  • A nurse who happens to be a former Olympic athlete says she was detained by police at the Salt Lake City hospital where she works. Alex Wubbels says it was an unlawful arrest and that she wants the public to see the disturbing video so it doesn’t happen again. NBC’s Steve Patterson reports for TODAY.

      Now this Utah police department has to worry about 2 possible lawsuits, 1 from the original victim (truck driver) and now the nurse. Bad karma tends to follow bad people...

      No...she was arrested because she 1.) refused to cooperate with a lawful order (or so the police officer believed, which gives him every right to arrest her), and 2.) she resisted arrest, (which allows him/them to use "reasonable" force to take her into custody. Police officers aren't judges. They are law enforcement. They are empowered to act when they BELIEVE someone is breaking the law. Judges determine guilt or innocence. Police officers are never going to be 100% perfect executing in their duties. Citizens and guests of the United States are REQUIRED to submit to lawful orders, allow themselves to be taken into custody, and let the legal system sort out the details. When I see cases on the TV news where a police officer shot someone, it's almost always because that person resisted arrest. Guilty! Don't resist! GO PEACEFULLY! Then sue them if it was an unlawful arrest!

      Winston Thurston Well he thought it was a lawful order and was wrong. Maybe she thought she was not resisting arrest. He should have checked if he needed a court order or subpoena. If that patient would have died because his drip was stopped or vent turned off because his nurse was in the back of a police car, what would his blood be worth then? HIPAA clearly states what law enforcement can and can not do without patient permission.

      Why would you sue the hospital? That's goofy. The hospital was doing everything they could to help but the police weren't having any of it. If she has a case against the police department then should pursue that, however, suing the hospital is ridiculous.

    Looks like the cops were trying to blame the crash on the truck driver because they will probably be sued for pursuing a dangerous car chase that ended in a severe accident and left the truck driver in critical condition.

      Quite a sound explanation for why they wanted to draw blood so badly. So even if you're the victim of a crash, you're better off never consenting. Good to know tbh.

    one HUGE thing being glossed over, they wanted blood from the VICTIM of this event, NOT the guy they were chasing, but the innocent VICTIM of that police chase who is unconscious and badly burned all over his body... they wanted his blood hoping to find something they can use against him when he sues the crap out of the police department, this is an example of police victimizing the victims so they can find something to excuse any police mistakes...

      Yeah, interesting. I was wondering why the police were pushing so hard to get a tox screen on a victim of a car chase. As a ICU RN if we get a trauma unable to speak for himself and we're unable to reach next of kin/proxy we sometimes have to draw emergent labs/tox screens for treatment. I believe the authorities do not have access to the results without a signed consent and or warrant.

      Evan Whitehead Yes, why didn't they get a warrent to begin with? With those injuries, anyone with two brain cells to rub together would KNOW blood had been drawn at intake. I am now convinced it was to contaminate the samples in the police lab so the driver couldn't sue.

    She prints out the terms/laws that the hospital and police department both agreed to. It doesn't get any clearer than that. Yet he acts like a big baby when he doesn't get his way. He needs to be fired.

      No, he was not doing his job. He had no right to the sample he asked for. She was in the right to refuse. The arrest was not valid. No actual injury has to happen for something to be assault. If you can't see this, don't vote because you are not qualified to make any important decisions for the rest of the public.

    Cop: I needed a blood sample, but I didn't have the warrant to request a blood sample I supposedly needed, so I arrested a nurse!

      Jack... youre stupid as schit.. the drunk driver, fleeing from the police is dead.. the unconscious driver was the the driver of a semi truck that was hit by the driver fleeing police.. he was THE VICTIM. not the driver fleeing police. youre just jumping to conclusions to something you have no knowledge of. The police wanted to draw blood from the innocent victim of the crash for no apparent reason.

I would sue the individuals that were just standing there doing nothing especially those cops that allowed this woman to get dragged out of the hospital like that and disturbing the peace of other patients

      Trooper2221 trooper this story really stirred me up ! I'm so upset that this cop just arrested this women like that ! No support ! These administrators sit in these offices getting paid six fig salaries being able to reach them you have two sometimes three layers of bureaucrats people reception ,secretary, personal assistant for them to pick up a call or answer an email. It is ridiculous I'm sure while this woman was working the hospital administration was out to lunch ! Where was the head doctor ? Other nurses ? This is a big deal story ! It shows how vulnerable we are ! Plus I learned a lesson from this story our blood is our property- never thought of that.

