Let's say si fresh grad na on probationary employment sa start-up company (10 month-old company) sa HR position, with less than 10 employees ay bigla pong inassign to handle 4 more sister companies/branches kasi less than 10 lang naman daw ang number of employees ng start-up. During hiring, hindi po siya sinabihan na ganyan pala ang gagawin. Akala po ni employee na sa company lang na inapplyan niya siya magwowork. Wala ring nakalagay sa contract na ipapasa-pasa pala siya sa sister companies. Si probationary HR is 3 weeks old palang, and the company timeline plans to use said employee within 4 months to handle 5 companies/branches agad while on probationary period kasi kako "overseeing" lang naman daw, with no discussions relating sa compensation or even the chance to ask the employee kung papayag ba siya or hindi. Pasok na po diba ito sa exploitation? Pwede po bang mag say no si probationary employee? What would be your best advice po?

Is the decision of NLRC on appeal ordering reinstatement likewise IMMEDIATELY EXECUTORY even pending appeal to CA? Thank you very much in advance po.
that is different. you need to ask for a writ of execution when the decision of the NLRC becomes final and executory. ang covered lang kasi ng Art. 229 ay decision of the LA at hindi ang decision ng NLRC on appeal

Sir, question po. If employment contract provides for, say, 6-hour normal working hours, then the employer asked the employee to work for 8hrs for two months. Is the employee entitled to any extra pay for the 2-hr extra working hours? If yes, ano po tawag doon sa extra pay? Sorry po.
thats not what the law provides but if the parties agreed so be it. their agreement is their law. there is no term under the law because overtime work is normally after eight hours. let us allow the parties to call it the way they want in their contract
