Press Conference: Update on SLC Police and UMED Incident

  • On September 13, 2017, Salt Lake City Mayor Jackie Biskupski briefed reporters on the status of the Internal Affairs (IA) and Police Civilian Review Board (CRB) investigations regarding the actions of two Salt Lake City Police Department officers at the University of Utah Medical Center on July 26, 2017. During the update, findings of both investigations were provided.
    Note: The announcement was NOT the final step in the process. The reports and findings of IA and the CRB will be sent to Chief Mike Brown, who will use them to help guide his decision as it relates to the employment status of the two officers involved.

    This event happened almost 3 years ago and I still get ENRAGED as I did when it happened. I am a Registered Nurse myself and I can say that Nurse Alex is a perfect example of the integrity of OUR profession!!!

    The incident occurred July 26. This press conference occurred in September, after the nurse involved in the incident released the body cam video on Facebook.
    The only reason the nurse posted the video was she had not been contacted by the police, not even to apologize, due to the “ongoing internal investigation”.
    Once the video was posted, the investigation was quickly completed.
    Always film the police. The nurse had to obtain the body cam video through a FOIA request. Fortunately the body cam video wasn’t lost by the police department.

      @@Onullm This needs to stop. As an RN myself with 30 years in the Operating Room, I have been researching this and have found even more disturbing events. Are you aware that officers are taking phlebotomy courses and drawing the blood alcohol levels themselves via e-warrant from a judge? Here's my question: I am exponentially more qualified than law enforcement officers to draw blood, but how is it they are doing it WITHOUT a physician's order???? A judge can write orders all day long, but he is NOT a physician and does NOT have the ethical, moral or LEGAL authority to order an INVASIVE procedure on a human being! If I can't do it without a physician's order, how the hell are they getting away with doing it?

    The nurse released the video because of the inaction of the PD, and the city. Your apology sounds like a bunch of damage control and no sympathy for the nurse.

      The arresting officer was eventually fired (he was also fired from his side-job as a paramedic) and the supervisor was demoted from Lieutenant to Officer.
      Nurse Wubbels received a settlement and she stated part of the money would go towards making body-cam footage more accessible.

    if you have not fired this police officer an his lieutenant that told him otherwise. you are in a conflict of violating a U.S. citizen nurse Constitutional rights if not done so you should be fired.mayor.

      According to Utah newspapers he was fired the next day and his supervisor was demoted. On Oct. 31 nurse Wubbels was awarded a $500,000 settlement from the city and the police dept..

    I have to say that my FIRST reaction to that " officer " attacking and launching himself at Alex was "I wonder how often he beats his wife.". That was thuggish, vicious and, unfortunately, what we are becoming used to with the people who are charged with protecting us. I doubt I will ever trust an officer again. I have no respect for them because they have no respect and regard for OUR rights. His action has become the rule rather than the exception.

    **UPDATE** Last I can see, the officer who arrested her was fired (From his jobs as police officer and ambulance attendant) in Oct 2017. Another officer was demoted. They are both appealing. As of Nov 2018 The officer fired is suing for 1.5 million, saying he should have been offered better training in the blood collection laws, and should have been sentenced to more training. Far as I can quickly see...the city offered the nurse a half million not to sue.

      Don’t forget that the truck driver they were trying to get blood from was in an accident caused by a car being chased by the police. They are trying to cover it up and blame it on the truck driver that’s what they wanted the blood for.

    Until you start criminally charging these thugs with badges over their bruised egos, this is all just lip service. Take away their ability to be an officer anywhere, and put them before a judge and jury with full force. When they are held accountable every damn time, things will change. Period. firing them does nothing. They will just go elsewhere and do it again. Stop them or admit you are just part of the problem and lying to us.

    You see more and more police over stepping their authority. This was one of the most egregious misuse of an officers duty as I have ever seen. Over stepping their authority in this manner can not be tolerated . This is a sad day in America.

