The judge has been extremely fair, unbiased, and by-the-book throughout this entire trial. From my understanding, this could benefit Johnny Depp in the long run. If Johnny wins, Amber will undoubtedly appeal. She won't, however, have a basis to appeal for reasons such as the irregularity or discrepancy in the application of law, violation of rights, or fault in judicial procedure. The judge is handling this case like a champ.
Oh absolutely! But I believe she will attempt to appeal on the basis of /ineffective council/. We have seen how callous she has been, throwing her team under the bus on the stand, etc.

I actually kinda feel bad for them sometimes. How effective can you be when your client lies constantly, your own witnesses don’t “cooperate” with you … i don’t know the rules, but I would’ve walked weeks ago based on the fact my client lied to me and the court. Can they do that?

I love this judge. She’s smart, prudent, and patient. She has handled this case without bias, with respect for the essential dignity of all those involved in this trial. Her confidence stands out without pomposity or authoritarian tendencies. She has strong, dignified interpersonal skills that command authority.
And she has such a gentle tone that it would be hard to be ugly towards her. She takes her job seriously and with kindness.

Although that is all great for JD it'd be a serious blow to men facing domestic violence and abuse, it would be a great loss for men in similar situations at a time where we try to bring attention to a widespread and serious issue that has been glossed over for ages.

@@balkantvofficial it means that if JD wins AH can't appeal. The judge is unbiased and is allowing the evidence or lack of be heard. This allows the jury to deliberate fairly with all of the testimony and evidence or lack of evidence to make a decision. So that AH can't appeal or say that she didn't get a fair trial. I'm all for JD but I would hate it if AH was able to appeal because the judge didn't do her job.

Just so y’all know, ITS COMMON to have motion to strike a counterclaim as dismissed. Granting a dismissal of a counter suit in cases like these are very very rare

@@SweetTea742 depps lawyer moved to strike the counter claim. The judge can only do that if there no remotely credible evidence to support the counter suites claim. She went over the tiny amount of supporting evidence for her reason to dismiss the claim (the defamatory statement was made by depps lawyer which means it's legally inferred it was made by depp)

It’s been very clear who should win, but prolonging this just adds insult to the injury of the true victim. I do hope we can see this case end soon so Johnny can start healing and focus on rebuilding his career.
Both sides will have, per judge’s order, to rest their case b4 Memorial Day or just be stopped by judge herself who counting the few hours each side has left to present their case. I don’t expect jury deliberations to be too long even faced with so much data. They’ll have a clean laptop @ their disposal to review all recordings & testimonies. This will further save time instead of writing 1 question at a time, passing it to bailiff who in then passes it to judge as it was done in the past.

I have a lot of respect for the judge. I think Amber's counterclaim is total BS but legally it's for the jury to decide whether the statements were malicious, untrue and made in Depp's behalf. If the judge were to deny the jury the right to make that call, amber would have a great shot at winning an appeal later on.

both parties at one point wanted to drop the case and the judge denied both times, so I am assuming that since the judge wants to play this out for the sake of the jury, the punishment would be worse and finalized. You are correct.

This whole case is ridiculous. There is proof with her own mouth that she's the abuser. He never even raised his voice at her in any of the recordings I heard. I believe he loved her alot but she does show classic bpd signs which I myself have. It is not easy to love with people who have bpd. He needs his name cleared. Yes he does stuff people don't agree with and perhaps needs rehab and counseling but he has not been proven in any way to be an abuser.
This case isn’t about proving Amber or Johnny the abuser. It’s about proving that Ambers claims are lies about Johnny and that caused him troubles with his career and reputation. Amber is counter claiming that it was the other way around. Either way, Johnny has already been exonerated in the worlds eyes thanks to this case. Whether he wins or not.
There is a decent chance he may not win this case, but he will come out on top either way. The judge made a fair judgement not to dismiss this case, and it could potentially pave a way to an even larger victory for Johnny if he does win. Amber will not be able to make an appeal.

The judge won't dismiss this at this point. It's very rare for that to happen. She always intended to leave it up to the jury. It's safer that way. Makes the case stick better. Ben knew this, but he used this time to address the public. Savvy.

Furthermore, I believe the highest amount of losses the expert witness for amber heard spoke of was “ up to 40-50 million, potentially”- and since so many people (we don’t know what jury believes, just what we have seen from the public) don’t believe even that was proven, if against all odds she was awarded.. I highly doubt it would be anywhere near that amount.. just imo.

Johnny’s lawyer failed to mention. It’s not only her abuse of the system. It’s abuse, (just a different form of abuse) regarding her verbal actions towards JD.
Johnny was not given Due Process with a false restraining order. This is unconstitutional and simply Amber abusing the process of our courts for a bad purpose, including attention. She should be held accountable.
It was a valid order based on being obtained with false information. Heard is a liar. With TRO's, the order is temporary. A TRO is issued until all parties can be present to see if the Temporary order is made permanent. The court does this to keep the parties separated until the court can hear all sides to determine if a permanent order is to be granted on the initial complaint.

The judge is fair, and dismissing a case isn't something that is done often. This doesn't mean Amber and her team are wrong and lying, because at this point it's a fact and their case is a shambles. All this does is provide Depp and his team to further embarrass Amber and her team.

Another thing to point out is that she and her team, KNOWS that she isnt going to win this case! The only thing they have against JD are drug and alcohol use. Thats their main thing against johnny, theyre trying to paint him as a woman beater(no evidence of alleged abuse, and even police and security said they didnt see harm) fueled by drug use. Theyre just slandering him, THEY WANT HIM TO SETTLE! Maybe I'm looking in a bit too deep out of my own personal bias, but it *almost* appeared as though Depp's team really didn't plan on having the motion to strike granted, BUT - rather take that opportunity to get on the stand and summarize/remind the jury of all of Heard's wrongdoings and highlight the evidence against her. 9 uninterrupted minutes just to...refresh the jury of everything so far.

One of the biggest things that compels me to believe that Amber Heard was outright guilty of defamation is the fact that this - being the alleged abuse of Depp against her - could have been directly reported and processed through legal means.
This is the reason why we have a system, laws, and ordinance that set us apart from other animals. This made us become more civilized... But she didn't.
She wrote an op-ed and promoted it, so the argument that "she wrote and had that op-ed published was for her to somehow get more publicity and fame as Aquaman comes out" is valid.
I love it when he said, "the law is the law!" Because it seems to be forgotten and pushed aside in this case.

Yes it’s ridiculous everyone knows that, I’m sure the judge does too, but she is there to uphold the law, and by the law she can’t allow her personal feelings to interfere with the case. She has to uphold the counterclaim as it can be proven that Heards career was negatively affected by Mr Waldmans statements. We all know she’s lying but by the law the counterclaim has to be upheld.

It's up to the jury to decide if there was actual intent. It makes sense in a legal regard, which isn't always the same as the court of public opinion.
Because that's not her job, and everything she said here was absolutely correct and lawful. Just like the arguments she made when dismissing the other team's request to throw out the whole case just a couple weeks ago. They didn't have grounds to dismiss either.

The gist: actual malice is for the jury to decide. Just my impression but I get the feeling the judge didn't see any evidence of actual malice anywhere. If she had I imagine she would cite it when denying the motion to strike.
Also remember that truth is a defense for defamation. If the jury feels like AH's accusations were actually a "hoax" after all, there's no defamation.
