    In my five years in lawschool, ito pinaka da best na free lecture.. parang wala na ata tatapat nito.. boring kasi yung iba, mga monotone, eto ang anda ng audio.. kaa pala take 1 yung friend ko sa USJR Cebu, cum laude pa..

How about those employment contracts that contain a stipulation requiring the employee to reimburse in full overpriced "training expenses" in case the employee resigns before the end of the stipulated period?

    I am repeatedly watching this video Atty. and I found it fascinating. I'm just a bit confuse regarding sa article 926 bakit 1-2 years ang probationary contract ng mga private school teachers then after the said contract another contract na naman if gusto mo pang magtrabaho.Legal po ang practice na ito? Maari mo po bang ma enlighten mo ako on this situation po . Thank you very much, Atty.

      Thanks but that is art 296.. probationary period. pls watch again. the probationary period for private school teachers is maximum of 3 school years as provided by the Manual of Regulations for Private Schools that is affirmed by the Supreme Court in a lot of cases one is Magis Young Achievers vs. Manalo.

    sir, pwede po ba mag POST ang isang retailer store ng JOB HIRING ng employee /worker na ang Contract nila ay fix-term for less than six months, at walang malalabag na batas sa labor law?halimbawa lang 4 sales ladies, 8hrs/day ; kada weekly or per day ang sahoran... Thank you.

      that is unclear under the law because they are not considered as government employees and not as private sector employees.. they may try filing a breach of contract before a regular court

    Lower Court employee po ako sabi nila ang CA ay somewhat like SC meron konting fiscal independence meaning may substantial distinction between them and the lower courts pag dating sa pananalapi, kaya medyo may saysay sa kanila ang Workers Association, ngayon po ay may nagpapatunog na magkaroon din sa Lower Courts of course may Agency Fees Sa US sabi nila bargaining for terms and conditions of employment sa public sector ay necessary political and maybe violative of the Right to Association Alam naman po natin na Fixed by Law ang terms and conditions ng employment namin, pakiwari ko po ay yari na , pwede po bang hindi magpa Miyembro at magpakaltas dito?

    Hi po Atty Duka. What if may CBA pero ang provisions ng kontrata ay same lang sa minimum allowable benefits ng labor code? Tapos 2 decades same lang provisions no change in 20 years tapos kinakaltasan ang empleyado ng union dues. Tama po ba ito? Eh lahat po upon employment ay member agad ng union, walang pwede umayaw. Tama po ba ito? Ano po pwede gawing hakbang?

    Sir, pag yong workers namatay (not related to work), pero 20 years na siya sa serbisyo, silent ang policy kung maymatatangap ang employee. wala din CBA,
    entitled ba siya sa "separation pay" kasi bigla siyang namatay. in short, may makukuha ba ang pamilya niya sa company, bukod sa unused leaves? Ty, Atty. Duka.

May an employer discriminate job applicant who has tattoos and even expressly include it in the Job hiring poster? What law in the labor code or special laws would the employer violate if ever and where would the applicant report such act of the employer? your videos serve as my guide in reviewing for the BAR...Thank you very much and more power to you!

      thanks. pag regular holiday kahit di sya pumasok bayad yun 100% pag pumasok sya 200% pero kung di sya pinapapasok pumasok pa rin 100% lang kasi di authorized pagpasok nya

    Atty. May tanong lang po ako private school teacher po ako sa isang private school kaso 1 year na po ako sa school na un pero hindi pa din regular wala din po ako nakukuhang any benefits even holiday and leave pay wala po. Tapos nung time po na hinire nila ako wala po silang binigay sa akin na kahit na anong criteria / standard na written doc. Ehh alam ko po bawal po un sana po atty matulungan niyo po ako

      para kasi maging permanent ka dapat matapos mo ang 3 school years ayon sa manual of regulation for private schools. pwede ka humingi ng written contract karapatan mo yan. pwede ka rin dumulog sa dole para mpag usap kayo ng management

      @@CDDukaLaw salamat po atty sa pagsagot, pero tanong ko lang po sana ulit as private school teacher kung meron po ba ako laban sa employer ng school kasi po nung time po na hinire nila ako wala po silang binigay na any criteria standard /evaluation checklist na kung saan don po nila ibabase kung na attain ko po ba ang standard nila para maging regular. May nabasa po kc ako na kapag wala daw pong any written doc criteria na ibinigay nung day na hinire nila ang isang employee consdered na daw po na regular employee siya tama po ba at applicable din po ba un sa aming mga private school teacher. Wala din po ako contract sir sa kanila

      If paid leave, that is valid para mabawi ng employer ang ginastos for you. you may be required to pay back the salaries and benefits received plus damages

      @@CDDukaLaw aq po ay ngttrbaho ng 12hrs/day 4x a week, sa kontrata ko po ay 48hrs/week po tlga ang nklagay.kpag late, may kaltas pro kpg lumalagpas nman kmi ng 12hrs minsan isang oras mhgit pa wala nman OT pay. Ilan oras po ba ang nrrapat na trabaho? 15k/month po sahod q, ilocos sur area. Salamat po

      @@CDDukaLaw Attorney commitment bond sa contract na ang employee will pay 300k kapag nagresign within the 3 years contract. Then may damage penalty na babayaran ang employee na 500k.
