣. So now WILL WE SEE a SPAWN MOVIE or a "SPAWNED DEAD RABBIT "!!🤣😂🤣😂😩😂
How do they trademark the name of a street gang? It's really because they have a Dead Rabbit comic and Image has a Dead Rabbit comic. I'm sure they only found out about it because people looked up this dope comic and they got that Bar bullshit that nobody reads.
DeAdsEt X the gang wasn’t trademarked so I think they could snatch it up plus the trademarks are related to the categories in which they apply them to. Specific to comics literature etc. I could be wrong but that’s how I understood it
Image should move on and retitle the book. I'd call it The Natives.
