    What’s most upsetting is that this young woman didnt have one knowledgeable adult in her life to tell her not to sue the manager. Idk how long ago this happened but darling, go to your state’s corporate business website and type in the business name in the search bar. Open the articles of organization and you will find the owner’s name and address. Sue THAT person.

      I believe the owner was responsible for crooky and shady business went down in that store and the manager and owner can come to the store via the back or side entrance.

    I don’t know. It sounds like the company was operating illegally. I think I’d try to dig and see if the company was actually set up correctly to have protection under an llc or corporation. If it was not I’d report the owner and sue him personally. I’d report him to the U.S. Department of Labor for failure to pay earnings. I’d also report him to the Attorney General of my State. At the most I’d get my money. At the least he’d regret pulling that stunt on me.

    The damn manager himself could have taken the money, how do they magically decide it MUST be the lady? I think that the owner was on hard times and made up this crap with the manager to have an excuse to keep 450 knowing they were already knee deep in debt already.

    How do we know the defendant/store manager didn't take the $450 - twice - once from the store and again from her. She said she was paid in cash with no pay stub in the envelope. He could have taken it - both times. Also, the person who closed the store the previous night could have taken it, as was pointed out. Even the other employee who came in that morning with the plaintiff , perhaps when the plaintiff went to the donut shop. Maybe she ate the donut at the shop or on the way back. For that matter, the owners of the business could have taken it as a frame-up if they wanted to discharge the plaintiff for some other reason. I believe the plaintiff. I don't think she would be going to all this trouble to sue if she had stolen the money. If she were guilty, it's more likely that she would want the whole thing to go away. That company NEEDS to be out of business; doesn't sound like anybody knows what they're doing.

    You can't legally doc an employees check without their consent. even for theft doesn't matter that is even a bigger crime than an employee theft of $450.

      @@sharonlewis3979 what no that is not how it works especially for theft only the court can make her pay. Now a place can ask you either we dock your pay or call the cops. But there is no waiver you sign for that it would be voided in any court, because that would interfere with the judicial process.

If you break an item in the store it comes outta your pay. If you give a discount that wasn’t authorized then it comes out of your pay. What you’re talking about doesn’t even make sense… you know how long it would take for businesses to recoup their losses if they had to do what you stated ? Why would a company pay you your regular pay check when you stole something from them ? lol that don’t even make sense

      The "entrepreneurs" that run Corporates branches are some of the shadiest people i've ever known.. They know exactly what they're doing and know how to avoid liability. I knew a guy that would open up a branch, run it for a few years, close it down, change companies, open up a new branch, etc.. He was the shadiest guy i've ever met.

    This actually happened to my team when I was in my early twenties and worked at a popular shoe store. Right before they went bankrupt, they sent an investigative team to our location and accused us of nonsense. It’s interesting that he closed his locations after money goes “missing” and that the mode of payment was inconsistent.

      Usually, they have to write down the bills when counting the money.... 4- $100's, 6- $20's, and so on, on a transaction slip

    This is exactly why when I was cashier and it was time for me to go I refused to leave. I stayed until the draw was done being counted and deposited into the safe. And I made sure they paid me until that was done.

    Pain & suffering is also determined by anxiety & fear. But I really wish people know this prior to filing a court case. Pain & suffering is physical, HOWEVER, that’s after an accident or crime. It’s not for stupid crap like ‘I was inconvenienced’, ‘they made me mad’, ‘they said lies about me’, etc
    Edit: Not just this case, but the rest of the cases.

      I was fired because of my district having a high shortage percentage. It was my responsibility. Not my fault.
      I am educated and confident and I was stunned and struggled to think on my feet.

    According to the law of responsibility, key holders assume charge in the absence of officials.
    In other words, if the manager fails to open the door, but you do open the door, then you are presumed to be in charge and responsible for all matter of business until someone from management arrives and relieves you of the responsibility.

      I don’t necessarily believe that. What better way to try and look innocent than by suing. Not saying she did it. Obviously they can’t say who did and her pay should not have been docked without proof but it doesn’t prove innocence.

      Working in retail a lot of employees walk in and out at random times. I’ve had a lot of my managers at the retail store I worked it would open it so we could come in, and leave to get breakfast or we’d do the samething so her story isn’t surprising. Just because she didn’t come back with anything doesn’t mean she never had it, plenty of people just eat in the car or before they get back.

    Ok, I’ll play the Devils advocate. What if the manager stole the money in the morning when he got there and blamed it on her? Is this possible? YES! Because it happened to me many times while working midnight shift at a gas station. The manager would come to work in the morning and count the receipt money in his office. I was always $10, $15, or $20 short and the deducted it from my paycheck. I complained to corporate headquarters. They sent a corporate representative out and he worked the midnight shift with me and HE deposited all the money in the safe. Every time there was $100 in the till it went into the safe. I didn’t touch the money. He drove to a restaurant before the manager came in. Then about 30 minutes later he showed up pretending he was just arriving to check on the station. He asked the manager how the night receipts were. The manager replied, oh he was $20 short. The manager got fired on the spot and I ended up getting all my money back that they had deducted from my pay check.

    I don’t think she stole it I would have investigated the other stores to see if the owners did anything shady. For them to close down so abruptly.

