    Yes! The police will pursue you mercilessly over 33 in a 30 zone. Just after they've cleared the backlog of hurty microaggression tweet offences but before things like robbery and burglaries because they're, like, really hard work.

    I just try my best, not to mess up when driving. The same goes when it comes to tax, mot and insurance. Also goes with my job. I am a professional psv and lgv driver. When driving I am under constant scrutiny. Digital Tachometer card. Onboard telematics. Onboard cctv. And including the five year training course DQC. My point is, if you fuck up, own it and get on with your life.
    I know many drivers that have tried to con the way out. It don’t work.

    I once received an FPN for speeding on camera on a Saturday morning 200 miles from where I was. I accepted that mistakes happen, but what riled me was that the only options offered were to admit it or to name someone else - no means of challenging it. For that I had to write to them (thanks to an internet legal site for that advice) to tell them they were wrong.
    But then what really angered me was that I never heard another word; no acknowledgement, no further action, no apology, no explanation. Was it mistaken ID, cloned plates or what? I'll never know.
    I did once get a genuine speeding ticket in a hire car in Germany. There they automatically give you the pics of the number plate and the driver's face - why can't they do that here?
    (That incident cost me way more in transaction charges than the fine itself, but that's another story.)

      Same here. We bought a car from Kingston Toyota but unknown to us it was being driven to the garage from elsewhere in Surrey.
      A dealer delivery driving a brand new car cross country that you are actually picking up from the dealership is something of a mickey take anyway. But two weeks after collecting the car (and an absolutely foul bottle of cheap champagne) an FPN arrived.
      Luckily it was dated the day before we even collected the car - but Toyota would not say who was driving and the FPN issuing authority never replied to our challenge or confirmed the FPN had been cancelled.
      Btw Toyota did take their 'revenge.' The car acquired some prominent scratches on it bonnet during its one month check-up. The manager had to park the car inside the showroom right outside his office to "guard" it whilst the scratches were fixed (badly). We cut our losses - which seems a philosophy forced on most motorists.

    Loophole #8 - Drive a company owned car and have the proprietor's wife (who can't drive) take responsibility as the fleet manager.

    @Blackbeltbarrister Question. Do the new laws regarding vehicle registration plates in the UK apply retrospectively? If you have a vehicle with a plate that was manufactured according to the previous regulations and on the vehicle before the law came into force have to be changed or is it "legal"?

    Afew years ago, a pal had a NIP and was going to pay up. I said he'd better ask them for a photograph to ID the driver, which he did and it turned out the his girlfriend. I assume that if he'd just paid up he could have been inadvertently perverting the course of justice. What is the situation regarding a spouse giving evidence against their husband/wife. Is it still a thing and if it is I suppose motoring offenses are exempt?

    As ever, thanks for the clarification. This may be related, so can I please ask how the court regards the following:
    1) An N1SDT form that claims damages, but does not provide evidence to support that claim.
    2) A notice of proposed allocation to the small claims track, still without evidence to support the claim.
    At what point in proceedings does the court expect evidence to be provided and why would a defendant need to respond to a form N180, when no evidence for the claim is provided?
    Hope that is an interesting topic on how the court system works and at what point a claimant must provide evidence and perhaps at what point a defendant can seek compensation for a false claim.
    Perhaps one day the court will provide a flow diagram!

    Have you done a video on private company wardens or council wardens yet?
    There's a place near me where dog wardens are detaining and demanding details of folk..I'm fairly sure they don't have these powers but a video specific to these people and their powers (or rather lack of) would be greatly appreciated...thanks...

    I managed to get prosecuted for excess speed and opted for a driving training course. Then Covid arrived and for the last three years I have received letters from the Court deferring my case. Is there not a statute of limitation for an intended prosecution or alternative.?

    Hi I’ve been given a traffic offense report over 6 months ago,I’ve just had the paperwork that requires a plea. Do I have to go along with it or have they left it too late to prosecute? Do you have a website or helpline I can refer too

    The NIP requires you to admit it was yourself driving, or name the other person. If you fail to do either then you are nailed for failing to disclose and they charge you with that as the offence. It is a bit Moreton's Fork. However, you have the right to remain silent, you cannot be coerced to self incriminate and you have a right to a fair trial, which is denied if you are forced under duress not to be silent and confess, and forced under duress to confess. All of these are in contravention of the basic tenets of English law. I took on the local Police Safety Partnership entity and would only reply to the Chief Constable. He wrote to me to say they were taking no further action. All true.

    Dan is it Correct if You recieve a Fixed Penalty after 30 days of the Offence its invalid providing its not a Hire Vehicle where there might be delay in Replying from the Hire Company

    I can't understand why people would even try to lie in any of these events that you put forward today BB. If caught lying, you might find yourself in prison. Definitely not worth it.. These are all very minor infractions, so just take it on the chin, you'll be glad you did in the long run.

