Drunk On-Duty Officer Wrecks Police Car, Refuses Tests

  • *Nine minutes of footage from this video were published roughly one year ago when the Piqua Police Department proactively disclosed the footage to a local news station. This is the first time that the entirety of the footage is available for public view.*
    The following is excerpted from a supplemental report written by Lieutenant Rick Byron of the Piqua Police Department:
    "On October 27, 2018 at approximately 1937 hours I was requested by Officer Justin Augustine to meet him behind the old Board of Education Office at 719 E Ash Street. Officer Augustine made the request over the radio.
    Upon arrival in the area I observed Officer Augustine's patrol vehicle (P145) parked next to a flatbed semi-trailer loaded with concrete barriers used to separate lanes in road construction areas. Officer Yingst was also present as he had been previously requested by Officer Augustine to meet him at this location to talk.
    After exiting my patrol vehicle I was approached by Officer Augustine. Officer Augustine stated "I was trying to take a piss over there. " Officer Augustine was pointing toward the Southeast corner of the building. Officer Augustine was asked to repeat what he said and he again stated "I was trying to take a piss over there." I asked Officer Augustine why he was telling me this and he advised "Because I f’d my cruiser up." From where I parked and the location I was speaking with Officer Augustine I could not see any damage to his patrol vehicle.
    Officer Augustine walked me to the passenger side of his patrol vehicle where I observed significant damage to the entire passenger side starting at the front windshield and ending on the rear quarter panel. The windshield and both passenger side door windows were broken. I asked Officer Augustine what happened and he stated "I was trying to take a piss," I asked Officer Augustine how fast he was going and he stated 20 mph.
    While Officer Augustine was gathering his personal backpack and other items I observed him drop a handcuff key on the ground. I advised him he dropped it and he was unable to bend over to pick it up and fell forward stepping over it. Officer Augustine never picked up the key so I picked it up and handed it to him
    After Officer Yingst left with Officer Augustine, I photographed the damage to P145 and the trailer that was struck. I had previously had dispatch contact Lumpkins Towing to pick up the patrol vehicle and take it to their shop to be placed inside. While the tow truck operator was on scene Officer Yingst arrived back and advised that he felt I needed to go on station to deal with Officer Augustine as he appeared to be impaired and was demonstrating odd behavior to include hugging and kissing him and other officers and telling them that he loved them."
    Officer Augustine resigned. He was later found guilty of first-degree misdemeanor weapon under the influence, amended down from fifth-degree felony improper handling of firearms in a motor vehicle, and first-degree misdemeanor physical control of vehicle while under the influence, amended down from an OVI. He was sentenced to one year of probation, 177 days of suspended jail time, a $300 fine, and court costs, plus an additional three days in jail, which were dismissed after he completed an educational program.

    There is no sympathy for this guy. He got drunk and didn't give a dam about other road users whose lives he may have taken. His colleagues who tried to help him mentally but at the same time showed no favour, only professionalism, are a credit to their force. The public needs to see the cameras work both ways, and police have a very difficult job from many angles, which is why the public needs to see videos like this. John ( Retired Officer UK). 🇬🇧

      Probably not, a police officer in our community pulled a gun on another cop in the office and only got 1-2year suspension with pay.
      Makes no sense.
      He didn’t even follow the rules they made for him like no drinking, I seen him drinking every weekend lol

    I lost my drivers license 24 years ago and was in addiction for 23 years but now I have almost 5 years clean and sober. And even in sobriety I am still trying to get my drivers license back. Before my addiction I was an EMT/ fire fighter on a volunteer fire department and I crashed my personal vehicle responding to an emergency call but I was not under the influence at that time I didn’t even drink or take anything. After getting into the accident I was cut from my car with the jaws of life by my own fire department members. After going to the hospital and getting prescribed narcotic pain medication I became addicted and later on ended up getting pulled over. I can’t find a job because nobody will hire anybody without a license. And I can’t pay my fines without a job. Hard lesson to learn is once you make a mistake in life you will pay for it for the rest of your life. 2 years ago I worked as a drug and alcohol addictions counselor Peer Recovery support specialist. And now I’m am looking for a job but no license no way to travel to work.

      Congratulations on your sobriety!! Is there a UPS in your area by chance?? Not sure if you have limitations from your injuries, but for loaders/unloaders, they hire and do all the onboarding online. No in-person anything until orientation. Half of the crew I’m on doesn’t drive/have transportation. They take the bus or carpool with those of us that drive. The closest bus stop is still 1.5 miles away from our hub, so I time it where I can grab 3-4 coworkers when they come off the bus if they want. There’s lots of us that do this, and I’m sure you’ll find people willing to do the same no matter where you end up working! Best

    He got no DWI. No jail time. All the original charges were reduced. There is no dash cam or body cam from him. He was never booked. Never handcuffed. They didnt even frisk him for an ankle gun. That's just not right.

    This breaks my heart for both of them. Hard one to watch. I know what its like to be an alcoholic and lose everything. You can turn it all around, but it will take time. I know its like the worst day of his life. Im glad he didnt hurt anyone. Im almost 10 years sober now, and almost done getting my degree to help others through it. Addiction does not discriminate.