    False arrest happened on July 27 internal investigation started days later and took 1 1/2 months during which Police Chief & Mayor didn't view the video and a public statement and civilian review investigation only started after the nurse released the video on Aug 30. Civilian review board begins work on Sept 1 and concludes with findings of wrong doing by detective and supervising Lt. only 14 days later. So why delay by SLCPD. Answer is simply the PD and Mayor delayed hoping the nurse would calm down and drop the complaint so they could coverup the crimes, the the coverup only made the nurse angrier and led to the video being leaked to the press. Had they done something like suspending the bad Cops without pay for 10 days earlier instead of covering up the nurse might have felt vindicated and the video may never have seen the light of day with a private settlement hidden from public scrutiny. The coverup is often worse than the crime and takes down more people.

    I noticed at no time did the officer or his supervisor advise Alex of her rights! He forced her outside,against the wall ,cuffed her and dragged her to his car and put her in ! What about her rights! Way to go Alex for standing up for yourself and your patient who couldn't defend himself!

    Having a Internal Affairs investigation is like asking a thief caught red-handed if he is a thief. What a joke. Most of the time spent "investigating" will actually be used for damage control. The mayor's words ring very hollow. She's more worried about how the incident will affect the flow of $$ into the city and how they might be perceived by the public.

    I'm 72 years old. There was a time in my life that I respected law enforcement officers. There was a time that I felt "bad cops" were an extreme exception. No longer. Now, I believe that one should be wary of all of these officers. What changed?
    Video and the ease of access of information! Now there are literally millions of eyes on police. And that's a good thing. No, a great thing!
    I am among those that doubt this particular incident would have received this much attention without video and without the millions of people who viewed the video and lodged their objections.
    Mandatory police body-cams are part of the solution but a small part ... for one thing, videos taken by police are not easily accessible nor widely available. Unlike private videos, police as a public institution are not free to publicize their videos - they are (legitimately) constrained by laws respecting citizen's privacy. Private videos can be distributed virtually without any constraints.

    Somehow I doubt that the Mayors office got involved with this incident the day after it happened. Otherwise why wait until 2 weeks after the release of the video, which was released 2 months after nurse Wubbles was arrested, to hold this press conference? If she were involved, she at lease would have come forward with this no more than 2 days after the release, and preferably before the release.

    The SLCPD do not face any more danger than any other PD in the US. You need to do right by the public and get rid of these officers. The arresting officer had several complaints against him already and you kept him on the force, that makes you and your department negligent.

      Larry Green if they can get any substances from the blood test then they can say the truckie is partly responsive and reduce any payouts. Also the police can say they weren't responsible for causing the crash. In Australia police must end a high speed chase when there is danger to the community. A lot less police related crashes and deaths over here.

      Richard Douglas Richard that's standard in America too you have to get authorization to pursue a high speed chase you literally have to tell dispatch the road conditions weather conditions n traffic status before being allowed to keep pursuing the chase n most of the time police are told to back down America is no different then Australia in that regard the cops can't take it upon themselves to pursue the high speed chase if it will endanger civilians so I'm sure if that officer didn't get clearance or did that needs to be looked at as well.

      @@sammir6415 They did eventually admit that the chase violated their own policies and the cop that arrested nurse wubbels knew it. he wanted to protect his brothers in blue and would have done anything for that end, he went berzerk, in his state of mind at the time even murder can't be ruled out.

    As serious and unique as this incident is (I've NEVER heard of a police officer assaulting an on-duty nurse before), it highlights an issue which affects every police department in America; Implied Immunity. Nobody, regardless of their job description, should be excused or absolved from personal liability for their unlawful actions and behaviour, why should the "community" have to pay for these officers bad choices?