      Lasalle, this goes even deeper than HIPPA. The US Supreme Court has ruled that the police can not take a blood sample from a patient without consent unless he's under arrest or they have a search warrant. That cop tried to force a nurse to violate a patient's 4th Amendment rights.

      This actually has some basis in fact. Police departments don't like to hire smart people. There was a famous case where the New London, CT police department rejected an applicant because he scored too high on their intelligence test (equivalent of a 125 IQ). He sued for discrimination and lost.

      I agree nurses are highly intelligent professionals not just giving injections. Many times they save their patients informing doctors when patients are crashing at 2am. They are smart cookies the way she was presenting the data was cool calm and logical while the detective clearly didn't like to hear it he resorted to force. This was a conflict of law and medicine. She was following the law he represents the law but it's the written law that counts in court

    I am a nurse and there is not enough words to express how disgusted I and nurses across this country are feeling right now. We are people of peace, we are people who care about other human beings, we are people who do our job and follow the rules. Wubbles is one of us and like one of us she was following the federal HIPPA rules and hospital policy. Nurses are angry and shocked. Mostly we are angry. Police have no right to brutalize us or any other person in this country. Trust was broken.

      the other cops who just stood there and let it happen should be arrested and sued as well, they are all complicit. The police chief should be fired immediately for not immediately firing every cop on the scene. Until not only the rogue cop but all who allow it to happen, are fired, arrested and sued, this will continue to occur.

      I agree that the man should be fired and striped of his pension. but she already is planning to sue the department if they don't take action to fix this problem so that it doesn't happen again. In my opinion every cop there should be fired. NONE of them tried to stop that guy and in fact helped him arrest her! who knows how horrible this department is. just purge it, I say!

      When I worked at EMS a cop stopped our ambulance for speeding while we had a patient in the back. I sued a won a small amount but the patient sued and was awarded several million. The state ended up having to come in and take over that county because it bankrupt the whole county government.

      +Steven Tripup. As a nurse, I can say that it definitely puts patients at risk. Nurses know their patients, not other nurses patients. Every patient is different and even simple treatments can have harmful consequences if the treatment isn't right for the patient. When we hand off our patients to other nurses, it takes anywhere from 10-15 minutes per patient to look up allergies, medications, lab tests, imaging, procedures, health history, diagnoses, plans of care, vital sign trends, etc. That's not to mention assessing our patients, which takes approximately 5-15 minutes per patient depending on your experience and acuity of the patient.
      If suddenly a patient were to crash, it would leave those responding to the emergency no idea what led up to the emergency, leaving them to look up and test for everything possible, and delay care long enough to potentially save a life.

    wait... I read the piece on nbc news website and now am watching this, if I understand both correctly, then the truck driver who was the patient in her care, was the VICTIM caught in the aftermath of a chase?! Why are they looking for substances in his blood? I know hospitals have standard procedure to do such tests on all patients but the nurse was within her rights protecting her patient by refusing the police blood draw. SMH...I don't agree with a lot of "sue-happy" situations, but she really should sue...

      The cops are looking for a way out of being sued themselves by the truck driver. They could be held liable for pursuing a dangerous car chase that left him in critical condition. That is the only reason they would want his blood period.

      Michael Lucas you can, in serious cases, a DNA test( such as a blood test) can be warranted for by a judge. But this wasn't a serious case. The full story is this. During a high speed police chase, a police car had an accident with a civilian vehicle. Then, the police found the hospital to where the man was admitted, and tried to essentially shift blame to the civilian. That's what they were trying to do.

If any officer doesn't have proper documentation to collect evidence then they have no right to ask for any samples of blood, urine or any other body fluids. This isn't rocket science. He clearly acted prematurely and out of anger and in my opinion he didn't follow proper protocol.

    My wife is a cop and I have three other cops in my family. I'm a huge law enforcement supporter and I am appalled by that LEO's actions. He did that out of spite and could have easily just waited for a warrant. Instead he let his emotions take over and lost his cool. Now if there's more to this video than what we see here, fine. But from what I see here, that LEO needs to be on UNpaid admin leave until the investigation is over.