      What grips me is we get points on our license and 5 years worth of increased insurance premiums for a minor speeding offence, yet Boris Johnson and his boys, celebs, police, pedos can do whatever the hell they want and get zero punishment.

      The law is very different to the legal
      Legal is created by Parliament Acts.
      Legal exists to fine persons.
      Acts are Acts, you only believe its different to the theatre through years of brainwashing.
      When God gave man dominion over all of earth including all living creatures he gave it to you also
      But you were tricked like we all were into English taught in school, slave english legalese

It was unbeknown to them, but just like you register a car and become the registered keeper, not the owner
      You become the keeper of your baby, you're as with a car responsible for its fuel and running costs, but if they want to impound it they can. As they are the owner, you must pay the fines only.

    I never carry my drivers documents whilst driving, and I certainly wouldn't keep them in the car. Someone told me recently that it is law that you must have them with you whilst driving - is this true?

    I have a question that's been a topic of debate for years now. This could apply on a motorway with 3 to 4 lanes but for argument sake Iets go with a Duel Carrigeway. You are in the offside fast lane trying to merge back to the left lane with busy moving traffic whilst you notice a police vehicle at high speed approaching you from behind with their emergency lights on. Do you (A) stay at 70mph and wait till it's clear to move over the left lane or (B) do you make an exception in this instance and adjust your speed so the officer behind can pass you sooner?

      I did something similar to avoid the fast approaching vehicle. I exceeded the variable speed limit and received a fine. Contesting it failed miserably.

      @@paulcollyer801 it's a given that no matter what scenario is at hand the only way to stay safe is to play safe. I can only imagine how that must of been in your case and your daughter feeling pressure as someone just starting on learning as we all had to learn from the bigining. On the plus side it's good to have a little challenge here and there that takes you out the element of surprise as it's something to take on board when it comes to not just your test but also there after towards your experience when your on your own no longer under supervision by an instructor and your not unstuck as to what to do. All the best to your daughter with learning on how to drive.

    Who needs to be insured whilst using your own car which is insured to facilitate a student whilst teaching them to drive. Does the student need additional insurance or does your own insurance cover both of you.

      Initial contact by the authorities will be with the leasing finance company as their details will be used for the registered keeper. Upon receiving such notices, they will locate your name and contact details from the lease contract, and pass them onto the authorities. A revised notice will then be sent to you.
      At this point (given the video is about loophole myths) it is probably worth mentioning the 14-day requirement on Notices of Intended Prosecution (NIP). It is required that the notice is served to the registered keeper within 14 days of the offense. That being it should be sent such that it could reasonably be expected to be received by the registered keeper within 14 days. Other people in the potential drivers chain don't apply. So on a lease vehicle, if somebody thinks they may be receiving an NIP for their driving at some point, reaching that 14 day point won't mean anything for them.

      @@keithcolman9868 that may vary from provider to provider I guess. In hire-purchase or financed-purchased agreements I believe you would be the registered keeper. It's been a few years since my last lease, but I did a quick check before posting my initial response, and the information I see was the same as my prior experience, which was that for a non-purchase lease, you aren't the registered keeper.
      But as I say, That may depend on the leasing and financing companies involved.

    Correct me if I'm wrong but I've seen posts saying you can be fined for using your phone in a drive through!! I thought it was Private Road and Not public road ! SO WHAT RULES APPLY???

      Public access, same as with a public car park so the RTA still applies.
      That said if you have a problem the experience seems to be the police will attempt to fob you off and claim public car park (or drive thru) = civil matter.

    Hi my name is hamid barkaat my license is about 7 months old about 4 days ago police stopped me for driving wrong on motorway then they have checked my drug test and alcohol test but they haven’t find anything in the test after that they have my insurance they found different address on insurance and license now they seized my car can u tell what they gonna do in a future are they going to send a fine or any penalty points

    I won't challenge for my poor sighting, but would seem unfair on the A10 in North London this Feb month changed the speed limit from 40mph to 30mph this week; I have been driving that stretch for 25 years and didn't know or observe the sign changes or knew TfL had changed that section this month. Would the police have any leniency in the law or grace period, that drivers didn't intentionally know or be extra vigilant of the signs. Its a fair cop i was doing over 30mph and have to take the points and learn from it. It's only money for hardworking people it is unfair when signs are poorly visible. I have warned friends and families but my barrister friend tells me it part of the risks of owning a car in London these days that i agree.

    Years ago it was common for fully comprehensive insurance policies to cover the policy holder for driving a car not owned by them with 3rd party cover. This is however no longer common practice and most car insurance policies DO NOT cover 3rdparty cover for driving a vehicle not owned or hired by the policy holder. So always heck your policy before driving someone elses car, I was nearly cayght out like this a couple of years ago, when I checked with my insurer "Churchill/ Direct Line i was NOT covered when i was required to drive my sons car home, I was able to obtain a temporary cover but do ask if you are in this situation..

      Driving somebody else's car with 3rd party insurance is as bad financially as no insurance at all. What happens if you have an accident? Who pays?