    I've been following this story since it started,I live and was born in Texas,but I was raised in the Wasatch Valley,attended and graduated Hillcrest High School and U of U , Farmed in Riverton and met and than worked part time for Mr.Larry H. Miller whom believe it or not I met at a Kmart parking lot !!!! He actually was shopping at Kmart !!! He owned the UTAH JAZZ and had dozens of car dealerships and was the most honest and simplest gentleman , swear to God that ,a few times out to lunch at a burger joint called Artic Circle !! He was the most simplest gentleman I've ever met !! I love Utah, consider Utah and the Wasatch Valley my real hometown ...... Well, you'll never see my ass in Utah ever again, u heard that fkn pig on the video were he clearly confesses that they don't care about laws BUT THERE OWN LAWS !! This coming from someone who's been a pig for years ,I wouldn't doubt it ...... How come this never came up ?? What does Salt Lake Police Department have to hide ?? It was really odd they settled the issue ..... There's a saying , that when the river is noisy ..... It's cause it's got a lotta water running thru it ........ PS. You'll never see my ass ever again in Utah .... Was gonna go to my 30th year Greetings reunion in Lagoon late spring , but no freaking way I'm ever stepping Utah ground again !! ..... PS. F..K DA POLICE !! 🖕

    I've been a police officer for 33 years and this is beyond embarrassing. Unreal that even supervision couldn't handle that situation. The nurse deserves more than what she was offered!

    So sad, now I've seen video of police officers arresting fireman, and now nurses in the line of duty. I've watched countless internal investigations, and and found that I've become jaded, and untrusting against our legal, and law enforcement communities. What have we become when we no longer know right from wrong, or stand up against a thug mentality. I've gotten to a point that whenever I hear the words "Launching an Internal Investigation," to becoming synonymous with the words "Cover Up." At some point our law enforcement has learned to react, and no longer think, or have any emotional thought towards the effects of their actions. It is unfortunate because I remember a time when almost every child dreamed of being a police officer, so they could one day protect and serve their communities. Today, we have turned Police Officers into revenue generators, setting up speed traps in order to issue tickets to generate revenue. Gone are the days a police officer became a part of its community, interacting, and becoming known on a first name basis, a true friend, highly respected.

    None of the cops present did anything to stop the behavior. The lieutenant who arrived on the scene after Ms. Wubbles was forced into the police car was attempting to intimidate her with lies.
    I don't think the mayor's job was to sound off with PR statements for the SLCPD.

    The person that they wanted the blood from was an off duty cop. They wanted the blood to protect him when and if he ended up in court and the driver of the vehicle that hit him tried to assert he had been drinking. They were trying to protect a fellow cop. The other thing is that the cop who made the arrest was given an order by a Lt. Kennedy at the station. He flat out told the arresting officer, "If she won't comply, arrest her." I am not defending the "----bag" who arrested her, but everyone focuses on him, and not his boss. Kennedy is the one that needs to go too.

      They didn't know he was a PT police officer at that time. They were protecting their own a$$e$$ because it was a SLCPD chase that got out of hand. Fearing a lawsuit, SLCPD hoped to show the victim had been drinking or otherwise under the influence, so it would make SLCPD less culpable in the ensuing lawsuit brought against SLCPD or by his estate, should the victim die. This was collusion to minimize the SLCPDs already criminal behavior of continuing a police chase when there was a clear chance of injury to the citizens. It's the same reason an officer doesn't randomly shoot at a fleeing suspect on a busy street; the likelihood of injury to bystanders is too great to just shoot the guy who's running away. The guy they were initially chasing was incinerated when he collided head-on with the victim's semi-truck. So the blood was needed only to have an Ace up the SLCPDs sleeve when they are used. If the victim lives he will need ongoing medical care, possibly for the remainder of his shortened life, IF he lives.

      redseven lily once an injury or death occurred an immediate investigation occurs dash cam footage will be reviewed to make sure the officer gave dispatch correct info regarding conditions of the road traffic you now have to get approval n authorization to pursue a high speed chase u literally have to tell the dispatcher who has the commanding officer ok it if the weather is good roads are dry traffic is light heavy or none before you can continue to pursue that high speed chase my boyfriend is a cop things have changed you can't just engage high speed chase anymore Willy nilly hell even motorcycle chases more then likely u get told back off cause it puts others in danger. So regardless if they knew this was a part time officer it has nothing to do with that a death n injury resulted in this chase the cop automatically gets investigated to see if he should have proceeded with the chase n if the info he gave i.e. road conditions were correct. It's clear he knew this n was trying to protect himself that's why he wanted that blood work he knew he had zero probable cause to get it that's why he took it out on the nurse he was mad she wouldn't help him cover his own ass.