      Yup, there's more to the video than what you see here. The nurse is told by another officer that she's the problem, and an officer tells her "you're interfering with _my_ law." Then there's what you can see, where cops have no problem watching him break the law. Then there's the fact they probably caused the accident chasing another vehicle, and the truck driver had nothing to do with it. Just dirty all around on this one. Cops always like to close ranks in cases like this. The "good" cops are ineffective because they can't arrest the bad cops, or are too stupid to notice how corrupt their precinct is. I just dealt with the police, and two of the three people I spoke to were taking money from the guy who robbed me. I hope your locals are cleaner than that, but frankly it's not too likely.

    Lemme get this clear, a trucker was driving on the highway, cops was chasing a suspect on the on-coming lane, the suspect hits the truck right on and the suspects car explodes and the truck burns, the suspect die instantly and the truck driver suffered burns and is uncousoius and taken to the hospital.       He didn't give her that choice and the outcome would of been the same. The hospital board was already angry that he tried to take blood from an unconscious patient without a warrant. Even if he hadn't assaulted her like that the hospital would of still sued the police department.

    I don't understand how people can continue to defend these polices. This police is not protect the law. He was violating the law -- in multiple occasions. The person on phone even told him (1:10) that he cannot threaten the nurse. Next thing he did? He arrested her. He didn't arrest her because she broke the law. If in the doubt, this officers could have called his supervisor to verify the situation. But no. He arrested her because he didn't want a "no" as an answer.

    The truck driver and the subject of the blood draw was the VICTIM of a high-speed police pursuit when a suspect being chased by the police crashed into him. Why did the police want a blood sample from the truck driver? So they could place the blame on the victim who had no control over get in the accident and not themselves for starting the chase. Local and State police never take responsibility for their actions. We need civilian review boards reviewing every police interaction. I'm thankful the body cam footage wasn't "lost." BTW I'm a former FLEO.

      Brian Beeler I'm a truck driver and no matter who's at fault if we're involved in an accident we have to submit a blood sample other wise DOT (department of transportation) will take away our CDL (license to drive heavy vehicles)

    Personal injury lawyers will have a field day with this case. Military personnel know you never treat a nurse like this. The doctors and hospital administrators should tell the offending police department that, until lawyers and judges have resolved this matter to the satisfaction of all persons involved, they are barred from the hospital premises and should take all their business elsewhere.

    When a driver signs on with a company they sign a paper giving permission for drug testing to be done after an accident for drug testing if the driver is unconscious. This is to be done by the company the drive works for, and the federal D.O.T. with the permission from a judge. That cop and his office should be sued and he should be demoted to writing parking tickets. However maybe the office should be jailed for practicing low without a license. A warrant was needed.

      Cops screw up in their jobs (i.e. shot someone), they're sent on paid leave. Anybody else screws up, they get fired.

    Burn unit. Let that sink in. Can they immediately replace her or were patients put in danger. Nor can he compel her to do any medical procedure. What law allows a police officer to force a nurse to do anything. It doesn't exist.

      Mountain Mama .. ..the cop will not forgot the "burn unit" he stumbled over his sense of entitlement into. This'll burn for quite some time on his record----and should. It's hard to name a more trusted american career vs. a least trusted american career...cop v. R.N. is never easy to defend. But she can lose more than just her job----she can easily lose her state nursing license as well. Confidentiality is highly litigated in medicine law. He needs some serious community service done at the burn unit or any other spot that overworked and undervalued nurses work.

      It's not easy or quick to replace a nurse taken off-shift; it usually means the other nurses in that ward have to take over her patients. It's not necessarily a critical situation, but yes - does impact the quality of the patients' care.

      While the legal system often does have a tendency to look after its own (for better or for worse), I wouldn't be too optimistic about this officer's future in the police. Unlike those dodgy cases of officers getting off after using deadly force on suspects who probably didn't warrant it, there's no shaky legal precedent protecting them (ie, self-defense), no huge counter-protest defending the officer's actions, etc. Had the nurse complied, she would have broken the law and put her registration at risk (clearly the officer had a poor appreciation for how much accountability and regulation nurses are under).
      This case is making pretty huge waves in the nursing community all over the world; us being a profession that traditionally has a fairly close-knit relationship with the police. It's not an event SLCPD can defend (the nurse was shortly released without being charged), and they know that it'll take more than an apology from the police chief to fix.

      McTittyFucker if we did a blood test to get a driver license this would take a HUGE HUGE HUUUUUGE chuck out of our right to privacy. The right to privacy is based off of what a reasonable person believes is private so it can be a slippery slope. This is why that is a BAD IDEA.