    This is so sad to watch. I don't know what's going on with this officer, but he is obviously suffering. He's struggling, that's for sure. It's good to see that he has a fellow officer that is genuinely concerned for his welfare and is doing what he can to help him.     Body cams are the greatest thing to ever happen to police. Videos like this that show accountability helps to restore public trust. There's no more being above the law.

    The officer with the body cam, breaks my heart. He was put in such a difficult position.
    He was the only officer there. Only officer hearing admition of intoxication but obviously the other officers friend.
    He cant step away from this situation because it's his job and responcibility, but you can hear the heart break, stress and dificulty the arresting officer is going through. He doesnt want to be in this situation. His friend put him in this position and there is no option for this cop.
    People in the comments are stating that he was going to allow him to drive. But he didnt know he was intoxicated at that time. He mentioned that he knew there were other things going on in the intoxicated officers life. Which meant he probably knew he was going through a difficult time and putting the behaviour down to reasons of shock, distress and mental unwellness DUE TO THE ACCIDENT. He didnt just allow the officer to drive away but showed concern and compassion by following him out to carpark to try and ascertain if the intoxicated officer was MENTALLY and EMOTIONALY fit to drive.
    I really really hope that the arresting officer was given some help.and counselling to get this off his chest, mind and soul.
    A person can do the right thing and yet still be weighed down by the emotions of the action. It seemed like they were friends. They knew each others families and they knew outside curcumstances. This arresting officer NEEDS support and reinforcement for doing the right thing and recognition about the level if difficulty this arrest would have been. Such a sh**ty thing, doing the right thing sometimes. I have such a high level of respect for this officer.
    P.s. i really hope the intoxicated officer got some help too. Sounds like he is also going through a rough patch. 😢

    I know how the drunk cop is feeling. He’s realizing this is the moment where his life will change forever, and he will (hopefully) have to work SO hard to climb out of this mess. Been there myself. Lucky for me, after 12 years of struggle, I’m two weeks away from reaching that very last step of getting back to where I was. He absolutely deserves the consequences of his actions, but I hope he was able to move beyond this.

      May Haughey if you read the stats on cops and firefighters the majority of them go through mental struggles and have ptsd. Lots of then turn to alcohol and it goes down hill from there. Highest rate of suicide than any other profession as well as divorce rate. These people do not get a break from the hell they see everyday, that is their life they live through it at home as well.     It’s ironic to see so many people in this comment section have so much empathy and compassion for the cop who drove drunk and wrecked his vehicle, but not keep that same energy for the majority of civilians that drive drunk and wreck their vehicles in similar videos. When it’s an average citizen or someone who looks like an addict/alcoholic (same thing), those comment sections are filled with people criticizing them, laughing at them, and mocking their behavior. But here you have a cop doing basically the same thing, and everyone feels bad for him. I’m a recovering addict and I think this cop and the civilians that drive drunk both deserve compassion (with the proper consequences). So the next time you watch one of these videos and it’s a civilian, just remember that cops are no better than they are, and they make mistakes too. Whenever I see videos like these, I think about how this is probably the rock bottom moment for these people and I hope they were able to get help and find change. It’s a struggle every day but it’s a struggle worth the fight

      He pays for the rights to use them too. Almost every department charges for footage and files, and that's only offered if it doesn't affect the ongoing investigation. It's gross they can hide footage like that, so people like Real Police are amazing.

      Jeff DIxon - that’s interesting. I started to wonder just what has slipped through the cracks after I saw that video of the police officer who was found to have ties to white power gangs and had multiple serious charges in Norway, that somehow, the stateside agency that employed him completely overlooked. He was on the job as a cop for at least a year prior to their discovery of it, if memory serves.

    Hats off to the sober cop, he handled this with extreme professionalism. The drunk cop is obviously a broken man who needs help. I could hear in his voice and see in his eyes that he was desperate and on the brink of reaching his breaking point. There should have been multiple other cops there because this man seemed like he could snap at any moment and become extremely aggressive.

    Body cameras are a real blessing for cops! This video demonstrates exactly what cops deal with and just how great some cops are in this country. I hope the drunk cops gets the help he needs to turn things around. I hope his supervisor sleeps well knowing he is kind, fair, compassionate and level headed and deserves praise for his professionalism.

      I think the only reason he didn’t cuff him right away was because there would have been a fight, and he was by himself. Even civilians get uncuffed once they get to the police station. The superior officer even told the arresting officer to treat this like a “normal DUI”. He is getting the same penalties as anyone would get for a refusal. He was ordered to take a blood draw (which they only do to civilians if it is a suspected drug DUI). So that is actually more severe. Civilians also get picked up after they are done with their paperwork. Some states require a mandatory hold, but a lot of states allow a sober person to pick up the drunk driver as soon as the paperwork is done. I’ve seen drunk drivers call for their ride before they even leave the scene. There was not much done differently. Aside from being cuffed from the scene to the station. Once inside, he was treated like any other DUI suspect. If anything, he received harsher penalties than most drunk drivers. Most drunk drivers don’t go on immediate suspension or lose their jobs.

      I feel the exact same way, however with him being drunk on the job he was done prior to the crash. Luckily he didn’t pull over someone and decide to snap with his equipment and attitude out in the field. It’s unfortunate but this was best case scenario as far as safety goes?