      @@andrewrobinson8447 If you have 3rd party insurance and have an accident the insurance pays for any damage to the 3rd party vehicle or person/s but not to your vehicle, if the 3rd party is responsible for the accident then their its their insurance that pays, if they are uninsured then your insurance will pay but recover their own losses from their own underwriters. It used to be quite common for people to have only 3rd party insurance in the past as second hand cars could be bought quite cheaply and were not worth paying extra for fully comp, but things have changed drastically over the last 30 /40 years with claims getting bigger and costlier due to the increase in ambulance chasers fraudulent whiplash claims. Maybe the olden times really were the good old days, when people were generally honest.

    3:42 - I think deception as to the driver is far more likely to be charged as fraud under the 2006 Act. NB: The SC Guidelines (for some reason) treat fraud far more severely than common law perverting the course of justice

    I issued 2 infringement notices to a vehicle this morning, as I was printing the second of these a male approached the vehicle. I asked for clarification as to whether it was his vehicle, which he confirmed it was, and called me a wanker. I offered him the notices, which he declined to take, so I affixed them under the wiper blade and moved on to the next vehicle.
    The driver decided in his wisdom that the best way to deal with his notices was to remove them from his screen and walking up to me he told me where I could stick them and thrust them down the front of my vest. Following this the driver walked away from his vehicle leaving it parked in a P5 time limited area.
    Once I had finished the notice for the other vehicle, and updated my officer notes on the tickets that were still lodged inside my vest, I issued a third notice to the vehicle for the time limit offence. To avoid conflict I decided it prudent to post this notice out rather than attach it to the vehicle.
    The two notices that had been attached are considered to have been served and will not be posted out, if payment has not been received in 28 days a reminder will be sent. The next step after that is for the bailiffs to visit.
    As was stated in the video, don't ignore notices that have been served, address them promptly, and however frustrating you may be to receive an infringement notice, be polite, if you contest a ticket the officer will delight in repeating to the JP/Magistrate/Judge all the abuse to gave them and this will help their case not yours.

    Just drive like a sane person! Cars are dangerous even when everyone follows the rules, speeding and parking inconsiderately are even more major offenses than people think! Driving is a privellage- one we make too accessible- if you can't follow the rules you should be on a bus!

    If you were riding a motorcycle in the 80's you got to know the law pretty quick due to being pulled over every other week (sometimes more) and often for no other reason than mode of transport (oh yes it was). Then we took our chances, laid on the BS/charm/humour/ignorance and talked our way out of it, or hope the cop wasn't a mardy tosser

    No driving offence is a CRIMINAL OFFENCE so has nothing to do with the Po-lice. How ever theft and high way robbery is a CRIMINAL OFFENCE as carried out by the Po- lice. As for perverting the course of justice how about presumption and assumption they have the right to pervert the course of justice that some one is going t to pay their penalty charge (Bill) and no generally they don't care who it is along with the burden of proof is on them to prove their case and as we are innocent of a crime until proven guilty that is their job not ours. They simply change the rules to suit them selves. Shall we move on to threatening behaviour ,intimidation, harassment and force they use on you should you wish to challenge their position? The way offences (not crimes) are administered stinks to high heaven. No victim=no crime, a civil matter not criminal so nothing to do with the revenue collecting private company Po-lice FORCE as opposed to service. No wonder they have no time to deal with crime, it's not profitable.

    Its not a vehicle and you are not the owner nor are you a driver
    You're a keeper only

    The problem is that public transport is never ever going to satisfy the requirements of people. Most households rely on two partners working. People workplaces have many differing start and finish times. And, public transport is always more expensive. Millions of people would not be able to get to work, look after aged parents etc, if they did not have a vehicle to rely on.
    On top of this, most garages are used for other purposes because modern day homes are too small so the garage is either another room or a store room and councils often allow garages to be converted.
    So the roads are too narrow to allow opposite houses to park in the opposite sides of the street and would restrict bin lorries and emergency vehicles.
    What do people do?

    Road traffic act... Acts and statutes do no apply to the living man/woman. Which is what we all are. Yet they want to ruin our lives with fines and points.

    With the 10% +2 police policy why do people get tickets for 33 in a 30 and what about going down hill is there a defence for this?

      Because there is no such policy. Its a myth.

      Most forces 30 is 30 etc the plus 3 or the ten per cent rule is up to each police force. As most speedometers are very accurate and some digital no room for error

      @@keithcolman9868 Its not a complete myth. Its from guidance on speed enforcement set out by the national police chiefs council on when a prosecution would normally be taken forward. Where people get it wrong is that any individual police force may set their own, differing policy and of course as its guidance and not law a prosecution can be instituted at any speed above the tolerance of the approved device used to record the speed. Although again from the strict legal definition of speeding the offence is committed as soon as the speed limit is exceeded, it isnt possible to convict within the device tolerance as its not possible to prove the limit to have been exceeded to the without reasonable doubt standard required in criminal prosecutions