    So, the truck driver (patient who's blood the police wanted drawn) was innocently driving down the road, and hit by a car driven by someone running from the police. The truck caught on fire, and the truck driver was badly burned. Why would the police be so desperate to get blood results? To some how shift blame to the truck driver? I support the Men Blue, but this stinks of some sort of cover up.

      unclevroomvroom Innocent truck driver was seriously injured due to a police chase. Police needed something anything to not be liable for the truckers injuries. Even if they had gotten the truckers blood samples I seriously doubt it would have been admissible.

      "No"
      "Did you have a warrant?"
      "No"
      "Was he under arrest?"
      "No"

    This is even more disturbing, once I watched the video.
    You can see the force, the officer used, when handcuffing the Nurse.
    At 1:36, his hands are bright red, from his grip.
    As a nurse, everything Alex Wubbels did was 100% correct by any hospital protocol; From checking policy, to calling hospital administrator.
    WTH was this Police Officer thinking? Given his age, I have to assume he isn't a rookie.
    This isn't something I've ever seen, while working in the ER. I worked in a big city, New Haven CT. Police were frequently present and always had an amazing rapport. There's a great respect for each other and complete understanding of protocols, on both sides.
    This truly is shocking.

    There are laws in some states that give complied consent. That means you are consenting to breath test, field sobriety tests, and blood tests when applying for a driver's license.
    Now, remember consent can be revoked at anytime. If a driver revokes the consent then they can lose their license for up to a year or longer depending on the driver's past. The question here is if the driver, who is unconscious, can revoke consent. Many courts have ruled against the argument that the suspect was not able to revoke the consent. They ruled that once the consent is given then the Suspect has to revoke the consent in order for the search to stop.
    As far as the nurse, she does not have implied consent. She never gave consent to use her as a nurse to draw blood. She was not interfering with a criminal investigation. If she tried to stop other nurses, or the police officer who is a licensed phlebotomist, then she can be charged with interfering.
    The Supreme Court has ruled that a warrantless search of a suspects blood while receiving hospital treatment does not violate the 4th Amendment; only when the officer has PC to believe the driver was under the influence. This is to stop officers from drawing blood on anyone they choose without cause. Did the officer have PC to believe the truck driver was under the influence? Just because you are in an accident does not give an officer PC.

    The Updated facts: A. The Truck Driver was the VICTIM of a head on collision caused by a high speed police chase. B. The Truck Driver was NOT Under arrest, Conscious to give consent, and NO warrant was obtained. Also, The TRUCK DRIVER IS AN OFF DUTY RESERVE POLICE OFFICER unknown to the Police at the time. This has ALL the smell of them trying to blame the truck driver for causing a wreck that THEY IN FACT CAUSED! This investigator has the "I'm God" complex, other officers stood around and did nothing while he attempted to violate the truck drivers constitutional rights and violated the nurse's rights. She was after all ONLY relaying the information from Hospital Administration on the phone!

    The patient was a victim of the crash and a reserve police officer to boot.
    This 'dectective' was well out of order. As an ex nurse, no nurse is FORCED
    to take blood. The police have NO jurisdiction in the care of a patient.
    The Supreme Court made it illegal only in 2016 to take blood unless their
    is consent of the patient, warrant from a judge if the patient is under arrest!
    She should sue to make sure it is not done again! Too many incidents are
    swept under the carpet and most offenders do not learn from their mistakes!

    It is called a WARRANT. Police can't just get whatever they need on the spot. I respect Police a lot but this particular detective and his supervisor need to learn the laws. I hope this poor nurse who is just doing her job sues them.

      True, but doesn't warrant the behavior and cuffing. Both of those officers could have gotten on the phone with hospital administration and their leadership and worked it out. It's not that hard to wake up a judge, when there's a dispute of law. This behavior is uncalled for and it damages the relationship between law enforcement, EMS, Fire Dept and ED, who rely on each other tremendously and often have bonds and trust. No excuse for the behavior, no matter how "right" you think you are. Higher Ranking officers should be held accountable too IMHO. They could have easily de-escalated this situation.

      Implied consent only applies if the person is under arrest. That was the third condition. He was not under arrest, so there is no implied consent.

