    The CARS Rule also is a big win for honest industry members who already implement the Rule’s principles of truth and transparency at their dealerships. Most salespeople can recount a story of losing a sale to a cross-town competitor who used questionable tactics to lure away a prospective customer. That shouldn’t happen. Dealers who work hard to treat customers fairly shouldn’t have to go head-to-head against competitors who resort to deception to close a deal. The CARS Rule establishes clear rules of the road that apply to all car dealers - meaning that consumers will be able to comparison shop based on truthful claims about price, financing, and service. When all dealers are held to the same clear standards, dealers who meet (or exceed) consumers’ expectations have a fair shot at winning the sale, gaining customers’ loyalty, and earning a word-of-mouth reputation as the dealer to do business with. Another benefit is that the CARS Rule accomplishes these goals without requiring consumers or dealers to fill out more paperwork.
    What are those bottom-line truth-in-car-buying principles? Here’s a summary of what the CARS Rule does:
    The CARS Rule prohibits misrepresentations about material information.
    The CARS Rule requires dealers to clearly disclose the offering price - the actual price anyone can pay to get the car, excluding only required government charges. Before they visit the dealership and throughout the transaction, consumers have the right to know the drive-off-the-lot price. If a dealer mentions optional add-ons, the dealer has to tell the consumer they can say no. And if discussing a monthly payment, the dealer has to tell the consumer the total payment.
    The CARS Rule makes it illegal for dealers to charge consumers for add-ons that don’t provide a benefit.
    The CARS Rule requires dealers to get consumers’ express, informed consent before charging them for anything.

    FYI for those who wish to make a consumer complaint: Do *not* use the Better Business Bureau. The BBB is basically Yelp for old people. They have no legal authority. File your complaint with the state attorney general office and/or the Federal Trade Commission. These entities have legal authority to force unscrupulous businesses to shape up or pay a fine.

      Hi. Here at The Homework Guy team, we always advise people to contact the State Attorney General. Most often, they are more helpful than the FTC and sooner. How is the AG in NC?

      @KevinHunter Fraud in NC provides by statute for automatic triple damages whether civil or criminal. That guy needs to file a police report for forgery and falsification with intent to make financial gain. He has to start there. The AG will ask him if he filed a police report, etc. Laws are not self-enforcing. The victims have to initiate the enforcement process. Mostly the same in every state by uniform laws

    IMO, Consumers NEED the FTC CARS rule NOW! When I see the list price of a vehicle, I want to know that it is the full price (including fees, taxes, license, etc.) before negotiations. For now, the listed price is the "base price" starting point plus BS add on fees plus government fees & taxes. And the "No Haggle Price" dealers want the listed price plus BS "Documentation Fees" and whatever else they can pull out of their backsides. NOT GOOD FTC!! Also, the "NADA" can go do the physically impossible.

    We recently had an accident where a deer ran in front of the car and totaled the car as it was nine years old. We found a dealer selling a brand new 2023 Hyundai Sonata with good discount and Hyundai had an additional incentive to clear out the 2023 models. Basically the "sales guy" presented us with a price about $5000 dollars more than the price on their website apparently thinking we were suckers. I raised a huge stink in their showroom in front of other customers and they relented and we bought the car at the advertised price. My guess is most people don't pay close enough attention to the paperwork. (also in NC but not Greensboro)

    A Mazda dealer, gave me a price then at the last minute when doing paperwork, the Mazda dealer added $1500.00 dealer fees for paperwork over and above what was on the Monroney Sticker.
    I was appalled. The sales manager sent my credit through two different financial companies (I received paperwork from both Financing companies), so I was unsure which company was doing my financing. I was told that Mazda was offering special program with 0% interest and first payment in 90 days (March, 2024). Sales manager changed the paper work so that I would not get the first payment in March. Sales manager made false statements over and over. What a shame.