    The interesting thing here would be to see how long she had been working there along with the one that counted the money down for the deposit.
    Here is where it gets interesting.
    Since the plaintiff was there to open - Seems to me she used that time to her advantage to both take money out of the deposit and hide it as well using the DD as the excuse to leave the store.
    IF she knew she wanted to go to DD she could have done that before you entered the store to open it up.
    The dead giveaway would be - She knew the deposit was still there from the night before and she honestly had no reason to go near it. Knowing there was a camera in place to document her going to the room where there are no cameras in place that can show how long she was back there.
    If she honestly wanted to clear her name she shouldn't have left the store before another manager came knowing she was the only one with the deposit still there in the store along with the fact she was in the room with it.
    The employee that counted the money for the deposit and placed it in the drawer would seem to be in the clear just because there is documentation of her counting it and the time it took to place it there.
    If indeed it was short or stolen at that point - it would have been discovered the next day by the manager.
    Which we both know did not happen. ( He got there late )
    Clearly there is room for an exploit of the camera not being in place and all we have to go by is the timing of who goes into the room with the deposit.
    It seems to come down to who is most likely to have removed the funds.
    If both were suspected WHY did only one employee get fired?
    I would have loved to see the video of the deposit and the video of deposits being made at other times along with the day she was there to open the store and left for DD.

    I use to work for them and yes the business was always sketchy we had to drive to another state to pick up everybody checks and they never really came on time. I had to tell them that they were making me pay my car payment late every week and I have to pay extra fees. My manager was lazy and when they had a meeting she would just stay away from the store my last day was when she held our checks for her to just be hanging out at home.

    Yeah, there’s a couple holes in her statement. If she left to go to Dunkin Donuts, why would she return with no food. And even if the manager is sometimes late, the person who closes at night can’t magically guess when he’s going to be late. So if they stole it, they would be the prime suspect. Now, it is possible that the other worker who was there with her did it, but her taking so much time, leaving the store, and then returning with no food makes her look the most suspicious. She definitely can’t sue the manager though. She’d have to sue the company. The fact that they had an open box and no cameras in the back was a terrible business practice, though, and I’m not surprised they are out of business.

    I kinda understand what she was saying: the nite girl counted the money on camera, when behind the doors, no camera, wrote $800 on deposit, then took the 450 out. (Could have happened). The plaintiff comes in the morning, not knowing its short. But the question should have been asked: how much was in the opening deposit? It could have been anyone bc there wasn't a lock.

      That’s what she was saying, but the judge is saying it doesn’t make sense that the closing employee would do that. Under normal circumstances, that would make the closing employee the prime suspect. The closing employee couldn’t foresee that the manager would be late the next morning, so why would she steal knowing that she’d be caught?

    Initially, I thought that the defendant stole the money. In my career in retail loss prevention, I have had to show up at 3 am to count deposits left in a safe, wait for a store manager to count the deposit and when it didn't match, we would have the manager arrested. There are managers who will either through financial hardships or just want to get rid of someone, blame missing money on them. However... after hearing that the plaintiff was in the backroom for 5-10 minutes and then left the property, it made me think she did it.

    Something is not right!!! Anytime you file for unemployment and they cannot verify the company, the company is not on the right side of the U.S. law. Also, another red flag is there are cameras only in the front of the store and none in the back, where the money is thrown in a regular old drawer. One would think that a legitimate business would have cameras everywhere where money is stored AND that it would be kept more securely in a *S-A-F-E.*
    I think she sued the mgr. because he's the only one she can find. I do not believe she stole anything. I truly do believe she is a victim, in this case.

    Alarms went off with her. She was cornered and HAD to sue otherwise it would be admitting guilt. "...but he wasn't always on time" - yes, but the other employee still couldn't predict what was going to happen the next day and she would've been in handcuffs! No, GUILTY and justice was served indirectly. She'll never see that extra $450. It was all a very risky waste of time. By the way the Judge saying "you should tell the boss we need a safe" made me laugh. Most bosses today don't want to buy paperclips! :)

    That supervisor could have stole the money and said she stole it. He could have known the company was going down.     I worked at a cash only BBQ restaurant that was hit or miss with the food. There was no button for refunds because the manager didn't want refunds done. Since I was the cashier I was told on 2 occasions the register was short and it was suspicious. What the manager didn't know was that his assistant manager would just give people cash refunds without writing anything down. When informed of it the conversation immediately shut down before he could even accuse me.

    I used to work at a Burger King as a young adult.
    We had a manager who, when doing skims, would grab a handful of money WITHOUT COUNTING IT. He would then enter a GUESS for how much he skimmed in the register. He often chewed people out because their register did not match, BEFORE counting the money at the end of the night, and finding out the totals actually matched.

    If you ask me there are three potential suspects. The closing employee, who could've easily counted the total within the camera's view, then swiped 450 and put it in the deposit box; the plaintiff could've went back there, grabbed it, then left to hide it then went back; or the manager who could've thought he'd have the perfect alibi by showing up late then claiming the deposit was short.

      I don't think the closing employee would have stolen it, because she knew she would be the only suspect. She thought the manager was going to come in early & get the money, so if it was short it would all be on her.
      I think it was either the plaintiff (who conveniently did not mention that she came in that morning, saw that the manager was late, spent 10 minutes in the back with the money, then left out the back door...which is really suspicious), or it could be the manager himself, like you pointed out, which would make him really scummy.