    That nurse is Alex Shaffer-Wubbels, she competed in Alpine Skiing in the Winter Olympics for the United States in 1998 & 2002 (she is an American hero). Another city about to loose millions in a lawsuit because of incompetent cop & his supervisor. The officer was arguing that he had "implied consent" - however, “implied consent” has not been the law in Utah since 2007, and the U.S. Supreme Court ruled in 2016 that the Constitution permits warrantless breath tests in drunken-driving arrests, but not warrantless blood tests.

    Cop was WAYYYY out of line. This video makes me furious! I hope he is subject to some sort of disciplinary action. I can't BELIEVE they are letting him be on active duty during this investigation. COMPLETELY effed up. I hope the nurse sues him for assault.

      Ptay0000 exactly. there was a cop driving drunk hit a mini van full of kids, killed 6 of them doing 112mph while off duty with no lights on. he stayed on paid leave for 4 years until the lawsuit was "settled" with unspecified damages and was immediately reinstated with a promotion and nearly double the pay.
      when the local released that information, he was transfered to another city and got another raise after another lengthy vacation while another complaint, this time for sexual assault, was "investigated". quite the buddy system they got going on.

      Also did you hear what happened to David Eckert in New Mexico a couple of years back? They literally anally probed the guy, 8 different times in one night. They had to pay out 1.5 million for that case.
      Seriously though, if the compensation settlements was coming out of the cops pay and pensions packages instead of the local municipality's general funds their behavior would dramatically improve overnight.

      Behavior improves when individuals know that the consequences of their actions will impact them negatively and in a substantial manner. Nothing does this more than financial pain. Doctors and others professionals carry extra insurance and are super cautious for this very reason.

    These two "police officers" should be thankful that I am neither a doctor or a nurse employed at this hospital or any other hospital. If one of them were brought to "Emergency" after being severely wounded - I would be sorely tempted to behave in a unprofessional manner pertaining to their care.
    I would be tempted to behave as unprofessionally as they treated this nurse who was following lawful procedures. I hope that I would have higher
    ethical and moral convictions than the behavior which they displayed in handling this incident.
    Nurse Alex Wubbels is an honorable compassionate professional health care worker. I am certain that she would treat them with the utmost highly professional care regardless of how they treated her.

    The cops were trying to get her to break a federally mandated law. It really is not just the policy of the hospital, it is a FEDERAL LAW. Those cops need to be stripped of their badges, let go from the PD without any severance pay, and go directly to jail. Exactly what that one cop was going to do to her. He deserves the same treatment, no worse! Because they had to be aware of this law for the last 12/14 years when HIPPA first came into effect. Every agency, hospital, Dr. Day care center, etc, etc, must abide by this law or be terminated or worse depending on the person(s) and/or agency that perpetrated this illegal act. They should be treated no differently for breaking the law, oh i should say, trying to get someone else to break the law for them by, strong arm tactics, gas lighting, abduction, oh gosh the list is long. That cop was nothing short of a being a woman beater and prob would have shown even worse procedures if the camera were not rolling. Husbands go to jail for doing what he did! I can't help but wonder if he is married or maybe i should say still married (I really don't know) but, if he is, I wonder just what he is like with her. If the police depts are supposed to be the long arm of the law, then they need to learn the laws before they can become an officer. It's ludicrous that most of them don't! Just saying...

    Alex gave every legal reason she has under the law to state why the blood sample could not be given. I have lived in Macau and China and have never seen such overkill with someone detained with no lawful cause. Alex saves lives. It is more like serve and protect own interests not the public. What the public here from government departments is talk and no action. You know what is right in this situation that Alex should not have been forcefully detained and the legal reasons she gave ignored. PERIOD. This is such an unintelligent way to undertake police work. The excuse that they Police do some things wrong is like saying a criminal who detains people against their will (kidnap) sometimes does some charity work so it is okay. Police need to intelligently and assertively clamp down on crime. Officer "WE'RE DONE. YOUR UNEDER ARREST" should be stood down in the same level of accountability the public you are supposed to serve get. Under arrest for what?       dsndicmsa the person they wanted a blood sample from was just in a passing truck. A fleeing suspect slammed into the truck driver. The person they wanted to get blood from was a victim in all this. They wanted to see if there were illicit drugs in his system so they could hopefully be free of blame in any future lawsuits the truck driver may bring against them for the injuries he sustained.

    That is so terrible. I am also a nurse. That nurse did the right thing by following policy and being an advocate for a patient. You would want her to be your nurse if you needed one.