    I live in Greensboro. I took me six weeks to replace our wrecked car. I've always avoided dealerships, new & used, but I had no choice to replace my car. In many, many years, I have found one honest (but expensive) dealership, two honest used car dealers, and two good (honest) private mechanics. When you check out your car, always check out the dealership, too. This thing about mandated doc fees by the state is a sham. Dealers quote a statute, but incorrectly. The state of NC sets a MAXIMUM doc fee, the dealer can charge any amount from zero to the state maximum. You have to be willing to walk away. Try buying a car near the very end of any month, you may get a better deal.

    I've seen this regulatory litigation process in action before. Generally, opponents of a federal decision-making file the case at the Court of Appeals for the DC Circuit (sometimes called "the nation's second highest court"). The regulations usually give the lawyers some time limit, like 90 days after a regulation is published. These kind of lawsuits tend to go through the argument that the federal agency did not follow the proper administrative procedures (or violated the intent of Congress), because it is easier to get judges to reverse a federal rulemaking based on those grounds as opposed to going into the technical nitty-gritty of the actual federal rule. Unfortunately, this litigation process could go on for several months or even years! Let's hope that the FTC dotted every "i" and crossed every "t" here.

    • @markh.6687
      @markh.6687 3 месяца назад +1

      The trial court could also issue an order staying implementation of the rule, so the FTC just did it themselves while the case plays out. Claims of "arbitrary and capricious" are gonna be hard to get past the court, because the FTC has the complaint data to back up their rulemaking. NADA is running scared.

    Greensboro is a shady town to shop for a car in anyway. Tried to buy a 2019 Pilot from the local Honda store. Had the deal worked out online for a new Pilot and arrived only to find out the vehicle was a demo with over 5,000 miles on the odometer. At no point in the week prior information gathering and negotiation process was this mentioned. Took my checkbook and left.

    Can you make a video about the leech scumbags that raffle vehicles and how they get rich by taking poor people’s money? It’s gambling and they use a loophole where you have to buy their products in order to win entries for the raffles.

    • @Funexpected
      @Funexpected 3 месяца назад

      The whole point of raffles is fundraising, whether for sports teams, social groups, or businesses to make money. People buying into raffles are clearly not poor, and if they are, that's their problem. Having the chance to win something while supporting a cause or receiving merchandise is up to the individual. Should THG make a video on the people who run Superbowl football squares, too, since poor people may take the gamble?

    • @wilfredotour3

      @@Funexpected Playing a raffle as a means to obtain a vehicle is stupid. Making a mouth watering video taunting a hot custom truck at thousands of people who can get one if they do the right thing instead of playing raffles, and inciting them to play along for your small chance to win…it’s inmoral. Lets put it this way. It’s becoming the norm. More and more people are doing it and they say that it’s to help. What it helps is their pockets. 30,000 people out of their money for the organizers to get rich and for one fellow to win his car. Maybe of ot was done to children you’d have a problem. But adults? Fuck adults. Right? Wrong. F u instead.

    While I have not all that many used vehicles, the last one I purchased (at a local CDJR dealership) was factual and honest. Of course I come with prepared loan commitments. Two things I asked for and got were copies of all the repair orders on repairs/updates on the Jeep before it hit the lot and a copy of the CarFax report. I know that dealers always run a CarFax report before they take a vehicle in trade, so they have the information. Ten years later I still have the vehicle, it is a second vehicle, my primary vehicle was purchased new from that same dealership. Incidentally, I have purchased my last 7 vehicles at that dealership. The owner had two dealerships, the other in a neighboring county - while he has sold the local dealership, he still has the other one. If I need another vehicle I will go there. A good dealership is sometimes hard to find.

It took me three weeks to notice the two tone paint and the rust on the left rear door seem of my new car. My mechanic gave me an assessment of all the parts that had been replaced and everything on the left rear of the car was replaced, spindle, drum brake assembly wheel rim, tire and hub cap. The salesman who sold me the car turned red in a flash when I confronted him about it in front of another mark, I mean, customer. After another week of haggling with the manager over the phone where he wanted to offer me $2.000 instead of a new car, I got the new car.