    The chief must be subject to this incident also, the cops who mishandled this situation along with the chief who’s in charge of the police department should be made responsible, and receive retribution equally. The man or woman in charge sets the tone down the ranks and this case is no exception. Beyond the official rhetorics and press statement we’ll see how long it takes make thing right and what exactly gets done about it -

What happened if anything to The Officer who put her in handcuffs, also the officer who pushed her escape path, to be placed in handcuffs, also the officer who came upon the scean explaining to her it may be against the law, but you must do as we told you to do inspite of search warrant procedures, with no patient consent, and the patient not being arrested? What happened to those Officers? We Want to Know. They should have all been fired and charged, and convicted. Police the police!

      no word on how to keep cops from breaking the law. none. only we are going to investigate. be patient. this (getting caught on video) won't happen again. the solution is always the same: more training (time away from the beat and instead sitting in a classroom eating doughnuts and coffee) and more pay so that they can help those poor overworked, underpaid, good cops. what a joke!

    The rift can only be healed when SLCPD and the Mayors office are honest and timely involving misconcoduct by its officers. You only responded when your officers conduct was released to the media. Only then did you take disciplinary action against the officers involved. Chief Brown was aware of the incident sometime before the incident became public. knowledge. You were forced to react due to the public outrage by your citizens, national and international outrage began to build. Officer Payne and Lt Tracy should have been arrested and charged with assault, armed criminal action, false arrest, kidnapping, abuse under the color of law. This saga is a long way from over. It is reprehensible that Lt Tracy still wears a uniform of the SLCPD. It is a slap in the face to every citizen every day he continues to wear the badge.

    People don't realize that these officers wanted to violate the rights of that patient by ILLEGALLY obtaining blood. They needed a SEARCH WARRANT. This has been upheld by the US Supreme Court .....PERIOD.. This patient was NOT under arrest ..Even if under arrest , a search warrant IS necessary. This nurse was following her duties required of her license, hospital policy , and the law. She IS A HERO

    I have watched all the videos relating to the assault on the Nurse Wobbles, and what really worries me is that Hospital security wanted to aid tge out of control copper, not the nurse being assaulted !
    This should never be their obligation as it is staff and patients they should be protecting from tyrants and bad people not aiding such individuals !
    What is wrong with them and I do hope tye Hospital have terminated their employment.

    This is nothing more than a politician admitting she didn't watch the video until a week later, admitting that only public attention to this case caused them to get serious about it, admitting that she can't do anything about it because of the police union, and making excuses for 1 1/2 months gone by while "two investigations" take place. Meanwhile the abusive officers are employed and still being paid. If any of us blatantly abused other people like this in our work place, we'd be fired immediately!

    I notice she condemned the people making phone calls to her staff and the police force as a portent but I've never heard her say anything like that about the police officers actions what I have heard was a bunch of mouth moving from a politician protecting her butt and protecting the police she said earlier in another interview this is not who Utah and the police force are this is not what we do well Miss Mayer apparently it's exactly what the police force there are all about because it sounds to me like you're still protecting these officers and the police force and doing your best to sweep this under the rug and hope it goes away quickly.

    What no one in authority has mentioned is that former dirt bag who was a cop tried to get that nurse to commit a crime . If she would have drawn blood or let the officer draw blood it would be violating the HIPPA Laws. That cop should have done jail time.

    I have to say your IA investigation seems to miss the fact of violation of Federal law and although I'm a union man these guys should have been done quickly. And that you're CRB investigated only after the video was released shows a complete lack of credibility. The mayor's staff getting threats is really too f'in bad.
